October 21-22, 2017 Living Catholic in the 808: Canon Law and Domestic Violence By: Fr. Mark Gantley Judicial Vicar Diocese of Honolulu Catholichawaii.org/stopdomesticviolence To put it bluntly, canon law recognizes the right of a party to not maintain a common household with one s spouse in situations of danger. While canon 1151 says: Spouses have the duty and right to preserve conjugal living unless a legitimate cause excuses them. canon 1153 1 provides an example of such a legitimate cause: If either of the spouses causes grave mental or physical danger to the other spouse or to the offspring or otherwise renders common life too difficult, that spouse gives the other a legitimate cause for leaving.... Note that the danger can be to either husband or wife or to children, and that the danger may be physical or some other danger or grave difficulty (e.g., drug use, alcoholism). The Church in these situations encourages repentance, change of behavior, forgiveness, and reconciliation. That said, as long as danger exists, the innocent spouse has no obligation to resume marital life. Divorce may even be necessary to protect the rights of the innocent party. The right to separate does not mean that the person has a right to marry someone else. The parties are presumed to still be married even if they civilly divorce. In this situation, the person may petition for a declaration of marital nullity through the Diocesan Tribunal to determine if the marriage was invalid from the beginning. This would allow a new marriage. Contact your parish to start the process. Daughters of St. Paul Appeal We are the Daughters of St. Paul from the Pauline Books & Media Center in downtown Honolulu and are in our 43rd year serving the church through the media of evangelization bringing the word of God to many and to your parish. We are self-supporting sisters not only in our mission but also in the maintenance of our building. Our book center, which is open to all people, is a center of light and inspiration where all can experience and discover hope. We have a chapel with the Blessed Sacrament where anyone can come to make a visit. We are turning to you for help regarding the maintenance of our building. The building has been here since 1928. Our AC system is breaking down and at this time we are in dire need to replace the Chiller system & components, which is located on the roof, just to get the cooling going. We have people of all ages coming into the book center and many suffer from the heat, which has made this request urgent. We have received the proposal for the work and it will cost approximately $120,000.00. We are asking you for a donation to help us with this cost; any support you give is tax deductible. Stewardship Corner Stewardship at Holy Trinity Catholic Church Lesson 69 You Can t Take It With You but the day or the hour, no one knows (Mk 13:32) Our investment of time, talent and treasure in the people of God are very important because they become part of the Kingdom of God. Those who spend their time gathering will come to realize they can t take it with them; while those who spend their time sowing and giving will realize a reward far greater than they could ever comprehend.
