Time to discontinue a dubious practice in the apartment trade By K. S. Ramakrishnan Registration of construction agreements in relation to purchase of new apartments has been made compulsory in Tamilnadu since October 1. The stamp duty payable is 2% of the contract value. A person s decision to buy a new apartment (which is either under construction or is proposed to be constructed) is based on the advertised price per sq.ft of the constructed area. The pith and substance of the transaction is the sale of the apartment by the promoter at an agreed price on an agreed future date. But, while drafting the agreement, the promoter artificially divides the agreed price into two components - price of the undivided share of land (on which stamp duty is payable at the time of registration) and cost of construction (on which no stamp duty was payable till recently), making it appear as if the buyer purchased the undivided portion of the land first and then engaged the promoter to construct the apartment on it, even though the sale of the undivided portion of the land also takes place only at about the time of handing over of the apartment. This dubious practice made financial sense when the stamp duty on the sale of property used to be as high as 20%. But, in recent years, this rate has been substantially brought down in many States, and is only 8% in Tamilnadu now. From 2010, the Central Government is levying a Service Tax of 4% on the cost of construction in such transactions. With the present 2% stamp duty on construction contracts, the total levy on the construction portion of the price of the apartment has become 6%. The result is that, while purchasing an apartment, there is a levy of 8% on the cost of the land and a total levy of 6% on the cost of construction, as against a levy of 8% on the total price of the apartment if registered as a straightforward sale transaction as in the case of a resale. In areas like Anna Nagar, over 80% of the price of an apartment relates to the cost of the land and only about 20% to the cost of construction. The total levy saved by the prevalent dubious practice is, thus, only 2% of 20%, or 0.4% of the total price of the apartment. On a Rs. 1 crore transaction, the amount saved is only Rs. 40,000. Is all the present charade necessary for saving this relatively small sum in government levy? It is well-known that, under the present practice, it is seldom that the promoter delivers the apartment on the agreed date, even though the buyer had paid a very major portion of the agreed price in instalments. The delay often runs into many months or even years, as can be seen from cases filed in the Consumer Courts, resulting in great financial distress to the buyer. While, as consumers, we are particular about seeing and feeling a product before purchasing it for even Rs. 500, we are forced to pay lakhs of rupees in advance (either of our own money or from an interest-bearing loan) for an apartment even without being sure how it is going to look like, its quality of construction or when it is going to be delivered. And all this only for saving a little bit of money in stamp duty. The time has come for the discontinuance of this charade which works against the interests of the buyers, so that the builder completes the construction of the apartments in all respects before putting them up for sale, and the buyer can make a purchase decision after actually seeing the final product, and pay the price in a single instalment. This will, of course, involve a new financing pattern for the promoters but this has to be worked out by the building industry in consultation with the financial institutions. The procession passed along roads in West LETTERS TO THE EDITOR Jothi Ramalingam Street needs re-laying Sir, I am a resident of Jothi Ramalingam Street (West Mambalam) for the past 20 years. The road is in a very bad condition and gets slushy during rains. There are a number of potholes and the road has not been re-laid for many years. I have written several times to Chennai Corporation, but to no avail. Also water has been overflowing from the hand pumps and stagnating on Pushpavathi Ammal Street near its junction with Jothi Ramalingam Street for the past couple of weeks. Stray dog menace Sir, - It was about 5.30 p.m on Dec. 18. I was proceeding to Sai Baba Temple on Jai Shankar Street, West Mambalam when a stray dog pounced on me. Though I tried to ward it off it caught my hand in its mouth. I managed to escape but its teeth left a mark on my hand. To play it safe, I rushed to a doctor and had an anti-rabies shot which cost me Rs. 500. A railway personnel may be posted to check tickets. (Enough space is available between the railway tracks). These steps/ramps may be used by passengers alighting from south bound trains and commuters to reach Brindavan Street or Duraiswamy Road. A number of autos/share autos are available for passengers. MTC buses also ply to Mylapore, Triplicane and other areas. This arrangement will reduce overcrowding in Ranganathan Street and other streets connecting the railway station. S.R. Radhakrishnan. Relaying sans milling causes problems Sir, - 61st Street branches off from 7th Avenue which links West Mambalam and K. K. Nagar. 7 th Avenue is used by buses and other vehicles. It is relaid at regular intervals but without the top layer being removed first (milling) with the result all the side roads/streets are now at a level lower than 7 th Avenue. As a consequence, even when there are light showers water from 7 th Avenue flows into the side streets in the absence of stormwater drains or rain water pits. Very narrow pavements on both sides are in a neglected state and have been converted into public toilets. This years old problem was highlighted before Corporation authorities several times and was brought to the notice of the Mayor also when he visited the area, but there has been no response so far. While there are many other problems needing prompt action, street light posts which are in good condition are being replaced! I appeal to the Corporation to take action at least now. S. Chennai Runners plan special event for New Year About 130 members of Chennai Runners Ashok Nagar and Mambalam Chapter have been running between 4.30 a.m and 6 a.m on Tuesdays, Thursdays and Saturdays along the roads of Ashok Nagar, K. K. Nagar and Mambalam for the past several months. S. Ramakrishnan (runner and co-ordinator for Ashok Nagar, K. K. Nagar and Mambalam Chapter) told Mambalam Times that they started with 3 members and the figure is now nearly 400. He said that there were theory and practical sessions by the special running coach for members on the other days in Sivan Park (P. T. Rajan Salai, K. K. Nagar). Chellammal (resident of 127, Mumtaj Flats, Lake View Road, West Mambalam) passed away on Dec. 14. She was 102 and had been a resident of Mambalam for more than 34 years. Her husband Srinivasa Subbaiah Iyer died several years ago. She was born in Cuddalore and was married at the age of 13. She is survived by sons, daughters, grandchildren (17) and great grandchildren (40). She had celebrated her 102 nd birthday on Feb. 11, 2013. C. Vasantha (Chellammal s youngest daughter) had told Mambalam Time at that time that her mother was maintaining good health and was always cheerful. She was then independently managing all her daily chores without help from anyone. She gave birth to 5 daughters and 3 sons. One son died when she was 84. their first race at The Wipro Chennai Marathon 2013. Many of them were running for the first time. They were groomed by a group of experienced Chennai Runners, he added.
