SIDH:The protracted local government electons saga took another left turn on Monday as the Sndh Hgh Court struck down amendments to the Sndh Local Government Act 2013 as llegal. The most sgnfcant effect of ths decson wll be to render null and vod the delmtaton n both rural and urban Sndh. The Lahore Hgh Court soon followed sut, smlarly rulng aganst delmtaton. The hgh courts verdct may mean yet another delay n the holdng of the electons, scheduled as of now for January 18 n Sndh and January 30 n Punjab. The provncal governments can ether hold electons on tme but allocate seats on the formula that exsted before delmtaton started or fle an appeal wth the Electon Commsson of Pakstan and the Supreme Court requestng a delay. The former opton may not be tenable snce the ECP has dstrbuted nomnaton papers n accordance wth delmtaton and so wll have to prnt fresh papers, a process that s unlkely to be completed n tme to hold the electons. That the Supreme Court wll allow the electons to be postponed agan s also questonable snce t has been tryng to get the provnces to fulfl ther consttutonal duty and hold local bodes polls snce May. There are no good optons avalable to the provncal governments, wth the Punjab government already statng that t may need another fve months to hold electons, so they now just have to make sure that they don t take the worst possble route. That would be further draggng the process out and delayng the electons by months as they try to tnker wth the legslaton n a way that meets the approval of the judcary. We have wated too long more than a decade n fact for the rght to elect local representatves to have to endure any more delays. The ECP needs to publcly state how long t wll take to prnt new nomnaton papers and then the Supreme Court should set a new date for as soon as s feasble. Delmtaton was always gong to be controversal and never satsfy everyone, especally snce we haven t had a census snce 1998 and the make-up of the provnces has changed mmeasurably snce then. We wll now have to accept that the consttuences drawn up wll be flawed to some extent. Snce that n tself s not a good enough reason to scrap the electons altogether, the decsons of dstrct commssoners on delmtaton should be abded by even f they do not satsfy everyone. LAHORE: Law Mnster Rana Sanaullah on Wednesday announced that amendments to the Punjab Local Government Act 2013 could take up to fve months whle the Pakstan Tehreek--Insaf demanded local electons be held on tme. On Wednesday, the Lahore Hgh Court had struck down Sectons 8 and 9 of the PLGA rulng that the delmtaton of wards and unon councls n the Punjab should be conducted by theelecton Commsson of Pakstan (ECP), not the government. The apex court also accepted the Sndh government s appeal for hearng aganst the SHC s verdct, whch declared as llegal the fresh delmtatons before the upcomng LB polls n the provnce and sought detals of the amendments n the legslaton made by the SHC. The CJP remarked, LB polls should not be delayed for an ndefnte perod. Holdng LB polls s the responsblty of the ECP and provncal governments. We want to gve a decson after hearng all matters n detal. Durng the course of proceedngs ECP Secretary Ishtak Ahmed apprsed the bench that the Prntng Press Corporaton of Pakstan sought three weeks tme for prntng ballot papers. Meanwhle, Farogh aseem counsel for the Muttahda Qaum Movement (MQM) pleaded that the Sndh Hgh Court verdct was applcable and the electoral process would not be stopped. He pleaded that Sndh government s emended number of llegal provsons n the legslaton and made delmtatons accordng to ther wll and sought a quck judgment nstead of provdng nterm relef. On a bench query Khald Javed Advocate General Sndh apprsed the bench that the legslaton was made n speed to comply wth the apex court s order and there was a possblty of some mstakes. The AG also pleaded before the apex court to suspend the SHC verdct. The ECP secretary told the court that n vew of the revsed schedule, proposed by the ECP before the apex court on ovember 13, 2013, t was dffcult to hold local government electons n both the provnces. The chef justce nformed the ECP secretary that on ovember 13, 2013, the commsson proposed to the apex court a revsed schedule of LB polls n the two provnces. The court nqured about the holdng of LB electons n Khyber Pukhtunkhwa, Cantonment Board areas and the Islamabad Captal Terrtory (ICT). ECP Secretary Ishtak Ahmed repled that there was no change n the schedule for KP, the ICT and Cantonment Board areas, where electons would be held n February.Meanwhle, the court calledaddtonal Attorney General (AAG) Shah Khawar to assst the court after gong through the plea, made by the ECP. BE IFORMED 17 ELECTIO BULLE TI Delneatng Local Government Publshed on 22nd Dec, 2013 The aton Conductng local body electons across Pakstan, under a new consttutonal dspensaton after the Eghteenth Consttutonal Amendment, s turnng out to be messer than any of the poltcal partes had ntally envsaged. And the prevalng commoton across Sndh, over the past some days, s just the latest epsode of the protracted. In February of ths year, the Provncal Assembly of Sndh, repealed the Sndh Peoples Local Government Act, 2012, and Sndh Local Government Ordnance, 2001, and revved the Sndh Local Government Ordnance, 1979. Thereafter, and under harrowng pressure from the honorable Supreme Court, the government of Sndh (along wth all other Provncal Governments) had been workng on enactng fresh Local Government laws that can enable effectve fulfllment of the mandate of Artcle 10A of the Consttuton, whch requre each provnce to by law, establsh a local government system and devolve poltcal, admnstratve and fnancal responsblty and authorty to the elected representatves of the local governments. In ths regard, the People s Party government of Sndh clams to have undertaken extensve consultatons wth all other partes n the Provncal Assembly, culmnatng (amdst much protest), n the Sndh Local Government Act, 2013, n August of ths year. Ths new Act envsages, nter ala, local body electons to be conducted at the Unon, Town, Muncpal, Dstrct and Metropoltan level, along wth a handng over of poltcal, admnstratve and fnancal responsblty to the elected ndvduals.in a provnce where poltcal power and patronage s dvded across cultural, ethnc, and lngustc boundares, the most contentous ssue between poltcal partes (n regards to the local government laws) has been the manner and crtera set for delmtaton of boundares, wthn whch respectve consttuences of local government are dvded. In ths regard, secton 10 the 2013 Act declares that Unon Councl shall be an area comprsng one or more revenue deh(s) as notfed by Government. The Act also envsages that as far as possble, the area of a Unon Councl shall have terrtoral unty, unform populaton, and coherent revenue-crcle/patwar boundares. Smlarly, per secton 11 of the Act, a ward (another unt of local government), shall, as far as possble, consst of a census block or adjonng census blocks. Pursuant to these provsons of the law, the process of delmtaton of local government boundares was stll under way (and constantly beng contested by opposton partes n Sndh) when the Actng Governor, Mr. Sraj Khan Durran, promulgated the Sndh Local Government (Thrd Amendment) Ordnance, 2013. The promulgaton of ths Ordnance was met wth almost unanmous opposton by all poltcal partes n Sndh (except the PPP), and a judcal challenge to certan provsons of ths Ordnance has also been made. On the surface, ths amendment seems to only make slght tweaks to the exstng Act, but a deeper read and analyss of the Ordnance reveals ts far-reachng and possbly nefarous consequences. Specfcally, the 2013 Act stpulates that the government of Sndh may, after nvtng objectons from the resdents of an area and hearng those from amongst them who wsh to be heard, declare certan areas to be urban or rural (whch fact has a drect effect on the form and substance of local government n such area). The 2013 Ordnance has amended ths provson to nclude that where delmtaton offce (the Deputy Commssoner) comes to a concluson that an area has ether become rural or urban, he may declare the same (apparently, n exercse of arbtrary authorty and wthout gvng any reasons, or hearng objectons from any party). The challenge to ths provson, on the bass that t bestows unbrdled authorty on a Deputy Commssoner to nfluence the free and far conducton of electons, s a strong challenge. Such power, n the hands of the bureaucracy, whch frequently acts at the behest of the rulng government alone, does not seem reasonable or far. Through the exercse of ths power, the Deputy Commssoner can alter the complexon of local government n any gven area, shftng ts balance of power from one poltcal party to another, wthout recourse to the electorate or the judcal dspensaton. Addtonally, the 2013 Ordnance has also ncreased the dscreton of the Government (through ts bureaucracy) to consttute wdely dsparate Unon Commttees n Metropoltan Corporaton. Earler, the 2013 Act had envsaged that each such Unon Commttee shall consst of an area wth the total populaton of 0,000 to 50,000 people, whch (through the 2013 Ordnance) has now been expanded to a range of 10,000 to 50,000 people. As a result, through the exercse of ths dscretonary power, t s concevable to have one Unon Commttee to be fve tmes as large as another, thus resultng n unequal value of votes and nequtable dstrbuton of resources. Furthermore, the new Ordnance declares that electons to the local government are to be conducted by through a panel of canddates, no less than nne (9) n number. It also stpulates that, n case a poltcal party or ndependent canddates fal to form a panel for contestng electon, the nomnaton papers of all other ndependent canddates or nomnees of a poltcal party shall be deemed to have been rejected. There can be lttle cavl wth the fact that ths provson dscrmnates aganst the rght of smaller poltcal partes, or ndvdual azad canddates, to effectvely contest electons (n case they are unable to form a panel of 9 canddates). Ths s not only dscrmnatory towards such canddates (Artcle 25 of the Consttuton) but also nfrnges upon ther fundamental rght to contest electons (Artcle 17 of the Consttuton). The form and substance of our local government, pursuant to Artcle 10A of the Consttuton, sts at the very heart of our democratc dspensaton. Ideal mplementaton of our democratc sprt would ental that members of the Provncal and atonal assembles are restrcted only to the responsbltes of legslaton, whereas all admnstratve governance across Pakstan, s done by local government offcals, n partnershp wth the cvlan bureaucratc construct. Local government, as a result, s central to the provson of servces and utltes to all ctzenry n Pakstan. In ths sprt, the delmtaton of local government consttuences, the applcaton of ts laws, and the mplementaton of ts drectves, s the most fundamental buldng block, around whch our socetal edfce can be constructed. The 2013 Ordnance by the PPP government of Sndh has damaged ths dea, apparently n pursut of partsan and poltcal objectves. Ths s treacherous to the sprt of democracy n our land. And a betrayal of the confdence reposed by the hapless people of Sndh n ther government. The wrter s a lawyer based n Lahore. In our personal lves, we do tend to look before and after at the threshold of a new year. And, as the poet sad, pne for what s not. There s ths sense of a new begnnng and an opportunty to reflect on changes to be nducted n one s lfe. Mostly, there s an aspraton to do better and to set a few specfc goals to be acheved n the comng year. Snce our lves are ntertwned wth the destny of our naton or socety, though we generally pay lttle heed to ths rather esoterc bond, ths could be an opportune moment for us to look at where Pakstan s headed and f thngs are lkely to get better. aturally, we must also take stock of what has happened n the year that s about to expre. ow, I am aware of ths sense of pessmsm, even fear, about the present drft, n spte of the repreve provded by the survval of our democratc process n the electons of May, 2013. The demons of relgous mltancy and sectaran strfe, for nstance, have also survved and apparently ganed strength. Besdes, there are ntmatons of a new surge n poltcal turmol. Lves of ordnary people reman n deep dstress. On the other hand, and that s where some hope perhaps resdes, we wsh the best for our own selves and for our dear ones. Ths s partcularly the tme when we lke to look at the ranbow n the sky, n a personal sense. We become emotonal about the future prospects of the members of our famly and of those we love dearly. I often wonder about how these separate spheres of exstence overlap and nterrelate. Eventually, however, the overall poltcal and socal condtons do have a bearng on our ndvdual lves. Hence, we need to be conscously nvolved wth the affars of our country and establsh some connectons wth our collectve sorrows and aspratons. Accordng to a Gallup Pakstan survey released ths week, only 27 percent Pakstans beleve that the country s movng n the rght drecton. What people thnk and how they respond to pollsters may not be a good measure of the realty of a stuaton but t s mportant that a survey fnds 72 percent of the people not at all pleased wth the present state of the naton. The queston s: wll our leaders be able to do somethng about t n 201? Wll the people gan some confdence & trust n the leadershp that we have at ths tme? Incdentally, ths last week of December s exceptonally endowed n terms of how t provdes justfcaton for a serous dscourse on what we have made of Pakstan. Ths means that the usual year-end mood marked by an amalgam of nostalga & desre s further enhanced. On Chrstmas day, we celebrate the brthday of the founder of the naton and, even f n a rtualstc manner, try to nterpret hs vson. Then, we have the annversary of Benazr Bhutto s assassnaton only 2 days later. Ths juxtaposton of our orgnal msgvngs about what Pakstan was meant to be wth a hstorcally recent trauma seems provded n context of the role that relgon has played n our polty. The mystery of who subverted the Quad s vson s entangled wth the unanswered queston of who klled Benazr Bhutto. As far as the debate on whether the Quad had envsoned a secular state or some knd of an Islamc or theocratc dspensaton s concerned, we do not perhaps need to chew the cud any longer. We wll have to lve wth the conflctng quotatons that are cted. More relevant at ths tme s to ponder the meanng and mplcatons of Benazr s assassnaton. I am tempted, n ths context, to refer to the book wrtten by Heraldo Munoz, who headed the U nvestgaton nto Benazr s murder on December 27, 2007. It was publshed early ths month. The ttle tself tells you somethng: Gettng Away wth Murder: Benazr Bhutto s Assassnaton and the Poltcs of Pakstan. Tom Brokaw found t a chllng account of decet, corrupton and murder at the hghest level of power n Pakstan. In an artcle he wrote for Foregn Affars n August, the author sad that Benazr s murder remnded hm of the Spansh play Fuente Ovejuna n whch the hated ruler of a vllage called Fuente Ovejuna s klled and the magstrate who nvestgates the crme cannot fnd the culprt. Durng the nvestgaton, every vllager nterrogated declares that Fuente Ovejuna dd t. Heraldo Munoz adds: In Bhutto s case, t would seem that the vllage assassnated her: Al-Qaeda gave the order; the Pakstan Talban executed the attack, possbly backed or at least encouraged by elements of the establshment; the Musharraf government facltated the crme through ts neglgence; local senor polcemen attempted a cover-up; Bhutto s lead securty team faled to properly safeguard her; and most Pakstans would rather turn the page than contnue nvestgatng who was behnd her assassnaton. Yet t s hard to turn the page wthout beng assaled by dark apprehensons about the consequences of that assassnaton unless our rulers are able to decsvely confront the terror that s dentfed wth the Talban and other sponsors of relgous extremsm. Ths s really the bg queston about what s lkely to happen n Pakstan n 201. Wth the US posed to wthdraw ts forces from Afghanstan durng the comng year, Pakstan has to come to terms wth the monsters that have been nurtured under Afghanstan s shadow. A lst of what Pakstan s resolutons for 201 should be s bound to be long. Issues that relate to natonal securty are of fundamental mportance. It s now becomng more urgent to understand that these and the related queston of our dentty should not be defned n terms of relgon. We should have learnt ths lesson n the wake of ths snster rse n sectaran conflct. Benazr Bhutto was one leader fully aware of the threat posed by the mltant wng of poltcal Islam. To our msfortune, her own party, when t assumed power, refused to take on the mltants and the fanatcs. Young Blawal Bhutto Zardar s set to be formally nducted nto poltcs n 201, wth a seat n the atonal Assembly. Would ths allow the restoraton of PPP s lberal and progressve credentals? Whether that happens or not, t s now for Prme Mnster awaz Sharf to st on hs table of authorty and frame hs ew Year resolutons on behalf of all of us.
