2014 SHARIAH AUDIT CONFERENCE KEY PILLAR OF GOVERNANCE FOR ISLAMIC FINANCE SYNOPSIS The Bank Negara Malaysia s Shariah Governance Framework introduced in 2011 refers Shariah audit as a periodic assessment conducted from time to time, to provide an independent assessment and objective assurance designed to add value and improve the degree of compliance in relation to the business operations of Islamic Financial Institutions (IFI s) business operations, with the main objective of ensuring a sound and effective internal control system for Shariah compliance. Practically in Malaysia, it is the responsibilities of Shariah Advisor (SA) to ensure that all products and services and related policies and agreements of Islamic Instruments are in compliance with Shariah rules and principles. In terms of reporting, Shariah Advisors shall prepare a written Shariah opinion report in the Bank s annual financial statement in respect of its Shariah compliance. Duties and responsibilities of IFIs are to refer all Shariah issues to the Shariah Advisors. Shariah compliance audit is performed to manage operational risks in accordance with the Guiding Principles of Risk Management for Institutions (other than Insurance institutions) published by the Islamic Financial Services Board (IFSB). Currently, there is no standard Shariah Compliance Audit framework that can be used as guidelines in implementing external Shariah compliance audit in IFIs. Thus, the aim of the conference is to deliberate and facilitate the development of Shariah Audit Framework and Audit Programme to ensure the procedures (Maqasid Shariah) of each product in IFI are being followed. The participants will learn latest development on Shariah Audit and shall acquire adequate Shariah-related knowledge that will enable them to perform audit functions in a more constructive and effective manner.
