General Policy On Sexual Offenders for Church of the Open Arms, UCC Church of the Open Arms UCC, is an open and affirming congregation and as such affirms the dignity and worth of all persons. We are committed to being a religious community open to those who are in need of worshiping with us, especially in times of distress and serious personal troubles. Safety and security of all who attend Church of the Open Arms is our first priority. We agree to honor the needs of the congregation to have reasonable assurance that a sex offender in our care will not have an opportunity to re-offend as a result of lapses in our management of the offender. We have concerns about allowing sex offenders into our congregation and therefore are adopting a policy that will limit the contact of any known sex offender with children, youth, and survivors of sexual misconduct ( Survivors ) in our congregation. This policy is designed to reduce the risk to our children, Survivors and sex offenders of an incident or accusation, as well as the continued recovery of the Survivors. Sex Offenders participation will be limited to ensure the safety of our children, youth and Survivors and to assure that the sex offender will not be subject to future accusations. The church will maintain a list of resources to help individuals and families affected by sexual abuse including names of counselors our church recommends, websites, books, and other materials to help survivors as well as offenders. Complete adherence to our Safe Sanctuary policy, with quarterly parent meetings to review the details, will be a top priority for all leaders and staff of the church. Our church will sponsor a workshop, conference, or educational program at least once each year for our congregation and the community at large focused on sexual abuse survivors and society s issues of abuse, including but not limited to the Our Whole Lives educational programs. Secrecy about situations with the church may encourage abuse; transparency makes everyone safer. The identity of any person on a sex offender registry will not be kept secret in our congregation. Those in leadership, including but not limited to all clergy, all members of the staff/leadership team, all members of the Response Team, and anyone who wants to know the identity of all such persons, will be fully advised of the person s name, will be provided access to a current photograph of the person, will be fully advised of the crimes for which the person was convicted, the circumstances relating to the crimes and a description of the age and gender of the victim(s). This information will be communicated through the Response Team, Education Team, quarterly meetings with parents and with the church council meetings as needed. 1

To implement this policy the Staff/Leadership Team shall appoint a Response Team. This team will be an ad hoc team of at least seven (7) members, including, among others, the pastor, the Chairperson of Staff/Leadership team, the Chairperson of the Education team, a lawyer, and a social worker or licensed professional counselor. Meetings of the Response Team will be open meetings with only the appointed members having a vote. The responsibilities of the Response Team include: Conduct an initial individual assessment of any registered sex offender wishing to worship with the church using at least the criteria listed below. Design a specific Covenant of Limited Access for each individual sex offender to fit the specifics of the offense using the format adopted by the Church on March 17, 2013. Review compliance with the Covenant of Limited Access by conducting a quarterly review meeting held with the sex offender. Design the escort training program, approve of each escort and designate a lead escort. Report to the Staff Leadership Team who will report to the church Council when a registered sex offender is extended a Covenant of Limited Access, or when that Covenant is modified. When a person on a sex offender registry contacts the church wanting to attend, an individual assessment of that person will be conducted by the Response Team. Each person on a sex offender registry must be evaluated in relation to the specific crimes committed and the risk that they pose to our congregation. The Response Team will review the following with respect to each such individual: Crime convicted of and all circumstances relating to same including a review of publicly available records of the victim s allegations; Compliance with terms of conviction, probation and/or parole; Participation in a sexual offender treatment program; Opinion of the sex offender s parole officer, sexual misconduct treatment provider and any mental health care provider as to this person s participation in church related activities and potential to re-offend; Length of time since last offense and release from incarceration, if any; and Complete criminal record including national criminal background check obtained by Response Team. If a majority of the Response Team approves of the individual s participation in church activities, the Covenant of Limited Access agreement, in substantially the same from as approved by the Church Council on March 17, 2013, will be presented to the individual for his or her agreement. Each Covenant of Limited Access will be have specific terms 2

that correspond to the crime committed by the applicant. The sex offender may not attend church activities before the covenant is signed by all parties. The church will at all times comply with the limitations and prohibitions placed upon the offender by courts, probation authorities and the laws of the state or federal government. A minimum of six (6) escorts must be approved and trained before the first offender is invited to attend. Initial training for escorts will include a minimum of 4 hours of training approved by the Response Team. Selection of escorts, as well as their training must be approved in advance by the Response Team. Any and all registered sex offenders who are approved by the Response Team, will be limited to participation as stated in the specific Covenant of Limited Access developed for that individual by the Response Team. No modification of the document will be made without recommendation of the Response Team and approval of the Staff/Leadership Team. The Response Team has full authority to limit or completely deny the individual access to church activities and church property. Reasons to exclude a specific sex offender If a victim of the registered sex offender attends church services at our church, is a member of the congregation, is an employee or client of other services provided by the congregation, then the registered sex offender shall not be permitted to attend the church or church activities. If the sex offender, refuses to sign Covenant of Limited Access or to negotiate the terms of the agreement, then he shall not be permitted to attend the church or church activities. 3

Limited Access Agreement for Convicted Sex Offenders This Limited Access Agreement is executed between: Church of the Open Arms UCC, referred to below as we, the congregation and clergy ; And (Petitioner Name), referred to below as you and your Church of the Open Arms UCC, is an open and affirming congregation and as such affirms the dignity and worth of all persons. We are committed to being a religious community open to those who are in need of worshiping with us, especially in times of distress and serious personal troubles. However, based on your background, we have concerns about your contact with children, youth and survivors of sexual misconduct ( Survivors ) in our congregation. The following rules of your participation are designed to reduce the risk to both you and them of an incident or accusation, as well as the continued recovery of the Survivors. Your participation will be limited to ensure the safety of our children, youth and Survivors and to assure that you will not be subject to future accusations. Within these rules, the congregation approves your participation in worship services on the second and fourth Sunday of each month, the coffee time for ten minutes immediately before and after those worship services and the quarterly review meeting with the Response Team. Do not enter the lower level of the church building at any time or for any reason. You are to avoid all contact with children and youth on church property or congregation-sponsored events. This includes the following: Do not talk with children. Do not volunteer or agree to lead, chaperone or participate in events for children and youth including such things as religious education classes, stories or talks for worship, youth group events, activities during intergenerational events, driving or otherwise transporting children and/or youth. You must remain in the presence of an assigned Escort, who has been advised of your situation by church leadership, at all times. You must meet that person before coming onto church property (or before arriving at the church related activities in which you have been authorized herein to participate), remain with the assigned Escort at all times, and depart with the Escort. If a child or youth approaches you, either at church or in a community place, politely and immediately excuse yourself from the situation. You will not be in the church or any church-owned building or church-rented space at any time without an assigned Escort present with you at all times. Do not ask for, seek access to, nor remove from the church any materials, files, directories, etc. listing members, participants and friends of the church. You will limit your time in coffee hour immediately before and after worship services to about ten minutes. You agree that the leadership of the church shall make it known to the members, constituencies and customers of the church that the church has accepted among us a registered sex offender. You acknowledge and agree that you have no expectation of privacy relating to your inclusion on the sex offender registry and the facts and 4

circumstances surrounding the same. You further acknowledge and agree that those in leadership, including but not limited to all clergy, all members of the staff/leadership team, all members of the Response Team, and anyone who wants to know your identity, will be fully advised of your name, will be provided access to a current photograph of you, will be fully advised of the crimes for which you were convicted, the circumstances relating to the crimes and a description of the age and gender of the victim(s). The conditions and limitations that apply to your participation in the church shall also be known to all. As part of this Agreement it is understood that members of this congregation, approved by the church Response Team, who know thoroughly your history, are willing to serve as your assigned Escort. You will be welcome on church property at the limited church-sponsored events as set out herein, but must be accompanied at all times by one of the assigned Escorts named below: (Escort 1 Name and Cell No.) (Escort 2 Name and Cell No.) (Escort 3 Name and Cell No.) (Escort 4 Name and Cell No.) (Escort 5 Name and Cell No.) (Escort 6 Name and Cell No.) It is agreed that you will meet on a quarterly basis with the Response Team and Lead Escort to discuss matters of mutual interest and concern. These meetings will also serve as an ongoing review of the implementation of and your compliance with this Agreement. The agreement, to allow you to participate in the church activities as set forth herein, is based upon a review by the Response Team of the most current supporting documents and as stated in the General Church Policy on Registered Sex Offenders. Any change in the above records, reports or documentation, including arrest, charge or indictment for any sexual misconduct must be reported immediately by you to the Chair of the Response team. REASONS FOR EXCLUDING YOU FROM ALL CONGREGATIONAL ACTIVITIES INCLUDE, BUT ARE NOT LIMITED TO: Refusal to allow the Response Team to contact the appropriate treatment provider and parole officer. Report by a treatment provider, risk assessment provider or parole officer that you are at too high a risk for recidivism. Refusal to sign an amended Limited Access Agreement. 5

Failure or refusal to comply with the requirements of this or any other Limited Access Agreement. Conviction of any crime relating to sexual misconduct. This agreement will remain in effect until/unless: You fail to honor the terms of the agreement, thus nullifying it. It is superseded by the church council, Staff Leadership Team or Response Team. You, the clergy, and the Response Team mutually agree in writing to change the terms of this Agreement in compliance with the General Policy on Sexual Offenders adopted by the Church Council.
