Estate of Joseph and John Morrison 16 Sep 1880 Glasgow Sheriff Court Wills Reference SC36/51/80 We Joseph Morrison and John Morrison sometime Curriers and Leather Merchants Glasgow now residing in Monteith Row there for the purpose of settling the succession to the means and estate which shall belong to the survivor of us at the time of his death Do hereby Dispose Assign & Convey to an in favor of our Brother James Morrison residing at Upper Norwood Surrey William Alexander McLachlan of Auchertroig James Phillips Wholesale Grocer Campbell Arcade Glasgow Alexander Buchanan of the firm of John Buchanan Brothers Confectioners Glasgow and such other person or persons as we or the survivor of us may name hereafter and the survivors & survivor of them who shall accept the whole means estate and effects which shall pertain & belong to the longest liver of us at the time of his death (a majority of those accepting surviving and resident in Scotland at the time being always a quorum) with the whole writs titles vouchers and securities thereof as Trustees and in Trust for the following purposes viz First. For payment of all the just and lawful debts of the longest liver of us of a legacy of one hundred pounds free of legacy duty to each of the said Trustees who shall accept and of any other legacies which the survivor of us may leave by an Writing under his hand however informal. Second. For payment annually to our two Cousins Ellison Mitchell and Isabella Mitchell residing at Grangemouth and the survivor of them of an annuity of twenty five pounds sterling free of legacy duty payable in equal portions at the terms of Whitsunday and Martemmas beginning the first payment at the first of these terms which shall happen after the death of the longest liver of us. Third. For payment to the said James Morrison of a legacy of one thousand pounds sterling free of legacy duty and also for delivery to him of the following articles viz. the whole household furniture and plenistring of every description including Books pictures silver plate and pungibles jewellery body clothes and in general all moveables belonging to the survivor of us with the exception of our uncle John s portrait which we bequeath to John Morrison of Number three Adelaide Place King William Street London and which shall be delivered to him. Fourth. Our said Trustees shall hold the whole residue and remainder of the means and estate hereby conveyed for behoof of the said James Morrison in liferent during all the years and days of his life and upon his death for behoof of our two nephews William Lochore and Joseph Morrison Lochore equally and the survivor of them in liferent for all the years and days of their respective lives and upon the death of the whole of the said liferenters our said Trustees shall hold and dispose of the said residue and remainder of our Estate subject always to the payment of the said annuity of Twenty five pounds should the said Ellison Mitchell and Isabella Mitchell or survivor be then alive as follows 1 st Our said Trustees shall invest for behoof of the congregation of Regent Place United Presbyterian Church Glasgow the sum of sixteen hundred pounds sterling & shall apply the interest thereof towards paying the pen duty or ground annual affecting the Church In the event of any dispute arising regarding the management and disposal of the said sum of sixteen hundred pounds the same shall be decided by the United Presbyterian Presbytery of Glasgow. 2 nd Our said Trustees shall invest for behoof of the United Presbyterian Congregation Bucklyvie Parish of Kippen the sum of one thousand pounds sterling and shall apply the interest or income thereof in augmenting the Ministers Stipend of said Congregation. 3 rd Our said Trustees shall hold the houses and fens in Bucklyvie and the four parks known as Acremuskin presently belonging to me the said Joseph Morrison and shall apply the rents in augmenting the Teachers Salary in Bucklyvie said Teacher to have a Government Certificate and any dispute regarding the disposal of the said Legacy of One thousand pounds sterling and the said houses fens and parks shall be decided by the United Presbyterian Presbytery of Stirling. 4 th Our said Trustees shall pay to the Glasgow Royal Infirmary the sum of Five hundred pounds sterling on condition of the Directors agreeing to set apart two beds yearly for two patients from Bucklyvie or neighbourhood in all time coming. 5 th Our Trustees shall pay to the Glasgow Asylum for the Blind the sum of Three hundred pounds upon condition of the Directors binding themselves to take one Boarder from Bucklyvie or neighbourhood regularly free of charge in all time coming. 6 th. Our Trustees shall pay to the Glasgow Eye Infirmary the sum of Three hundred pounds on condition of the Directors binding themselves to take in one person from Bucklyvie or neighbourhood regularly free of charge in all time coming. 7 th. Our Trustees shall pay to the Glasgow Institution for the Deaf & Dumb the sum of Three hundred pounds on condition of the Directors binding themselves to take one Boarder from Bucklyvie or neighbourhood free of charge in all time coming. 8 th Our Trustees shall pay to the Glasgow Stirlingshire Sons of the Rock Charitable Society the sum of Three hundred pounds on condition of the Directors binding themselves to raise all recipients on the Roll to Five pounds annually. 9 th Out Trustees shall pay to the Glasgow City Mission the sum of Three hundred pounds. 10 th Our Trustees shall pay to the Glasgow Old Mans Friend Society and to the Glasgow Old Woman s Friend Society the sum of Three hundred pounds each. 11 th Our Trustees shall pay to the fund for Aged and Infirm Ministers of the United Presbyterian Church the sum of Three hundred pounds and to the Manse Fund of the said United Presbyterian Church the sum of Three hundred pounds. 12 th Our said Trustees shall hold the five shares of the National Bank of Scotland presently belonging to us, and worth at present about Fourteen hundred pounds & shall apply the interest or dividends arising therefrom in Busaries One of fifty pounds and the other of the remainder of the income, or in such proportions as the Glasgow United Presbyterian Presbytery shall see fit; to be given to United Presbyterian Students of Divinity belonging to Bucklyvie or Parish of Kippen but should there be no such Students of Divinity then to be given to United Presbyterian Medical Students belonging to Bucklyvie and failing any such Students belonging to Bucklyvie then the said Bursaries may be given to any such Students belonging to the United Presbyterian Church Students of the name of Morrison whether Divinity Students or Medical Students having a preference over others of the same class. The Glasgow United Presbytery shall have the sole Control in managing these Bursaries and fixing the Subjects for examination and examining the candidates and awarding the Bursaries And the said Presbytery shall have power if they see cause to recall and cancel any Bursary in so far as not paid and to make any rules and regulations there..anent which they may consider proper Fifth. should there be any surplus after implementing the foregoing instructions such surplus shall be equally divided among such of the congregations and Charitable Institutions before named as our said Trustees shall think fit but should there be a deficiency to implement fully the said instructions such deficiency shall be taken from the said Sixteed hundred pounds appointed to be invested for behoof of the Regent Place United Presbyterian Congregation Glasgow which sum of Sixteen hundred pounds shall to the extent of said deficiency be diminished accordingly. Sixth. All the said bequests and bursaries although coming out of the Estate of the survivor of us shall be styled the Joseph & John Morrison Bequests and Bursaries. Seventh. We hereby acknowledge that at the date of these presents we hold the folloiwng property in Trust for behoof of John Morrison Deptford viz First Fifteen shares Original Stock of the Glasgow & South Western Railway, Second the said William Alexander McLachland s Promissory Note for seven hundred pounds. Third One thousand pounds on Deposit receipt in the National Bank of Scotland. Fourth Mortgage for one thousand pounds by the Clyde Navigation Trustees and Fifth Cash as per statement in small Ledger and Small Book in safe. Eighth. The Congregations of Regent Place and Bucklyvie shall not lose their interest in the foregoing provisions for them although they should unite with another body of Protestants in Scotland and all the powers hereby conferred on the United Presbyterian Prebyteries of Glasgow and Stirling shall be exercised by any presbytery or Presbyteries embracing respectively the said Congretations by whatever name they may be known. Ninth. It is hereby declared that the survivor of us shall have full power to alter innovate or revoke these presents in whole or in part. And we hereby appoint our said Trustees and their foresaids with their quorum to be the sole Executors of the survivor of us And we provide and declare that the said Trustees and Executors shall be entitled to the fullest powers and exemptions usually conferred in similar cases according to the most liberal interpretation or belonging to gratuitous Trustees by law & particularly we authorize & empower them to submit to arbitration or settle by the advice of Counsel all disputed claims competent to or against the Trust subjects and Estate to compound & take part for the whole of any disputed debts or claims to lend out the whole or any part of the Trust Funds & Estate on heritable Security or the Debentures of Incorporated Companies or on the Security of the Government funds or of shares in Chartered or Incorporated Companies in Great Britain or to invest the same in the Government funds or in the purchase of Heritable property duties ground annuals or other heritages or of the guaranteed or preference or debenture Stock of Railway or other incorporate Companies in which the liability of each shareholder is limited to the value of the stock held by himself or to retain the same in Bank in Great Britain and from time to time to alter & renew the securities as may ne necessary or may seem to them expedient; to appoint any one or more their own number or any other person or persons to be Factor or Factors of Law Agent or Law Agents under them for the management of the Trust Estate and to allow such Factors suitable remuneration for their trouble & such Law Agents the usual professional fees but for the intromissions of such Factors they shall not be liable provided the party or parties so appointed were reputed solvent at the time. And we Provide and Declare that the said Trustees and Executors shall not be liable for the sufficiency of the securities on which they may lend out the Trust funds or of the Banks in which the same may be deposited but only that they were reputed sufficient at the time nor shall they be responsible that the properties fenduties ground annuals stock and others which they may purchase with the Trust Funds in terms of the powers hereby conferred or any part thereof shall realise the price or prices at which the same were purchased. And we Declare that each of the said Trustees and Executors shall be liable to account only for the funds actually received by himself and not for any funds which he may have authorized Trustee, Executor, Factor or Agent to receive and that any Trustee or Executor who shall pay over to a Co-Trustee, Executor, Factor or Agent or shall do or concur in any act enabling such Co- Trustee Executor Factor or Agent to receive any moneys for the general purposes of the Trust or for any definite purposes of the Trust or for any definite purpose authorized by this Settlement shall not be responsible for any loss resulting from his failure to see to the due application of the funds entrusted to such Co-Trustee Executor Factor or Agent. And none of our Trustees and Executors shall be responsible for the failure to recover any debts or the Dawn Chambers Page 3 of 6

realisation of which has by him been entrusted to, and undertaken by a Co-Trustee, Executor, Factor or Agent to the Turst. And we Consent to the Registration hereof for preservation. In Witness whereof these presents consisting of this and the four preceding pages with the marginial addition on page fourth all written by William Kidston Writer in Glasgow for W. J. B. & J. Kidston Writers there are Subscribed (under this declaration that the words any such are interlined between the eight and ninth words of the fifteenth line of the third page hereof before subscription) by us both at Glasgow this twenty eighth day of March Eighteen hundred and seventy one before these Witnesses the said William Kidston and James Burns Kidston Writer in Glasgow [signed] Joseph Morrison John Morrison William Kidston Witness J. Kidston Witness Codicil 1 We Joseph Morrison & John Morrison the makers of the foregoing Trust, Disposition & Deed of Settlement do hereby make the following additions to and alterations upon the same First We hereby nominate and appoint Archibald Hervey formerly Currier in Kelso now residing at Auchentroig Balfron to be a Trustee and Executor along with the other Trustees and Executors therein named. And we Leave & Bequeath to him a Legacy of One hundred pounds in the same terms as the legacy of that amount bequeathed to the other Trustees. Second. We Recall & cancel the instructions to our said Trustees to invest for behoof of the Congregation of Regent Place United Presbyterian Church Glasgow the sum of Sixteen hundred pounds and all clauses connected therewith And we direct our said Trustees to pay the said sum of Sixteen hundred pounds to our brother James Morrison in addition to the other sums bequeathed to him by the said Trust Disposition & Deed of Settlement. Third We Recall the directions to our Trustees to hold the houses and fens in Bucklyvie & the four parks known as Acremuskie and the application of the Rents thereof in augmenting the Teachers Salary in Bucklyvie and we direct our said Trustees to convey the said houses and fens and four parks known as Acremuskin to the said James Morrison our Brother. Fourth We direct our Trustees to set apart the sum of Three hundred pounds for behoof of Alexander Baird sometime Tailor and Clothier in Jedburgh now Stationer & News Agent Great Western Road Glasgow and his family to be expended for behoof of the said Alexander Baird or any one or more of his family in such sums and at such times as the Trustees may think proper. Declaring that the said sum of Three hundred pounds and all interest accruing thereon shall not be arrestable for the debts of the said Alexander Baird or his family or any of them and shall not be assignable being intended for the alimentary use of the said Alexander Baird and his family or such of them as the Trustees of the survivor of us may think fit. Fifth. We hereby Recall the fifth article of the instructions to the Trustees of the survivor of us regarding the disposal of any surpluses after implementing the instructions given in the said Trust Disposition and Deed of Settlement And in the event of there being any surplus after implementing the instructions in the said Trust Disposition and Deed of Settlement (in so far as not hereby altered) and in this Codicil we hereby Direct our Trustees to divide the said surplus equally as follows viz To the fund for the better support of aged Ministers in connection with the said United Presbyterian Church one third part thereof To the Manse Fund of the said United Presbyterian Church one third part thereof and to the University of Glasgow situated at Gilmorehill the remaining one third part thereof. We farther Direct that should there be a deficiency to meet the specific legacies in the said Trust Disposition and Deed of Settlement and this Codicil such deficiency shall be made up from the bequests to the public charities pro rata according to the amount of the respective legacies bequeathed to the said Charities. By which Charities we mean The Glasgow Asylum for the Blind, The Glasgow Royal Infirmary, The Glasgow Eye Infirmary, The Glasgow Institution for the Deaf and Dumb, The Glasgow Stirlingshire Sons of the Rock Charitable Society, The Glasgow City Mission, The Glasgow Old Mans Friend Society, The Glasgow Old Woman s Friend Society, The fund for aged & infirm Ministers of the United Presbyterian Church. And we declare this to be a codicil to the said Trust Disposition & Deed Dawn Chambers Page 4 of 6

of Settlement and to be read and construed as if it were embodied in and formed part of the same. And we Consent to the registration hereof for preservation. And this I do in consideration of the great care and kindness she has bestowed upon us. In witness whereof these presents written Malcolm Macfarlane Clerk to W. J. B. & J. I hereby bequeath to Miss Mary Morrison London my silver tea set and also my China Tea Set and also my Silver Tea Spoons except the small ones which I hereby leave to my servant Bella Arthur. And I also hereby leave to Miss Mary Morrison all my Silver table and Desert Spoons and Silver forks and Silver Toddy Laddles. Also my Silver Bread Basket and Cruet Stand. I also hereby leave to Mr John Morrison Bushmead my Cruet Stand in the Wooden box and also the silver spoons inside of said wooden box.
