ORDINANCE NO. 2017 - BE IT ENACTED BY THE QUORUM COURT OF THE COUNTY OF BAXTER, STATE OF ARKANSAS, AN ORDINANCE TO BE ENTITLED: AN ORDINANCE ESTABLISHING A FEE TO BE COLLECTED FOR INSUFFICIENT CHECKS RECEIVED BY BAXTER COUNTY. WHEREAS, ACA 4-60-103,(a), Liability for Restitution, states that: A person who issues a check that is not paid because the check was written on an account with insufficient funds has fifteen (15) days following the date of a written demand mailed or delivered to the drawer of the check at the address shown on the check or his or her last known address to pay to the holder of the check or his or her agent the amount of the check and a collection fee not to exceed thirty dollars ($30.00), plus the amount of any fees charged to the holder of the check by a financial institution as a result of the check s not being honored. NOW THEREFORE, BE IT ORDAINED BY THE QUORUM COURT OF BAXTER COUNTY, ARKANSAS THAT: Section 1. It has been determined that it is in the best interest of the County to establish a fee of thirty dollars ($30.00) for all insufficient checks received by Baxter County, and that the collected fees will be deposited into the Baxter County General Fund. Section 2. This Ordinance shall be codified in the Baxter County Code of Ordinances, and the sections may be re-numbered and re-lettered to accomplish such intention. APPROPRIATION ORDINANCE NO. 2017 - BE IT ENACTED BY THE QUORUM COURT OF THE COUNTY OF BAXTER, STATE OF ARKANSAS, AN ORDINANCE TO BE ENTITLED: AN ORDINANCE APPROPRIATING 2016 CARRYOVER FUNDS FOR THE PURPOSE OF THE CLEAN-UP OF 2016 PERSONAL SERVICES BUDGET LINE ITEMS. WHEREAS, to rectify deficits in the 2016 Personal Services budget line items, it is necessary to utilize funds totaling $143,570.76 from the 2016 carryover in the following funds: County General Fund (#1000), Animal Control Fund (#1800), Recorder s Cost Fund (#3006), Public Defender Fund (#3024), and Juvenile Probation Fees Fund (#3031). NOW THEREFORE, BE IT ORDAINED BY THE QUORUM COURT OF BAXTER COUNTY, ARKANSAS, THAT: Section 1. APPROPRIATION ORDINANCE NO. 2017 - BE IT ENACTED BY THE QUORUM COURT OF THE COUNTY OF BAXTER, STATE OF ARKANSAS, AN ORDINANCE TO BE ENTITLED: AN ORDINANCE APPROPRIATING FEES AND REIMBURSEMENTS RECEIVED IN THE MONTH OF DECEMBER TO THE SHERIFF S DEPARTMENT 2016 BUDGET. WHEREAS, the Sheriff s Department has collected the following fees, reimbursements and donations in excess of the anticipated budgeted revenue amount in the month of December, 2016: $ 130.00 received from DWI Fines from District Court $ 250.00 received from Drug Enforcement Fines $ 25.00 received from VIN checks $ 395.00 received from Act 770 fees $ 60.00 fees from Black Powder Prints $ 1,025.89 reimbursement for ADC invoices and Inmate Prescriptions $ 252.10 reimbursement for Inmate Postcards and 309 s Cable Bill $ 400.00 reimbursement for Inmate Social Security $ 152.30 received for Inmates Medical Reimbursement $ 95.00 received for Restitution-Extradition/Prisoner Transport $ 1,289.64 received from a Refund WHEREAS, it is necessary to appropriate said monies totaling $4,074.93 to the appropriate line items in the Sheriff s Department 2016 budget for future expenditure. Section 1. APPROPRIATION ORDINANCE NO. 2017 - BE IT ENACTED BY THE QUORUM COURT OF THE COUNTY OF BAXTER, STATE OF ARKANSAS, AN ORDINANCE TO BE ENTITLED: AN ORDINANCE APPROPRIATING FUNDS IN THE AMOUNT OF $10,300.00 FROM THE SPECIAL JAIL FEES FUND INTO THE 2016 BUDGET. WHEREAS, the Sheriff is requesting that available funds from the Special Jail Fees revenue fund (#3017) be moved into other line items in the Special Jail Fees and County Jail 2016 budgets for the appropriate assignment of expenditures. NOW, THEREFORE, BE IT ORDAINED BY THE QUORUM COURT OF BAXTER COUNTY, ARKANSAS, THAT: Section 1. The IT Manager is authorized to make the following appropriations from the Special Jail Fees revenue fund (#3017) into the following designated budget line items in the Special Jail Fees 2016 budget: $ 400.00 appropriated to GL# 3017-0418-2001 (General Supplies) $ 2,700.00 appropriated to GL# 3017-0418-4004 (Capital Outlay: Machinery & Equip.) APPROPRIATION ORDINANCE NO. 2017 - BE IT ENACTED BY THE QUORUM COURT OF THE COUNTY OF BAXTER, STATE OF ARKANSAS, AN ORDINANCE TO BE ENTITLED: AN ORDINANCE APPROPRIATING FUNDS IN THE AMOUNT OF $3,700.00 FROM THE SPECIAL JAIL FEES FUND INTO THE 2017 BUDGET. WHEREAS, the Sheriff is requesting that available funds from the Special Jail Fees revenue fund (#3017) be moved into other line items in the Special Jail Fees 2017 budget for the appropriate assignment of expenditures. NOW, THEREFORE, BE IT ORDAINED BY THE QUORUM COURT OF BAXTER COUNTY, ARKANSAS, THAT: Section 1. RESOLUTION 2015- A RESOLUTION AUTHORIZING THE BAXTER COUNTY JUDGE TO APPLY FOR AN ARKANSAS RURAL COMMUNITY GRANT ON BEHALF OF THE CLARKRIDGE VOLUNTEER FIRE DEPARTMENT. BE IT RESOLVED BY THE QUORUM COURT OF THE COUNTY OF BAXTER, STATE OF ARKANSAS, THAT: WHEREAS, the Baxter County Quorum Court has determined that the Clarkridge Volunteer Fire Department meets eligibility requirements necessary to apply for a grant under the Arkansas Rural Community Grant Program; and WHEREAS, the Clarkridge Volunteer Fire Department has presented plans to purchase extrication equipment for their second rescue unit, to include a gas engine powered hydraulic pump, hoses, spreader, shears, rams and fluids. WHEREAS, the Clarkridge Volunteer Fire Department has raised $10,348.00 to complete the matching requirement for this project; and WHEREAS, the Baxter County Quorum Court recognizes the need for this project, concurs its importance, and supports the Clarkridge Volunteer Fire Department in its efforts to proceed with the same; and NOW, THEREFORE, BE IT RESOLVED that the Baxter County Judge is hereby authorized to submit an application of formal request to the Arkansas Rural Development Commission for purposes of securing state grant funds in the amount of $10,348.00 to aid and assist the Clarkridge Volunteer Fire Department in executing the proposed project described herein and that the County Judge is further authorized to administer the grant funds for the same project.
