DID YOU KNOW By Jim Jones, Parishioner Abortion policy in America that essentially denies all human and civil rights to the child in the womb has developed based primarily on two Supreme Court cases. The first, Griswold, established a constitutional right to privacy. The second, Roe, used the Griswold right to privacy to legalize abortion on the request of the mother. In 1961, Griswold, Executive Director of Planned Parenthood, plead guilty to violating the Comstock Act (1873) that prohibited advising on the means of preventing conception. Planned Parenthood was initially known as The American Birth Control League, formed by Margaret Sanger in 1921. Planned Parenthood had been openly and routinely violating the Comstock from various locations in New York for decades. Griswold was fined $50 for the violations. In 1965, he challenged the law in the Supreme Court and won. The Court decided Griswold s right to privacy had been violated. That Court reasoned that enumerated rights (e.g., free speech) have penumbras formed by their emanations. The Oxford English Dictionary defines penumbra, The partially shaded outer region of the shadow and emanations, that which originates or issues from a source. So, the Court discovered the unmentioned right to privacy emanating from, and lurking in, the shadows of specified rights. While Griswold did not strip any legal protections from the child, it was used by the Supreme Court to reach its decision in Roe since it had established that the government cannot interfere with certain personal decisions about procreation, marriage, and other aspects of family life. Griswald paved the way for Roe, which opened the floodgates of the slaughter of the innocents.
