DATE: September 12, 2016 TO: FROM: Mayor and Commissioners Reid Silverboard, City Manager SUBJECT: Motion on Serving Alcoholic Beverages on Sunday As you know, the issue of supporting the City of St. Petersburg request to the County Commission to amend the Sunday sale of alcoholic beverages law to be consistent with the hours of other days of the week was brought to the Mayor s Council. After discussing the item, the Council concluded the best approach was to have each City s Council or Commission discuss the issue and obtain a determination of what was best for their city. In unincorporated areas of Pinellas County, packaged alcoholic beverages may be sold between 11:00 AM and midnight on Sunday; and between 8:00 AM and Midnight, Monday through Saturday. Alcoholic beverages may be served in bars and restaurants between 11:00 AM and 3 AM on Sunday, and between 8:00 AM and 3:00 AM, Monday through Saturday. The City of Treasure Island Code of Ordinances Chapter 3 Alcoholic Beverages, Section 3-34 Closing Hours provides that all business establishments, whether public or private, in the city dealing in alcoholic beverages shall remain closed from the hours of 2:00 AM to 8:00 AM on each day of the week except Sunday. On Sunday such establishments shall remain closed from 2:00 AM to 10:00 AM. This item has been placed on the Agenda after having been workshopped at the September 6, 2016 meeting. If the Commission is in favor of increasing the time for the sale of alcoholic beverages, it should direct the staff by motion to draft the appropriate Ordinance to amend Chapter 3 consistent with the hours it desires. Further, the Commission by motion can direct that a letter be sent to the Pinellas County Commission supporting the change in hours for sale of alcoholic beverages in stores and restaurants and bars from 8 AM to 3 AM seven days a week. Thursday April 14, 2016 Charlie Justice, Chairman Pinellas County Board of County Commissioners 315 Court St. Clearwater, FL 33756 Dear Chair Justice: Earlier this year, I contacted County Administrator Mark Woodard to discuss the County s repealing of the prohibition of sales of alcoholic beverages before 11 a.m. on Sundays. Sec. 6-29. - Closing hours. (b) All such business establishments shall remain closed on each Sunday from the hours of 3:00 a.m. to 11:00 a.m., unless any municipality in Pinellas County establishes shorter opening hours as provided in section 6-31 of this article. Administrator Woodard requested that I bring the issue to the Pinellas County Mayors Council to allow the Mayors of the municipalities within the County to weigh in on this issue. As such, I first brought up the issue at the February meeting and again at the March meeting, during which thorough discussion of the pros and cons took place. While no opposition to the repeal was voiced at either meeting, it was requested that the mayors survey their city councils to identify any concerns that might be expressed. At our recent April meeting, I requested the Council send a letter to the County Commission reporting on our desire to move forward. In response to that request, a couple of mayors said that they had not yet brought it up with their councils, and the Mayor of Seminole voiced her opposition to the repeal. Because each Mayor had not yet discussed the issue with their councils, no formal vote to send a letter to the Commission was taken. Instead, it was agreed that each city would notify the County Commission individually of its desire to move forward with the repeal of the Sunday morning prohibition. Please be advised that I have discussed this with St. Petersburg City Council members and on their behalf, as well as that of the business owners in our city affected by this restriction and our citizens, ask that the County Commission amend its ordinance to allow for alcohol sales at 8 a.m. on Sundays.
