OrderNo. 345 DFPFof 2015 Dated: 31-03-2015 Whereas, the department issued the district wise final seniority lists as per the merit obtained in selection of SSRB of Forest Protection Force Guards of Kashmir region on 28-01-2008 as per Classification, Controi and Appeal Rules, 1956. Whereas, the Forest Protection Force Rules, 2012 were notified vide SRO -264 of 2012 dated 09-08-2012. Whereas, after the notification of SRO-264 of 2OI2, number of service writ petitions were filed in the Hon'ble High Court at Jammu as well as in Srinagar for fixing the seniority as per rule 38 of SRO-264 of 2Ot2. Whereas, the Hon'ble High Court in SWP No, 241612A12 vide order dated 03.09.2014 directed the respondents to re-draw the seniority of Forest Protection Force Guards as per applicable ruies i,e. SRO-264 and the judgement was upheld by the Division Bench in LPA(SW) No. 149 l2ol4 dated 11-11-2014. Whereas, SWP No.2322 of 2014 titled Feroz Aalam Bhat and others versus State and others was filed in the Hon'ble High Court at Srinagar and Court passed the direction not to revise the seniority of the petitioners. Whereas, the Advocate General vide No. SUH/GAl2OI4l69-70 dated 26-II- 2014 advised that the seniority of all the officials other than peti.tioners can be revised as per the judgement dated I9-I2-2o14 in SwP No. 2322 of 2014. Whereas, the Administrative department vide letter No. Fi Lit/FPF123612014 dated 19.11.2OI4 asked the department to redraw the seniority of the force except the seniority of petitioners as per Hon'ble High Court direction dated 03-09-2O 14. Whereas, one more writ petition titled SWP 22g12015 Mehrij-ud-Din Wani and others V/s state and others was filed by the Forest Protection Force Guards of Kashmir province, where in the Honble Court disposed of the matter with the direction to fix the seniority of the petitioners alongwith ali others Forest Protection Force Guards of Kashmir Division ip accordance with rules occupying the field; in pursuance of which Administrative Department vide No. F/Lit/FPF/2412015 dated 04-03-2015 directed this office to comply with the Court directions. Whereas the Administrative Department has been appnised of all the events right from selection, training, placement, number of litigations etc of the Forest Protection Force Guards vide this office No. DFPFlSenll3S/Esttl5879 dated 03-03-2015. In response to this the Administrative Department vide No" F/Lit/FPFl284l2OI4 dated 16-03-2015 asked this office to proceed in the matter as per latest judgments of Hon'ble High Court to avoid any contempt proceedings. Whereas, the rule 38 (1) of SRO-264 of 2Ol2 envisages that Candidates who are sent for initial training to a training schooi shall rank in seniority in the relevant grade, according to the order of merit obtained at the examination held at the end of training period before being posted against working posts and those who pass examination in the second attempt shall rank junior to those who passed in the first attempt but shall rank senior to those who pass in the next or subsequent batches and where candidates secure equal marks, the seniority shall be determined by the date of birth-the elder candidate being senior Now in view of the above and in compliance of the Honble High Court judgment, the tentative seniority list of Forest Protection Force Guards of Kashmir region is annexed with this order as Annexure-'A' drawn on the basis of their merit obtained at the end of the Initial Training Course and the Seniority of the petitioners of SWP No. 2322 of 2014 titled Feroz Aalam Bhat and others versus State and others shall be subject to the outcome of the writ petition. List of the petitioners is enclosed as Annexure-'B'.
