City Council Agenda Item #10_ Meeting of June 27, 2016 Brief Description Resolution approving the final plat of LEGACY OAKS 3 rd ADDITION Recommendation Adopt the resolution approving the request Introduction In June 2013, the city council approved the LEGACY OAKS preliminary plat. The plat allowed for development of the existing 26-acre Jondahl Farm. As per the approved preliminary plat, LEGACY OAKS includes single-family homes, twin homes, and either condominium units, townhomes or a combination of both. (See pages A1 A2.) In April 2014, the city council approved the LEGACY OAKS final plat. The plat created the single-family and twin home lot portion of the property in the west and central area of the development. The east area was platted as outlots, with the expectation that future phases would be final platted just ahead of construction. (See pages A3 A4.) In January 2015, the city council approved the LEGACY OAKS 2 nd ADDITION final plat. The plat created a lot for the first of three, 20-unit condominium buildings. (See page A5.) At this time the applicant, Ron Clark Construction, is requesting approval of the LEGACY OAKS 3 rd ADDITION final plat. This plat creates two lots for two, 20-unit condominium buildings, as well as four twin home lots. (See page A6.)The site and building plans for the condominium buildings themselves were recently reviewed and approved by the planning commission. (See pages A7 A11.) Staff Recommendation The LEGACY OAKS 3 rd ADDITION generally reflects the site design approved as the preliminary plat, as well as a phased approach to development. As such, staff recommends the council adopt the resolution approving the final plat for LEGACY OAKS 3r d ADDITION. (See pages A12 A13.) Resolution No. 2016- Resolution approving the final plat for LEGACY OAKS 3 R ADDITION Be it resolved by the City Council of the City of Minnetonka, Minnesota, as follows: Section 1. Background. 1.01 On January 26, 2015, the city council approved the LEGACY OAKS 2 ND ADDITION final plat. 1.02 Ron Clark Construction has now requested final plat approval for LEGACY OAKS 3 RD ADDITION. 1.03 The property to be included in the plat is legal described as: OUTLOT B, LEGACY OAKS 2 ND ADDITION, HENNEPIN COUNTY, MINNESOTA. Section 2. Council Action. 2.01 The city council grants final plat approval of LEGACY OAKS 3 RD ADDITION. Approval is subject to the following condition 1. Submit a revised plat drawing that assigns a lot number to the area currently labelled as Outlot B and renumbers other lots accordingly. 2. Prior to release of the final plat, provide title evidence that is current within thirty days of submittal for review and approval of the city attorney.
