NEXT CONSTABLE TRAINING SEMINAR SCHEDULED FOR SATURDAY, MAY 19, 2012: Time and Place: Commencing at 8:00 A.M. at West Cummings Park, 800 Washington St., Woburn, MA, Bldg. 800, 4th Floor Conference Room #4750. Please complete the Member Registration Form, at the end of this newsletter, and return asap to MBCA Secretary, Sally M. Hoyt, P.O. Box 531, Reading, MA 01867. Participants must attend the entire Seminar to receive a Certificate of Completion. The Seminar itself is free to members. However, participants must purchase the updated Constable Training Manual and Mileage Guide to be able to follow along with the course. Cost: $150. We require a minimum of 15 members to populate a Seminar. If you were not able to take the Seminar on the dates that were available last November, now is your opportunity to do so. Those members who have taken the Training Seminar rated it A+++. Education and knowledge about your position as a constable is important and MBCA is proud to sponsor this much needed training. IMPORTANT -- ANNUAL REPORT TO COUNTY TREASURER: Don t forget you must file an Annual Earnings Report with your respective County Treasurer/s by April 15 th, 2012. A sample form that you can use may be found after the Seminar Registration Form at the end of this Newsletter. RECENT QUESTIONS ASKED BY NEW CONSTABLES WHO DID NOT TAKE THE COURSE: When serving documents please do not serve the original since the original generally has the Court Seal on it and must be returned to court by the Plaintiff/Attorney/or you, with your Return of Service. endorsed thereon. If you mistakenly served the original document, return to the address where you served it and ask for its return, replacing it with a copy in an envelope addressed to the person who is named therein. When you are given a document to serve and you were told by the Plaintiff or Attorney that the defendant resides with his/her family, be sure the defendant actually resides at that address. In many cases, the parent will usually accept the document if the person named in the document resides at the family address. When serving a witness subpoena be sure you enclose a witness fee by calculating the miles the witness must travel from the point where the subpoena was left, to the address where he/she is to travel to be a witness.
Members who take the Constables Seminar will be given a Mileage Guide containing charts which allow you to calculate the mileage from one point to another anywhere in Massachusetts. It is also a good idea to round off the amount. Do not tender $9.50. go to the next dollar and give the witness $10. If you do not enclose a witness fee, unless the witness is being summoned on behalf of the Commonwealth, the person being subpoenaed will not have to appear in court, or for a deposition. Be sure you know exactly what to do before you serve any document. It will save you a lot of grief. We welcome you to the MBCA April meeting and look forward to seeing you at the Attleboro City Hall.
