The regular meeting of the Fruitland Planning and Zoning Commission was held at the Fruitland City Hall on Tuesday, July 11, 2017 at 7:00 p.m. Commissioners present were Tracy Leonard, Helen Dickinson, Terry Heitz, Barry Carlman, Doug Deardorff, Mike Smith and Suzanne Pearcy. Commissioners Kent Stampfli and Carrie Grant were absent. Guests included Andrew Kimmel, Troy O Dell, LaVaughn Beck, Ross Barton, Stewart Harris, Danny Little and Rick Watkins. Commissioner Deardorff made the motion to approve the June 13, 2017 meeting minutes. Commissioner Pearcy seconded the motion. Motion carried. Public Hearings: Rick Watkins explained public hearing procedure and asked commissioners to disclose any conflicts. No conflicts were declared and the first hearing opened at 7:04 p.m. Mesa Land & Development, Inc. - Replat of Brookwood Estates Subdivision: Andrew Kimmel representing Riedesel Engineering explained Brookwood Estates Subdivision was platted in 2007 and not developed. Mr. Kimmel explained Troy O Dell has purchased the property and would like to make changes to the plat including the reduction in the number of lots and widening of roads to meet the requirements of the current code. The commissioners questioned whether the recommendations by the city engineers could be accomplished and Mr. Kimmel as well and Mr. O Dell assured the commission the plat could be revised to meet the standards required. Commissioner Carlman asked about a landscape buffer on NE 8 th Street. Mr. Kimmel questioned to what extent the city wanted development along NE 8 th Street as there are sporadic areas of development. Commissioner Deardorff stated the developer was responsible for development along their property only. Mr. Watkins stated written testimony had been received from the Public Works Supervisor, Idaho Transportation Department, Farmers Co-operative Irrigation Company, Mason & Stanfield Engineering and HDR Engineering. Stewart Harris (2060 NE 8 th Street) testified he is concerned with the potential increase in the elevation of the subdivision. Mr. Harris explained his neighbor, Mr. Ahlstrand has elevated his property and with the elevation of the subdivision, it leaves him in the center and is concerned with the runoff and the potential for his property to collect the water. LaVaughn Beck (2188 NE 8 th Street) testified she resides east of the development and questions whether a fence will be built prior to construction to prevent the wind from blowing materials into their fields as they are still farming.
Troy O Dell testified he is planning on erecting a fence before construction and explained the dirt being brought into the subdivision is not to elevate the streets and drainage will be taken care of to prevent runoff. Mr. Watkins asked if the subdivision will be done in one phase and Mr. O Dell stated it would be. With no further testimony, the hearing was closed at 7:21 p.m. Ross Barton (712 SW 4 th Street) testified he had a visit from an ordinance officer regarding a soft cover canopy that had been on his property for eight years. Mr. Barton explained he visited with Mr. Watkins expressing his concern the code required the canopy to meet the same guidelines as a shed and didn t feel it was right. Working together they came up with a definition of a portable canopy and regulations to where a canopy could be placed on property.
