CITY OF ROGUE RIVER City Council Minutes CALL TO ORDER INVOCATION PLEDGE OF ALLEGIANCE QUORUM THURSDAY, APRIL 26, 2018 CITY HALL COUNCIL CHAMBERS CITY OF ROGUE RIVER, JACKSON COUNTY, OREGON The Regular Council meeting was called to order by Mayor Pam VanArsdale at 7:00 p.m. Pastor Steve Keeton with the Calvary Chapel delivered the Invocation Mayor Pam VanArsdale led the Council and audience in the Pledge of Allegiance COUNCIL MEMBERS PRESENT: Mayor Pam VanArsdale City Councilor Bob Pascalar City Councilor Fred England City Councilor Robert Catherwood City Councilor Shelli Spencer City Councilor Don Daugherty City Councilor Mark Poling ALSO PRESENT: Mark Reagles, City Administrator/Planner Carol Weir, City Recorder A quorum was present and due notice had been published. COMMITTEE REPORTS: Community Relations; Rogue River Chamber of Commerce: City Councilor Ryan Hess reported that they would not be doing a car show during Rooster Crow but were planning to hold one in September. They would not be asking the City for anything since they would be holding the event at New Beginnings Church. They re planning monthly mixers for businesses around town on the first Thursday of each month and in May LeFluer Bouquet would be hosting. And, it was his understanding that the City may be hosting in September. Also, the Chamber would not be participating in the Rooster Crow. Community Relations; Rogue River Community Center: City Councilor Wayne Stuart reported that for Morrow Heights they held a High Tea and seventy-five ladies attended and they made some money from the event. The Food Pantry was taking donations and holding garage sales to raise money. They need $25,000 to match a State Grant and they current need $17,000 but felt it would take a while to get to their goal. Also, they held board elections and wound up with one new member who would be starting at their meeting next month. They also have been having good

REGULAR COUNCIL MEETING Page 2 turn outs for their Friday Dinners. Emergency Communications of Southern Oregon: City Councilor Wayne Stuart reported that they did not have a meeting but he did have the opportunity to meet with Margie who gave him a tour of the dispatch center and he really appreciated that. Mayor Pam VanArsdale commented that she had been told someone donated a message chair for the dispatchers to help relieve some of their stress. City Councilor Wayne Stuart also commented that the dispatchers also have peddling devices at their desks to help with circulation while sitting. Finance Committee: City Councilor Bob Catherwood reported that they met twice during the month of March 2018 to review and approve the bills as submitted and signed 69-checks totaling $88,424.33. Personnel Committee: City Councilor Mark Poling reported that the current opening in public works was being filled and that the Police Commissioner would be reporting on the police department s status. Planning Commission Liaison: City Councilor Mark Poling reported they had been reviewing proposed changes to the commercial zone. Police Commission: City Councilor Fred England reported that there was not too much to talk about other than the department currently had two-healthy officers. The newest officer was involved in a search where he hurt his leg and was off work and the Chief was still on medical leave from his recent surgery. Rogue Valley Council or Governments (RVCOG): Mayor Pam VanArsdale reported they had a presentation from a group called Connect America Now (CAN) who was trying to increase world broadband in more homes in our area getting connected to the internet. They discussed using white space on TV band, apparently there was a lot of white space available and easier to connect with compared to fiber. A transmitter would be attached to a building which did have a fiber connection allowing you to broadcast out about 60-miles and through mountains. Though they were still working with the FCC to allow the program and encouraged citizens to contact their legislators to put some pressure on the FCC to consider opening up this part of the spectrum to allow a connection. Students are being forced to find locations such as restaurants just to do their homework. Hoping to have the bids for the Josephine Food and Friends building to come in and hoping that if they came in below the estimates they were good but if they came in higher they were going to be short. They needed a match for the CDBG Grant and at last count they were short about $140,000.

REGULAR COUNCIL MEETING Page 3 Middle Rogue Metropolitan Planning Organization (MRMPO): Mayor PamVanArsdale reported they met to approve projects added that Oregon Department of Transportation (ODOT) added to their transportation plan and they adopted their Unified Work Program which was done every two-years. The Unified Work Program was used to spend money out of the program. And, the state wide group would be meeting in Grants Pass the following day allowing them an opportunity to network. The recording of the meeting stopped at this point. NEW BUSINESS: AGENDA ITEM 1 Appeal: Hold a Public Hearing on an appeal filed by Richard Porta with Gold River Botanicals regarding a sign permit. Mayor Pam VanArsdale declared the Public Hearing open at 6:21 p.m. She read a prepared script that will remain part of the permanent record for the property described as T36S, R4W, Section 22BB, Tax Lot 600 located at 204 Madrone Street, Rogue River, Oregon. The appeal was made by tenant/business owner Richard Porta of Gold River Botainicals. Mayor Pam VanArsdale asked if anyone had any objections to jurisdiction and if it was proper for the City Council to hold the Public Hearing? None were heard. Mayor Pam VanArsdale asked the City Council if anyone present wished to declare ex-parte contact, site visit or they had a conflict of interest, bias, or other reason to be disqualified from participation in the hearing? City Councilor Fred England stated that he had drove by the building. City Councilor Don Daugherty stated that he was Chair of the Sign Review Board that denied the application. Mayor Pam VanArsdale asked the audience is anyone wished to challenge any of the City Councilor s qualifications to participate in the hearing? None were heard. City Administrator Mark Reagles explained that the applicants sign permit application had been denied because it did not meet the criteria of sign regulations addressed in the Marijuana Ordinance. That the applicant had proposed two- LED signs that would be changing content and that these signs would be placed directly across from a single family residence and a multi-family residential unit. He said the Ordinance was very clear that a marijuana dispensary was only allowed one sign per building.

REGULAR COUNCIL MEETING Page 4 Mayor Pam VanArsdale commented that they had applied for two-led signs facing the freeway and the intersection of Classick Drive and Depot Street, which was one of the busiest intersections in town. Operations Manager Dan Schorr stated that they needed to have two-signs in order for the public to find their business. He said the current sign could only be seen directly from the street and not from the freeway or the intersection coming off the freeway. Also, the sign would only be on during working hours. Mayor Pam VanArsdale commented that they still had their sandwich board sign that was visible from the street. City Administrator Mark Reagles commented that the sandwich board sign was only to be displayed while the store was open to the public and need to be put indoors when the store was closed. City Councilor Ryan Hess commented that their sign could be seen. City Councilor Fred England stated that flashing signs distracted drivers and it was so close to the busiest intersection coming into downtown. Mayor Pam VanArsdale quoted the Ordinance that said a business was allowed one-identification sign. City Administrator Mark Reagles commented that he was concerned with a reader board sign and that the Sign Ordinance regulated the impact in residential areas. City Councilor Mark Poling stated that he needed more time to consider everyone s comments and had more questions that needed to be answered. City Councilor Bob Pascalar stated he wanted more time to review the information. City Councilor Fred England stated that he too needed more time before he could make a decision. City Administrator Mark Reagles recommend to the City Council that Mr. Porta be allowed to leave their temporary signs up for the time being. AGENDA ITEM 2 Appointment: The Mayor s recommendation to appoint City Councilor Ryan Hess to the Community Relations Committee as Liaison to the Rogue River Chamber of

Mayor Pam VanArsdale presented former City Council Shelli Spencer with a plaque depicting her time served on the City Council and that she was happy that Ms. Spencer would still be volunteering for the City by serving on the Council s Advisory Committee until she did leave to go to school in Eugene. AGENDA ITEM 3 Appointment: The Mayor s recommendation to appoint Shelli Spencer to the Council s Advisory Committee. MOVED (PASCALAR), SECONDED (POLING) AND CARRIED TO APPOINT SHELLI SPENCER TO THE COUNCIL S ADVISORY COMMITTEE. AGENDA ITEM 4 Sponsorship: A request from the Rogue River Kiwanis to Sponsor the 65 th Annual National Rooster Crowing Contest and advertise in their pamphlet. MOVED (ENGLAND), SECONDED (PASCALAR) AND CARRIED TO BE A GOLD SPONSOR FOR THE 65 TH ANNUAL NATIONAL ROOSTER CROWING CONTEST AND PLACE A FULL PAGE ADVERTISE IN THE PAMPHLET FOR A COST $635. AGENDA ITEM 5 Proclamation: The Mayor to Proclaim May 3, 2018 as the National Day of Prayer in the City of Rogue River, Oregon. Mayor Pam VanArsdale declared May 3, 2018 be the day to celebrate the National Day of Prayer in Rogue River, and encouraged everyone to attend the Mayor s Prayer Breakfast being held at the Rogue River Community Center on the morning of May 3, 2018. AGENDA ITEM 6 Proclamation: The Mayor to Proclaim May 6-12, 2018 as Municipal Clerks Week in the City of Rogue River, Oregon. Mayor Pam VanArsdale declared May 6-12, 2018 as Municipal Clerks Week in Rogue River, and thanked both City Recorder Carol Weir and Administrative Assistant Kailin Honea for their dedication to their profession and the City. AGENDA ITEM 7 Proclamation: The Mayor to Proclaim May 13-19, 2018 as Police Week & Peace Officers Memorial Day in the City of Rogue River, Oregon. OTHER BUSINESS: Mayor Pam VanArsdale announced that Administrative Assistant Kailin Honea had received a Scholarship in the amount of $1,150 to attend her first Professional Development (PD1) class being held in Tacoma, Washington this summer. Mitchell Kroll of North River Road asked the City Council why they had the bench removed from in front of Rogue River Pharmacy? He said that a petition was being passed around gathering signatures to return the bench commenting how important the bench was for the people in our community whose walking was their form of transportation. City Administrator Mark Reagles told Mr. Kroll that the City was not the one who had the bench removed. That the businesses contacted the Kiwanis who placed the bench there years ago to have it removed. They said that the bench was attracting the wrong element of people who would sit there for hours at a time begging and panhandling from the public. The local citizens were not feeling safe going in and out of the stores. At the request of the Kiwanis the City s public works department took the bench to the City yard. Mayor Pam VanArsdale said that it would be up to the property owner of the shopping center and the business owners if they would like to have the bench placed back in the shopping center. Jinny Neiswanger of the Cattlemen s Saloon updated the City on her recent event music event that the City denied her an Extension of Premises through the Oregon Liquor Control Commission (OLCC). She said they were not able to the move the event to another location so they still held the event and everything went well, they had no issues. They also shut down the music early. Mayor Pam VanArsdale said the City Council would be reviewing the application and procedure process for Special Events at their next workshop and invited Ms. Neiswanger to attend and give her input. ADJOURN There being no further business to come before the City Council and upon motion duly made (PASCALAR), seconded (DAUGHERTY) and carried, the meeting adjourned at 7:24 p.m. ATTEST: Carol J.
