Defendants Redwood County, Paxton Township, Sherman Township, Honner Township, Renville County, Birch Cooley Township, Sibley County and Moltke Township ("Municipal Defendants") submit this memorandum in opposition to Plaintiffs' motion for the Court to take judicial notice of the Lower Sioux Indian Community Corporate Charter. For the reasons set forth herein, Plaintiffs' motion should be denied. ARGUMENT Plaintiffs' Motion is wholly inappropriate because while couched as a simple expansion of the record in this matter; in actuality, Plaintiffs are impermissibly seeking the opportunity to raise new legal theories and arguments on appeal. This Court dismissed Plaintiffs' Amended Complaint with prejudice on March 5, 2015 and judgment was entered thereafter. (ECF Nos. 196 & 197). Rules 59(e) and 60(b) of the Federal Rules of Civil Procedure permit a court to alter, amend, or vacate a judgment after its entry or, in limited circumstances, reconsider a substantive aspect of a previously rendered determination. One of the primary purposes of such a motion is to permit the correction of any manifest errors of law or misapprehension of fact. United States v. Metro. St. Louis Sewer Dist., 440 F.3d 930, 933 (8th Cir. 2006). The Rules are not designed to furnish a vehicle by which a disappointed party may reargue matters already argued and disposed of, nor are 2
CASE 0:14-cv-01597-MJD-FLN Document 273 Filed 04/23/15 Page 3 of 3 they aimed at providing a mechanism for advancing new arguments or legal theories, which could and should have been raised prior to the issuance of judgment. Id., see also Concordia College Corp. v. W.R. Grace, 999 F.2d 326, 330 (8th Cir.1993), cert. denied, 510 U.S. 1093, 114 S.Ct. 926, 127 L.Ed.2d 218 (1994). The document at issue in this Motion has been in existence for 78 years and, thus, there is absolutely no reason that Plaintiffs could not have formulated any legal arguments relating to it during the motion to dismiss proceedings. Per the case law set forth above, attempts to take a second bite at the apple or to pad the record for purposes of appeal (especially when new legal theories or issues are not previously argued, but subsequently come to the mind of the losing party), are, thus, impermissible. Accordingly, Plaintiffs Motion must be denied.
