PUBLIC COMMENT: None. MINUTES: The minutes of October 7, 2009 were pre read and approved by motion of Sharon Hamm, 2 nd by Mike Spangler, motion carried. EXPENDITURES & RECEIPTS: Expenditures dated October 16, 23 & 30, 2009 and receipts were reviewed and approved by motion of Sharon Hamm, 2 nd by Mike Spangler, motion carried. OFFICE ADMINISTRATOR: The office will be closed the day after Thanksgiving since the Secretary and Zoning Officer will not be here. The deadline for giving us letters of interest for the Zoning Hearing Board and Recreation Board was today. Will discuss the trash hauler contracts later in the meeting. ROAD DEPARTMENT: Business as usual. ZONING OFFICER REPORT: The Cleveland Motel has most of the grass cut, so I am going to cancel the hearing. Noticed people living at the motel. Sent them a notice that no certificate of non conformity can be issued. They have appealed this determination. All junkyard inspections are completed so I recommend approval of permits to: Lloyd Gastley, CSR, Joe Flynn, Tom Aughenbaugh, Frank Thomas, J.K.L.M., Ray Sibert, Tom Sibert, Jerry Klocker, Jim Ortman, Nevin Riley, and Allan Conaway. Mike Spangler moved to approve the junkyard licenses, 2 nd by Sharon Hamm, motion carried.
Page 885 Someone got a permit from a third party inspector before they got our permit. I informed them they must obtain a land use permit from the township. RECREATION BOARD: Got the mower seat. Mower has been cleaned. Jiffy johns have been removed. Contacted the company in regards to the play station being extended and the trees that we had in mind. They told me that one tree should not be planted to extend the play station. Signage should be put up that says, No Trespassing after 10:00 p.m. Violators will be Prosecuted. OLD/NEW BUSINESS: Sharon Hamm moved to approve the Ag Security 7 Year Reviews, 2 nd by Mike Spangler, motion carried. Sharon Hamm moved to authorize advertisement for the 2010 Budget on November 12, 2009 with the intent to adopt at the December meeting, 2 nd by Mike Spangler, motion carried. Wally Davis explained that at the public hearing there were a couple of issues with regard to the proposed zoning amendments. Access ways to shopping centers, which will be kept at 2 for more than 25 acres and size of expanding a non conforming use will be 20% across the township. People are of the belief that this would shut down the Shining Stars program and it could not be expanded. In this proposal, this use is permitted by right. Shining Stars is already there and can remain there. Frank Thomas commented about no outdoor storage permitted in the Historic Overlay, on street parking and no parking on alley ways. Wanted to know why the Supervisors do not want a right in/right out at a shopping center. There is a right in/right out at Sheetz. Marvin Stanley (Freedom Valley) questioned the 20% limitation. The 50% allows us to do the expansion we are working on right now. We were told before the 20% was a typo. Wally Davis stated it was not a typo. Dean Plank (Freedom Valley) stated the letter they initially sent the township requesting that churches be permitted in the EC 1 District, no one ever responded. Wally Davis stated you didn t ask for a response. Mr. Plank presented a pamphlet of what they want to do at Freedom Valley and that they need the 50%. Wally Davis stated if they want to go to 50% there could be a different standard for the EC 1 District or they could get a variance to build larger.
Page 886 Troy Martin stated we worked on this a long time. We put more teeth in it. It will help the Planning Commission and Zoning Hearing Board. Brandy Craig (Shining Stars) stated she has seen this program working so well in other communities. The church has helped us keep cost down. We normally charge $12.00, if they can t afford it, we don t charge. Henry Heiser representing Freedom Valley stated maybe there needs to be more dialogue. Is there any way we can set up a meeting to discuss this. Wally Davis explained what Mr. Plank had just discussed with the Board and that we already have language from Bob McQuaide requesting churches be permitted in the EC 1 District. Dusan Bratic wanted to know what the township had against a right in/right out for a shopping center. The Board was satisfied with the proposed zoning ordinance amendment pertaining to access to a shopping center. Sharon Hamm moved to adopt the Zoning Ordinance amendments (Ordinance# 2009 04), 2 nd by Mike Spangler. Mike Spangler stated we need to get this adopted tonight and can work with the church. Troy Martin stated we are willing to work with the church. Sharon Hamm stated we need to move forward so we can update our SALDO, motion carried. AN ORDINANCE PROVIDING FOR THE SUPERVISION AND REGULATION OF ALL WELLS OR BOREHOLES WHICH MAY BE CONSTRUCTED FOR OBTAINING OR ACCESSING WATER FOR DOMESTIC AND OTHER PURPOSES IN STRABAN TOWNSHIP, ADAMS COUNTY, PENNSYLVANIA. LAND USE REVIEWS: Sharon Hamm moved to grant the Historic Preserve an extension until 2/3/10, 2 nd by Mike Spangler, motion carried. PUBLIC COMMENT: Frank Thomas stated a bill has passed where you can obtain grants for rehabilitation on residential structures. If you go across the road from Freedom Valley and look at their site, they come out as a plus. Tom Flynn inquired about sign regulations.
