Sholosh Seudot Halacha Discussion One Shabbos, after Torah reading in shul, the gabbai called on Mr. Fisher to do hagbah, which involves lifting up the Sefer Torah for all to see. I have a pain in my shoulder, explained Mr. Fisher, please ask someone else. The gabbai patted Mr. Fisher on the back and said jokingly, At your age, I could lift up you and the Sefer Torah together. Come on, now. It s a light Sefer. Mr. Fisher was embarrassed to refuse again with the entire shul watching him, so he agreed. He went up the bimah, lifted up the Sefer Torah, and within a few seconds his arm collapsed from under it. Someone was nearby to catch the Torah, so it did not fall to the floor, but Mr. Fisher had dislocated his shoulder. His searing pain forced him to go home immediately. After Shabbos, he had his shoulder treated in the hospital and he missed two days of work. The gabbai felt terrible about having pressured Mr. Fisher into doing hagbah and causing him to dislocate his shoulder. Mr. Fisher was hurt, had to spend money on his treatment and missed two workdays as well. The gabbai wondered if he was obligated to compensate Mr. Fisher for these damages. What does the Torah say about such a situation? Find out with Rabbi Rothman at Shalosh Seuda
