TOWN COUNCIL MEETING Coventry Town Hall Council Chambers 1670 Flat River Road, June 23, 2008 6:00 p.m. TOWN COUNCIL MEETING Present: Anthony Colaluca, Justin Pomfret, Frank Hyde, Bruce Thompson Acting Town Manager Paul Sprague Town Solicitor Patrick Sullivan Absent: Kenneth Cloutier Pledge of Allegiance led by Town Sergeant Invocation led by Councilman Review of evacuation plan. President Pomfret presented proclamation from the Town of Coventry and citation from the State of Rhode Island to Janis Jendzejec in honor of her recent retirement and years of service to the Board of Canvassers. Motion made by Bruce Thompson seconded by Anthony Colaluca to approve minutes of the May 19, 2008 Town Council meeting. Motion made by Frank Hyde seconded by Bruce Thompson to move item J1 - public hearing on Boats and Waterways ordinance to a position before public comment. Motion made by Anthony Colaluca seconded by Bruce Thompson to rescind boats and waterways ordinance for further study. Councilman Colaluca informed public that there would be a meeting on July 15 at 8:00 p.m. with the Johnson s Pond Civic Association at Coventry Community Center to get input from the association and then to move forward at a later date. Solicitor Sullivan noted that ordinance would have to be readvertised at a later date if a public hearing is to be held. PUBLIC COMMENT Charles Vacca 124 Fairway Drive Mr. Vacca Suggested adding Quidnick Reservoir and other adjacent waterways to the ordinance as well as Johnson s Pond and Tiogue Lake. Robert Bennett Isle of Capri Road Mr. Bennett informed Town Council of the very serious problem at the Hill Farm Road bridge. Kids parking bikes and cars, jumping off the bridge. Submitted pictures to the council; Manager Sprague was instructed to organize meeting with the police chief to discuss this issue and how it may be resolved.

Resolution appointing Col. Ronald DaSilva as Acting Town Manager from July 12 19, 2008 10. Resolution authorizing Interim Town Manager to execute document concerning design of the Coventry Greenway 11. Resolution authorizing Interim Town Manager to execute documents regarding transfer of real estate located on Main Street Motion made by Bruce Thompson seconded by Anthony Colaluca to approve Consent Agenda. LICENSES 1. Application by Dennis Colicchio for victualling license for Tommy Ruggeri s Kitchen, 656 Main St. Motion made by Frank Hyde seconded by Bruce Thompson to approve license. 2. Application by Richard Irving of G Tech Corporation, 1372 Main Street for victualling license Motion made by Bruce Thompson seconded by Frank Hyde to approve license. All PUBLIC HEARINGS AND ENSUING ACTION Application for Class B. Ltd and victualling license by Harry Hall, Jr., for Father & Sons Restaurant, 1532 Main Street Motion made by Anthony Colaluca seconded by Bruce Thompson to open public hearing. No one present. Motion made by Anthony Colaluca seconded by Frank Hyde to close public hearing and place this item further down on the agenda before the Executive Session in case applicants are running late.

Application of CVE Restaurant, dba Lena s Place, 435 Washington Street to change class of liquor license from B Ltd license to B license Motion made by Frank Hyde seconded by Bruce Thompson to open public hearing. All Motion made by Frank Hyde seconded by Anthony Colaluca to close public hearing because applicant not present. Motion by Frank Hyde seconded by Bruce Thompson to place on agenda before executive session in case applicants are running late. All voted Aye. So voted. Application by Edith Therrien, 17 Sandy Bottom Inc. dba the Sandy Bottom for mechanical and electronic device license (mechanical bull) President Pomfret recused himself from this vote as he performs at the Sandy Bottom. Present: Edith Therrien 20 Johnson Blvd. Ms. Therrien stated that she has applied to operate a mechanical bull at her establishment. She has met the guidelines, is well within the limits including clearance to ceiling and has a 16 x 16 air mattress surrounding the bull. There will be no cost to ride the bull. Motion made by Frank Hyde seconded by Anthony Colaluca to close public hearing. Motion made by Frank Hyde seconded by Anthony Colaluca to approve license. INTRODUCTION OF ORDINANCE Ordinance amending Zoning Ordinance, AP 55, Lot 77, 614 Washington Street from I-2 to Mill Conversion District Motion made by Frank Hyde seconded by Bruce Thompson to advertise for public hearing. ****** PUBLIC HEARINGS AND ENSUING ACTION 1. Application for Class B. Ltd and victualling license by Harry Hall, Jr., for Father & Sons Restaurant, 1532 Main Street Motion made by Anthony Colaluca seconded by Frank Hyde to table to July 28 since applicant not present. 2. Motion made by Frank Hyde seconded by Bruce Thompson to open public hearing for Class B. Ltd and victualling license by Harry Hall, Jr., for Father & Sons Restaurant, 1532 Main Street. Present: Harry Hall, Jr. Harry Hall, III 7 Congdon Street Jeannette Hartley - Opposed to a liquor license at that location, not opposed to these people, the Halls. It s the present owner of the premises, need to make sure to keep him in line. President Pomfret suggested 90 day review; then if any problems arise revoke the license. But, for now would get them a 90 day license to get going. Motion made by Frank Hyde seconded by Bruce Thompson to close public hearing. All voted aye. So voted. Motion made by Anthony Colaluca seconded by Frank Hyde to abide by same stipulations as previous owner and also approve with 90 day review including readvertisement. Stipulations: 1. If corporation, Board of Directors, Shareholders, Officers or Owners change, the B Ltd. License is revoked. 2. B Ltd. License is non-transferable. 3. No transfer allowed of any assets to a third party. 4. No alcohol served after 9:00 p.m. on Thursday and Sunday. No alcohol served afger 10 p.m. on Friday and Saturday. 5. Attorney Timothy Williamson 1193 Inman and Tourgee Tiogue Avenue Attorney Williamson represented Lena s Place. Motion made by Frank Hyde seconded by Bruce Thompson to open public hearing. All In April 2006, my client was granted a B Ltd. License. They want to go to a full B. they have been good tenants and good business citizens in the Town of Coventry. No public comment for or against application. Motion made by Frank Hyde seconded by Anthony Colaluca to close public hearing. All voted aye. So voted.
