A REGULAR MEETING OF THE MAYOR AND BOARD OF TRUSTEES OF THE VILLAGE OF BOLINGBROOK JUNE 22, 2010 CALL TO ORDER The Regular Meeting of the Mayor and Board of Trustees of the Village of Bolingbrook was called to order at the hour of 8:02 p.m., June 22, 2010, in Bolingbrook, Illinois, by Mayor Roger C. Claar. PLEDGE OF ALLEGIANCE Mayor Roger C. Claar requested that Rich Berg, retired Bolingbrook Police Officer, lead the Pledge of Allegiance to the Flag. ROLL CALL Village Clerk, Carol S. Penning, called the roll. Present were: Mayor Roger C. Claar, Trustees Leroy J. Brown, Michael T. Lawler, Rick Morales, Joseph B. Morelli, Patricia Schanks Absent: Sandra S. Representing the press: Bob Anderson The Bolingbrook Sun Alice Fabbre - Free Lance Writer for the Chicago Tribune Laura Katauskas - The Bolingbrook Bugle JOURNAL OF PROCEEDINGS Motion Brown, second Lawler to approve the minutes of the June 8, 2010, Village Board meeting submitted by the Village Clerk. Voice vote. Motion carried. APPROVAL OF AGENDA/ADDITIONS Village Attorney, Jim Boan, requested that Motion #3, second bullet point, be changed to read "$650,000" not "65,000". Motion Morelli, second Morales to approve the agenda as amended. Voice vote. Motion carried. 1

APPROVAL OF APPOINTMENTS None PROCLAMATIONS NATIONAL HISTORIC PRESERVATION WEEK, June 27th through July 3rd, 2010: Mayor Claar proclaimed June 27th through July 3rd NATIONAL HISTORIC PRESERVATION WEEK and called upon residents to join their fellow citizens across the United States in recognizing and participating in this special observance. Historic Preservation Chair, Jim Childress, accepted the proclamation. MUNICIPAL CLERKS WEEK, June 27th through July 3rd, 2010: Mayor Claar proclaimed June 27th through July 3rd as MUNICPAL CLERKS WEEK and extended appreciation to our Municipal Clerk, Carol Penning, and to all Municipal Clerks for the vital services they perform and their dedication to the communities they represent. Village Clerk, Carol S. Penning, CMC, accepted the proclamation. PRESENTATIONS ARBOR DAY:. Barbara Ann Parker, Chair of the contest and member of the Beautification Commission, talked about the details of the Arbor Day Poster contest and announced the winners. 2010 STATE OF ILLINOIS CRIME STOPPERS AWARDS: Contributor of the Year Award went to Senior Patrol Officer Richard Berg (retired). Outstanding Board Member went to Pastor Paul Carlson of New Life Lutheran Church. Pastor Carlson explained the Rich Berg has been instrumental in helping to promote the Crime Stoppers of Bolingbrook Program through building their web page and instituting other ways for Crime Stoppers to communicate to the public or have the public send anonymous tips about crimes by using today's technology. In two and one-half years, Crime Stoppers has received 110 tips, helped to arrest 41 criminals, $58,000 in property has been recovered along with drug busts. Crime Stoppers offers rewards for tips and have paid out $16,000 in tips that have led to arrests of criminals in the community. They also have an active program in the High School. BILL APPROVAL Motion Schanks, second Morales to approve expenditures submitted as Bill Listing A - Payables in the amount of $1,424,304.02 and Bill Listing B - Pre-paids in the amount of $231,134.27 totaling $1,655,438.29. (Copies were made available in the Finance Dept. and Clerk's Office.) 2

TAX RECEIPTS: 1. March 2010 State Income Tax -- $701,444.58 (March 2009 State Income Tax -- $864,476.34) an 18.86% Decrease 2. April 2010 Sales Tax -- $1,912,016.96 (April 2009 Sales Tax -- $1,886,822.21) a 9.2% Increase 3. April 2010 Motor Fuel Tax -- $153,959.93 (April 2009 Motor Fuel Tax - $141,734.71) an 8.6% Increase MOTION TO ACCEPT LOW BID FROM SKC CONSTRUCTION, INC. IN THE AMOUNT OF $112,285.00 FOR THE 2010 CRACK FILL PROGRAM Motion Brown, second Morales to approve a motion to accept the low bid from SKC Construction, Inc., in the amount of $112,285 for the 2010 Crack Fill Program. This motion accepted the low bid for the Village s annual road maintenance crack filling program. These are non-mft funds. Seven (7) bid packets were sent out and three (3) bids were returned. SKC Construction, Inc., was the low bidder. The bid was $112,285.00 which was well under the budgeted amount of $250,000. This motion awarded the 2010 Crack Fill Road Maintenance Program to SKC Construction. MOTION TO ACCEPT LOW BID FROM AMBER MECHANICAL CONTRACTORS IN THE AMOUNT OF $648,388 TO REPLACE ALL HVAC ROOF TOP UNITS, CEILING DAMPERS AND CONTROLS AT VILLAGE HALL Motion Schanks, second Lawler to approve a motion to accept the low bid from Amber Mechanical Contractors in the amount of $648,388 to replace all HVAC roof top units, ceiling dampers and controls at Village Hall. The Village received a supplemental grant from CDBG. The $652,000 grant was designated for energy conservation. Village Hall was built in 1980 and the HVAC units are original. The units are inefficient and have been experiencing a growing number of breakdowns. The dampers and control units are obsolete and replacement parts are no longer available. This motion accepted the low bid from Amber Mechanical Contractors to replace the units. Four (4) bid packets were sent out and two (2) bids were submitted. The low bid was in the amount of $648,388 which was $3,612 under budget. The HVAC units should be installed in time for the heating season. 3

RESOLUTION 10R-039 APPROVING POLICY WITH REGARD TO THE COLLECTION, USE AND COMMUNICATION OF INDIVIDUALS SOCIAL SECURITY NUMBERS Motion Morelli, second Schanks to adopt a resolution approving a policy with regard to the collection, use and communication of individuals' Social Security numbers. The State of Illinois has adopted Public Act 096-0874 titled the Identity Protection Act. It required all units of government to adopt standards and policies to protect individual personal identifiers by July 1, 2010. Personal identifiers are information such as Social Security and driver s license numbers. This resolution adopts the Act s identity protection requirements. The staff is in the process of reviewing Village forms and procedures to insure compliance with the Act. PC 10-15 APPROVAL OF A SPECIAL USE PERMIT FOR A PLANNED COMMERCIAL DEVELOPMENT WITH VARIANCES, FINAL DEVELOPMENT PLAN, AND FINAL PLAT OF SUBDIVISION; JULIAN S PLAZA, 120-160 E. BOUGHTON ROAD; BJP HOLDINGS, VITO DIPIETRA, APPLICANT Motion Brown, second Lawler to accept Plan Commission Report PC 10-15 for approval of a Special Use Permit for a Planned Commercial Development with variances, Final Development Plan and Final Plat of Subdivision for Julian's Plaza, 120-160 E. Boughton Road; BJP Holdings, Vito DiPietra, Applicant. Voice vote. Motion carried. 4

ORDINANCE 10-040 APPROVING SPECIAL USE PERMIT FOR PLANNED COMMERCIAL DEVELOPMENT AND FINAL DEVELOPMENT PLAN JULIAN S PLAZA (BJP HOLDINGS) Motion Lawler, second Schanks to pass an ordinance approving a Special Use Permit for a Planned Commercial Development and Final Development Plan for Julian's Plaza (BJP Holdings). The Portillo Restaurant Group d/b/a BJP Holdings purchased the 6.78 acre site at the northeast corner of Rt. 53 and Boughton Road. The restaurant chain has opened its fast food store on the front part of this site which has been named Julian's Plaza. The applicant would now like to construct a 30,000 square foot multi-tenant building on the rear of the property where the former Jewel building was located. The proposed building will be anchored by Grove Dental and Honey-Jam Café. The applicant requested approval of a Special Use Permit for a Planned Commercial Development with three (3) associated variances. They also sought approval of a Final Development Plan. The Plan Commission has reviewed and recommended approval. Vito DiPietra, representing BJP Holdings/Julian's Plaza, explained that "Julian" is Mr. Portillo's middle name. He explained what type of businesses would be located in the new plaza and a rendition of the building was shown. Honey-Jam Café will be the anchor restaurant in the building. It will be a higher end breakfast/lunch restaurant that is reasonably priced. Opening date for the east end of the building is October 1st and the entire project should be completed by March, 2011. ORDINANCE 10-041 APPROVING FINAL PLAT OF SUBDIVISION OF JULIAN S PLAZA FOR PORTILLO S AND MULTITENANT BUILDING (NORTHEAST CORNER OF BOUGHTON AND ROUTE 53 - BJP HOLDINGS Motion Brown, second Morales to pass an ordinance approving a Final Plat of Subdivision of Julian's Plaza for Portillo's and a multi-tenant building on the northeast corner of Boughton and Route 53 - BJP Holdings. This ordinance approved the Final Plat of Subdivision for the Julian's Plaza. The Plan Commission has reviewed and recommended approval of the Final Plat of Subdivision. 5

ORDINANCE 10-042 AMENDING CHAPTER 13 OF THE MUNICIPAL CODE DECREASING CLASS D-1 FROM SIXTEEN (16) TO FIFTEEN (15) AND CLASS D-2 FROM SEVEN (7) TO SIX (6) GONZO S TAP AND GRILLE Motion Morales, second Schanks to pass an ordinance amending Chapter 13 of the Municipal Code decreasing Class D-1 from sixteen (16) to fifteen (15) and Class D-2 from seven (7) to six (6) for Gonzo's Tap and Grille. Gonzo s Tap and Grille, located in the Ditka Dome on North Rt. 53, has gone out of business. This ordinance reduced the number of Class D-1 licenses from sixteen (16) to fifteen (15) and Class D-2 licenses from seven (7) to six (6) to reflect the closing. ORDINANCE 10-043 AMENDING CHAPTER 13 OF THE MUNICIPAL CODE INCREASING CLASS D-1 FROM FIFTEEN (15) TO SIXTEEN (16) AND CLASS D-2 FROM SIX (6) TO SEVEN (7) GRECO S AMERICAN GRILLE Motion Morelli, second Morales to pass an ordinance amending Chapter 13 of the Municipal Code increasing Class D-1 from fifteen (15) to sixteen (16) and Class D-2 from six (6) to seven (7) for Greco's American Grille. Greco s American Grille has taken over the space in the Ditka Dome formerly occupied by Gonzo s Tap and Grille. They have requested a D-1 and D-2 liquor license. This ordinance increased the number of D-1 licenses from fifteen (15) to sixteen (16) and the number of D-2 licenses from six (6) to seven (7). Owner, Alex Greco, explained his plans for the new establishment. They have most of the same staff that they had at The Woodlands, a high end restaurant that used to be in Bolingbrook. They will concentrate their efforts on great food and being a family environment. 6

QUESTIONS FROM THE AUDIENCE George Smith, 436 Cottonwood Circle, mentioned the article on gangs in the Bolingbrook Bugle. He told residents to get more involved when they see a problem and notify the Trustees and Police Department. He asked that Trustee Morales and DuPage Township Tax Assessor, John Randall, have an information meeting on how the taxes are computed and the taxing bodies that are included in the tax bills. He also encouraged residents to bring any issues they may have to the Village Board. QUESTIONS FROM THE PRESS None TRUSTEE COMMENTS Trustee Morales congratulated the Arbor Day Poster Contest winners. He wished residents a Happy 4th of July. He stated that he has not had a meeting with John Randall, Tax Assessor, and has not prepared any type of program. Trustee Morelli gave details on the North American Youth (NAYS) Sports Annual National Championship Youth Basketball Tournament being held throughout the Village from Wednesday, July 21st through Sunday, July 25th. Trustee Schanks gave information about the 26th Annual Village Picnic on Sunday, June 27th, from Noon to 7:00 p.m. behind Village Hall. She urged all residents to attend. Trustee Brown responded to George Smith's concern regarding gangs in the Village. He noted that he has conducted a number of forums on this subject in the Village with residents and the Police Department. He asked: Do we have a gang problem? The answer was "No". There are some gang members in Bolingbrook that cause trouble and the Police Department works diligently on this every day. But most of the kids that look like gang members aren't actually a gang member. They are just making bad decisions and identifying themselves by imitating gang members. Trustee Lawler gave details on the 4th of July "All American Celebration" at the Bolingbrook Golf Club on Sunday, July 4th. Events will take place all day starting with early morning golf games, the "Taste of Bolingbrook" from 1:00-8:30 p.m., and a fireworks display at dusk. EXECUTIVE SESSION None 7
