1 MINUTES OF MEETING CELEBRATION COMMUNITY DEVELOPMENT DISTRICT The regular meeting of the Board of Supervisors of the Celebration Community Development District was held Tuesday,, at 6:30 p.m. at the Celebration Community Center, 851 Celebration Avenue, Celebration, Florida. FIRST ORDER OF BUSINESS Call to Order Mr. McCollum called the meeting to order at 6:30 p.m. SECOND ORDER OF BUSINESS Roll Call Mr. Moyer called the roll and stated a quorum was present for the meeting. THIRD ORDER OF BUSINESS Pledge of Allegiance There being no flag, the next order of business followed. FOURTH ORDER OF BUSINESS Administrative Matters and Announcements Mr. McCollum stated the CCDD is a local unit of special-purpose government created pursuant to Chapter 190, Florida Statutes. This means we are a real, elected public government, just a special-purpose government, limited to what the State Law

2 allows us to do, as opposed to a general-purpose government, like Cities, Counties and States, who can do what they choose to do except what is prohibited by law. We are not the Enterprise CDD (ECDD), which operates the water company and is responsible for infrastructure in Celebration Place, Water Tower Place and lands west of I-4. Nor are we the Residential Property Association, known as CROA or the Non-Residential Property Association, known as CNOA. Our primary responsibilities include the financing and construction of the community streets and alleys, street and alley lighting, stormwater management systems, walking trails, sidewalks, boardwalks and some passive parks, plus the maintenance of those same facilities including the street lights, street trees, stormwater quality and aquatic weed control. We are responsible for some enhancements to Osceola County services, such as mosquito control. You can retrieve more information about the CDD, who we are, what we do, what physical areas we are responsible for, how to get in touch with us, and review our public records on our website at Mr. McCollum stated we have some community announcements. Please be careful not to over fertilize or over water your landscaping, and be aware there is already plenty of phosphate and nitrogen in the reclaimed irrigation water. Please do not wash your landscape clippings down the storm drain or allow your contractor to do so, as this additional organic matter is the primary contributor to the water quality challenges here in Celebration. Please remember that if you use a landscape contractor, make sure they have a Green Industries Best Management Practices certification and a Limited Commercial Fertilization Application license. Please remember it is not okay to put signs in the CDD right-of-way, and our staff is authorized to remove signs placed in our rightof-way without our permission. Please exercise extra care while driving in our alleys. These are not construction or property maintenance parking areas, nor are they highspeed cut throughs to get around slower traffic or stop signs. There are often children playing in or near the alleys. Remember that the speed limit in Celebration is 25 mph unless posted otherwise, and our stop signs in Celebration really do mean stop. FIFTH ORDER OF BUSINESS Approval of the Meeting Agenda Mr. McCollum reviewed the meeting agenda and requested any changes or additions. 2

3 On MOTION by Mr. McDonald, seconded by Mr. Gebhardt, with all in favor, unanimous approval was given to the meeting agenda as presented. SIXTH ORDER OF BUSINESS Public Comment Period Mr. Dave Orosz asked when is the landscape contract going to be renewed and are you going to bid on it as a joint venture with CROA? Mr. Smith stated we have not had that conversation, but I will be happy to talk with CROA. Mr. Orosz stated we are interested in doing that. Especially with Spring Lake coming online, we need to add that to our contract to be bid out. Our contract ends at the end of the calendar year, and I recall the CDD s contract ends at the same time. Mr. Smith stated that is correct. Mr. McCollum stated I thought they were staggered. Mr. Gebhardt stated they corrected it the last time. We were going to do a joint contract, but CROA decided to contract on its own. Mr. Orosz stated that was four years ago. In the last two years, you extended it two years because you had that provision in the contract. The two-year renewal is up at the end of this year. That is why I am asking so we know what we are doing. Mr. Smith stated I will look into this and get back with Ms. Pat Wasson. Mr. Orosz stated we have a meeting next week. SEVENTH ORDER OF BUSINESS Consent Agenda A. Minutes of the January 14, 2014, Workshop and January 21, 2014, Regular Meeting Mr. McCollum reviewed the January 14, 2014, workshop minutes and requested any corrections, additions, or deletions. Mr. McDonald made a MOTION to approve the January 21, 2014, workshop minutes. Mr. Luosey seconded the motion. Mr. McCollum stated some minor typos were provided to Ms. Brenda Burgess. However, page 15 has a statement that is not understood, Mr. Akey stated I have to Commissioner Michael Harford. Mr. Akey stated I meant I have to contact Commissioner Michael Harford. 3

4 Upon VOICE VOTE, with all in favor, unanimous approval was given to the January 21, 2014, workshop minutes, as amended. Mr. McCollum reviewed the January 14, 2014, regular minutes and requested any corrections, additions, or deletions. Mr. McDonald made a MOTION to approve the January 21, 2014, regular minutes. Mr. Luosey seconded the motion. Mr. McCollum stated there were some minor typos, which were provided to Ms. Burgess, namely that Mr. McDonald was not present. Upon VOICE VOTE, with all in favor, unanimous approval was given to the January 21, 2014, regular minutes, as amended. B. Invoices and Check Register On MOTION by Mr. Gebhardt, seconded by Mr. McDonald, with all in favor, unanimous approval was given to the invoices and check register. EIGHTH ORDER OF BUSINESS Contractor and Third-Party Reports and Presentations A. Major Contractor: Clark Mosquito Control Ms. Solis stated it has been fairly cold with little rain, so there has not been a lot of standing water. We are doing trap counts once a week. Trap counts have been very low. In March, we will be starting our spraying based on trap counts and the nightly landing rate counts. We are also going to start our inspections for standing water. Mr. Bisienere asked given the winter conditions, can we predict heavier or lighter mosquito counts? Ms. Solis stated it is hard to tell. It all depends on how much rain we end up getting, if we get an early spring rain or if it holds off until May or June. It is really hard to tell. Mr. Bisienere asked is there a general rule for conditions like this winter? I am not asking for predictions. I am just curious. Ms. Solis stated there is not a general rule. It is a science. 4

5 B. Security: Deputy Jerry Weiland Deputy Weiland stated we are still having traffic problems with people speeding through town and not obeying stop signs. There have been details in here, and they have been writing quite a few tickets. I just want to remind everyone to stop at stop signs. Stop at the line, or you are going to pay the fine. It will cost $166 and three points on your license. Please also watch your speed. It is 25 mph. Captain Lang stated I am the coordinator with the town of Celebration and have been so for 12 to 13 years. I am very familiar with Celebration. Lieutenant Snyder and Sargent Guevara attended with me today. Mr. Akey and I have been in constant contact, either through or telephone calls, talking about the recent trend of incidents in town. I just want to reassure everyone that the Sheriff s Office is taking every case seriously and actively working these cases. Lieutenant Snyder and Sargent Guevara are in charge of the investigation. If they can answer a question, they will. If there is anything you have not already been made aware of by us, we will try to answer your question as best we can within limits, as there is some information we do not want to release to the public. Mr. Luosey stated I keep getting questions about the recent string of break-ins. Lieutenant Snyder stated we had a media release last evening and had some information released previously. Once of the reasons why we did not do a full release initially was because we had to confirm the validity of our information. We do not want to confuse anyone when we release information. Five of seven recent break-ins within the past few months we believe are by the same suspect. We had some decent information, some leads and video as well as a potential vehicle description, which is being followed up on. We are also using our resources as an agency and implementing them throughout Celebration and have been for a while now. We did have some close calls today. We ended up catching one person who had a felony warrant. Unfortunately, he was not the burglar, but he was suspicious. We had another concerned citizen who called something in a few hours ago and we followed up on it as well. We do have various different techniques we are using within the community. This is something we will continue to do. Obviously, we need the community to help out. It might not be anything suspicious, but it does not hurt to call us and let us come and check it out. That is what we are here for. People say they do not want to bother us. Let us come and check it out. If it is nothing, fine. We will shake the person s hand and tell them to have a nice day. You never know. Information we received initially was a video, which some of you may have seen already, 5

6 of a person nonchalantly walking out the front door. This person may be comfortable when you see them, but if you do not recognize them, pick up the phone and call us. If you do not know the non-emergency number, you can call 911 to get us there. We are going to be in the area until we either catch them or they decide to move on. We have a suspect identified on some unrelated construction thefts, and we just have to track this person down. Captain Lang stated over the past year, we have had 25 to 30 burglaries. Are these really burglaries? I see on the Front Porch a lot of discussion where they are calling them robberies. First of all, they are not robberies. Robbery is when you have taken something from somebody s person. These are burglaries, where property is taken from a home. If you are not home, they break in and steal something. Sometimes they do not steal anything. Two of the incidents Lieutenant Snyder referred to was where the suspect made contact and it was witnessed; he spoke to a neighbor. The neighbor thought it was suspicious, but no phone call was made to us. We had another one where children were home and he went to up the neighbor s door. He does not get in but rattled the door. They thought he matched the description. They may have waited to tell their mother, but there was no call made to us at the time. Locking your doors is great. But if you see something suspicious, call. All you need to do is call us. We do not mind coming out on these cases at all. We will respond. That is what we are here for. However, we do not know. It is a large County and we have resources out here. Are they out here 100% covering all of Celebration? We have Deputy Jerry Weiland out here and other deputies. You know how big Celebration is. If you see something, we are asking the residents to notify us. We need your help. We cannot do it on our own. As far as Sheriff Bob Hansell is concerned, you are still a well-protected community, and we are putting all of our resources to help bring these burglaries to an end. If you have been watching the news recently, you will see we are not the only community having these problems. It is happening in Avalon Park and Baldwin Park. It could be the same group hitting us, leaving us and going someplace else. I have also seen questions on the Front Porch wanting to know why we are not communicating with the residents. It is a dilemma. Yesterday, we released a composite of the gentleman as well as a video of his car. Channel 9 put it on the news last night, so he now sees the video of his car out here, so he will not come in that car next time. We may not be fully communicating with you at times, but this is a resource we do not want to 6

7 give out. I have sometimes given information to the town with too much information. If we do catch the guy, we do not want people to know that because now he is going to know what we know. We are not trying to intentionally keep information from you, but as a law enforcement resource, we will put out the littlest we can, if possible. We will make you aware of it, which we do. As I said, Mr. Akey and I have regular communications about this, and I am making the public aware of what is going on. We try to communicate as best we can, as we did in terms of the video we released yesterday. Hopefully the suspect will not see it and will come back with the same car. Lieutenant Snyder stated before we give information out, we like to confirm we are disseminating good information. I would much rather have specifics than put what we think might be accurate because we get too many people going in different directions. Anything you see that looks out of the ordinary and does not feel right, report it to us and let us check it out. Maybe it will turn out to be our suspect the next time. I appreciate everyone doing this. Mr. Gebhardt asked is there any specific advice for residents in terms of making their homes safer? If someone were to report something, what is the best phone number to call? Captain Lang stated Deputy Weiland wrote a news article last month for the Celebration News listing the simplest things you can do to make your homes safer, such as installing alarms and locking doors. If you are going away for a while, let your neighbors know. If you see something out there, report it. The main non-emergency number is , but if it is busy or you cannot get through, call 911. We will never hold anything against you because you dialed 911 to report a burglar. We want to catch these guys, so whatever phone call you need to make, make it. Deputy Weiland stated I have written and reported previously that we offer free security surveys. All you have to do is call our Community Services Department or the Crime Prevention Department at Either one of their officers or I will personally come out to your home, for free. We will walk around your house and discuss ways to lessen the opportunity for burglaries to happen. There are different locks and different suggestions we can make. We would be happy to do this, and it is a free service we provide. 7

8 Captain Lang stated do not leave your jewelry setting on top of your dresser in your bedroom. Put it someplace else where it is secure. If someone wants to get into your home, there is nothing you can do to stop them if they really want to get in, other than putting a guard dog in your house to stop someone from entering your home. Prevention is number one. In a number of the burglaries, they broke a window or door to enter the premises. They did not enter an unlocked door. They may have left through an unlocked door, but they used force to enter the residence. Whatever you can do to minimize your liability will help. Please communicate with us. Deputy Weiland stated I suggest getting out of your house and talking with your neighbors and learn what kind of vehicles they have. Many, many times we have been called for suspicious vehicles parked outside of their house for three days. We run the tag and it turns out to be your neighbor s car. It is funny, but we really should be speaking with our neighbors and knowing their cars and letting them know when you go on vacation. We also have a vacation check service if you call This is our non-emergency line and you can let our dispatchers know you would like to put in for a vacation check. They will take all of your information and relay it to all of the deputies. We will do periodic checks around your house between calls and whenever we can. Between talking with your neighbors and letting us know when you are going to be on vacation, we can help. Mr. McDonald stated this is a good service. We had it done. Deputy Weiland stated there is going to be more information in the article for next month. Celebration News is also going to list all of these suggestions among all of the free services we offer. Mr. Gebhardt asked if someone suspects their house has been broken into when they return from vacation, should they call you before they enter their home? Perhaps they should go to a neighbor s house until you can get there. Lieutenant Snyder stated absolutely. You can make this call in the driveway with your cell phone. This way we can come and clear the house and collect any evidence to help in our investigation. Deputy Weiland stated another suggestion is to write down the model and serial numbers of your appliances and electronics, and take photos of your jewelry. Part of the 8

9 investigation entails going to pawn shops. If we have a photo of your missing jewelry, we can try to get your jewelry back, as well as catch the perpetrator. Lieutenant Snyder stated believe it or not, one of the most difficult things to do is to identify who the property belongs to. If all of you have a similar TV in your home and you do not remember what model or serial number it was, we might recover it, but we do not know who to give it back to. This is unfortunate, but it happens all the time. The same thing happens with jewelry. We can go to a pawn shop and see countless numbers of items and not be able to identify who the item belongs to. Many do not have the serial numbers on them. Photos are the best way to do it. Captain Lang stated there is also an issue with the theft of bicycles. Residents have been getting better and we have been getting information, but the majority of residents do not have serial numbers or a photo to give us. We have a lot of unclaimed bicycles at the Sheriff s Office, which have been found but you cannot identify because you do not have the serial number. Deputy Weiland stated give us a call and I would be happy to come out to your house and get the serial number for you so you can keep it on record. We will not keep a record, but we will give it to you. I will help you find it since they are in different places on bicycles most of the time. Mr. Gebhardt stated you have been very helpful and we appreciate having you here tonight. Mr. McCollum stated I appreciate all of you coming out here tonight. We have been discussing for probably six months about having cameras at the entrances. Lieutenant Snyder stated we like cameras; they help us to do our job. If you are going to purchase cameras, purchase good ones that provide a quality picture. Otherwise, do not even bother purchasing them unless you are getting them for a deterrent. The reason why I say this is because so many times if we had a decent quality picture, we would be able to identify the person or the tag from their vehicle. Usually we get a picture that is substandard. Deputy Weiland stated there are some communities farther west that have cameras at their entrances. I have been involved with catching a perpetrator based on talking with neighbors and utilizing that video. 9

10 Lieutenant Snyder stated one of the arrests we made in Sector One, which is farther west, was specifically because one of our detectives went through the footage and found the tag of someone we knew was a criminal. It turned out that was exactly who it was. This person had no reason to be in this area, and we were able to catch them in the act in Orange County some time later. If we did not have this camera, we might still be investigating this incident. Mr. Luosey stated one of the things we requested was information on the types of cameras. Is this something you have? Lieutenant Snyder stated we do not recommend any products. Obviously, digital is easier to download. Higher pixilation gives a better quality picture. However, you have to look at the range and clarity. Being Celebration is a substantial community as far as population, what I would recommend is having vendors present to you what they have available. Captain Lang stated Mr. Akey and I have been in discussions about this, and a representative from the Sheriff s Office has communicated with Mr. Akey and provided him suggestions on what other communities are using. Mr. McCollum asked Mr. Akey, is this something you can work on? Mr. Akey stated yes. We may have the detective come out and do a ride around and give us some options. Then we will ask some vendors for options. Captain Lang stated I have been involved in the beginning with Deputy Weiland. Is there anything you would like for me to take back to the Sheriff or answer any questions about Deputy Weiland or our contract? Mr. McCollum stated I think he is doing a great job. Mr. McDonald stated I actually like Deputy Weiland. Mr. McCollum stated he is doing a great job. I am not just speaking for myself, but from a lot of residents. Mr. McDonald stated I have heard a lot of good things. Mr. Gebhardt stated he has been very visible and a great help. Deputy Weiland stated thank you very much. I appreciate the opportunity to be out here and I consider Celebration my town, even though I do not live here. I take it very personally when things like this happen. I cannot take responsibility, but I take it 10

11 personally. Working with Lieutenant Snyder and Sargent Guevara and the rest of the deputies, we are doing the best we can to stop it. Mr. McCollum stated thank you for coming out tonight and speaking with us. Mr. Akey stated as a matter of information for the Board, we rearranged the detail sheet and did some spot checks. The details focused on a couple of areas, like North Village and South Village. We have an average of 14 to 15 stops in an eight-hour time period. We still have some issues with traffic. Mr. Gebhardt asked stops for speeding or stop sign violations? Mr. Akey stated that is correct. Those are the big items: speeding and stop signs, especially stop signs on Celebration Boulevard in North Village, by the East Village pool, and by Heritage Hall. I have said it before and Deputy Weiland has said it before that some of these violations are flagrant. We are not talking about speeds of five or seven miles an hour over the speed limit. Some Deputies are giving written warnings. However, if they gave you a warning three weeks ago, you may not get a second warning. Also, there have been robberies and burglaries on West U.S. Hwy 192. Sheriff Hansell has made it clear that stays with the West U.S. Hwy 192 patrols. Deputy Weiland does his patrolling and traffic, and the details will do more patrolling. They are still monitoring traffic. Cars go through stop signs by some of these pools, and there is speeding through some alleyways. In some of these areas, kids are playing and you have to use common sense. C. Technology Update and Presentation: Amy Westwood Mr. Moyer stated the understanding I had with Ms. Westwood from the last meeting is she would contact me when she was ready to appear before the Board. I placed this item on the agenda as a placeholder. I have not had any feedback from Ms. Westwood. Mr. Bisienere stated I have had several meetings with SmartCity, and I will leave you with a lot of questions that I cannot answer. It is frustrating, but I am optimistic that SmartCity is close to presenting us with a proposal. They want to upgrade the entire community to gigabit-ready fiber to the pedestal. In your neighborhood is a pedestal that all houses will connect to. That is their commitment. They will not release any further details to me. Even though I have urged them several times, they are not ready to meet with us. I think something is coming soon, but I do not have it yet. Mr. Gebhardt asked have they given you any date on when they would give you a response? 11

12 Mr. Bisienere stated they would like to announce it tomorrow. Without getting into a lot of details, they are having a hard time making a proposal or a pitch to us with details. They told us they have spoken to upper management within SmartCity and they received the go ahead to proceed. However, there are some issues I am not permitted to speak about that are holding them back and once those get resolved, then we can make things public. Mr. Gebhardt asked are they things that the CDD or CROA has any control over, or are they things we have no control over? Mr. Bisienere stated we have no control over these things. Mr. Akey asked are you holding a regular meeting with Comcast and SmartCity? Are these scheduling meetings? Mr. Bisienere stated that is a good question. I have been seeing SmartCity on average twice a month. I have yet to have contact with Comcast. Comcast is a much larger company, and it has been very difficult to get involved with them and get them engaged with us. Even Ms. Westwood has been having a difficult time getting one-on-one conversations with them. I believe you probably heard about the recent acquisition. I think some of this was due to the Time Warner negotiations with Comcast. Ms. Westwood told me something is coming from Comcast to us soon. Mr. Akey stated that is what we have heard from Comcast for quite some time. Mr. Bisienere stated I know. Mr. Akey stated Ms. Westwood said she had contact with the Vice President of Comcast in Miami. There is also a Vice President in Jacksonville. Mr. Bisienere stated those have not been very productive conversations. Mr. Gebhardt stated I would not let them off the hook with the Time Warner deal because they are a nationwide organization. I would hope there is someone here you can talk to about a community of roughly 10,000 people. Mr. Bisienere stated we are trying to chase them down. Mr. Orosz stated I complained to SmartCity about Comcast. They were putting in some lines into a couple houses in my neighborhood. They just ripped the wires apart and left them out with a cover on it. Wires were sticking out the bottom all over the place. I had to go out there and actually stuff them back in and seal them over so the weather or 12

13 animals would not get to them. I actually called to speak to a supervisor because their guys are sloppy. Mr. Akey stated this is a similar conversation we had with Mr. Mark Russell when he was the area supervisor. I believe the lady in Jacksonville offered to come down here and meet with us about nine months ago. I thought Ms. Westwood was following up with her to invite her down. We heard a Comcast representative was going to be in the community where people could go to 851 Celebration Avenue to meet with. Did this happen yet? Mr. Bisienere stated no, not yet. D. Status of CROA Master Plan and Recreation Plan: Bob Bisienere Mr. Bisienere stated we have been making presentations to the community. We have the third of a series of presentations coming up on February 25 at 851 Celebration Avenue. I believe it is directly after our CROA meeting. The presentations have been well attended and well received. There is a question-and-answer period after the presentation. We have been getting some good feedback and some good questions. There is a news article coming out in the Celebration News the first of March, which will have the details and a recap of the presentations, as well as more of a question-and-answer section. Contact the CROA Board if there are any questions. Everything is going very well. We have a ballot question coming up. The ballots will be sent to the residents at the end of this week. Not only will they have an opportunity to vote for the four at-large positions for the CROA candidates, but there will be a ballot question. Because of the ballot question, we are not allowed to vote online, which is a change from previous years. Everything will either be mailed or brought into Town Hall. Hopefully, this does not stop people from participating. Mr. McCollum stated we were supposed to have a March 4 meeting to vote on the transfer of the tract. Mr. Bisienere stated that is correct. Mr. McCollum stated I know you asked to delay this again. Mr. Bisienere stated I have. Mr. McCollum stated you are delaying it for reasons we specifically discussed we were not going to delay it for. I said you could come and make your case for why the Board should consider delaying this vote yet again. It has been since January of last year. We said we would be done by August. You and I met and we decided to have the vote on 13

14 March 4, and now you want to delay it again. I think the Board needs an explanation for that. Mr. Bisienere stated I totally appreciate your point of view. You sent me an wondering if the CROA Board is committed to this proposal and project. I can tell you firmly that we certainly are. We are excited and we value this opportunity. The delay is due to the March 4 vote being very close to the March 17 date when the ballot question will be either approved or disapproved by the community. issues. Mr. McCollum asked so what? It has no impact. They are two completely separate Mr. Bisienere stated you and I certainly know this. Mr. McCollum stated this is what we discussed. Mr. Bisienere stated you and I certainly know there is no impact between the two issues. However, the concern is the community may not have an understanding. The capital funding ballot question has nothing to do with the proposal that CROA and the CDD are about to engage in, so you are absolutely correct. Make no mistake about it; the civic corridor s first priority for us is ball fields, while the civic corridor s first priority for you is the maintenance facility. The Town Hall proposal is very important to us. We apologize and we request your patience while we proceed. Mr. McCollum stated I was disturbed after watching the video from the January 29 CROA meeting. There were a lot of misstatements and untrue statements by a CROA Board member. He was not stopped and no one corrected him, not even the Town Manager. They let him speak. I have copies for you of what we are discussing because I would like it on the record that everyone knows exactly where we stand because frankly, I do not think we are all in agreement. This is what is bugging me. We have been discussing this since January of last year, and every time we get to a point, there is another delay from CROA, and now we are delaying it again. Reading these comments and watching the video were very upsetting. In the first section, I agreed with you that this is the best source of information, not somewhere else. I thought that was fine. Then when I started hearing the misstatements made, I got pretty upset because they are directly related to what our agreements have been over the last 14 months. In the second section, I marked comments made by Mr. Lee Moore who said, Our goal is not to spend CROA s money and just throw it out. It is really to work with partnerships if we can, the 14

15 CDD in some cases, also. If we can facilitate this and get this to our residents quicker by partnering with somebody, we will do that...which we have been doing. If we read the sentence, it sounds as if we have not been partnering. Mr. Bisienere stated everyone knows that all of the CDD meetings are public so there is no secret that we have been meeting. As you already expressed, this has been going on for quite some time. Mr. McCollum stated a question from the audience was whether the CDD is building that building at the entrance to North Village. Mr. Moore stated There is talk, but nothing has been done. Again, we had been working on it for 13 months at that point. Mr. Moore continues saying There has been discussion that the CDD needs office space. I guess their lease is up and they are looking for office space. One of their thoughts was to actually build the building on that spot and make it the CDD offices. Remember, they do the CCDD as well as ECDD for utilities. Possibly there is an opportunity for CROA to move in, if they felt like they were running out of room at some point. That definitely has been discussed. In fact, they came to us a couple of weeks ago and discussed it, but I do not really know for sure. When I hear this and no one from the Board steps up and says anything, I am suspect about why there are all of these delays. Mr. Gebhardt stated you should state what the actual fact is for everyone. Mr. McCollum stated the fact is we have been working on this for over a year, since January 2013, to have a joint CCDD, CROA and ECDD building occupying a new Town Hall on the easterly tract of the civic corridor on Celebration Avenue at North Village. CROA would, in turn, take the 851 building and turn it into a flex-space building. We had CROA voting to support the CDD trading the land for the appraised value to construct the Town Hall and fields as appraised-value funds would allow. We held five public meetings to confirm the direction. CROA held five separate votes of support for this project, the last one being less than six weeks ago. Yet, one of your Board members, at a public meeting posted online, sounded like we have not been doing anything. I do not think I am interpreting this incorrectly where he says if CROA runs out of room, you will move in with us. Mr. Bisienere stated when I was up there listening to what Mr. Moore was saying, and as I read it, I do not totally agree with what he is saying. I did not get the sense he was saying this has only been going on for two weeks. 15

16 Mr. McCollum stated or any of the other things he said, that if you felt you were running out of room at some point, you would move in. This is what this entire discussion has been for the last 13 to 14 months. It has nothing to do with you running out of room. I feel as if this is being couched to get a recreation tax put in and has nothing to do with the facts. In section three, there was a question from the audience whether you had a Plan B if you did not get the 400 yes votes. Mr. Moore said I do not believe there is a Plan B. I do not even know if we can take the land or do something with it if we do not have a funding source. Your recreation plan is Plan B. We had a Plan A, which was for the CCDD to take the entire land and give you funds to build your ball fields. This was the plan all the way until October. Then all of a sudden in October, CROA said they were no longer interested. There was no reason why, and I would love to know why just as a citizen. Then you have a statement saying there is no Plan B. You moved on from Plan A where it was a funded plan, to Plan B where now you need a recreation tax passed to get it. I am not saying a tax is good or bad, but I am saying the things put on the record and said on TV were not true. It really is disturbing, especially with the votes we had and the delays. We just keep delaying this month after month, and now there is another delay because we might mix it up with another vote. It has nothing to do with that vote. In my opinion, we need to have CROA say yes or no as to whether they are in this or out of it. Not a poll or anything else. There is no reason to wait for new Board members. Every year, are we going to wait for new Board members and revisit this? It is crazy. view. Mr. Bisienere stated I hear the frustration in your voice and I understand your point of Mr. McCollum stated I am very frustrated. Mr. Bisienere stated I can tell. Mr. McCollum stated there has been 14 months of this. Mr. Bisienere stated I understand. Do you remember the latest straw poll we took? Mr. McCollum stated yes. Mr. Bisienere asked do you remember what the results were? Mr. McCollum stated yes. It was six to one, with Mr. Moore being the dissenting vote. He is the one making the comments describing this at the meeting, and no one cuts him off, not even the Town Manager. No one says anything but just lets him talk about complete untruths. 16

17 Mr. Bisienere asked did you have an opportunity to read this and study it? Mr. McCollum stated no, I did not have to read it. I listened to it on the video on the internet, and I was very upset. Mr. McDonald stated Board members on their own say stupid things at a public meeting. Mr. McCollum stated it was in a video that was posted online. Mr. McDonald stated I have been on a lot of Boards, and it is not always corrected. Mr. McCollum asked ethically, should it be corrected? Mr. McDonald stated I do not know whose responsibility it is to correct it. Mr. McCollum stated they are representing the home owners, and they should be correcting these things. This is ridiculous. It sounds like we cooked this up a little while ago. Mr. Akey stated the more significant issue is, we have been talking about this for three or four years, and the maintenance facility has still not started. Mr. McCollum stated I know; we just keep delaying it. Mr. Akey stated Mr. Bisienere and Mr. McCollum have been working hard on this, and you can continue to work on this building where we can all move in together. But the CCDD can proceed with building its maintenance facility for its basic needs. It is not like in three years, we are going to tear it down and move to another building. You can always use it for something. CROA s main objective right now is getting the ballot question voted on. Mr. Bisienere stated yes. Mr. Akey stated you are asking residents to vote on the ballot, and once you get the vote, you will determine what your long-term plans are for the parks and recreation. Mr. Bisienere stated no, as soon as we get the results, whether I am President or not, I will urge the CROA Board to act quickly to get an official vote. All I am asking for is an additional two weeks. Mr. McCollum asked what date are we looking at? You were going to have a date set when you came tonight so we would know what date was good. Mr. Bisienere stated I am one seventh of the Board. 17

18 Mr. McCollum stated I know, but you said you would talk to the CROA Board members and the people who were running to make sure they were okay with March 25. Has that happened or not? Mr. Bisienere stated you will have an answer on March 25. Mr. McCollum asked can we set the meeting for March 25? Mr. Bisienere stated I do not have a calendar in front of me. If that is the date of the next CROA meeting, then yes. Mr. McCollum stated this is the date we talked about having a joint meeting. On record, we are done. I have had enough of this. We just keep pushing it and pushing it. It will be March 25, which is a Tuesday. I believe we had our joint meeting set for an hour before. Mr. Moyer stated I think we ended up scheduling our meeting for April 1, but we will schedule it for March 25. Mr. McCollum stated April 1 was the backup date. Mr. Bisienere stated I do not want to commit to the March 25 date, so I will just say it will be as of the next CROA meeting. Seven Board members have to agree on the next meeting after the election. Mr. McCollum stated when you and I spoke, the agreement was you would speak to the other CROA Board members. There are only four people running. All you had to do was to ask the Board members and those four people about their availability, and we would know whether March 25 was good. Mr. Bisienere stated I did what you asked me to do, but I did not specify dates. I am saying the next meeting immediately after the election. Mr. McCollum stated then we have to advertise the meeting, so now we are sometime in April. We are not delaying two weeks. We are delaying it well over a month, again. No one seems to care about this. I read these comments. You and I spoke about setting the meeting for March 25. We are sitting here trying to get you to commit to this date and you cannot. Who on CROA cares about this? Mr. Bisienere stated if it was within my power to commit to this date, I would, but I am telling you we are going to vote on this matter at the next meeting and give you our decision. Mr. McCollum asked what are you going to vote on, to transfer the property? 18

19 Mr. Bisienere stated just what you are asking us to do. Mr. McCollum asked at the very first meeting you have, this is going to happen? Mr. Bisienere stated that is correct. Mr. McCollum stated I guess it is up to the Board if this is acceptable or if we just keep waiting or what we are going to do. Mr. Gebhardt stated what seems disappointing based on the characterization was that initially, CROA came to us and asked about doing something on a joint basis on the civic corridor. We were immediately interested in trying to work together on this. It seems odd that it is now being characterized the other way around, like we were the prime mover. We look forward to cooperating and doing something on a joint basis that would be something better than what either of us can do on our own. It is disappointing having it characterized as if we had this plan and CROA is not sure whether or not they are interested. CROA came to us. This was their idea. Where are they 14 months later? Mr. Bisienere stated you are absolutely right. I hear the frustration in your voices and I understand your point of view. I can only control so much. I am here to say we are genuine about this and we value this opportunity. We hope the Board gives us the opportunity. Mr. McDonald stated bear in mind, the one person who is mischaracterizing it is the one person who voted against it. posted. Mr. Bisienere stated that is correct. Mr. Gebhardt stated it was a public meeting that was being recorded and it was Mr. McCollum stated I think it needs to be corrected. I am going to ask to have it corrected. Mr. McDonald stated we are doing that now. Mr. McCollum stated there needs to be something on their website listing the errors and their corrections. It is not right for people to go on there tomorrow and the next day to listen to the recording and know it is wrong. It is horrendous for this to be going on. I believe something needs to be said so they can get through something that Mr. Moore wants. 19

20 Mr. Bisienere stated beyond saying that Mr. Moore made some incorrect statements, you will have to send me what you want me to hear. I will look at it and make every effort to correct it. Mr. McCollum asked if the first meeting CROA has will include a vote on this project, do we need to schedule a joint meeting for the CDD to accept it, or can we do this at our next regular meeting? What do you prefer? Mr. Moyer stated I certainly think you can do this at your regular meeting, which would take place a couple of weeks after their meeting. I need 10 days to advertise a meeting. Once Mr. Bisienere polls the CROA Board and has a date, if you want to hold a joint meeting, this is not a problem and we will advertise it. Mr. McDonald asked is it necessary for us to have a joint meeting? Mr. Moyer stated it is not necessary. Mr. McCollum stated if CROA is willing to do it, after their vote, then we can proceed. Mr. Moyer stated this Board already voted. Mr. McCollum stated that is correct. I thought Mr. Geoffrey Mouen did an incredible job on the drawings. It is a master plan so some things are not going to happen. It was very well done. I just did not like the comments that were made at the end. Mr. Bisienere stated I understand why. Mr. McCollum asked what effect will Island Village and the possible approval of the recreational funding have on your decision to locate in the joint Town Hall? In other words, if you found out tomorrow Island Village was online, does it have any effect on this decision? Mr. Bisienere stated none, whatsoever. Mr. McCollum asked do the residents actually understand, from our conversations with The Celebration Company (TCC), that there will be no further recreational development in Celebration? This came out and it actually bothered me. I am not sure if even CROA understands except you agreed to the land. When Island Village comes along, they are not doing anything, and we are not getting another dime out of them. Is this your understanding, as well? Mr. Bisienere stated I am not familiar with the Island Village plans. I suspect there will be recreational facilities within Island Village. 20

21 Mr. McCollum stated they said there would not be any further development. If they gave you the civic corridor land, nothing else would be coming. Mr. Bisienere stated I did not hear that. Mr. McCollum stated you were at the meeting with me and it is in the minutes. Mr. Bisienere stated that was not my understanding. I would be surprised if there were no recreational facilities. Mr. McCollum asked is this something we can get clarified with TCC? Mr. Bisienere stated yes. I think they are close to making an announcement. As they do make this announcement, I think more details will come out. Mr. McCollum stated this is what they said on the record when we discussed this. Mr. Bisienere stated I heard TCC say to us Do not come back to us for more land. This is the way I understood it. I did not understand it to say We are going to build a whole bunch of houses and residences in Island Village, but there will be no recreational facilities and amenities. I did not take it that way, but that is how you are describing it. Mr. McCollum stated I specifically asked if there were going to be any more recreational facilities, and the answer was no. Mr. Bisienere stated I do not recall that. Mr. McCollum asked when can we have this clarified by? Mr. Bisienere stated I would like for you to send me an on what specifically you want me to ask them, and I will get you an answer as soon as I can. Mr. McCollum stated thank you. I appreciate you coming to the meeting. E. Status of Maintenance Facility Plans and Next Steps: Danny Bumpus Mr. McCollum stated I told Mr. Bumpus there was no need to attend today s meeting. We needed the March 4 vote to happen for him to do anything else. Mr. Vincutonis is still moving forward, whether it is Plan A or Plan B for the offices, since neither affects the civil engineering. Mr. Vincutonis stated we are moving forward with geotechnical services. They will be doing the boring. I do not exactly what day they are going to be out there. They will be looking at some stormwater management. I have been in contact with RCID to get some information on the ponds that we are tying into. Then Mr. McCollum and I can meet with Mr. Bumpus to tweak the site plan and address the aesthetic questions. 21

22 Mr. McCollum stated nothing is really happening until the CROA vote. We have not released the property appraisal because we are looking for the vote of confidence from CROA. They verbally approved it and it was put it in writing by the Board President. I do not know if we need to have them vote on whether or not they are going to reimburse us if it does not go through. Mr. Moyer stated I actually went back and looked at the minutes of our December meeting. It was clear we wanted something formal from CROA on reimbursing the District. At this point, I have not received it. Mr. McCollum asked will you send a letter to the CROA Board and request this as well as for Mr. Vincutonis s time for any surveying work and the appraisals, should the project not go through? Mr. Moyer stated yes. F. The Celebration Company s Representative Mr. Gebhardt stated Mr. Parker previously reported that Evander Square was going vertical, and they have. Thank you for the heads up. NINTH ORDER OF BUSINESS Action Items A. Acceptance of Arbitrage Rebate Reports Mr. McDonald made a MOTION to approve the Arbitrage Rebate Reports. Mr. Gebhardt seconded the motion. Mr. Moyer stated the results of the analysis indicated we had no rebate liability. Upon VOICE VOTE, with all in favor, unanimous approval was given to approve the Arbitrage Rebate Reports. B. Designation of Representative to the Celebration Joint Committee Mr. McCollum stated it sounds like Mr. Akey wants to step down from that role. Mr. Akey stated I will step down if someone else wants to be the representative. Mr. Gebhardt nominated Mr. Akey. There being no further nominations or discussion, Mr. Akey was appointed the District representative to the Celebration Joint Committee. Mr. McCollum asked who schedules the meetings and who sends out the notices for these meetings? Mr. Akey stated Ms. Cindy Swisher sends them out. 22

23 Mr. McCollum asked do you get those all the time? Mr. Akey stated yes. TENTH ORDER OF BUSINESS Regular Reports A. District Manager i. Financial Statements Mr. Moyer reviewed the financial statements, which are included in the agenda package and available in the District Office for public review during normal business hours. Mr. Moyer stated 88% of our non-ad valorem assessments were collected as of January 31. This is not unexpected as it typical of the way the revenues flow into the CDD between the end of November and March 31. We are pretty much on target. There is not much to highlight for the Board in terms of expenditures. Mr. Smith has taken on an aggressive maintenance activity in the last four months, and this is reflected in the financials. We are under budget overall in terms of expenditures and are doing fine. ii. Website Statistics Mr. Moyer reviewed the website statistics, which are included in the agenda package and available in the District Office for public review during normal business hours. B. Field Operations i. Monthly Highlight Report Mr. Smith reviewed the monthly highlight report, which is included in the agenda package and available in the District Office for public review during normal business hours. Mr. Smith stated we included the insurance claim report. There is one missing. We had an accident on Stickley in Artisan Park where we lost a light pole. We are still trying to locate the police report which we have not received. The rest are included on the report and are complete. I also included my field work assignment schedule. Cleaning poles is proceeding fairly quickly. We are working downtown and are teak-oiling all of the benches. We painted both of the shade structures and roofs since Christmas. We painted the structure at the Celebration Avenue bridge as well as the roof. We are working diligently to get all of the sidewalks completed. We are grinding them as well as replacing panels. You will see a lot of panel replacements on Celebration Place. The crews are moving along fairly well. While Celebration Place is in Enterprise CDD, I am using an outside contractor that I used in North Village. They did a fairly good job for us there. They still have work to do in North Village, but I moved them to Celebration 23
