UNITED STATES COURT OF APPEALS FOR THE SEVENTH CIRCUIT ERNEST GIBSON, Minor, by his Guardian ad litem, SUSAN M. GRAMLING, Plaintiff-Appellant, Appeal No. 10-3814 v. AMERICAN CYANAMID, CO., et al., Defendants-Appellees. ON APPEAL FROM THE UNITED STATES DISTRICT COURT FOR THE EASTERN DISTRICT OF WISCONSIN, CASE NO. 2:07-CV-00864-RTR The Honorable Rudolph T. Randa MOTION OF DEFENDANTS-APPELLEES ATLANTIC RICHFIELD COMPANY, AMERICAN CYANAMID COMPANY, E.I. du PONT de NEMOURS & CO., NL INDUSTRIES, INC., AND ARMSTRONG CONTAINERS, INC. FOR JUDICIAL NOTICE Defendants-Appellees respectfully request that this Court take judicial notice of the First Amended Complaint in Allen v. American Cyanamid Co., No. 11-C-55 (E.D. Wis. Jan. 26, 2011), another case pending in the District Court involving Wisconsin s lead pigment risk contribution rule. The document is attached as an exhibit to the accompanying declaration of Anthony S. Baish. Judicial notice of its
content is authorized by Fed. R. Evid. 201. See Opoka v. I.N.S., 94 F.3d 392, 394 (7th Cir. 1996) ( Determinations to be judicially noticed include proceeding[s] in other courts, both within and outside the federal judicial system, if the proceedings have a direct relation to matters at issue. ) (quoting Philips Medical Sys. Int l v. Bruetman, 982 F.2d 211, 215 n.2 (7th Cir. 1992)). As explained in the Statement of Facts of the DefendantsAppellees brief concurrently submitted to this Court, the Allen case presents in a single action the claims of 164 different plaintiffs under Wisconsin s lead pigment risk contribution rule. The number of such claims is relevant to the severity of that rule s effect, an issue addressed in Defendants-Appellees brief. 2
