Education New Zealand and The Energy and Resources Institute present New Zealand India Sustainability Challenge Terms and Conditions for Entrants Education New Zealand ( ENZ ) in association with The Energy and Resources Institute ( TERI ) would like to invite tertiary level students between 18 and 22 years old from recognised colleges, universities and institutes in Tamil Nadu, Karnataka, Maharashtra and Delhi NCR to participate in the New Zealand India Sustainability Challenge. Participants must register in teams comprising two students and one mentor on www.studyinnewzealand.govt.nz/nzisc and submit their proposals by 8 August 2017. The ultimate winning team from India will get the chance to travel to New Zealand in February/March 2018. Terms and conditions These terms and conditions apply to the students who participate in the New Zealand India Sustainability Challenge ( Competition ). The term Entrants, Team, you or your shall henceforth be used to refer to the contestants of the Competition. The terms proposal or Entry refer to the online application form, proposal and any other entry or proposal information that is submitted to ENZ and/or TERI by an Entrant who is participating in the Competition, including any updated versions of proposals developed during the course of the Competition. Competition Dates 1. The Competition will be conducted in four stages (as more fully described at www.studyinnewzealand.govt.nz/nzisc): (a) Stage 1: registration; (b) Stage 2: regional rounds for shortlisted Teams; (c) Stage 3: finale for winning Teams from Stage 2; and (d) Stage 4: the ultimate winning Team travels to New Zealand. 2. The key dates are as follows, as may be extended or amended from time to time in ENZ s sole discretion: Competition Goes Live 29 May 2017 Competition closes 8 August 2017 (5.00pm India time) Regional rounds for selecting finalists (six teams) August/September 2017 Finale in Bengaluru 8 December 2017 Ultimate winning Team to travel to New Zealand Feb/March 2018 3. ENZ reserves the right to:
(a) modify or cancel the Competition or any of the arrangements, schedules, plans, dates or other details related to the Competition at any time and for any reason if deemed necessary in its opinion; and (b) modify the terms and conditions for this Competition by notifying you of any changes by posting a revised version of these terms and conditions on www.studyinnewzealand.govt.nz/nzisc. Eligibility 4. The Competition is open to teams comprising two students (each a Student Entrant ) and one mentor ( Mentor Entrant ) (together a Team ). 5. To participate in the Competition you must: a. be between 18 and 22 years of age as at 8 August 2017 in the case of a Student Entrant; b. be a citizen of India and physically living in India; c. be a student (in the case of a Student Entrant) or a faculty member (in the case of a Mentor Entrant) of a recognised college, university or institute in Tamil Nadu, Karnataka, Maharashtra or Delhi NCR; d. hold a valid passport, with a validity period of at least six months from Feb/March 2018; and e. have and provide to ENZ and/or TERI the consent of your college, university or institute on the form set out on ENZ s website. 6. Officers or employees of ENZ, New Zealand Foreign Affairs and Trade, TERI and their immediate family members are not eligible to participate in the Competition. 7. Each Entrant may only be part of one Team. Each Team may only submit one Entry. Selection Process 8. Each Team must submit by 8 August 2017 an Entry comprising: a. An application on the form provided at www.studyinnewzealand.govt.nz/nzisc; and b. A university consent form signed by each Entrant and on behalf of the Team s university. 9. ENZ and TERI will consider each Entry and select which Teams will progress to stages 2, 3 and 4 via the process described at www.studyinnewzealand.govt.nz/nzisc. Judging Criteria 10. Entries will be judged on how innovative, feasible and scalable your sustainable solution is. 11. More detailed judging criteria for Stages 2 and 3 will be circulated among the selected Teams closer to the time of the relevant judging. 12. In the event of any dispute regarding the rules, conduct, results and all other matters relating to the competition, the decision of the judge(s) shall be final and no correspondence or discussion shall be entered into.
Entry Description 13. The Entry must: a. be in the form set out at www.studyinnewzealand.govt.nz/nzisc; b. be respectful to any nation, custom, tradition, moral, ethics and religion; c. not encroach or infringe on any rights or interests of any person, association or organisation in a way that may damage their reputation or privacy; d. not contain or convey any indecent content or message and not use words or expressions which are rude, defamatory, insulting, offensive, encourage gossip or that incite disharmony, violence or conflict; and e. be an original creation of the Team. 14. ENZ cannot accept responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction, alteration of, or unauthorised access to Entries, or Entries lost or delayed whether or not arising during operation or transmission as a result of server functions, virus, bugs or other causes outside its control. 15. ENZ accepts no responsibility for Entries that are lost or delayed, or which are not received for any reason. Prize 16. The ultimate winning Team will win the New Zealand India Sustainability Challenge Award and, subject to the grant of a Visa, which is not within the control of ENZ, will travel to New Zealand for three weeks for an internship experience. 17. ENZ will: (a) arrange and pay for domestic airfares in India and New Zealand (as required); (b) arrange and pay for return economy airfares on airlines of ENZ s choice for travel from India to New Zealand; (c) arrange for its New Zealand university partners to provide accommodation, ground transport, sightseeing and educational experiences for each Entrant for three weeks; and (d) pay a stipend to each winning Entrant to cover the Entrant s reasonable food and incidental costs (such amount to be determined by ENZ) for three weeks (together, the Prize ). Notification of Prize Winners 18. If a winning Entrant is unable to be contacted after reasonable attempts have been made to do so, ENZ reserves the right to offer the Prize to the next best entry.
19. A winning Entrant must arrange and submit all necessary visa documentation to ENZ. If a winning Entrant is disqualified or is unable to obtain a visa for any reason, ENZ reserves the right to offer the Prize to the next best Entry. 20. Any attempt by an Entrant to influence the result or subvert the Competition will lead to immediate disqualification. Competition Entry Fees 21. There are no entry fees and there is no purchase necessary to enter this Competition Obligations, Warranties and Representations 22. By entering the Competition, you agree to: a. maintain at all times a responsible attitude to the Competition; b. be available for and participate in activities and events associated with Stages 2 and 3 of the Competition, if selected, and, in the case of activities and events associated with Stage 2, to travel to such events at your own cost; c. comply with all applicable laws and regulations; d. comply with your university s relevant terms and conditions, academic honesty and plagiarism rules, and any other relevant rules or policies; e. comply with any reasonable directions or guidelines ENZ and/or TERI may give you from time to time, including those contained on www.studyinnewzealand.govt.nz/nzisc; and f. not engage in any conduct that may, or is likely to, cause damage to, adversely affect, bring into disrepute, scandalise or ridicule the good name, reputation or image of ENZ and/or TERI. 23. ENZ and/or TERI reserves the right to withdraw your Entry for any reason at its discretion, including (but not limited to) if you provide incorrect or incomplete information. 24. ENZ reserves its right to remove any person from contention for winning a Prize for any reason and at any time. 25. If at any time ENZ and/or TERI identifies that: a. an Entry contains incorrect or incomplete information; or b. an Entrant is ineligible or unable to participate in the Competition in accordance with these terms and conditions; or c. an Entrant has breached any of its obligations under these terms and conditions; or d. an Entrant has made any representation or warranty that is not correct, ENZ and/or TERI reserves its right to immediately disqualify that Entrant from the Competition and to choose another Entry or in his/her place.
Permissions 26. You hereby authorise ENZ and TERI to: a. publish your name, photograph, and other Entry details on the ENZ and/or TERI website in connection with any content regarding the Competition or other ENZ or TERI promotional or marketing activity; b. take photographs and film you, including during the Competition process ( Promotional Materials ); c. use your personal information (including your name, age and photograph), the information contained in your Entry and the Promotional Material for ENZ s or TERI s promotional activities (including to promote and market New Zealand as an education destination in any type of media, including on social media); d. use your personal information to facilitate your participation in the Competition, including to contact you about your Entry and to share information with our third party service providers and the internship providers. 27. You agree that the collection, use, storage and disclosure of the personal information that you provide to ENZ in relation to the Competition is subject to ENZ s privacy policy (www.studyinnewzealand.govt.nz/on/in/privacy). 28. By entering the Competition you: a. agree that the ownership in and rights to all of the intellectual property and other rights in and to your Entry and any solution which is developed or created from your proposal will be determined in accordance with your college, university or institution s relevant intellectual property policy; b. agree that all of the intellectual property and other rights in and to the Promotional Material are the property of ENZ; and c. irrevocably provide all waivers and consents, including without limitation, a waiver of your moral rights in relation to your Entry, to allow ENZ (as well as its agents, affiliates and related government entities) and TERI to use your Entry, any solution which is developed or created from your proposal, and the Promotional Material for: i. ENZ s promotional activities (such as to promote and market New Zealand as an education destination on any type of media, including on social media); ii. TERI s promotional activities; and iii. to facilitate and promote the Competition. 29. The Entrant confirms that he/she will do everything and execute all documents necessary to give effect to these terms and conditions, including without limitation to assign and transfer to ENZ or ENZ s
nominee, successors or assigns all of your rights, title and interest in and to the Promotional Materials from time to time and to enable ENZ or ENZ s nominee, successors or assigns as the case may be to use and/or register intellectual property rights in relation to the Promotional Materials anywhere in the world. Liability 30. The Entrants waive all claims against ENZ, its personnel and agents arising out of any oral or written publication or republication of any statement made in connection with the Competition, their person or their Entry. 31. The Entrant declares and warrants that the Entry submitted is their own or their Team s original work and does not infringe any third party s rights such as copyrights, patents, trade marks, trade secrets, musical composition or performance rights, video rights, image rights or any other intellectual property rights of any third party. 32. If your Entry incorporates any personal information of any person (including the identity or image of any person) you confirm that the personal concerned has consented to the use of his/her image and personal information. 33. The Entrants bear the sole liability for any claims relating to their activities carried out in relation to the Competition. 34. ENZ does not accept any responsibility for any damage, loss, injury or disappointment suffered by any Entrant entering the Competition or as a result of accepting any Prize. 35. ENZ is not responsible for any problems or technical malfunction of any network or lines, computer online systems, servers, or providers, computer equipment or software, failure of any email or entry to be received on account of technical problems or traffic congestion on the Internet, telephone lines or at any web site, or any combination thereof, including any injury or damage to the Entrant's or any other person's computer or mobile telephone related to or resulting from participation in the Competition. Nothing shall exclude ENZ s liability for death or personal injury as a result of its negligence. 36. All taxes, insurances, transfers, spending money and other expenses (including personal expenses, upgrades etc.) as the case may be, are the sole responsibility of the Prize winner. 37. To the fullest extent permitted by law ENZ will not be liable for any loss or damage whatsoever (including but not limited to indirect or consequential loss) or for personal injury as a result of the Entrant s participation in this Competition. 38. The Entrants agree to indemnify, and keep indemnified, ENZ against all claims, demands, costs (including legal costs on a solicitor and client basis), losses, expenses and damages arising out of your participation in the competition or your breach of these terms and conditions (including by giving an incorrect
representation or warranty) or out of any use of your entry by ENZ in any manner reasonably contemplated by these terms and conditions. 39. If any act, omission, event or circumstance occurs which is beyond the reasonable control of ENZ and which prevents ENZ from complying with these terms and conditions, ENZ will not be liable for any failure to perform or delay in performing its obligations. Jurisdiction 40. The Competition and Rules will be governed by the law of India and any disputes will be subject to the exclusive jurisdiction of the courts of India.
