MEMORANDUM OF AGREEMENT Between the UNITED STATES COAST GUARD and the UNITED STA TES DEPARTMENT OF AGRICULTURE, FOREST SERVICE FIRE AND AVIATION MANAGEMENT regarding Incident Cmmand System On-The-Jb Training fr Cast Guard Persnnel FS Agreement N. 14-MU-11132543-003 1. PARTIES: The parties t this Memrandum f Agreement (MOA) are the United States Cast Guard (USCG) and United States Department f Agriculture, Frest Service, Fire and Aviatin Management (Frest Service), hereinafter referred t as USCG and Frest Service. 2. AUTHORITY: This MOA is entered int under the authrity f 14 U.S.C. 93(a)(7) and (20). 3. TITLE: Incident Cmmand System (ICS) On-The-Jb-Training (OJT) Fr USCG Persnnel 4. PURPOSE: a. The purpse f this Agreement is t dcument the cperatin between the parties and set frth terms by which the Frest Service crdinates shadwing pprtunities n incidents where a Frest Service Type 1 Incident Management Team (IMT), Type 2 IMT, r Natinal Incident Management Organizatin (NIMO) are wrking. These pprtunities assist the USCG in maintaining the qualificatins f persnnel n Emergency Management Teams (EMTs), IMTs, and special teams. b. Additinally, the pprtunities build chesiveness between the USCG and Frest Service by facilitating a cmmn shared experience in ICS and enabling the members and agencies t learn each ther's apprach s they can wrk tgether effectively when deplyed t an incident. In cnsideratin f the abve premises, the parties agree as fllws. 5. RESPONSIBILITIES: a. Cast Guard Shall: 1. Cver all shadwing assignment expenses fr USCG persnnel including travel csts fr persnnel and expenses f prgram management thrugh separate bligating instrument. 2. In accrdance with the Operating Plan, crdinate with the Frest Service t arrange mutually acceptable times and lcatins fr persnnel t arrive at designated incidents. USCG members will typically carry ut shadwing assignments fr duratins f five t seven days.

b. The USCG is nt required t submit status/prgress reprts t the Frest Service. c. Frest Service shall, in accrdance with the Operating Plan, wrk cllabratively with USCG members s they can gain experience wrking in Cmmand Staff, General Staff, r Unit Leader ICS psitins. 6. OPERATING PLAN: The dcument entitled "Operating Plan t Prvide Shadwing Assignments fr USCG Persnnel'', hereinafter referred t as the "Operating Plan", is incrprated by reference. The Operating Plan prvides the supprting details f the agencies' agreement fund in this MOA, and the descriptins f the key elements that will be included in a separate bligating instrument shuld the parties require the future transfer f funds between each ther in rder t exchange gds and/r services f value. 7. Nthing in this Agreement is intended t cnflict with current law r regulatin r the directives f the United States Cast Guard, Department f Hmeland Security, United States Frest Service, r Department f Agriculture. If a term f this agreement is incnsistent with such authrity, then that term shall be invalid, but the remaining terms and cnditins f this 2

agreement shall remain in full frce and effect. c. This MOA des nt create any right r benefit, substantive r prcedural, enfrceable by law r equity by persns wh are nt a party t this agreement, against the USCG, Department f Hmeland Security, Frest Service, r Department f Agriculture, their fficers r emplyees, r any ther persn. d. This MOA des nt and shuld nt be cnstrued as a cmmitment, bligatin, r transfer f funds. Each party will bear any csts resulting frm its respnsibilities under this MOA. Shuld the transfer r bligatin f funds becme necessary in the future, bth parties agree that apprpriate funding dcuments and mechanisms fr such exchange between federal agencies will be executed in writing and in accrdance with each agency's fiscal and cntracting laws and regulatins, including prper administrative review prir t bligatin f thse funds. In additin, thse binding cntracts r funding agreements shuld reference and incrprate the tenns f this MOA. 9. NOTICES: Any cmmunicatins affecting the peratins cvered by this agreement given by the Frest Service r USCG is sufficient nly if in writing and delivered in persn, mailed, r transmitted electrnically by e-mail r fax, as fllws: T the U.S. Frest Service Prgram Manager, at the address specified in the MOA. T USCG, at USCG's administrative cntact address shwn in the MOA. Ntices are effective when delivered in accrdance with this prvisin, r n the effective date f the ntice, whichever is later. 10. PARTICIPATION IN SIMILAR ACTIVITIES: This MOA in n way restricts the Frest Service r USCG frm participating in similar activities with ther public r private agencies, rganizatins, and individuals. 11. ENDORSEMENT: Any f the USCG's cntributins made under this MOA d nt by direct reference r implicatin cnvey U. S. Frest Service endrsement f USCG's prducts r activities. 12. NONBINDING AGREEMENT: a. This MOA creates n right, benefit, r trust respnsibility, substantive r prcedural, enfrceable at law r equity. The parties shall manage their respective resurces and activities in a separate, crdinated and mutually beneficial manner t meet the purpse(s) f this MOA. Nthing in this MOA authrizes any f the parties t bligate r transfer f value. b. Specific prspective prjects r activities that invlve the transfer f funds, services, prperty, and/r anything f value t a party require the executin f separate agreements and are cntingent upn numerus factrs, including, as applicable, but nt limited t: 3

agency availability f apprpriated funds and ther resurces; agency and cperatr administrative and legal requirements (including agency authrizatin by statute, etc.). This MOA neither prvides, nr meets these criteria. If the parties elect t enter int an bligatin agreement that invlves the transfer f funds, services, prperty, and/r anything f value t a party, then the applicable criteria must be met. Additinally, under a prspective agreement, each party perates under its wn laws, regulatins, and/r plicies, and any Frest Service bligatin is subject t the availability f apprpriated funds and ther resurces. The negtiatin, executin and administratin f these prspective agreements must cmply with all applicable laws. c. Nthing in this MOA is intended t alter, limit, r expand the agencies' statutry r regulatry authrity. 13. FREEDOM OF INFORMATION ACT (FOIA): Public access t MOA r agreement recrds must nt be limited, except when such recrds must be kept cnfidential and wuld have been exempted frm disclsure pursuant t Freedm flnfrmatin regulatins (5 U.S.C. 552). 14. TEXT MESSAGING WHILE DRIVING: a. In accrdance with executive Order (EO) 13513, "Federal Leadership n Reducing Text Messaging While Driving", the fllwing are prhibited: 1. any and all text messaging by Federal emplyees while driving a Gvernmentwned vehicle (GOV) r driving a privately-wned vehicle (POV) while n fficial Gvernment business; 2. using any electrnic equipment supplied by the Gvernment when driving any vehicle at any time. b. All cperatrs, their emplyees, vlunteers, and cntractrs are encuraged t adpt and enfrce plicies that ban text messaging when driving cmpany wned, leased r rented vehicles, POVs r GOVs when driving while n fficial Gvernment business r when perfnning any wrk fr r n behalf f the Gvernment. 15. COMMENCEMENT/EXPIRATION DATE: The terms f this agreement will becme effective as f the date flast signature and will be effective fr five years. 16. MODIFICATION: This agreement may be mdified upn the mutual written cnsent f the parties by issuance f a written mdificatin signed and dated by all prperly authrized, signatry fficials, prir t any changes being perfrmed. Requests fr mdificatin shuld be made, in writing, at least 30 days prir t implementatin f the requested change. 17. TERMINATION: Either party, upn 30 days written ntice t the ther party, may terminate this agreement in whle, r in part, at any time befre the date f expiratin. 4

OPERA TING PLAN JCS SHADOWING ASSIGNMENTS FOR USCG PERSONNEL Pursuant t the Memrandum f Agreement (MOA) between the U.S. Department f Agriculture, Frest Service (hereinafter referred t as the Frest Service), and the U.S. Cast Guard (hereinafter referred t as the USCG), this Operating Plan prvides supprting details f the agencies' agreement. Purpse: This perating plan prvides USCG persnnel with pprtunities fr shadwing assigrunents t further develp skills, gain experience, r maintain current qualificatins needed t functin in ICS Cmmand Staff, General Staff, r Unit Leader psitins. Issue: In accrdance with Hmeland Security Presidential Directive (HSPD) - 5, respnse persnnel must be trained in ICS. This MOA prvides the pprtunity fr USCG persnnel t gain experience wrking with the JCS by "shadwing" qualified Frest Service persnnel. Backgrund: The USCG has entered int a MOA with the Frest Service with the fllwing strategic bjective: Develp a shadwing prgram where USCG members can gain practical experience in ICS Cmmand Staff, General Staff, r Unit Leader psitins in rder t further develp skills, gain experience, r maintain current qualificatins and develp interagency mutual supprt. The USCG adpted JCS fr hazardus material and il spill respnse actins in 1996 and adpted JCS fr all hazards in 1998. ln 2005, the USCG adpted the cmplete Natinal Incident Management System (NlMS) in accrdance with HSPD-5. The Frest Service typically emplys cmplete, chesive, and well-established IMTs that have wrked tgether fr many years. The Frest Service typically dispatches Type 1 and Type 2 IMTs t many incidents each year and implements the JCS extremely well. The Frest Service als has a wellestablished ICS training and qualificatin prgram. USCG members with basic JCS training and/r experience can gain significant skills by shadwing the Frest Service IMTs. Key Pints: USCG members n the CG-IMAI', LANT-IMAT, PAC-IMAT, Natinal Strike Frce, and select USCG members with JCS training (n Sectr r District IMTs r Deputy Cmmandant fr Missin Supprt Emergency Management Teams, fr example) may deply n a shadw assignment t gain experience in an ICS Cmmand Staff, General Staff, r Unit Leader psitin. This deplyment can include but is nt limited t wildfires r any incident where a Frest Service Type 1 IMT, Type 2 IMT, r Natinal Incident Management Organizatin (NIMO) is wrking. The USCG Office f Incident Management and Crss Cntingency will serve as the shadwing assignment cntact crdinatr. These duties may be delegated t the Atlantic and Pacific Area ICS Crdinatrs r Incident Management Assistance Team (JMAT) Crdinatrs. A~s+. The Frest Service DeputfDirectr f Fire Operatins, Natinal Interagency Fire Center will act as the lead shadwing assigrunent crdinatr fr the Frest Service. USCG persnnel will be expected t arrive n scene at a time acceptable t the receiving Frest Service IMT. All transprtatin expenses will be the respnsibility f the USCG. Assigrunents will generally last seven days with tw days fr travel and five days fr the actual shadwing

experience. USCG persnnel must understand that there culd be ther persnnel frm lcal, state, r federal IMTs present at an incident at the discretin f the Frest Service IMT, and that cperatin with these ther persnnel is imperative t ensure the maximum learning experience fr all perslulel. The receiving Frest Service IMT will cmmunicate with the USCG persnnel and the shadwing assignment crdinatr abut ldging ptins, including publicly available infrmatin n lcal htel accmmdatins r access t the base camp, which may require the USCG persnnel t use their wn tents and sleeping bags. Once n the incident, if facilities are available and are in reasnable prximity t the Incident Cmmand Pst (ICP), the persnnel may have access t sleeping, shwer, and fd facilities that are part f the base camp. At a minimum, USCG persnnel will need t travel with the fllwing items: a Apprpriate unifrms (Operatinal Dress Unifrm) r pants and shirts (fr civilian persnnel), underclthes, and scks fr a seven-day field assignment. USCG units d nt typically buy r stre sleeping bags r tents. If a sleeping bag and/r tent are required, USCG persnnel may have the ptin t rent it and claim the cst n their travel claim. Any ther anticipated persnal prtective equipment (PPE) fr shadwing participants must be specified by the Frest Service and will be prvided by the USCG. In the event f an emergency r ptential emergency requiring specialized PPE, participants may be laned this PPE thrugh the incident Lgistics Sectin fr the duratin f the assignment; the USCG participants will return this PPE t the incident Lgistics Sectin upn cmpletin f the assignment. The member will be respnsible fr the cst f any PPE nt returned. The Frest Service supprts the prgram by prviding pprtunities fr shadw assignn1ents thrugh dispatch and crdinatin centers. Opprtunities will be crdinated thrugh the Natinal Interagency Fire Center (NIFC). The Frest Service Type 1 IMTs, Type 2 IMTs, and NIMO teams will be briefed n the gal f this initiative, prcess fr implementatin, and expectatin f supprt. 2

Fiscal Items: Travel and ther persnnel expenses fr USCG persnnel will be cvered by USCG. Bth parties are respnsible fr their wn expenses using their agencies funds. Any bligatin that arises whereby the parties exchange smething f value will require a separate fund bligating instrument (as referenced in prvisin 12 f this MOA). This shall include any csts assciated with ldging, equipment use, and/r meals.
