IS LIABLE On October 18, 2009 (the Petition Date ), the Catholic Diocese of Wilmington, Inc. ( CDOW or the Debtor ) filed a voluntary petition for relief under chapter 11 of title 11 of the United States Code (the Bankruptcy Code ). The Debtor, its address, case number, proof of claim forms and other relevant information related to this chapter 11 case may be obtained at (http//www.cdowreorganization.com). Numerous individuals (each a Tort Claimant and collectively, the Tort Claimants ) have asserted abuse claims against CDOW and/or the parishes, schools and institutions located within the geographic territory of the Roman Catholic Diocese of Wilmington (the Diocese ). 2 Any person who believes that he or she has or may have a claim arising from abuse for which the person believes the Debtor may be liable (each a Tort Claim, and collectively, the Tort Claims ) should carefully read this notice. YOU MAY WISH TO CONSULT AN ATTORNEY REGARDING THIS MATTER AND MAY ALSO OBTAIN INFORMATION FROM THE OFFICIAL COMMITTEE OF UNSECURED CREDITORS BY CALLING (888) 570-6269. 1 The last four digits of the Debtor s federal tax identification number are 5439. FILING DEADLINE The United States Bankruptcy Court for the District of Delaware (the Court ) has entered an order establishing April 15, 2010 at 400 p.m. (prevailing Eastern Time) as the last date and time for each Tort Claimant to file a proof of claim form (the Tort Claim Bar Date ). The Tort Claim Bar Date and the procedures set forth below for filing proofs of claim apply to all claims against the Debtor based upon events occurring prior to October 18, 2009, including any known or potential Tort Claims. WHO MUST FILE If you believe that you have a Tort Claim, you must file a Tort Proof of Claim Form to maintain and/or preserve any claims that you have against the Debtor. Even if you have already filed a lawsuit against the Debtor alleging abuse prior to October 18, 2009, you must still file a Tort Proof of Claim Form to maintain and/or preserve your rights in the Debtor s chapter 11 case. WHO SHOULD NOT FILE You should not file a Tort Proof of Claim Form if Your Tort Claim has already been paid in full; You hold a Tort Claim that has been allowed by an order of the Bankruptcy Court on or before the Tort Claim Bar Date; or If you do not have a claim against the Debtor. WHAT TO FILE YOU MUST FILE A TORT PROOF OF CLAIM FORM. YOU MAY OBTAIN A COPY OF THE TORT PROOF OF CLAIM FORM BY FOLLOWING THE INSTRUCTIONS BELOW. PROCEDURES FOR FILING A TORT PROOF OF CLAIM FORM To file a Tort Proof of Claim Form, you must take the following steps Fill out the Tort Proof of Claim Form. For additional copies of the Tort Proof of Claim Form (a) photocopy the Tort Proof of Claim Form, (b) contact the Debtor s Claims Agent between the hours of 900 a.m. and 500 p.m. (prevailing Eastern Time), Monday through Friday, at (800) 761-6220, or visit the Claims Agent s website at (http//www.cdowreorganization.com); (c) visit the office of the Clerk of the Court, United States Bankruptcy Court for the District of Delaware, 5 th Floor, 824 Market Street, Wilmington, Delaware 19801 during regular business hours; (d) visit the Court s website (http//www.deb.uscourts.gov) by following the directions for accessing the ECF system on such website; or (e) visit the Debtor s website (http//www.cdow.org). Please note that the Claims Agent s staff is not permitted to give legal advice. You should consult your own attorney for assistance regarding any other

inquiries, such as questions concerning the completion or filing of a proof of claim. Do not file or mail the Tort Proof of Claim Form with or to the Court. Instead, all Tort Proof of Claim Forms should be sent to the Claims Agent at the address set forth below. Return the completed Tort Proof of Claim Form to the Claims Agent at the address set forth below no later than April 15, 2010 at 400 p.m. (prevailing Eastern Time). Tort Proof of Claim Forms will be deemed timely filed only when they are actually received by the Claims Agent by April 15, 2010 at 400 p.m. (prevailing Eastern Time). Please note that Tort Proof of Claim Forms submitted by facsimile, telecopy or electronic mail transmission will not be accepted and will not be deemed filed. If you are returning a Tort Proof of Claim Form by mail, allow sufficient mailing time so that the Tort Proof of Claim Form is received on or before April 15, 2010 at 400 p.m. (prevailing Eastern Time). Tort Proof of Claim Forms that are postmarked before that date; i.e., the Tort Claim Bar Date, but which are received by the Claims Agent after the Tort Claim Bar Date will be considered late. Any person who has a Tort Claim and does not file a Tort Proof of Claim by that date may NOT be treated as a creditor for voting or distribution purposes under any plan of reorganization and such claim will be subject to discharge. Further, if such Tort Claim is discharged, the Tort Claimant may be forever barred and prevented from asserting his or her Tort Claim against the Debtor or its property, and may not receive any payment or distribution in connection with such Tort Claim.

CONFIDENTIALITY Pursuant to the Bar Date Order, Tort Proofs of Claim will remain confidential in this bankruptcy case, unless you elect otherwise in Part 1 of the Tort Proof of Claim Form.
