Inaugural Address From His Excellency Hamood Sangour Al-Zadjali The Executive President of the Central Bank of Oman Oman Second Islamic Finance and Banking Conference Al-Bustan Palace Hotel, (17-18) March 2013 بسم الله الرحمن الرحيم Your Highness Sayyid Shihab bin Tariq Al Said, Advisor to His Majesty the Sultan s and Patron of the Ceremony Your Highnesses and Excellencies Dear guests Ladies and Gentlemen I would like to extend my sincere gratitude and appreciation to His Highness Sayyid Shihab bin Tariq Al Said - Adviser to His Majesty the Sultan - for his gracious patronage of the inauguration ceremony of Oman Second Islamic Finance Conference, which is organized by Al- Iktissad Wal-Aamal Group in collaboration with the Central Bank of Oman. I would also like to thank Their Excellencies the Governors of central banks and monetary institutions for participating and speaking at this Conference and enriching its sessions with their expertise in the field of Islamic banking. It also gives me pleasure to welcome our distinguished guests who are participating from outside the Sultanate, wishing them all a pleasant stay in their second home, Oman. Oman s First Islamic Finance Conference, which was held in January 2012, and its remarkable success, was a launch pad for educating society members and providing them with insight the concept of Islamic banking and close understanding of the basis and mechanisms of Islamic finance, as well as gaining knowledge of other countries experiences in this regard. The Second Conference complements all of the above through addressing future prospects of Islamic banking in the Sultanate and the opportunities and challenges expected to rise in this domain. The local banking market has witnessed many developments. Perhaps the most prominent of all was the issuance of Royal Decree No. (69/2012), dated December 6 th, 2012, stipulating amendments to some provisions of Oman s Banking Law issued by Royal Decree No. (114/2000). This created new horizons for the Omani banking sector by licensing the conduct of Islamic banking operations through specialized Islamic banks or independent windows for Islamic banking in licensed banks. The new Articles of the Banking Law include provisions relating to the legal framework for Islamic banking, licensing, monitoring, supervision and the jurisdiction of the Board of Governors of the Central Bank of Oman in the development of the regulations and instructions associated with these operations. Due to the special nature of Islamic banking, the amendments made to the Banking Law included exempting Islamic banks from fees imposed on dealing in assets and real estate together with the foundations of Sharia monitoring of Islamic banking operations. Furthermore, the Central Bank of Oman issued the Legal Framework for Islamic Banking, which included clear instructions and detailed information on the regulatory and supervisory matters pertaining to licensing requirements, Sharia supervision, accounting standards, audit and review reports, capital adequacy requirements, credit risks, market risks, operational risks and liquidity management and the associated risks. 2
We are confident that the existence of a solid and supportive legal and regulatory framework for Islamic banking that entails full compliance with the requirements of banking and Sharia supervision will create a suitable environment for the growth of Islamic banking in the Sultanate. Thus, we sought to benefit from previous experiences in the field of Islamic banking, supervisory and regulatory principles, basis and standards developed by international entities that support Islamic banking. With the legal and regulatory framework for Islamic Banking and Finance in place, the Central Bank of Oman granted the banking license to Bank Nizwa, which began offering Sharia compliant banking services at the beginning of January this year. In addition, Al-Izz Islamic Bank was granted the initial approval to practise Islamic banking operations and is expected to start offering its services in the near future. Commercial banks, such as Bank Muscat, Al-Ahli Bank, Bank Dhofar and the National Bank of Oman, have also been licensed to set up independent windows for practising Islamic banking operations. Ladies and Gentlemen / Honorable Guests Islamic finance is witnessing steady expansion at the global level in terms of financial resources, the number of institutions and the level of deployment. Related studies indicate that the value of global Islamic banking and finance assets is witnessing significant growth rate of around 20% per annum. No doubt this remarkable success naturally imposes a set of challenges, perhaps the most prominent is the complete knowledge of the rules of Islamic finance and its Sharia-related and applicable regulations. This requires the availability of qualified personnel capable of advancing the Islamic banking industry and leading it forward towards the desired target. Therefore, it is the duty of Islamic banking institutions to develop plans and programs to qualify staff and devote their attention to supporting training programs and plans based on solid scientific methodology. 3
On the other hand, it is imperative for Islamic banking institutions to diligently comply with Sharia Law and avoid imitating conventional banking products. Hence, these institutions need to create Sharia compliant tools and financial products that are varied, innovative and flexible enough to respond to public demand. These tools and products must also be credible, reliable and satisfactory. Although the Islamic banking industry in the Sultanate is under formation, the onset of Islamic banking operations has brought remarkable activity in the banking sector that led most licensed commercial banks to increase their capital to open independent Islamic windows in addition to the two licensed banks Islamic banks bringing the total capital of Islamic banking in the Sultanate to almost 500 million Omani Riyals. Overall, it is safe to say that there is optimism among all parties concerned on Islamic banking in the Sultanate in view of its anticipated progress alongside the potential role it can play in stimulating the national economy by contributing to the financing of various economic projects. Thus, licensed banks and Islamic windows are required to exert extra effort to attract savings and diversify and develop new financial instruments as well as focus on the quality of banking services. The Central Bank of Oman expects sound practice of Islamic banking with efficient and effective application of Islamic Sharia laws to ensure the safety and integrity of the banking sector and its growth, and to provide added value for the national economy. In conclusion, I would like to express my gratitude and appreciation to all those who contributed to the organization of this conference, in particular the Economy and Business Group for their pioneer initiative and valuable efforts in this respect. صاحب السمو / راعي الحفل ا صحاب المعالي والسعادة الحضور الكريم لقد كان المو تمر الا ول للتمويل والصيرفة الا سلامية الذي عقد في يناير 2012 م وما حققه من نجاح ملحوظ منطلقا لتوعية ا فراد المجتمع وتبصيرهم بمفهوم الصيرفة الا سلامية والتعرف عن قرب على ا سس وا ليات التمويل الا سلامي والوقوف على تجارب الدول الا خرى في هذا الصدد ويا تي هذا المو تمر الثاني مكملا لذلك من خلال التطرق لا فاق المستقبل المرتقبة للصيرفة الا سلامية في السلطنة والفرص والتحديات المتوقعة في هذا المجال. لقد شهدت السوق المصرفية المحلية العديد من التطورات لعل من ا برزها صدور المرسوم السلطاني رقم 2012/69 بتاريخ 6 ديسمبر 2012 م با جراء تعديلات على بعض ا حكام القانون المصرفي العماني الصادر بالمرسوم السلطاني رقم (2000/114) والذي ا ضاف ا فاقا جديدة للقطاع المصرفي العماني من خلال الترخيص بممارسة ا عمال الصيرفة الا سلامية عن طريق مصارف ا سلامية متخصصة ا و نوافذ مستقلة للصيرفة الا سلامية في المصارف التجارية المرخصة. ولقد تضمنت المواد الجديدة في القانون المصرفي ا حكاما تتعلق بالا طار القانوني للا عمال المصرفية الاسلامية والترخيص والرقابة و لا ا شراف واختصاص مجلس محافظي البنك المركزي العماني بوضع اللواي ح والتعليمات المرتبطة بهذه الا عمال. ونظرا للطبيعة الخاصة بالا عمال المصرفية الا سلامية فقد تم بموجب التعديلات التي ا دخلت على القانون المصرفي ا عفاء المصارف الا سلامية من الرسوم التي ت فرض على التعامل في الا صول العقارية والمنقولة كما تضمنت ا سس الرقابة الشرعية على الا عمال المصرفية الا سلامية. 2
وبالا ضافة ا لى ما تقدم قام البنك المركزي العماني با صدار الا طار التنظيمي والرقابي للصيرفة الا سلامية الذي اشتمل على تعليمات واضحة ومفصلة حول المساي ل الرقابية والا شرافية المتعلقة بمتطلبات الترخيص والرقابة الشرعية والمعايير المحاسبية وتقارير التدقيق والمراجعة والمتطلبات المتعلقة بكفاية را س المال ومخاطر الاي تمان ومخاطر السوق والمخاطر التشغيلية وا دارة السيولة والمخاطر المرتبطة بها. ا ننا على يقين با ن وجود ا طار قانوني ورقابي داعم وفع ال للصيرفة الا سلامية وما يتطلبه ذلك من ضرورة الا متثال التام لمتطلبات الرقابة المصرفية والشرعية سوف يهيي البيي ة المناسبة لنمو الصيرفة الا سلامية في السلطنة. ولقد قمنا في سبيل ذلك بالا ستفادة من التجارب التي سبقتنا في مجال الرقابة على الصيرفة الا سلامية وما وضعته الهيي ات والا جهزة الدولية الداعمة للصيرفة الا سلامية من مبادي وا سس ومعايير رقابية. ومع ا كتمال الا طار القانوني والتنظيمي للصيرفة الا سلامية قام البنك المركزي العماني بمنح الترخيص المصرفي لبنك نزوى الذي بدا بتقديم خدماته المصرفية المتوافقة مع الشريعة الا سلامية في بداية يناير من هذا العام كما م نح بنك العز الا سلامي الموافقة المبدي ية لممارسة ا عمال الصيرفة الا سلامية ومن المو مل ا ن يبدا تقديم خدماته قريبا. وتم الترخيص ا يضا لبنك مسقط والبنك الا هلي وبنك ظفار والبنك المصرفية لمزاولة الا عمال الوطني العماني لفتح نوافذ مستقلة الا سلامية. 3
ا يها الحضور الكريم ا ن التمويل الا سلامي يشهد توسعا مطردا على الصعيد العالمي من حيث الموارد المالية وعدد المو سسات ومستوى الا نتشار حيث تشير الدراسات التي تمت في هذا الشا ن ا لى ا ن قيمة الا صول المصرفية والمالية الا سلامية العالمية تشهد معدلات نمو كبيرة تبلغ نحو %20 في السنة. ولا شك في ا ن هذا النجاح الملحوظ يفرض بطبيعة الحال مجموعة من التحديات لعل من ا برزها الا لمام التام بقواعد التمويل الا سلامي وضوابطه الشرعية والتطبيقية وهو ما يتطلب بالضرورة توفر الكوادر المو هلة والقادرة على النهوض بالصناعة المصرفية الاسلامية والسير بها قدما نحو الهدف المنشود. ومن ثم فا نه يتعين على المو سسات المصرفية الا سلامية ا ن تضع الخطط والبرامج لتا هيل الموظفين وا ن تولي عناية ا كبر بدعم برامج التدريب وخططه على ا سس منهجية علمية مدروسة. وفي الجانب الا خر فا نه من الضروري قيام المو سسات المصرفية الا سلامية بالعمل الجاد للا لتزام بالا طر الشرعية وتجنب محاكاة المنتجات المصرفية التقليدية. ولذا فا ن هذه المو سسات بحاجة ا لى ا بتكار ا دوات ومنتجات مالية متوافقة مع ا حكام الشريعة الا سلامية ومتنوعة ومبتكرة تتيح لها المرونة الكافية للاستجابة لا حتياجات الجمهور. وا ن تتمتع هذه الا دوات والمنتجات بالمصداقية والثقة والقبول. 4
هذا وبالرغم من ا ن الصناعة المصرفية الا سلامية داخل السلطنة في طور الانشاء والتا سيس ا لا ا ن بداية العمل بالصيرفة الا سلامية قد ا حدثت حراكا ملحوظا في القطاع المصرفي ا دى ا لى قيام معظم البنوك التجارية المرخصة بزيادة رو وس ا موالها لفتح نوافذ ا سلامية مستقلة بجانب البنكين الا سلاميين المصرح لهما ليصبح بذلك را سمال الصيرفة الا سلامية في السلطنة نحو 500 مليون ريالا عمانيا. ويمكن القول بصفة عامة با ن هناك حالة من التفاو ل تسود جميع المهتمين بالصيرفة الا سلامية في السلطنة نتيجة لما سوف تحققه من مكاسب بجانب الدور المرتقب الذي سوف تلعبه في تحفيز الا قتصاد الوطني من خلال المساهمة في تمويل مختلف المشروعات الا قتصادية. وبالتالي فا ن البنوك والنوافذ الا سلامية المرخصة مطالبة ببذل مزيد من الجهد لجذب واستقطاب المدخرات والعمل على تنويع وتطوير ا دوات مالية جديدة والتركيز على جودة الخدمات المصرفية. ويتطلع البنك المركزي العماني ا لى الممارسة الرشيدة للصيرفة الا سلامية مع التطبيق الصحيح والفع ال لقواعد الشريعة الا سلامية بما يضمن سلامة ونزاهة القطاع المصرفي ونموه وا ن يقدم قيمة مضافة للا قتصاد الوطني. وفي الختام ا تقدم بالشكر والتقدير ا لى كل من ساهم في تنظيم هذا المو تمر وا خص بالذكر مجموعة الا قتصاد والا عمال على مبادرتهم الراي دة وجهودهم المقدرة في هذا المجال. ا شكركم وا تمنى لهذا المو تمر كل التوفيق والنجاح. والسلام عليكم ورحمة الله وبركاته ******* 5
