1776 CITY OF MOYIE SPRINGS Regular Meeting October 3rd, 2018 City Council met in Regular Session October 3rd, 2018 at 7:00 PM The regular meeting on October 3rd was called to order by Mayor Chad Farrens at 7:00 PM. Present were Council members Steve Economu, Geoff Hollenbeck, Terry Johnson, Tim Narvaez, Public Works Supervisor - John Nelson, Fire Chief - Ken English, City Clerk/Treasurer - Donna Wilson-Funkhouser, and City Attorney - Dan Featherston. Signed in: The meeting attendance also included the following Nancy Mabile from PAC, Jim Ball, Craig and Diane Charter, Bill Mutter, Tom & Marie McCurry, Rosanne Smith, and Dennis Weed from EDC. Open Meeting with the Pledge of Allegiance: Prior Minutes September 5th, 2018 Meeting Minutes: Mayor Chad Farrens asked for the Council s comments or questions on the September 5th regular meeting minutes. A motion was made by Steve Economu and seconded by Terry Johnson to approve the minutes as written from September 2018. Motion carried. Prior Minutes September 26th, 2018 Meeting Minutes: Postponed till November 7 th meeting. Approve Current Financials: Mayor Chad Farrens asked for the review of the current financials from September 2018. Mayor Chad Farrens went through each department funds. He asked if there any questions or comments. Mayor Chad Farrens then entertained a motion to accept the current financials. A motion was made by Steve Economu and seconded by Terry Johnson to approve the current September financials. Motion carried. PAC Nancy Mabile Grant Income Survey - Update: Mayor Chad Farrens addressed Nancy Mabile from Panhandle Area Council (PAC). Nancy Mabile explained what she had been working on for the City: the required income survey to apply for block grants for a fire station and emergency facility. She explained that the grant application needed to be completed within five weeks and that she recommended since the income survey was not complete that the Council consider working on the income survey and apply at a later date for the grant monies. She said that when the income survey was completed that it was good for five years. She supplied a handout of the progress of the income survey. The Council agreed with her recommendation. Mayor Chad Farrens thanked Nancy Mabile for the update. Charter 185 Wells Street Split Parcel into two lots Water Supply: Mayor Chad Farrens addressed the Charters. Steve Economu updated the Council on the discussions on the parcel split request and the ability to supply water due to the water line upgrades needed. Diane Charter had given the Council documentation of what the split would consist of. The Charters would like to split into one 2 acre lot and one 3 acre lot. Steve Economu explained that one
1777 additional hook on would not necessarily cause a burden for the water supply, but any further potential development or lot splits would force the need for the waterline to be upgraded to a 8 line. John Nelson said that the waterline is a 4 water line that ties into an 8 waterline. He said it would require an upgrade of an 8 line from the start of Wells Street. Tim Narvaez said that when a previous request for multiple lots split to that land parcel was enquired about the Council had required the upgrade to the waterline. Tim Narvaez asked if there was a survey that was used to determine the need for the waterline upgrade. John Nelson said that there was not an engineer study done, but the number of users on the line caused the concerns. John Nelson said that the waterline looped there and the waterline was supplied from both ends. Ken English said that if there was further development, it would require an additional fire hydrant and that waterline would have to be upgraded to the 8 waterline. Jim Ball said he had done some figuring and that he did not think that the water velocity would be an issue. Mayor Chad Farrens said he thought that the Council could put the stipulation on the property that it would not be able to be further developed without the upgrade. Steve Economu asked Dan Featherston if legally the Council could put stipulations on the land split. Dan Featherston said that there could be stipulations set. The Council discussed any future development and the required waterline upgrades. Tim Narvaez asked if the City required ¾ acre lots in the City, are they also required to supply water to those ¾ acre lots. Mayor Chad Farrens said that the property owner had to pay the expenses for waterline expansions. Mayor Chad Farrens asked for the Council decision. The Council agreed that one additional water hook on was acceptable on the waterline. Tim Narvaez said that there is one additional water hook on available on the waterline on Wells Street and it will be first come first served. Diane Charter asked if there was a timeline for the water hook on purchase. Steve Economu said that the Council could agree to the land split, but could not guarantee the water hook on without the waterline upgrade. He said that there is one water hook on available on Wells Street without the upgrade, but the Council cannot hold that hook on for the Charter s. Tim Narvaez said that the drawing were unacceptable to be signed off. Diane Charter said she would present a drawing of their proposed plans and make sure that the land split was allowable before they spent the money to get the land surveyed and a plat map. Mayor Chad Farrens said that they could proceed with getting the property surveyed and a plat map to present to the Council for approval. 2103 Roosevelt Bill Mutter Zoning Variance Fence Stipulation: Mayor Chad Farrens addressed Bill Mutter. Mayor Chad Farrens asked Bill Mutter if he had started the fence that the Council had required to allow the zoning variance for his business. Bill Mutter explained his progress and hold ups on building the fence. Steve Economu said that the Council needs to have the fence completed to allow the zoning variance, as the Council has received additional complaints regarding his business. Bill Mutter asked if he could have a month to finish the fence. Steve Economu said that he thought that he could have till the next regular Council meeting in November to have the fence completed. Mayor Chad Farrens asked the Council if there were any other comments. Tim Narvaez agreed that the fence needed to be finished and that the next meeting would give him a month to complete the work. 1778 Bill Mutter that the next meeting would be on November 7 th at 7:00 PM and that he should finish the fence by that date. Jim Ball 2590 Roosevelt Road Subdivision: Mayor Chad Farrens addressed Jim Ball and his request to subdivide property at 2590 Roosevelt Road. Jim Ball presented handouts regarding his intentions for splitting the property at 2590 Roosevelt Road. He explained his plans for development into four lots. Jim Ball asked if the will serve for water without any upgrades was allowable. John Nelson said that there would be adequate water hook ons available for that area. The Council discussed the land splits. The question of the need for a public hearing was discussed. The Council thought Jim Ball could proceed with the necessary surveys and plat map to be considered for approval to split the land. Private Drives Miley Court / Jaden Court City Streets Requirements Upgrades: Mayor Chad Farrens asked what the private streets would need to be considered for public city streets. Steve Economu asked if they needed to meet City specs. Terry Johnson said that they would have to meet the City s requirement for street and road standards. John Nelson said that Dave Volking questioned the requirements for the new homeowners on those streets. John Nelson said that the streets would need to be compacted and did not meet the width requirement. Tom McCurry said that Dave Volking had mentioned bringing the street up to City specs. He said that the current road access was 30 and would require a 60 road easement to be considered for City public streets. Tom McCurry said that he was okay with the private street and was not willing to give up the additional 30 of land for easement. He said that he did not think that it was necessary and that the original plan with waterlines and utilities complicated any further width requirements for a city public street. Street Access Elk Road Rosanne Smith: Mayor Chad Farrens addressed Rosanne Smith and her concerns with the road access for the RV parking on Elk Road. Rosanne Smith said that her neighbor had questioned the access for the RV that was allowed on Elk Road. The Council discussed that there was a road access permit for allowing access to City streets. Tom McCurry questioned when the need would be to get a permit to access city streets. The Council confirmed the need and requirement for road and street access permits and approval. Update Camp Trailers Violations: Mayor Chad Farrens proceeded to the issue of the camp trailer of Baker s on Westwood that was still in violation of usage as a residence. Dan Featherston had previously sent a letter advising of the violation and gave 60 days for the removal of the camp trailer as part of his residence. John Nelson had a picture of the camp trailer as currently being used. Dan Featherston explained the next legal steps needed to proceed in regards to the violation. Mayor Chad Farrens entertained a motion to begin the legal process. A motion was made by Terry Johnson and seconded by Steve Economu to move forward and have Dan Featherston proceed with legal action regarding the violation. Motion carried. Questioned Burn Permits: Mayor Chad Farrens asked if there was a need for burn permits. Steve Economu said that there had been a fire on Moyie Street by Jim Ball that the fire
1779 department had been called out on twice on the same day that had been left unattended. Jim Ball publicly apologized for the incident. Steve Economu said that he felt that the City should require burn permits when it is a closed burn season for the County. He said this is a serious matter when someone starts a fire and causes a serious outcome. He said that the City needs to have a burn permit to burn outside of the County s set burn season. Steve Economu said that the City currently allows burning when requested outside of the burn season depending on the conditions. Ken English said that most people don t even ask for permission. Steve Economu said that the City needs to make a City Ordinance to require burn permits when burning out of the County s burn season. The Council discussed the need. Dan Featherston said that he would generate an Ordinance to present to the Council for the next regular meeting for the consideration of adoption. Dennis Weed EDC: Playground Update: Dennis Weed said that the land lease agreement had been on the agenda of the Council of the City of Bonners Ferry. He had the LOI (letter of intent) from the City, but needed to have the CCR committee of the Moyie River Estates signed letter of approval of the playground. They have moved it to the next City of Bonners Ferry Council meeting agenda and requested that the Mayor of Moyie Springs attend. The main concerns of the City Council of Bonners Ferry were the fence for safety and sex offenders living in the area. They questioned the potential risk. Dennis Weed said that their next council meeting would be on October 16 th at 6:00 PM. Idaho State Code Manuals - Updated: Mayor Chad Farrens asked about the Idaho Code Manuals. Attorney Dan Featherston said that the expense would be about $550.00 to update the current Idaho State Code Manuals that Dan Featherston had donated to the City for legal reference. The Council discussed the usage of the books and the availability of the Idaho Codes online. Dan Featherston prefers the hard copy for a legal reference. Dan Featherston said he could use his books at their office. Volunteer Fire Dept. Report: Ken English reported that the new fire department garage door had been installed. He also said there would be classes to update the volunteer firemen s first aid cards and he would get more information on the classes. Ken English reported the following incidents from September 2018: September 7th Ambulance Assist at 75 West Railroad Street; September 10th Ambulance Assist at 2175 Roosevelt Road; September 10 th - Ambulance Assist at 75 West Railroad Street; September 11 th Ambulance Assist at 75 West Railroad Street; September 14 th Ambulance Assist at 157 Canyon View; September 22nd - Fire Moyie Street; and again September 22nd Fire Moyie Street. Water & Sewer Report: John Nelson reported on the water for the month of September 2018 - Total pumped for September 2018-6,503,300 gallons. High day was the 12th 308,400 gallons - Low was the 18th 159,700 gallons the average was 216,776 gallons for September.
1780 John Nelson said that the new water meter for the IFG mill had arrived. He said that he will meet with Dennis Warner from IFG Mill to schedule a time and date for the meter installation. John Nelson said that there had been a Sanitary Survey. He said the system had 6 deficiencies. He had to prepare a plan of correction. He said that most of the items were minor things. He said that there was a flag on the water tank to repair a seal and replace a couple of steel pipes stands. John Nelson explained a few other minor repairs required. He said that he needed to purchase a chlorine gas detector to replace the current one for around $2000.00. Mayor Chad Farrens entertained a motion to allow John Nelson to purchase the needed chlorine detector. A motion was made by Geoff Hollenbeck and seconded by Terry Johnson to purchase the needed chlorine gas detector. Motion carried. Misc Business: Steve Economu questioned the roads and getting coal mix for the repairs. John Nelson said he had a plan to go get a load of the coal mix from Interstate. Executive Session: None Discuss & Pay Bills: Mayor Chad Farrens entertained a motion to pay bills from September 2018. A motion to pay the bills was made by Steve Economu and seconded by Terry Johnson. Motion carried. Adjourn: Mayor Chad Farrens entertained a motion to adjourn.
