DECREE DECREE NO.10 OF 2005 WITH RESPECT TO THE MANNER OF EXERCISE BY THE PUBLIC COMMISSION FOR THE PROTECTION OF MARINE RESOURCES, ENVIRONMENT AND WILDLIFE OF ITS POWERS We, Hamad bin Isa Al Khalifa, King of the Kingdom of Bahrain, Article 1 Having examined the Constitution, And Legislative Decree No.50 of 2002 with respect to the Formation of the Public Commission for the Protection of Marine Resources, Environment and And Decree No.41 of 2002 with respect to the Organisation of the And Decree No.46 of 2003 with respect to the Re-organisation of the And upon the submission of the Prime Minister, And with the approval of the Council of Ministers, HEREBY DECREE THE FOLLOWING: The Public Wildlife shall exercise its powers provided for in Legislative Decree No.2 of 1995 with respect to the Protection of the Legislative Decree No.21 of 1996 with respect to the Environment and Legislative Decree No.20 of 2002 with respect to Organising Fishing, Utilizing and Protection of Marine Wealth in accordance with the rules and regulations provided for in these laws, the implementing rules and regulations and complying with the provisions provided for in this Decree. Article 2 The Commission shall have a Chairman to be appointed by virtue of a Decree for a fouryear renewable term. Article 3 The Chairman of the Commission shall undertake to manage its technical, financial and administrative affairs, propose a general policy adopted by the Commission and shall adopt required resolutions for the purpose of accomplishing any of the objects established within the limits provided for in the related laws and particularly: 1. To generally supervise all the Directors of the Commission. 2. To publish internal regulations to regulate technical, financial and administrative affairs of the Commission. 3. To review reports and memoranda submitted to him by the General Directors about the Commission s business. 1
4. To set up a data base to assist the Commission in carrying out its duties. 5. To review any subjects referred thereto by the Council of Ministers concerning issues related to its powers. Article 4 The Chairman may delegate any of the Director Generals to exercise some of his powers. Article 5 Employees of the Commission shall be subject to rules and regulations of the Civil Service Commission. Article 6 Rules and Regulations, in addition to the Orders issued for the implementation of the provisions of Legislative Decree No.2 of 1995 with respect to Protection of the Legislative Decree No.21 of 1996 with respect to the Environment and Legislative Decree No.20 of 2002 with respect to Organisaing the Fishing, Utilization and Protection of Marine Wealth at the time of publishing this Decree shall be applicable until they are amended or revoked. Article 7 Decree No.41 of 2002 with respect to the Organisation of the Public Commission for the Protection of Marine Resources, Environment and Wildlife shall be revoked in addition to any Order that may contradict with the provisions of this Decree shall also be revoked. Article 8 The Prime Minister and Ministers, each in his respective capacity, shall implement this Decree which shall come into effect from the day following the date of its publication in the Official Gazette. MINISTERIAL ORDER NO.1 OF 2006 WITH RESPECT TO DELEGATING MEMBERS OF PUBLIC COMMISSION FOR THE PROTECTION OF MARINE RESOURCES, ENVIRONMENT AND WILDLIFE WITH THE POWER OF JUDICIAL SUMMARY ARREST OFFICERS The Minister of Justice, Article 1: Having reviewed the Legislative Decree No.20 of 2002 with respect to Organising the Fishing, Utilization and Protection of Marine Resources, particularly Article (31) thereof, And Decree No.41 of 2002 with respect to Organisation of the Public Commission for the Protection of Marine Resources, Environment and And the Code of Criminal Procedure promulgated by Legislative Decree No.46 of 2002 particularly Article (45) thereof, And Legislative Decree No.50 of 2002 with respect to the Establishment of the Public And Decree No.46 of 2003 with respect to Re-organisation of the Public Commission for the Protection of Marine Resources, Environment and And Order of the Minister of Justice No.(3) of 2004 with respect to delegating certain officers of the Public Commission for the Protection of Marine Resources, Environment and Wildlife with the duty of the summary arrest officers, and upon agreement with the President of the Public Commission for the Protection of Marine Resources, Environment and HEREBY ORDERS: The following Officers of the Directorate of Marine Wealth at the Public Commission for the Protection of Marine Resources, Environment and shall be vested with the power of Summary Arrest Officers with respect to crimes that take place in areas of their jurisdiction in violation of the provisions of Legislative Decree No.20 of 2002 with respect to Organising Fishing, Utilization and Protection of Marine Resources and the Orders issued for its implementation: 1.
