MINUTES WEST PLAINS CITY COUNCIL REGULAR MEETING Monday, December 21, 2015 The West Plains City Council met for regular session at 5:30 p.m. on Monday, December 21, 2015 at West Plains City Hall Council Chambers, 1910 Holiday Lane with the following members present: Mayor Jack Pahlmann, Councilwoman/Mayor Pro-Tem Brenda Smith, Councilman Mike Topliff, Councilman Royce Fugate and Councilman Josh Cotter. City Attorney Charles Cantrell, City Administrator/Engineer Tom Stehn, Finance Director Allen Brinkman and City Clerk Mallory Hawkins were also present. PUBLIC HEARING A. Public Transportation Grant, State and Federal Funding a. There was no public comment. Fugate to adjourn the public hearing. I. PRELIMINARIES established a quorum and called the meeting to order. Dustin Harrison said the invocation and Councilwoman Smith led the Pledge of Allegiance. II. APPROVAL OF CONSENT AGENDA: The motion was made by Councilwoman Smith and seconded by Councilman Fugate to approve consent agenda. III. READING OF BILLS A. Bill 4397 to become Ordinance 4397. Second Reading. An Ordinance to adopt a naming policy for public buildings, structures, facilities, streets and parks in the City of West Plains. The motion was made by Councilman Cotter and seconded by Councilman Topliff to accept Bill 4397, which becomes Ordinance 4397, Second Reading. Councilman Topliff Councilman Cotter B. Bill 4398 to become Ordinance 4398. Second Reading. An Ordinance amending Section 6-81 of the Code of Ordinances for the City of West Plains, Keeping Hogs. 1
Topliff to accept Bill 4398, which becomes Ordinance 4398, Second Reading. Councilman Topliff Councilman Cotter C. Bill 4402 to become Ordinance 4402. First and Second Reading. An Ordinance amending the Nuisance Code, Chapter 27, Article I, Nuisance, Seciton27-2, Prohibited, Subsection 2 of the Code of Ordinances for the City of West Plains, Missouri. The motion was made by Councilman Fugate and seconded by Councilman Topliff to accept Bill 4402, which becomes Ordinance 4402. Motion Councilman Topliff Councilman Cotter D. Bill 4403 to become Ordinance 4403. First and Second Reading. An Ordinance to reassign certain street names in West Plains for 911 purposes, streets affected to be changed or named will be Amy Street, Independence Drive, Siloam Springs Road, State Route 17 Highway, State Route BB Highway, South Valley Road and Chestnut Bend. Willard Schnurbusch asked the City Council about addresses posted on buildings and if there were any provisions to require posted addresses? He stated there will be an epense for changing his numbering on his house. He asked if there would be any provisions to supplement the cost to property owners. Dustin Harrison stated on new structures it is required by code. On new occupancies it is also required. The criteria is 4 inches tall with ½ inch brush stroke. Cotter to accept Bill 4403. Failed by unanimous opposition. Councilman Fugate Councilwoman Smith Councilman Topliff Councilman Cotter Motion failed. E. Bill 4404 to become Ordinance 4404. First and Second Reading. An Ordinance to authorize the Mayor to apply for federal financial assistance on behalf of the City 2
of West Plains and to eecute any contract(s) resulting from such application for any grants between the City of West Plains and Missouri Highways and Transportation Commission providing for capital, operating, and/or marketing assistance, comprised of federal funds to be epended for commission-approved transit projects. The motion was made by Councilman Fugate and seconded by Councilman Cotter to accept Bill 4404, which becomes Ordinance 4404. Motion Councilman Topliff Councilman Cotter F. Bill 4405 to become Ordinance 4405. First and Second Reading. An Ordinance to authorize the Mayor to eecute a Relinquishment of Outer Roadway Agreement with the Missouri Highways and Transportation Commission. The motion was made by Councilman Topliff and seconded by Councilman Cotter to accept Bill 4405, which becomes Ordinance 4405. Councilman Topliff Councilman Cotter G. Bill 4406 to become Ordinance 4406. First and Second Reading. An Ordinance vacating an alley between Broadway and First Street and Lincoln and Garfield Avenue in West Plains. The motion was made by Councilman Fugate and seconded by Councilman Topliff to accept Bill 4406, which becomes Ordinance 4406. Councilman Topliff Councilman Cotter H. Bill 4407 to become Ordinance 4407. First and Second Reading. An Ordinance vacating a portion of right-of-way at the corner of County Road 6070 and Mitchell Road in West Plains. The motion was made by Councilman Cotter and seconded by Councilman Fugate to accept Bill 4407, which becomes Ordinance 4407. 3

Wiles Drive, an unnamed road, from Aid Avenue to South Hill Street in West Plains, Missouri. The motion was made by Councilman Fugate and seconded by Councilman Topliff to accept Bill 4408, which becomes Ordinance 4408. Councilman Topliff Councilman Cotter IV. DEPARTMENT PRESENTATION MIKE DAVIS, PARKS DEPARTMENT Mike Davis presented the Parks and Recreation Strategic Plan and some of his upcoming events, along with 2015 in review. V. COUNCIL ACTION A. Bid Fiber Optic Cable Cotter to accept the bid from SMC of Springfield, MO for $36,960.00. Motion B. Bid New Pick-up for Sanitation Department Topliff to accept the bid from Joe Machens of Columbia, MO for $21,062.00. C. Bid Used Pick-up for Parks and Recreation Cotter to accept the bid from Craig Cromer of West Plains, MO for $11,000. D. Bid Winter Sports Comple Divider Curtain Fugate to accept the bid from Alco of St. Louis, MO for $8,775.00. Motion E. Signatures accepting the 2015 Local Emergency Operation Plan 4
City Council signed the 2015 Local Emergency Operation Plan for Emergency Management Director Kent Edge. F. Recommendation regarding Broadband Presentation to City Council at Special Session December 15, 2015 John Colbert, President of Fidelity, spoke and stated they have been meeting with the Broadband Committee over the last few weeks and have a proposal with three ideas to present to the board. We would have a 1 gig connection to residents by the end of 2016. Fidelity would also commit to building out in the subdivisions in 2016 and commercial areas. Fidelity would do these things contractually to the city. If Fidelity doesn t fulfill the commitment they feel there should be some type of penalty. Topliff to table the recommendation until the January 19, 2016 City Council Meeting. G. Liquor License Application Bieller Enterprise, DBA Savor Café & Grille, 1449 Preacher Roe Blvd. Cotter to approve the liquor license application from Bieller Enterprise, which will be Savor Café & Grille. H. Liquor License Application Snappy Mart #49 LLC, 502 Porter Wagoner Boulevard Topliff to approve the liquor license application for Snappy Mart #49 LLC. I. Parks & Recreation Strategic Plan Topliff to approve the Parks and Recreation Strategic Plan with the changes noted that Park Board members are not commissioners. J. Planning & Zoning Recommendations a. Proposed Street Name Reassignments for 911 Purposes b. Vacate Proposal of the corner of County Road 6070 and Mitchell Street c. Vacate Proposal of an alley between Broadway and First Street and Lincoln and Garfield The motion was made by Councilman Topliff and seconded by Councilman Cotter to approve the Planning & Zoning recommendations, with the eception of item A. VI. ADMINISTRATOR S REPORT Project Update o We sent 881 cut-off notices this past month. 5
o Sirens have been installed and everything has gone well, they are ready to use. o We have a little over 2 miles installed of fiber from the Civic Center to City Hall. o We are looking to have the new transit station on fiber by the end of the year. o The new website is up with a few issues, we would appreciate any feedback. o The fire department has the aerial truck that was wrecked back in service. We should receive our new truck in the New Year. o We were not able to make the agenda for this month, but the January agenda will have an ordinance to prohibit smoking in public places and workplaces on the ballot in April. o Wednesday, December 30 th City Hall will be closed from 8-12 p.m. to the public for an in-house training. o We will be closed December 24 th, 25 th and January 1 st.
