Subject: - Government of Jammu and Kashmir Finance Department Civil Secretariat, Jammu. ******* Final seniority list of Guards of the Excise and Commercial Taxes Departments. Government Order No. I I b -FD of 2017 Dated:- 30-03-2017 Whereas, in order to update the seniority list of the Guards of Excise and Commercial Taxes Departments, it is expedient to exclude the names of officials, who have either been promoted to the next higher post substantively or have retired on superannuation, and include those who have been appointed to the posts of Guards through the authorized channel of direct recruitment/promotion and has completed probation. Whereas, in order to update the seniority list, a tentative seniority list of Guards, indicating the position as on 01-01-2016, was notified vide Notice, dated 27-01-2016 wherein objections, if any, in the said list were invited from all concerned within a period of 30 days from the date of the issue of the notice; Whereas, nine representations have been received from the following officials through the concerned Heads of Department, which have been scrutinized under rules and requisite modifications have been incorporated in the seniority list as below:- s. Name of the Official Objection filed No. 1. Mr. Daleep Raj The official is figuring at S.No. 19 of the tentative seniority list. He has objected that his date of first appointment as Excise Guard has been shown as 27-06- 1990 instead of 21-04-1986 and The date of joining of the official in the Excise Department as Guard is 21-04-

1986 instead of 27-06-1990 and the correction has been done accordingly. - 2. Mr. Mohd (ALC) 3. Mr. Mohd Rafi 4. Mr. Bhola Nath Bashir The official claimed that he is figuring in the tentative seniority list of Guards at S.No. 197 and second Mohd Bashir S/o Mr. Mirza Fazal Hussain Junior to him has been shown at S.No. 180. The claim of the official has been found genuine. In the appointment order No. 716 of 2007 dated 12-02- 2007 he is figuring at S.No. 81 whereas second Mohd Bashir is figuring in the said order at S.No. 95 and the correction has been done accordingly. The official figuring at S.No. 169 in tentative seniority list. He has been objected that his seniority position is not correct and has submitted that his date of birth has been recorded as 12-07-1983 instead of 25-02-1980. After examining the records, it has been found that the claim of the official has been genuine and it has been corrected accordingly. The official is figuring at S.No. 41 of the tentative seniority list. He has objected that his (SC) category has not been mentioned in the list. The claim of the official is incorporated in the final seniority, subject to the receipt of verification report of the concern Tehsildar. 5. Mr. Ramesh Chander The official figuring at S.No. 57 of the tentative seniority list. He has objected that he is figuring at Sr. No. 53 instead of Sr. No. 57 as his first appointment as orderly is 03-08-1993 and the appointment as Guard on 15-12-1998. The official on the directions of Hon'ble Court in LPA SWP No. 16/12 titled State of J&K V /s Ramesh Chander & Others have been regularized as Guards w.e.f. 15-12-1998 i.e. the day they were adjusted as Guards vide this office order No. 78/ Adm of 2014 dated 21-04-2014. As the correction has been done accordingly.

6. Mr. Ved Prakash The official figuring at S.No. 58 of the tentative seniority list. He has objected that he has figuring at Sr. No. 54 instead of Sr. No. 58 as his first appointment as orderly is 03-08-1993 and the appointment as Guard on 15-12-1998. The official on the directions of Hon'ble Court in LPA SWP No. 16/12 titled State of J&K V /s Ramesh Chander & Others have been regularized as Guards w.e.f. 15-12-1998 i.e. the day they were adjusted as Guard vide this office order No. 78/ Adm of 2014 dated 21-04-2014. As the correction has been done accordingly. 7. Mr. Ghulam Mohammad Bhat The official has objected that his name does not figure in the tentative seniority list and has forwarded his particulars for placing them in appropriate place and accordingly he has included in the seniority list of Guards. Mr. Mian Touseef Ahmad The official figuring at S.No. 85 of the tentative seniority list. He has objected that his 'ST' category has not been mentioned in the list. The claim of the official is incorporated in the final seniority, subject to the receipt of verification report of the concern Tehsildar. Now, therefore, without prejudice to and subject to the outcome of writ petitions, if any, pending in the Courts of Law, the Final Seniority List of Guards of the Excise and Commercial Taxes (Subordinate) Services depicting the position as on 01-01- 2016, is hereby issued forming annexure to this Government Order. In case any officials feel aggrieved with the position assigned to him, he is entitled to file a review petition, as per the relevant provisions of the Jammu and Kashmir Civil Services

(Classification, Control and Appeal) Rules, 1956. The review petitions, if any, containing facts, as have not been considered or as have come to light now and which have a material bearing on the issue of determination of seniority, should reach this office within a period of one month from the date of issuance of this order. The date( s) of birth as well as category recorded against the officials in the Final Seniority List, shall not be taken as authentic, and, shall be subject to the verification from Service Books/ulation Certificates viz a viz report(s) from competent authorities.
