Bennett, Assistant City Engineer DATE: September 8, 2016 RE: O Brien Drive Street Name Change Action Requested Approval of the attached ordinance entitled AN ORDINANCE NAMING A STREET, AVENUE, ALLEY, OR OTHER PUBLIC PLACE (Changing O Brien Drive to Napleton Way ). Background and Facts The Westmont-based Napleton Automotive Group purchased the O'Brien Auto Park on September 15, 2015. The Napleton Automotive Group has contacted the Public Works Department regarding changing the street name of O Brien Drive to Napleton Way. (Please see Exhibit A.) Public Works Department staff have reached out to utilities, units of local government, and City Department heads regarding the proposed street name change. The only objection was from AT&T, which was later withdrawn. The only mailing addresses on the street are Napleton s Auto Park properties. There are also an AT&T utility cabinet and several vacant lots. The location of the proposed street name change is shown in Exhibit B. Financial Impact The impacts to renaming O Brien Drive to Napleton Way involve the removal and replacement of street name signs and the installation of new street name signs. This cost is estimated to be less than twelve hundred dollars ($1,200.00). The Napleton Automotive Group will reimburse the City for the costs of removing and replacing the street name signs. Recommendations It is recommended that the City Council approve the attached ordinance entitled, AN ORDINANCE NAMING A STREET, AVENUE, ALLEY, OR OTHER PUBLIC PLACE (Changing O Brien Drive to Napleton Way ). ORDINANCE NO. 2016-09-081 AN ORDINANCE NAMING A STREET, AVENUE, ALLEY, OR OTHER PUBLIC PLACE (Changing O Brien Drive to Napleton Way ) WHEREAS, Section 11-80-19 of the Illinois Municipal Code (65 ILCS 5/11-80-19) provides that the corporate authorities of each municipality may name originally and then change the name of any street, avenue, alley, or other public place; and WHEREAS, the City of Urbana ( City ) heretofore originally named a certain street O Brien Drive, said street intersecting North Cunningham Avenue between Interstate 74 and Airport Road; and WHEREAS, a portion of O Brien Drive is adjacent to a complex of commercial retail automobile stores formerly known as O'Brien Auto Park; and WHEREAS, on September 15, 2015, EFN Urbana Properties, LLC, purchased and began operating the former O'Brien Auto Park as part of the Ed Napleton Automotive Group; and WHEREAS, the Ed Napleton Automotive Group has changed the name of O'Brien Auto Park to Napleton Auto Park; and WHEREAS, the Ed Napleton Automotive Group has asked the City to change the name of O Brien Drive to Napleton Way ; and WHEREAS, the corporate authorities desire to rename O Brien Drive to recognize the change in ownership of Napleton Auto Park; and WHEREAS, no dwellings or commercial establishments, other than Napleton Auto Park, use an O Brien Drive street address in the City; and WHEREAS, the corporate authorities, after due consideration, find that the best interests of the City are served by changing the name of O Brien Drive to Napleton Way ; and WHEREAS, in accordance with Section 11-80-19, no change in the name of any street, avenue, alley or other public place is effective until 30 days after the corporate authorities give notice of such change to the election authorities having jurisdiction in the area in which the name of the public place is changed and the post office branch serving that area. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Urbana, Champaign County, Illinois, as follows: Section 1. The street originally named O Brien Drive be and is hereby renamed Napleton Way. Section 2. The appropriate records of the City, including all maps which are Napleton Way / 1

part of the City s 2005 Comprehensive Plan, shall be adjusted accordingly to reflect the name change. Section 3. The proper officers, employees, and agents of the City are hereby authorized, empowered, and directed to do all such acts and things and to execute and deliver all documents and instruments as may be necessary to carry out the intent and accomplish the purposes of this Ordinance in accordance with its terms. Section 4. This Ordinance shall not be construed to affect any suit or proceeding pending in any court, or any rights acquired, or a liability incurred, or any cause or causes of action acquired or existing prior to the effective date of this Ordinance; nor shall any right or remedy of any character be lost, impaired, or affected by this Ordinance. Section 5. Upon approval of this Ordinance, the City Clerk is directed to send a certified copy of this Ordinance, by registered or certified mail, to the Champaign County Clerk and to the post office branch serving the area in which the name of the public place is changed. This Ordinance shall be in full force and effect thirty (30) days from and after the City Clerk notifies the appropriate election authorities and post office branch, in accordance with Section 11-80-19 of the Illinois Municipal Code. This Ordinance is hereby passed by the affirmative vote, the ayes and nays being called, of a majority of the corporate authorities (5 of 8 votes) of the City of Urbana, Illinois, at a meeting of said corporate authorities.
