BEFORE THE NORTH CAROLINA MEDICAL BOARD In re: John J. Harris, Jr., M.D., Respondent. INTERIM NON-PRACTICE AGREEMENT This matter is before the North Carolina Medical Board ( Board on information regarding John J. Harris, Jr., M.D. ( Dr. Harris. Dr. Harris admits and the Board finds and concludes that: STATUTORY AUTHORITY The Board is a body duly organized under the laws of North Carolina and is the proper party to bring this proceeding under the authority granted to it in Article 1 of Chapter 90 of the North Carolina General Statutes and the rules and regulations promulgated thereto. FINDINGS OF FACT On August 14, 2009, the Board issued a license to Dr. Harris, license number 32114. During the time relevant herein, Dr. Harris practiced medicine in Wilmington, North Carolina. Dr. Harris suffers from a medical condition, which if left untreated, affects his ability to practice medicine. Interim Non-Practice Agreement John J. Harris, Jr., M.D. Page 1 of 5
The Board recently received information that Dr. Harris may be currently exhibiting symptoms of this medical condition and that the medical condition may not be adequately managed. CONCLUSIONS OF LAW Dr. Harris admits that his medical condition, if left untreated, renders him unable to practice medicine with reasonable skill and safety to patients within the meaning of N.C. Gen. Stat. 90-14(a(5 and grounds exist for the Board to suspend, revoke, or limit Dr. Harris s license or to deny any application he might make in the future. PROCEDURAL STIPULATIONS Dr. Harris acknowledges and agrees that the Board has jurisdiction over him and over the subject matter of this case. Dr. Harris acknowledges that he has read and understands this Interim Non-Practice Agreement and enters into it voluntarily. ORDER Now, therefore, with Dr. Harris s consent, it is ORDERED that: 1. Dr. Harris agrees that he will be given a ten-day winddown period, beginning on June 14, 2017, and extending until June 24, 2017, in order to wind-down his practice and provide appropriate medication management to his patients. Dr. Harris further agrees that he will not practice medicine after June 24, 2017, until the Board gives him written permission to do so. Interim Non-Practice Agreement John J. 2. It is further agreed that the Board is not barred from imposing future discipline against Dr. Harris, if such action is warranted, based on the circumstances surrounding and leading up to the execution of this Interim Non-Practice Agreement. 3. Dr. Harris shall obey all laws. Likewise, he shall obey all rules or regulations involving the practice of medicine. 4. Dr. Harris shall notify the Board in writing of any change in his residence or practice addresses within ten (10 days of the change. 5. Dr. Harris agrees that should he resume the practice of medicine in violation of this Interim Non-Practice Agreement such resumption of practice will provide sufficient basis for the Board to summarily suspend his license. Dr. Harris further agrees that should the Board summarily suspend his license for resuming practice in violation of this Interim Non-Practice Agreement, Dr. Harris knowingly and voluntarily waives his right to a prompt hearing on the summary suspension. 6. If Dr. Harris fails to comply with any provision of this Interim Non-Practice Agreement, such failure shall constitute unprofessional conduct within the meaning of N.C. Gen. Stat. 90-14(a(6 and shall be grounds, after any required notice and hearing, for the Board to annul, suspend, revoke, condition, or limit Dr. Harris s North Carolina medical license or to deny any Interim Non-Practice Agreement John J. application he might make in the future or then have pending for a license. 7. This Interim Non-Practice Agreement shall take effect immediately upon its execution by both Dr. Harris and the Board and it shall continue in effect until specifically ordered otherwise by the Board. 8. Dr. Harris hereby waives any requirement under any law or rule that this Interim Non-Practice Agreement be served on him. 9. Upon execution by Dr. Harris and the Board, this Interim Non-Practice Agreement shall become a public record within the meaning of Chapter 132 of the North Carolina General Statutes and shall be subject to public inspection and dissemination pursuant to the provisions thereof. It will be reported to the Federation of State Medical Boards; however, it will not be reported to the National Practitioner Data Bank.
