A regular meeting was held August 15, 2017 at Hutchinson Hall, Newark Valley at 7:00 P.M. The following Board members were PRESENT: Stuart Yetter, Jr., Supervisor Dan Cheresnowski, Councilman Tim Dalton, Councilman Joe Tomazin, Jr., Councilman Warren Smith, Councilman Also Present: Karen McMullen, Levene, Gouldin, & Thompson, Attorneys to the Town; Charles Meade, Highway Superintendent; Denise Liske, Dog Control Officer; Sue Meade; and Tom Larson, Code. Meeting Called To Order Supervisor Yetter called the meeting to order at 7:00 P.M. Pledge of Allegiance Supervisor Yetter led all in the Pledge of Allegiance. Approval of Board Meeting Minutes for July 16, 2017 Resolution #73-2017 Approval of Town Board Meeting Minutes for July 18, 2017 On a motion offered by Councilman Smith and seconded by Councilman Dalton, the Town Board amended the July 18, 2017 minutes on page 3, under Work Place Violence Training, to end the sentence after September 6 training and eliminate the rest of the sentence. The Town Board approved the Meeting Minutes for July 18, 2017 as amended. Councilman Dalton AYE Councilman Tomazin AYE Councilman Cheresnowski AYE Supervisor Yetter AYE Privilege of the Floor Supervisor Yetter opened Privilege of the Floor. There were no comments. Privilege of the Floor was closed. 1

Highway Superintendent s Report Highway Report August 15, 2017 1. Gas Price: $1.81 Diesel Price: $1.60 2. All the shim spots are completed. I have a loader bucket and a half left of grader patch. There are small spots on Bailey Hollow for which it will fit wonderfully. 3. Also we took care of spots on Ketchumville Rd., Especially at the intersection of Wilson Creek Rd. and our Bridge. (Both Edges) 4. There was 1 spot on Davis Hollow Rd. over the 1 st big sluice pipe. There are numerous spots on Chamberlain Rd., up to Betty Lane Rd. There was one big area on Betty Lane Rd. and on Lane Rd. both intersections. Chamberlain Rd. and Davis Hollow were done. On the back side of Howard Hill 4-sections were re-topped, some both lanes some one lane. I still want to change 2 cross over pipes further down the hill. I hope before School opens. 5. We had to replace the water pump on the Cat-ex. Joe tells me he hears a knock in the engine. He doesn t want to say what it could be yet. 6. Sometime late or early September, we will stone and oil our projects, I hope, it s up to Suit-Kote and I know everything is behind! 7. I had our meeting with FEMA and SEMO last Thursday for winter storm work, so all of our beginning paper work is in. Our next meeting (Kick Off and Final Paper Work) will be in 2 weeks) we had a grand total of $39,300.00 estimated by FEMA and SEMO. 8. I did throw Newark Valley in for lost gravel on all of our gravel Rds. Along with ditch cleaning in the areas, approximately $10,000.00 plus or minus. The time table for these happenings is June 30 th through July 24 th 2017. Again more paper work. 9. Tappan Rd. will be closed starting next Monday, July 21. The railroad will be redoing the crossing (weather permitting) and the road will be closed for about one week. There was discussion about reworking Dalton Hill Rd. Superintendent Meade said the paver is working super and we are interested in buying it. He explained how it works. Councilman Dalton discussed the guardrail in front of his house with Superintendent Meade. Superintendent Meade said Markham Rd. may get sealed if we have enough money. New Business Supervisor s Financial Report Supervisor Yetter said everything looks good. We have one transfer tonight for the Historian. We are pretty much on track and the sales tax is coming in as expected. Superintendent Meade said the CHIPS money will be in by the end of the year. 2

Budget Transfers Resolution #74-2017 Budget Modifications On a motion offered by Councilman Tomazin and seconded by Councilman Cheresnowski, the Board approved the following budget transfers: $ 25.56 FROM A1990.4 TO $25.56 A7510.4 Historian C.E. Resolution #75-2017 Supervisor s Financial Report On a motion offered by Councilman Smith and seconded by Councilman Dalton, the Town Board accepted the Supervisor s Financial Report for July 2017 as submitted. Adoption of Discrimination and Harassment Policy There was a short discussion about this policy. Resolution #76-2017 Adoption of Discrimination and Harassment Policy On a motion offered by Councilman Dalton and seconded by Councilman Smith, the Town Board adopted the Discrimination and Harassment Policy as presented. Old Business Village Snowplowing Supervisor Yetter will talk with the Mayor about this at a later date. 3

Department & Council Reports We need to make changes to our Unsafe Structure Law so it will come into compliance with the State s new code. We will need to have a Public Hearing. There was discussion about the changes. Resolution #77-2017 Advertise Public Hearing for Local Law #3- A Local Law Providing for the Administration and Enforcement of the New York State Uniform Fire Prevention and Building Code On a motion offered by Councilman Tomazin and seconded by Councilman Cheresnowski, the Town Board authorizes advertising a Public Hearing for Local Law #3- A Local Law Providing For the Administration and Enforcement of the New York State Uniform Fire Prevention and Building Code, to be held September 5, 2017 at 7:15 P.M. at Hutchinson Hall in the Town of Newark Valley. Tom Larson discussed with the Board changing shed size requirements. After the Board considered his suggestion, they decided to leave the size as it is at 144 square feet. There was discussion about the sand/salt building money for the extended warranty. Code Tom Larson said that everything from last month has been taken care of US Bank owns the Person s property and they will not return calls Have heard nothing from Bruce Nelson concerning campground The Code Enforcement's monthly report is on file in the Clerk's office. There was discussion about Tony Meyers Rd. and the Well s property sales and where the money would come from if a new road had to be built. 4

Dog Control Denise Liske discussed with the Board the following: We have one judge who refuses to hear dog violations Ongoing problem with Jones/Jump Jonathan Peppin/Cinnamon Peppin dispute over dog ownership, court case pending Lori Kamrowski- dogs running at large -5 tickets issued Casey Frederici appearance ticket issued- dog terrorizing the neighborhood Victoria Wagner boxer declared dangerous for biting a child Ben Swagler- has 2 dogs and willing to have them rehomed Mark Akers appearance ticket for not licensing his dog Lenny Howe appearance ticket for dog running at large Numerous barking dog complaints Stray dog with mange on NV/Maine Rd. Dog attacking shop owners south of the village Planning Board No report. There was a question about HWY Bill H126 it is a chemical company who supplies the highway garage with lubricants, etc. named Castle products. Town Clerk The Deputy Town Clerk/Deputy Tax Collector resigned and we need to take her off all bank accounts and replace with new Deputy Town Clerk/Deputy Tax Collector. Resolution #78-2017 Remove Janet Smith and Replace with Lora Corson on Town Clerk/Tax Collector Bank Accounts On a motion offered by Councilman Cheresnowski and seconded by Councilman Dalton, the Town Board authorizes the removal of Janet Smith from all bank accounts of the Town Clerk/Tax Collector and to add Lora Corson to the Town Clerk/Tax Collector bank accounts. Councilman Smith ABSTAINED Denise Liske explained to the Board that Ben Swagler had a dog that mysteriously died. Stray Haven had the dog sent away for an autopsy but the results are inconclusive. 5

General Bills Resolution #79-2017 General Bills On a motion offered by Councilman Dalton and seconded by Councilman Cheresnowski, the Town Board authorizes the payment of General Bill Vouchers 203-225, inclusive, in the amount of $9,768.01. Highway Bills Resolution #80-2017 Highway Bills On a motion, offered by Councilman Smith and seconded by Councilman Tomazin, the Town Board authorizes the payment of Highway Bill Vouchers #H119 #H140 inclusive in the amount of $43,300.96. On a motion offered by Councilman Smith and seconded by Councilman Cheresnowski, the meeting was adjourned at 8:02 P.M. The next scheduled meeting is a Work Session to be held September 5, 2017 at 7:00P.M. with a Public Hearing at 7:15 P.M. concerning Local Law #3 - A Local Law Providing For The Administration and Enforcement of the New York State Uniform Fire Prevention and Building Code.
