1. R V Nikam, Police Sub-inspector, the office of the Director General of Police, Surat range, Surat. The facts of my complaint is such that since last two and a half years I am serving in Surat district and accordingly since last two and a half months performing my duties at the office of the Director General of Police, Surat Range. The duties assigned to us include, to analyze comprehensively all aspects of unlawful activities, influenced by leftist- extremist thinking in the districts comprising South Gujarat, within Surat Range. If any such unlawful activities is being noticed, we are responsible to undertake legal actions and restrict such activities. From the interrogation of apprehended important and underground revolutionary cadres of CPI (Maoist) and secret documents seized from the various parts of the country, especially from the neighbouring state of Maharashtra, it has been revealed that this banned Naxalite organization has prepared an action plan for enacting a total revolution in India, by making Surat city as focal point and focusing on North Maharashtra and South Gujarat. It is being revealed from a seized document entitled Surat Shabher- Em Kaam Ka Parlpekshya (Surat City- An important perspective), that as per this plan, banned Naxalite organization CPI (Maoist) has planned to mobilize public support in the Western Ghats of Northern Maharashtra and South Gujarat and hilly forest area of Satpura and establish Guerilla Zone S. Also responsibility has been taken to provide militant cadres and contact for other Guerilla Zones. Moreover, as a part of this plan, it was envisaged to focus o the labour class of industrially developed stretch of Ahmedabad and Surat City, the focal point of Golden Corridor, to implement the action plan of Naxalites. Under Surat perspective, banned CPI (Maoist) has also prepared a long-term plan to carry secret mission in Surat City and develop revolutionary movement in the State of Gujarat. It becomes clear from the report of interrogation of arrested secret revolutionary cadres of CPI (Maoist) from all over the country that some members of this banned Naxalite organization, under the leadership of network of professional revolutionary office bearers, are very secretly active in Surat and South Gujarat to implement their antinational action plant. To achieve their anti-national designs, they have adopted twosided and well planned strategy and method of establishing legal unions which acts as their cover organization and illegal underground secret organizations. To escape from legal proceedings of police and security agencies, the underground members of this banned Naxalite organization have made arrangement to settle important cadres of the party in this region from the other parts of the country.

This banned organization, CPI (Maoist) has also enacted a long-term policy with antinational, unconstitutional and illegal designs, to mobilize people support for people s war/people s movement in this region of North Maharashtra and South Gujarat by making false propaganda among the tribals/forest people as well as religious minorities such as Christian and Muslims and to separate them from the mainstream of the nation, to create civil war and to encourage to revolt against constitutionally established governmental and administrative machinery. Therefore, this FIR is against the underground leaders and members of banned Naxalite organization CPI (Maoist) who are very secretly active and with the intention of starting anti-national revolutionary people s war by making at front the people towards. Constitutionally established administration, inciting feelings of dissatisfaction among the minorities and tribal people, creating civil war and particularly by remaining in touch with the naxalite affected areas of the neighbouring State and helping each other and this conspire to undertake anti-national activities, this is my lawful complaint against all these persons under Section 120-B, 121-A and 153 A-B of Indian Penal Code and Section 38, 39, 40 of unlawful activities (prevention) Act, 1967. My evidences are as per revealed during the probe. These are the facts of my complaint.

M. Police Investigation Officer and Deputy Police Superintendent, Division Vyara District Tapi report that: Summary of Crime: That the complainant Shri R.V. Nikam, PSI, the office of Director General of Police, Surat Range, Surat has filed complaint against know-unknown office bearers of banned organization CPI (Maoist) at Kamrej Police Station on 25.02.2010 at 21.30 hours, F.G.R. No. 37/2010, that to start unlawful and unconstitutional People s war and mobilize people support in Surat in the entire North Maharashtra and South Gujarat, they are planning to spread false propaganda among the tribal/forest population and the religious minorities such as Muslims and Christians and trying them away from the main national stream and create civil war and to revolt against the constitutionally established government and administrative machinery, they have planned a long terms strategy and particularly by keeping contact with the naxalite affected area of the neighbouring states and by helping each other. They have conspire to perform anti-national activities for which a complaint was registered and initially the investigation of this case was entrusted to Police Inspector L.J. Solanki, S.O.G Surat Rural and as per order of the Director General of Police, Surat division, we have taken over investigation on 27.02.2010 and by studying the interrogation reports of accused who entered various areas of Maharashtra and were apprehended, received from the headquarters, it became known that CPI (Maoist) are conducting their naxalite activities very secretly in Surat and entire South Gujarat. In connection of this case, senior officers from Orissa formed (unreadable). From his home, they seized abundant Maoist literature and in a diary, his Surat contracts were brought on notice and in which address of Niranjan Mohapatra, R.C.L. II Block No. 2, Room No. 14, G.I.D.C. Colony, Pandesara, Surat, Gujarat was mentioned and a team of officers also visited Surat in connection of this case. In this connection we arrested abovementioned Niranjan Purushottam Mohapatra, resident of Plot no. 273, behind Jagannath Nagar behind Ganpat Nagar, Pandesar, Surat on 15.3.2010 at 17.15 hours and seized literature relating to naxalite activities from his home and arrested other accused Ramu alias Ram Krishna alias Tambuvat alias Ramesh alias Rakesh s/o Narayan Pawar, aged 54 years, resident of Satyamnagar, Saki Naka, Kurla Pipeline, Kashtakari Yuvak Samgathan, Mumbai-72 on 19.3.2010 at 21.00 hours and both the accused are at present in police remand till 26.3.2010, while the third accused

Kamkhiya Narayan alias K.N. Singh s/o Ramratan Chauhan, aged 47 years, presently resident of Voryayavadi Gate, Behind police Chowky, Murlidharan s premises Dist. Bhavnagar original resident of Chowtha Post, Bhorpur tadabchhwada, Dist. Begusarai (Bihar) on 20.32010 at 15.00 hours and he is in police remand till 25.3.2010. Following details have been obtained from the interrogation of the accused arrested in this case: One person named Vinayak alias Avinash alias Madhav s/o Keshavrao Malharirao Kulkarni, presently resident of Missionpada, in the house of Bharatbhai Mansukhbhai, Ahwa, Taluka district Ahwa, original resident of Belgaum (Karnataka) had joined CPI (ML) Janshakti Part since 1980 and till 1990 resided in Mumbai for party work and in the year 1981 when the issue of harassment of tribals in Dang district, so he came to Dang and Irfan Engineer left for Mumbai.Thus, after coming to Dang, Avinash Kulkarni played behind the scene role of investigating tribals to start violent agitation and as he was conducting naxalite activities of investigating the tribals by remaining in touch with CPI (Maoist) through CPI (ML) Janshakti Party, Vinayak alias, Avinash alias Madhav, s/o Keshavrao Malharirao Kulkarni, at present resident of Missionpada in the house of Bharatbhai Mansukhbhai, Ahwa, Taluka dist. Ahwa, original resident of Belgaum (Karnataka) was arrested in connected of the case on 22.3.2010. The accused joined CPI (ML) Janshakti Party in 1980 and he is on continuous contract of Central Committee Member Ramu Narayan Pawar, Niranjan Mohapatra and also in the continuous contact of Salejrai for whom police has started man-hunt. In the year 2006, the Chief Secretary, Central Committee, CPI (ML) Janshakti Party, Ranjana alias Anand was arrested in connection of Naxalism and to start agitation in protest of this arrest, Central Committee Member met this Avinash Kulkarni at Dang and discussed plan to start violent agitation against the government in protest of this arrest and in the year 2007, CPI (Maoist) party Thus, as the accused in connected with CPI (ML) Janshakti party since many years to conduct naxalite activities and secretly carry on naxalite activities, as well as creating sympathy among tribal people in respect of their judicial and other matters and carrying on their naxalite activities by remaining in constant touch of CPI (Maoist) members under the aegis of CPI (ML) Janshakti part and so far he has not provided any details during interrogation, his police custody is being needed in connection of this case for interrogation and investigation. Points of Remand:- 1. The details of accused meeting with Arjun alias Narayan of CPI (Maoist) at Kadodra, Char Raste in connection of naxalite activities is yet to be acquired. 2. As the accused in this case known Arjun alias Narayan of CPI (Maoist), his police custody is needed to arrest Arjun. 3. This naxalite Amar alias Devendra twice visited Dang and once met the accused, so details of their talk is yet to be collected and that time another person aged 25 years was also present, so who was he and where does his stay etc. details are also yet to be collected.

The accused presence is needed to seize naxalite literature from the place where he is staying and to conduct search as other suspected places in Dang where there is possibility of such literature being hidden. 5. Also this accused presence is needed for cross interrogation with other arrested accused Ramu Pawar, Niranjan Mohapatra, who are present on remand. 6. As the accused resides in Dang District since last 18 years and included some other people in his organization and it is needed to investigate about other people who aided him in the naxalite activities and arrest him. To acquire information about these people also this accused policy custody is needed. 7. Thus, it is to be investigated that by making CPI (ML) Janshakti as front organization and secretly keeping contacts with CPI (Maoist), which efforts he made to misguide tribals of Dang area to gain their rights through violence. To investigate the above mentioned points, accused presence in police custody is needed and as without his presence it is not possible to investigate abovementioned points, we request for 10 days police remand of the accused.
