It has been resolved to construct Nursery School at labour rate/contract basis. 2. It has been resolved to rent out Society Shops. 3. It has been resolved to re-carpet roads by cement on priority basis at labour rate basis as done previously. 4. It has been resolved to clean Society Sewer Line within Society resources first failing which GNIDA be requested to clean it mechanically on payment basis. 5. It has been resolved to clear storm water drains within Society resources. There should be no water in storm water drain. It should remain dry all the time. Members be requested to close water exist point of their houses leading flow of water in to storm water drain which is exclusively for clearing rainy water. Bath room water should go in to the sewer line and not in to the storm water drain as per society approved plan for constructing the house. If the members do not close the water exist outlet to storm water drain, the matter should be referred to GNIDA to intimate how the maps of these houses were not prepared as per approved Society plan. 6. It has been resolved that CEO Greater Noida be requested to withdraw the recovery notice of Rs 24,73,37,764/- failing which the Society will knock the door of Hon ble court for justice. 7. It has been resolved to file an application in the court of law for removing the obstruction being created in regard to construction of roads. The construction of Nursery School and re-carpeting of road have been forcefully stopped by Shri Kataria and others. 8. It has been resolved to re-carpet Society road on receipt of Court Orders. 9. It has been resolved to curtail the amount of Security deposit of shops from Rs 1 lac to Rs 60 thousand. It has also been resolved to curtail the amount of rent from Rs 1000 Sq Mtr to Rs 600 Sq Mtr. 10. It has been resolved to approve transfer of House No A-8 to Lt Col Yaduvender Singh Yadav. 11. It has been resolved to approve transfer case of House No. C-27 to Lt Col Kuldeep Singh.
12. It has been resolved to inform Members about the activities (Erection of RWA Board on NSG land) being carried out by these handful of non-eligible entrants and to take required action with the appropriate authority. 13. On the application of Col Ashutosh Kumar House No. B-14 against Contractor Rishi Pal, it has been resolved to inform the Member to lodge an FIR against Shri Rishi Pal Contractor or take the help of arbitrator. 14. Resolved to approve allotment of shop @ Rs. 400/- SQM and security deposit of Rs. 30000/- only to Society Members subject to the conditions that no sub letting is permissible. 15. Resolved to fix the date of AGM on 12.12.2015 instead of Nov 2015 and to conduct the AGM at SDG CRPF Block No. 2 Old JNU Campus, New Delhi 67 due to unauthorized occupants entering the AGM premises without the permission of the Society and also due to non availability of police personnel even after having been requested for their deployment at the AGM premises by the Society. 16. Resolved to approve transfer case of Sh Loku J Gianey House No. B/132 to Shri Naresh Kumar Yaduvanshi, ADG Medical. 17. Resolved to approve re-carpeting of road from Capital Constructions and ACC Ltd. The Management Committee approved the MOU. Later on resolved to give MOU to Shri RK Construction & ACC. 18. Resolved not to take formal approval from the Parishad in cases of transfers in view of Bye Law No. 8 and in view of 97 th Constitutional amendment. 19. Resolved to cancel plots of those members who had not paid Maintenance Charges for the year 2013 as was done in cases of those who had not paid Maintenance Charges for the year 2007 and 2010. Before however doing so, a final notice may be uploaded on Society web site. 20. Resolved to issue a reminder to GNIDA not to issue completion certificate to these Members whose maps were not approved by the Secretary of the Society. 21. Resolved to issue a reminder to the Secretary, Department of Telecommunications for removal of Vodafone Tower from House No C-75. 22. Resolved to file defamation case in the Hon ble Court against those who are making character assassination of Society President, Secretary and other Members of the Society by way of complaints and filing FIRs on false grounds just to assassinate their characters besides their eviction from the Society. 23. A number of members have sold their houses without the permission of the Society in violation of declaration No. 6 made by them. 2. A number of members although declared that they would live in Greater Noida after allotment of plots, are not living in the Society even after retirement. 3. Only approx 38 members are living on ground and 315 members are either not interested to live in Society or have sold their houses without the permission of the Society. Facts cannot be ascertained as they have not submitted the affidavit that they have not sold their house as per Para 1(vi) of Notice No. 73. 4. Construction of Nursery School and re-carpeting of road were forcefully stopped by the non-homogenous members. 5. Certain Members in connivance with bureaucrats conspired to bend transfer rules to accommodate non NSG personnel and later on allotted plots
to them who are creating problems after problems. Notices No. 104, 132, 135 refer. Matter has been referred to concerned authorities for appropriate action. 6. Maintenance Charges were not realized every year from the Members. It was realized only in 2007, 2010, 2013, 2015 & 2016. Even interest was waived to bring the Society to a financial ruin. Notice No. 154 issued for strict compliance. 7. It is proposed to realize maintenance fund for the calendar year 2017 @ Rs 30,000/- per annum. (Maint. Through Society web site Subject: Notice No. 154 - Non-payment of Maintenance Charges Sir, Ref: Notice No 149. 2. A number of members have not paid the amount of Maintenance Charge 2007, 2010, 2013, 2015 and 2016. The outstanding amount of these Maintenance Charges has now crossed the limit of over one crore and has reached to an alarming proportion. NSG Society is not funded by Govt. and is entirely maintained by Maintenance fund. Non-payment of Maintenance Charge is a violation of declaration made by members and therefore punishable with monetary punishment as per rules. 3. Non payment of Maintenance Charges is an another attempt by the defaulters to destabilize the Society to a financial ruin after conspiring to bend transfer rules in favour of non NSG personnel and thereafter to sell plot to them making the life of resident members miserable. In the past, there was a willful attempt not to charge Maintenance Charges for the years 2008, 2009, 2011, 2012 and 2014 and to waive the amount of interest thereon which resulted in not carrying out development work for years together. Not only this, the work of re-carpeting of roads and construction of Nursery School was stopped forcefully by these defaulters. The following instructions are therefore issued for strict compliance:-
a. Maintenance fund shall be paid within a period of time limit fixed by the Management Committee. Thereafter monetary forfeiture at the rate fixed thereon for non-payment of these charges will be levied till the date of making payment of amount of interest. b. Payment of Maintenance Charge without interest is not acceptable and is against the accounting procedure. The Society will be left with no option but to give the names of these defaulters to the Govt. Audit Board for necessary action. Argument that payment of road charges of Rs. 18000/- is not Maintenance Charge and will be paid after construction of road is also against the agreed accepted norms. c. Where Maintenance Charges has been paid partly or fully without interest, monetary correction at the rate already fixed thereon shall continue to be charged till the month of payment of interest. For example, if a defaulter has paid Maintenance charge for 2015 at any period of time, monetary liability @ Rs. 300/- p.m. shall continue to be charged from 1.4.2015 till date of payment of interest. The extreme step is necessary to save the Society from bankruptcy and to carry out development work. The Society has already received a notice of 70 lakhs from GNIDA for not depositing water charges wherein the defaulters are all individuals who have been using this facility on ground for years and at this belated stage the Society is not going to pay for their faults; instead as per the agreement with GNIDA a list of defaulters are being prepared. At that stage these defaulters will have no option but to pay. It is requested that individual may kindly clear their water bills and deposit a copy with office to prevent punitive measures. 4. Needless to mention, the Society is functioning in a computer age where every organization has developed its Web site and loaded all the relevant instructions. This Society has also uploaded all the instructions on the Society web site and therefore every member is requested to visit the Society web site and if living in Society may read the instructions in Society Office and not make a costly request that the letters should be sent to them. The Audit party of UP Govt. have pointed out that members have not paid full amount of Maintenance Charge. This state is serious and contrary to Cooperative rules. Attention of the Management has therefore been invited for taking legal action. 2. The Audit party of UP Govt. have also pointed out that contrary to the Cooperative laws, principal amount has been recovered first and interest thereon has not been recovered. This too is objectionable. Attention of the Management has therefore been invited. 3. Certain members represented against the recovery of interest on full amount of Maintenance Charge and have suggested that interest on the balance amount only should be charged. The matter has been examined and it has been decided that interest will be charged on the balance amount not paid. Amount already recovered in excess will therefore be adjusted at the time of recovery of Maintenance Charge 2017. Similarly, there will be no interest on the Maintenance Charge 2013.
