FOREST PRESERVE COMMISSION MEETING February 8, 2011 The Forest Preserve Commission meeting was called to order by President Hoscheit at 9:05 a.m. on Tuesday, February 8, 2011, in the County Board Room at the Kane County Government Center, Building A, 719 Batavia Avenue, Geneva, Illinois. The Pledge of Allegiance was led by Commissioners Donahue. Present: Executive Director Meyers Robert J. FP-R-02-11-2043 A RESOLUTION ACCEPTING A BID FOR THE PROCUREMENT AND INSTALLATION OF AN LED SIGN AT HUGHES CREEK GOLF COURSE WHEREAS, bids have been solicited and received for the for the procurement and installation of an LED sign at Hughes Creek Golf Course; and WHEREAS, the apparent low qualified bidder for the procurement and installation of an LED sign at Hughes Creek Golf Course is American Sign Company of Elk Grove Village, Illinois in the amount of $11,985.00., Illinois that the low qualified bid by American Sign of Elk Grove Village, Illinois in the amount of $11,985.00 be, and hereby is accepted and approved. FP-R-02-11-2044 A RESOLUTION ACCEPTING A BID FOR THE TREE THINNING AT BURLINGTON FOREST PRESERVE WHEREAS, bids have been solicited and received for the for the tree thinning at Burlington Forest Preserve; and WHEREAS, the apparent low qualified bidder for the tree thinning at Burlington Forest Preserve is Homer Tree of Lockport, Illinois in the amount of $32,000.00., Illinois that the low qualified bid by Homer Tree 303

FP-R-02-11-2045 A RESOLUTION ACCEPTING A BID FOR THE GARLIC MUSTARD REMOVAL AT BLISS WOODS FOREST PRESERVE WHEREAS, bids have been solicited and received for the for the Garlic Mustard removal at Bliss Woods Forest Preserve; and WHEREAS, the apparent low qualified bidder for the Garlic Mustard removal at Bliss Woods Forest Preserve, is Tallgrass Restoration, Inc., of Schaumburg, Illinois in the amount of $33,275.00., Illinois that the low qualified bid by Tallgrass Restoration, Inc. of Schaumburg, Illinois in the amount of $33,275.00 be, and hereby is accepted and approved. APPROVED AND PASSED this 8th day of February, 2011. 304

President Hoscheit called for a motion to bring to the floor Resolution FP-R-02-11-2046 a Resolution Authorizing an Intergovernmental Agreement with the Dundee Township Park District for use of Lincolnwood Park. Motion by Commissioner Castro, seconded by Commissioner Haley, to bring to the floor Resolution FP-R-02-11-2046 a Resolution Authorizing an Intergovernmental Agreement with the Dundee Township Park District for use of Lincolnwood Park. RESOLUTION NO. FP-R-02-11-2046 A RESOLUTION AUTHORIZING A LICENSE AGREEMENT ON DISTRICT OWNED PROPERTY WHEREAS, the is the owner of certain real estate located in Dundee Township and known as the Lincoln Wood Park located within Fox River Shores Forest Preserve; and WHEREAS, the Dundee Township Park District has had an informal agreement with the Forest Preserve for the use of this property for a neighborhood park; and WHEREAS, the District, Kane County and Dundee Township Park District agree on formalizing an agreement to allow the Dundee Township Park District to continue to provide a neighborhood park for the residences of the area and continue to maintain the park with no cost to the District., Illinois, that the attached agreement for a license between the District and the Dundee Township Park District be, and hereby is approved. RESOLUTION NO. FP-R-02-11-2047 A RESOLUTION AUTHORIZING AN INTERGOVERNMENTAL AGREEMENT WITH THE ILLINOIS DEPARTMENT OF TRANSPORTATION FOR TREE PLANING RESTORATION AT BIG ROCK FOREST PRESERVE WHEREAS, the is the owner of certain real estate located in Big Rock Township and known as the Big Rock Forest Preserve; and WHEREAS, the Illinois Department of Transportation (IDOT) will assist with the reforesting of 24.5 acres at the Big Rock Forest Preserve and maintain the site for two years including guaranteeing the tree for the same period of time. as approved, and that the President and the Secretary of the District be, and hereby are, authorized and directed to execute and grant to the Illinois Department of Transportation the approval for the reforesting of the 24.5 acres at the Big Rock Forest Preserve agreements and deliver the same to the Illinois Department of Transportation APPROVED AND PASSED this 8th day of February, 2011. 306

Motion by Commissioner Donahue, seconded by Commissioner Mitchell, to bring to the floor Resolution FP-R-02-11-2048 a Resolution Authorizing the reduction of Extended Property Taxes by Fund. RESOLUTION NO. FP-R-02-11-2048 A RESOLUTION AUTHORIZING THE REDUCTION OF EXTENDED PROPERTY TAXES BY FUND WHEREAS, the passed their 2010 Property Tax Levy on November 9, 2010; and WHEREAS, said Property Tax Levy was filed with the Kane County Clerk on November 9, 2010, in accordance with state statutes; and WHEREAS, the has been notified by the Kane County Clerk that, in order to be in compliance with the Property Tax Extension Limitation Act, the District may be required to adopt a resolution specifically reducing the extended rates by fund should the aggregate extension rate exceed the allowable 2.7% increase, under the act; and WHEREAS, it was the intent of the District, in passing the 2010 Property Tax Levy to increase the General Fund Levy, Construction and Development Fund Levy and the Insurance Liability Fund Levy to the amount allowable under the statutes and no more. that should the District be required to reduce the 2010 Levies to comply with the Property Tax Extension Limitation Act, the President and the Treasurer are hereby authorized to reduce the General Fund, Construction and Development Fund Levy and/or the Insurance Liability Fund Levy by the indicated overage, as they see fit. Motion by Commissioner Frasz, seconded by Commissioner Ford, to bring to the floor Ordinance FP-O-02-11-461 an Ordinance amending An Ordinance for the General Use of the, Illinois. ORDINANCE NO. FP-O-02-11- 461 AN ORDINANCE AMENDING AN ORDINANCE FOR THE GENERAL USE OF THE FOREST PRESERVE DISTRICT OF KANE COUNTY, ILLINOIS CHAPTER III REGULATION OF SPORTS AND GAMES No person shall, upon or in connection with any property of the District, engage in the following activities: SECTION 7 WINTER SPORTS a) Sled, toboggan, ski or slide in any area unless otherwise posted as expressly permitted by the President b) Enter on or upon any frozen waters to skate, slide or walk, or for any purpose whatsoever unless otherwise posted as expressly permitted by the President c) Fish though the ice on any frozen waters unless otherwise posted as expressly permitted by the President d) Bring onto or upon the frozen waters of any lake, pond or watercourse any iceboat or wind-driven-like device or other vehicle, without written permission of the President 308

e) Snowmobile on trails or other area unless otherwise posted as expressly permitted by the President f) Snowmobile in excess of 15 mph in all areas as expressly permitted by the President, or in excess of 35 mph on the Great Western Trail, west of Wasco ADOPTED AND PASSED this 8th day of February, 2011. EXECUTIVE SESSION None COMMENTS BY COMMISSINERS Commissioner Lewis announced the District was awarded the Community Park District award from the St. Charles Chamber of Commerce, in reference to the park being created on the old Youth Home Property. Commissioner Hurlbut thanked Staff for all their help to the citizens of the County during the blizzard. Commissioner Frasz stated he attended the meeting up in Rutland in regards to the CWD with the residents and a representative of the DNR. The last three years the DNR has been culling deer watching for the disease which is spreading into Kane County; this is a controlled testing to get a sample of the deer in the area. The DNR stated they would take 40 deer and let the hunters take 30, with testing for CWD on all the deer. This will come back to committee after another meeting with the residents and the DNR. COMMENTS BY PRESIDENT. President Hoscheit commented that on the April ballot there will be the referendum for land acquisition. There have been a number of meetings already with more to come. At a recent meeting in Dundee Township the Brunner property was brought up as to what improvements were going to be done to the property and if the District was planning on mining the property. President Hoscheit stated that there would be no mining and presently no formal plans for improvements have been made, the residents of the area will be asked for help in the planning of the improvements, during the public hearing process that will take place prior to any work being done. 309

The Conservation Foundation has approximately 30-40 volunteers fund raising and going to public meetings around the County taking to citizens in regards to the referendum. Numerous meetings have been set up, any Commissioner wishing to participate please contact him. REPORTS President Hoscheit called for a motion to place the Department Reports on file. -Motion by Commissioner Ford, seconded by Commissioner Kenyon, to place Department Reports on file; motion carried.
