Following is the information requested in the letter dated November 26, 20129 I. List the hours and dates you were scheduled to work? My regular schedule was Monday through Friday, 8am to 5pm, with a one hour lunch break. 2. What was the Name and Title of the person who discharged you? My letter of termination was signed by my immediate supervisor, Chief of Police Jeff Gilbert, and"'interim" Town Manager Laura Bruno 3 What was your Position/Title at the time of your discharge? My position was Police Secretary Level IL Title was Police Services Admin.istrtor. 4 What was the last date you performed services for this employer? On September 25, 2012, I went to see my physician regarding an ongoing stress related illness caused by i-nv CilIploSnieflI at the Quart7sitc Police Department. On that day, he ordered me to refrain from working until further notice. I returned to the police department, finished up the paperwork I had been working on prier to leaving for my doctor's appoiitnnt. and waited lbr my supci visor at the time, Acting Chic!' of Police James Schultz. \VLieri Acting Chief Schultz did not return from a council meeting that was being held, I waited as long as felt I could, about I to 1 1/2 hours, then I left a copy of the prescription my doctor wrote me that said No work t.iniil further notice" taped on his office door as well as one taped to the door ot Chief ofpolice Jeff Gilberts office. I explained to the senior officer on duty that I had been ordered by my doctor to refrain from working until he felt I was able to return. and I left the police department administration office. I was on sick and IMLA leave from September 25, 2012 until my date of discharge. 5 What date did your employer discharge you I received a letter advising me of my termination on October 31, 2012. At the time I was fired I was on I MLA leave and had not been cleared to return to work by my physician

For that reason I submitted my response to the pre-termination notice in writing rather than in person. 6 What reason did your employer give you for your discharge? My termination letter stated that I should be "dismissed with cause for misappropriation of Town records', engaging in conduct that might bring discredit to the Town failure to cooperate in a personnel inquiry; working against the best interests of the Town; action in violation of your duties of loyalty."' 7. Explain why you feel you were discharged? I was discharged in retaliation for bringing matters of public importance involving illegal conduct,, waste of public money, mismanagement and abuse of authority to the attention of town management. the Governor, the Attorney General, the Director of the Department of Public Safety, the La Paz County Sheriff and the La Paz County Attorney among others. I was not discharged for: A. Misappropriation of town records Ihe Town Records I allegedly misappropriated were the re, ecords ofa complaint tiled by an officer against (Thief Gilbert and Sergeant Garcia. I was provided the records by then assistant town manager Al Johnson and disseminated them in accordance with his instructions in a manner that made them public records B. Engaging in conduct that might bring discredit to the Town I reported such conduct, I did not engage in such conduct C. Failure to cooperate in a personnel inquiry This apparently refers to the fact that I did not return a telephone call from a man named I on) lord. Ford left a single voice mail on my telephone. He did not 'Identify himself as a town employee or agent of the town., but rather claimed to be an independent investigator looking into the complaints I had made. Initially, I thought he was employed by the Governor, but then he said he was working out of an office in To\x1I Hall. I conducted an internet search and discovered that he was a former police officer from Nevada who was conducting a private investigation for Interim [own manager" Bruno. I checked the DPS web site and discovered that he was not licensed to conduct such investigations in Arizona. I reported him to DPS as a result ol'this research. In addition to being on stress-related FNILA leave at the time that he called and knowing him to he an unlicensed person working as a private investigator for the town who had misrepresented his position to me,, 1 declined to return his call. D. Working against the best interests of the Town

Only if one assumes that permitting waste of public money, mismanagement, abuse of authority and illegal conduct by Town employees without even making an effort to report the misconduct 'in the best interests of The Town." I suspect Ms. Bruno has mistaken her best interests and the best interests of he r friend, Chief Jeff Gilbert with the best interests of the Town E. Action in violation of your duties of loyalty Again, this is true only if I owed a duty of loyalty to the "interim town manager" and her friend, Chief Gilbert. I took an oath of loyalty to the Town. Ms Bruno and Mr. Gilbert are not the Town. I believe J was discharged from my employment in retaliation for my reporting my employer's illegal conduct, mismanagement, waste of resources and abuse of authority, by means of complaint in compliance with A.R.S. 38-532 as incorporated in the Quartzsite Personnel Policy at section 1 507 sent to the Governor, Attorney General, Department of Public Safety, La Paz County Sheriff and La Paz County Attorney. I made this complaint believing the matters to be of public importance and believing that, pursuant to the aforementioned Arizona Revised Statutes section and section of the Quartzsite Personnel Policy, I qualified for protection from retaliation as a whistle blower. On August 28, 20 12, Town Manager Alexandra Taft was placed on administrative leave by the Common Council of the Town ofquartzsite, in an action I believe to be retaliatory for her placing my supervisor, Chief of Police Jeff Gilbert, on administrative leave pending the outcome of a criminal investigation. The investigation, involving at least three unaccounted hours for which a female. police sergeant was paid while she was known to not be at work which the Department of Public Safety has, according to "interim town manager" Bruno, was stopped after she characterized the allegation as one involving one hour of vacation leave. I had, prior to her placement on administrative leave, spoken to Town Manager Taft regarding the misconduct and potential illegal actions of Chief Gilbert and reported to her that I was concerned that if he should return to work, I would be retaliated against for not being loyal to Gilbert. Ms Taft advised me that the Town had provisions in the Personnel Policy for whistiehiower protection and I would be covered under that policy if Gilbert were to return to work, as well as being protected by the State's whistleblower protection statute. On September 11, 2012, the Quartzsite Common Council attempted to appoint Laura Bruno as "interim town manager" in apparent violation of Town Code. Ms. Bruno was known to be a personal friend of Chief GI* lbert, and I was concerned that the misconduct I had previously spoken to Town Manager Taft about would be revealed to Chief Gilbert by his friend and newly appointed 'interim" Town Manager Bruno. Also on September 11, 201 2, 1 went to see my physician due to severe headaches and feelings of extreme stress due to the actions of the Town C ouncil and threat of Chief Gilbert being returned to

active work status without being cleared in the criminal investigation. My physician noted that I was suffering from panic attacks, high blood pressure, and migraine headaches The Common Council adjourned its September ii, 2012 meeting early and reconvened the following afternoon apparently illegally appointing Ms. Bruno as 'interim town manager." On September 12, 2012, after having spoken to my physician, as well as consulting with my husband, I wrote a letter complaining of difficult/uncomfortable work environment addressing the concerns I had regarding the Council's interference with administrative appointees, Chief Gilbert's misconduct, and my fear that should he be returned to work from administrative leave, he would retaliate against me for speaking out about him. Also on September 12, 1 received a complete copy of an investigation Assistant Town Manager/Personnel Manager Albert Johnson conducted into a complaint made by a patrol officer against Chief Gilbert and Sgt. Fabiola Garcia. Mr. Johnson advised me to send the entire investigation file to the Arizona Police Officer Standard and Training Board (AZ POST) so that they would have a copy of the investigation to supplement their ongoing investigation into Chief Gilbert. In addition, he advised that me to send a complete copy of the investigation to the officer who had made the complaint so that he would be aware of the investigation's findings. Mr. Johnson advised me in my capacity as the custodian of records for the police department, that the original investigation file should be retained in the police department files. On September 1 3., 2012, aware that Mr. Johnson had been placed on administrative leave without being advised of the reason(s) therefore but not having received a countermanding order, I carried out Mr. Johnson's instructions and both faxed and sent copies by priority mail the entire internal investigation file of Chief Gilbert to AZ POST and Officer Anton Coetzee, who had made the complaint about Chief Gilbert and Sgt. Garcia Although Ms. Bruno claims that by sending this information to AZ POST and Officer Coetzee and including it in my whistle blower complaint. I sent attorney-client privileged information to third parties and sent out part of Officer Coetzee's personnel file without his consent, I have affidavits from Ms. Taft and Mr. Johnson stating that as town manager and assistant town manager at the time the advice was receivedl they had waived attorney-client privilege with regard to the information and from Officer Coetzee stating that I had his consent to use the complete record of the. investigation into his complaint as part of my whistle blower complaint In response to my letter regarding my clalin of a hostile work environrnent I received an undated letter from "Interim" Town Manager Bruno on September 1 8, 2012. In her letter Ms. Bruno explained in her opinion there was no reason to believe Chief Gilbert would retaliate against me, but she would consider reassigning me to another department ifi felt that would protect me from his wrath. She and I exchanged several written communications regarding my claims of a difficult/uncomfortable work environment over the course of approximately two weeks with no solution to the problem being proposed or reached On September 25,201 2, Chief Gilbert was removed fiom administrative leave and returned to his position as Chief of Police. That was the day I as seen by my physician and ordered to not return to work until further notice due to the health problems created by the ongoing stress at work As I previously explained I

j waited as long as I felt I could before leaving the police department administration office and returning to my home. 8. Were there any prior warnings? If yes, what when and how they were given and by whom? No. I had never received any prior warnings for any misconduct and had never been disciplined during my entire employment for the Town of Quaftzsite. To the contrary, I was repeatedly told that my performance was exemplary and exceeded expectations. Chief Gilbert publicly acknowledged my improvement of the case management system and the improvements I made in the functionality of the police department administration office numerous times. 9. Were you aware that your actions could result in termination? 'No. To the contrary, I was told by Town Manager Taft that the Town of Quartzsite does not retaliate against whistleblowers, and that I had a right and the duty to report any wrongdoing I observed during my employment. In 2011 a group of police officers and a clerk had flied an anonymous letter with AZ POST advising AZ POST of their claims ofniisconduct by Chief Gilbert. When these employees were investigated by the Town, they were found to have violated the chain of command and Town policy and failing to report the alleged misconduct to the proper public bodies as set forth in A.R.S. 3853l. They were required by town policy and state law to sign their complaint, reported the misconduct to the Town Manager and send the complaint to one or more statutorily defined public bodies instead of sending an unsigned letter to AZ POST. These officers and the clerk were fired for a variety of reasons by the Town. They later flied a suit in federal court claiming they were whistleblowers and entitled to protection. Being aware of what happened to these former employees. before I put pen to paper I consulted an attorney in Phoenix I had retained and relied on advice given by Town Manager Taft that whistlebiower protection is provided for in the Towns Personnel Policy. I made sure I did everything correctly to ensure that the whistieblower protection would apply to me. First, I advised Town management of the uncomfortable/difficult work environment created by the threat of retaliation from Gilbert so that the Town management could address the problem. When Ms. Bruno failed to provide reasonable assurances that I would not be retaliated against by either Chief Gilbert or the Town Council - who were deeply involved in personnel matters in violation of Town cod; causing our Town Attorney to obtain a Temporary Restraining Order from La Paz County Superior Court to prevent them from interfering in such matters - simply for pointing out Chief Gilbert's waste of funds, abuse of authority, mismanagement, and what I perceived to be illegal actions. Once the Town had an opportunity to address the concerns I raised and did nothing to resolve them or even do the slightest investigation of Chief Gilbert, I filed my formal complaint to the appropriate public bodies noted above and unlike the officers and clerk who were claiming they vvere wh1stle blowers after the

fact, I signed my name to the complaint. Had the former officers and clerk addressed their claims against Chief Gilbert in the appropriate fashion, I more than likely would not be unemployed due to Gi!berVs and Gilbert's fiend and newly appointed "interim town manager" Bruno's retaliatory actions.
