Supervisor Valentine asked if there were any comments. There were none. Supervisor Valentine explained that the ward system is expected to go into effect sometime after the 2020 census and the boundaries for 4 ward districts will be established by the Town Board. ADOPT LOCAL LAW NO. 6 OF 2018 ADDING CHAPTER 94, ENTITLED WARD SYSTEM, AND PROVIDING FOR THE ESTAB LISHMENT OF WARD DISTRICT BOUNDARIES, TO THE TOWN CODE OF THE TOWN OF CHESTER Be it enacted by the Town of Chester in the County of Orange, as follows: Section 1. Title This Local Law shall be referred to as "A Local Law Adding Chapter 94, Entitled Ward System, and Providing for the Establishment of Ward District Boundaries, to the Town Code of the Town of Chester. Section 2. Legislative Intent The Town of Chester has determined that it is in the best interest of the Town to create a new chapter of the Town Code of the Town of Chester to provide for the establishment of the ward system, the creation and fixing of ward district boundaries, and the election thereafter of one councilman from each ward. Section 3. Authority It is the intention of the Town Board of the Town of Chester to exercise its authority pursuant to Town Law 85 and the Municipal Home Rule Law 10(1)(ii)(d)(3), which grant local governments the authority to adopt or amend local laws relating to the property, affairs or government of the Town which are not inconsistent with the provisions of the New York State Constitution or not inconsistent with any general law. Section 4. Ward System Chapter 94 entitled Ward System is hereby added to the Town Code of the Town of Chester, to read as follows: 94-1. Creation of Wards. A. Whenever a proposition shall have been adopted in the Town for the establishment of the ward system and the election thereafter of one Councilman from each ward, the Town Board shall divide the Town into four wards and fix the boundaries thereof, unless a proposition shall have been adopted to increase the number of councilmen from four to six, in which instance, the Town Board shall divide the Town into six wards and fix the boundaries thereof. B. The division of the ward districts shall be made so that the number of inhabitants of each ward, based upon the last regular federal census, shall be substantially equal, with the wards composed of convenient and contiguous territory in as compact form as practicable. No election district heretofore or hereinafter created under the Election law shall contain parts of two or more wards. C. The Town Board shall make appropriate revisions of the boundaries of the wards so that they shall contain a substantially equal number of inhabitants not later than six months after the publication of the results of a regular federal census which indicated that the districts do not contain a substantially equal

number of inhabitants. D. When the Town Board shall have finally determined the boundaries of the wards, it shall cause a map of the Town to be prepared, which shows, in detail, the location of each ward and the boundaries thereof. The original map so made shall be filed in the office of the Town Clerk and copies thereof shall be filed in the offices of the County Clerk and the Board of Elections of Orange County. The ward system shall be deemed established after such filing is complete. E. After the initial establishment of the ward district boundaries, the Town Board shall have the authority to modify those boundaries in accordance with the provisions of applicable law. Section 5. Severability. If any clause, sentence, paragraph, subdivision, or part of this Local Law or the application thereof to any person, firm or corporation, or circumstance, shall be adjusted by any court of competent jurisdiction to be invalid or unconstitutional, such order or judgment shall not affect, impair, or invalidate the remainder thereof, but shall be confined in its operation to the clause, sentence, paragraph, subdivision, or part of this Local Law or in its application to the person, individual, firm or corporation or circumstance, directly involved in the controversy in which such judgment or order shall be rendered. Section 6. Effective date. This local law shall take effect immediately upon filing with the Secretary of State. REORGANIZATION MEETING ON A MOTION BY Councilwoman Smith and second by Councilman Wensley to set the Reorganization Meeting on January 9, 2019 at 7:00pm at the Chester Town Hall, 1786 Kings Highway, Chester, New York and direct Town Clerk Zappala to cause to publish same. MEETING CANCELLATION ON A MOTION BY Councilman Wensley and second by Councilwoman Smith to cancel the Town Board Meeting scheduled on December 26, 2018 and direct Town Clerk Zappala to cause to publish same. COMMUNITY PRESERVATION PLAN Supervisor Valentine introduced the latest version of the Community Preservation Plan, dated November 14, 2018 and read its preface which follows: The Town of Chester has long recognized that community planning is an ongoing process. In 2015, the Town Board adopted a Comprehensive Plan, which was an update of its 2003 Comprehensive Plan. The 2015 Comprehensive Plan recommended additional actions, plans and detailed studies to pursue the recommendations of the Comprehensive Plan. Among these were additional measures to protect natural resources, agricultural resources and open space. In September 2017, the Town Board appointed a Community Preservation Plan Committee (CPPC) to undertake the creation of the Town s first Community Preservation Plan. This Community Preservation Plan is not a new departure rather it incorporates and builds upon the recommendations of the Town s adopted 2015 Comprehensive Plan and its existing land use regulations. Supervisor Valentine announced that the Community Preservation Plan is available at the Town Clerk s Office and online and the Town s website, chester-ny.gov. He acknowledged Consultant, Alan J. INTRODUCTORY LOCAL LAW NO. OF 2018 A LOCAL LAW AMENDING CHAPTER 42 ENTITLED DOGS OF THE TOWN CODE OF THE TOWN OF CHESTER Be it enacted by the Town of Chester in the County of Orange, as follows: SECTION 1. Title

This Local Law shall be referred to as "A Local Law Amending Chapter 42, entitled Dogs, of the Town Code of Chester. SECTION 2: Purpose and Intent It is the purpose of this Local Law to amend Chapter 42, entitled Dogs, of the Town Code of the Town of Chester, as it relates to penalties for late renewals of dog licenses. SECTION 3: Add Subsection E to 42-8, entitled Dog licensing requirements and procedures, to read as follows: E. Renewals. For owners who fail to renew a dog license, the Town Clerk shall mail a late renewal fee invoice and warning the failure to renew the license within the requisite time frame has resulted in the issuance of a late penalty. The penalty for failure to renew a dog license which has expired shall be $5.00. This $5.00 late renewal penalty shall be in addition to the base fee for any such license renewal. SECTION 4: Severability Clause If any section or subsection, paragraph, clause, phrase or provision of this local law shall be adjudged invalid for any reason or shall be deleted or subsequently repealed, the same shall not affect the validity of this local law as a whole or any part or provision herein other than the part as adjudged to be invalid and/or deleted and/or subsequently repealed. The determination by any court of competent jurisdiction that any provisions of the within local law as unenforceable, invalid, void, unconstitutional or in conflict with federal or state law shall not in any way affect the enforceability or validity of any other provision contained herein. SECTION 5: Effective Date This local law shall take effect immediately upon posting and filing with the New York State Department of State. Supervisor Valentine explained this amendment would set a late fee in the amount of $5 for delinquent renewals. DIGITIZATION OF BUILDING DEPARTMENT RECORDS ON A MOTION BY Councilwoman Smith and second by Councilman Wensley to approve the digitization by NYSID of additional records of the Building Department up to $22,500.00 From the 2019 budget funds. RAISE APPROPRIATIONS ON A MOTION BY Councilman Wensley and second by Councilwoman Smith to raise appropriation A1620.2 in the General Fund from the Unassigned Fund Balance in the amount of $42,000 for the Police Department building renovation project. ON A MOTION BY Councilwoman Smith and second by Councilman Wensley to raise appropriation B1620.4 in the Part Town Fund from the Unassigned Fund Balance in the amount of $27,000 for the Senior Center building project. ON A MOTION BY Councilman Wensley and second by Councilwoman Smith to borrow $13,000 from the General Fund to Sewer District 5 for the payment of 2017-2018 chargebacks to the County of Orange. AUTHORIZATION OF 3 RD PARTY AGREEMENT MELLON BANK (STERLING) Supervisor Valentine read the request from Bookkeeper Conklin to authorize the 3 rd party agreement with Mellon Bank. Now that Sterling has acquired Mellon Bank, M&T can no longer be our 3 rd party custodian. ON A MOTION BY Councilwoman Smith and second by Councilman Wensley to authorize the Supervisor to sign the 3 rd Party Agreement with Mellon Bank (Sterling). SENIOR CENTER RECREATION GRANT Engineer Fusco explained that the Town is eligible to receive funds through the state municipal grant program, DASNY (SAM grant). He explained the requirement for the following resolutions to be adopted to accompany the application. ON A MOTION BY Councilman Wensley and second by Councilwoman Smith to adopt the following Resolution: TOWN OF CHESTER LEAD AGENCY RESOLUTION SENIOR CITIZENS CENTER RECREATION PARK At the meeting of the Town Board of the Town of Chester, held on December 12, 2018, the following resolution was introduced: WHEREAS, the Town of Chester, New York Town Board reviewed the file and determined to be lead agency as required by SEQR (6NYCRR Part 617) for Name of Action: Location: Senior Citizens Recreation Park Senior Citizens Center

Project: Action: Recreation Park Type II WHEREAS, the Town Board of the Town of Chester has applied for $150,000 for a Senior Citizens Center Recreation Park from the State and Municipal Facilities (SAM) program, Project #9371; and WHEREAS, The Town Board, as Lead Agency under SEQRA and identified the project as a Type II action; and WHEREAS, the DASNY Grant Administrator has project documents and contracts that need execution by the Town of Chester. BE IT RESOLVED, that the Town Board of the Town of Chester hereby authorizes the Supervisor, Robert Valentine; Deputy Supervisor, Cynthia Smith; and Town Attorney, Scott Bonacic, to sign any and all documents required for this project. ON A MOTION BY Councilwoman Smith and second by Councilman Wensley to adopt the following Resolution: TOWN OF CHESTER RESOLUTION STATE ENVIRONMENTAL QUALITY REVIEW FOR SENIOR CITIZENS CENTER RECREATION PARK WHEREAS, the Town of Chester has applied for funding from the State and Municipal Facilities Program (SAM); and WHEREAS, DASNY is the New York State Administrating Agency; and WHEREAS, the Town has reviewed the SEAF prepared for the project; and WHEREAS, the Town Board intends to be Lead Agency; and NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Chester has declared itself to be Lead Agency; and FURTHER RESOLVED, the Town Board has taken and determined that the application process to Type II action in accordance with 617.5 Type II Action as a non-residential addition under 4,000 square feet. AUTHORIZATION TO SIGN GRANT DOCUMENTS ON A MOTION BY Councilwoman Smith and second by Councilwoman Smith to approve and authorize the required signatures of the Supervisor, Deputy Supervisor and Town Attorney to the supportive documents to the grant application.

MS4 EAGLECREST Supervisor Valentine read the request received from the Engineer. Mr. Fusco advised that the Notice of Termination for Eaglecrest and since everything is stabilized, the Highway Superintendent and he advised to close out the SWPPP. ON A MOTION BY Councilman Wensley and second by Councilwoman Smith to authorize the Supervisor to sign the Notice of Termination under the MS4 for the Eaglecrest Subdivision. AGREEMENT FOR SEWER HOOKUP JENACK PROPERTY Supervisor Valentine advised the Board that Tin Barn Brewing provided Jenack s authorization to proceed with the Planning Board and in this regard requests sewer hookup. It was the consensus of the Town Board to direct the Town Attorney to draw up an agreement for an outside user and include back debt service and any hookup expense relative to the matter. ZONING MAP CORRECTION Attorney Bonacic explained that sbl 6-1-71 has always been in the IP Zone and through a map error had been inadvertently placed in the AR3 District. He said this error can be corrected by resolution. ON A MOTION BY Councilwoman Smith and second by Councilman Wensley to direct Engineer Fusco to correct the zoning map to show sbl 6-1-71 in the IP Zone. APPROVAL OF TAX RECEIVER BOND ON A MOTION BY Councilwoman Smith and second by Councilman Wensley to approve the Tax Receiver Bond to be filed with Orange County and authorize the Town Supervisor, Town Board and Town Clerk to sign same. COVIELLO PROPERTY PURCHASE Supervisor Valentine explained that the Coviello property on Poplar Drive is situated in the middle of Town owned property and the purchase of it would allow for water exploration and the development of wells and water infrastructure for the Walton Lake Water District. ON A MOTION BY Councilwoman Smith and second by Councilman Wensley to sign a purchase agreement, subject to attorney approval, for the Coviello property by the Walton Lake Water District in the amount of $60,000. POLICE DEPARTMENT SURPLUS OFFICE FURNITURE AND EQUIPMENT Supervisor Valentine said a walk-through of the old Police Department space for the anticipated renovation of space for various Town uses has uncovered used desks, lockers and miscellaneous office equipment that may offer no further purpose. ON A MOTION BY Councilwoman Smith and second by Councilwoman Smith to declare the office equipment in the old Police Department space surplus, to be repurposed and/or scrapped.

POLICE DEPARTMENT SURPLUS POLICE VEHICLES Supervisor Valentine read the request from Chief Doellinger for permission to sell three surplus police vehicles. ON A MOTION BY Councilwoman Smith and second by Councilman Wensley to approve the following surplus: 2014 Ford Police Interceptor sedan bearing VIN 1FAHP2MK5EG100878 This vehicle has over 110,000 miles on it and was replaced in 2017. 2014 Ford Police Interceptor sedan bearing VIN 1FAHP2MK3EG100877 This vehicle has over 125,000 miles on it and was replaced in 2017. 2014 Ford Police Interceptor utility with VIN 1FM5K8AR9EGC60841 This vehicle has over 124,000 miles on it and was replaced in 2018. IMA FOR 2018/2019 CRACKDOWN CAMPAIGN OVERTIME STOP-DWI PROGRAM ON A MOTION BY Councilwoman Smith and seconded by Councilman Wensley the following resolution was offered. BE IT RESOLVED, that Robert Valentine, Supervisor of the Town of Chester, New York, is hereby authorized and directed to execute the Orange County IMA for 2018/2019 Crackdown Campaign Overtime STOP-DWI Program for the period October 1, 2018 through September 30, 2019, with an assignment of up to $1,600 to be used by the Town during the preset enforcement periods listed on Schedule A, reimbursable by the County of Orange. CREDIT CARD AGREEMENT GOVTPORTAL Supervisor Valentine advised of the Recreation Director s request to enter into an agreement with GovtPortal for the acceptance of credit cards, since they are integrated with the MyRec software currently in use by the Recreation Department. ON A MOTION BY Councilwoman Smith and second by Councilman Wensley to authorize the Supervisor to sign the credit card agreement with GovtPortal, subject to attorney review. Discussion: The fee of 3% to the cardholder may be reduced to match the 2.5% rate currently offered through the Town Clerk s office through another vendor. RECREATION POLICY AND FEE SCHEDULE A discussion ensued concerning a new policy and fee schedule as submitted by Recreation Director Streichert. The Board acknowledged the submission and will have further discussions concerning same. LIEN RELEASE NORTHEASTERN Supervisor Valentine advised the Board that we have received a lien release request from Northeastern for the Police building reconstruction project. After the punch list items were reviewed by the Engineer, there remains one window that needs replacement, for which the Chief said he was okay with. ON A MOTION BY Councilman Wensley and second by Councilwoman Smith to authorize the Supervisor to sign the lien release with Northeastern for the retainage on the Police Department reconstruction project.

WINDRIDGE CONDOMINIUM REQUEST FOR LIGHT Supervisor Valentine read the request from the Windridge Home Owners Association for a light to be placed on Lily Pond Road. Councilwoman Smith will look into the matter. SET INTERVIEWS FOR TOWN BOARD MEMBER Supervisor Valentine said the Town Board is actively seeking letters of interest for the position of Councilperson and is happy to report the receipt of 13 requests thus far. He said interviews would be scheduled sometime in the near future. POLICE DEPARTMENT HIRE AND PROMOTIONS ON A MOTION BY Councilman Wensley and second by Councilwoman Smith to approve Michael Dunlop as a new fulltime Police Officer, effective 12/27/2018. Town Clerk Zappala administered the Oath of Office to Officer Dunlop. ON A MOTION BY Councilwoman Smith and second by Councilman Wensley to approve the promotion of Police Officer Christopher D Agnese to Police Sergeant, effective 12/13/2018. Town Clerk Zappala administered the Oath of Office to Sergeant D Agnese. ON A MOTION BY Councilman Wensley and second by Councilwoman Smith to approve the promotion of Sergeant Lee Slaughter to Police Detective, effective 12/13/2018. Town Clerk Zappala administered the Oath of Office to Detective Slaughter. PERSONNEL REHIRE Supervisor Valentine read the request from employee, JoAnn Maraglino concerning her rehire upon her retirement, without having to pay into her pension benefits. ON A MOTION BY Councilwoman Smith and second by Councilman Wensley to rehire JoAnn Maraglino, upon her retirement on January 28, 2019. EDUCATION REQUESTS ON A MOTION BY Councilwoman Smith and second by Councilman Wensley to approve the attendance of Patricia Hechinger and Arlene Rittenhouse at the court clerk training of the Association of Towns Conference in New York City from February 17-20, 2019 at a conference cost of $125 and hotel cost of $249 p/night, p/person plus meal and mileage reimbursement. ON A MOTION BY Councilwoman Smith and second by Councilman Wensley to approve the attendance of Lori Streichert and Michele Deshler at CPR training on Thursday, December 13, 2018 at the Town of Chester Police Department.

ANNOUNCEMENTS Supervisor Valentine announced SunCommon s Call for Hudson Valley Artists and Community Groups for a $3,000 grant to create an artistic installation for their community solar farm in Chester, NY. The deadline is December 31, 2018 and more information and the application can be found at occitizensfoundation.org/initiatives/suncommon-grant/. Supervisor Valentine announced the following Recreation Department updates: With the New Year quickly approaching and the Chester Senior/Recreation calendar filling up rapidly, it is imperative that we implement fees for programs so that we stay within budget guidelines. Having reviewed the schedules and fees of other senior/recreation centers they fall within the following and feel we should implement such: Senior Residents: Senior Nonresidents: Residents: Nonresidents: $10/month $35/month $5.00/class $8.00/class The above rates would be for the yoga, Osteo, & chair yoga. Other classes will be up and running in approximately February and those fees will be in accordance with the cost of the class or project, i.e. Art (make and take crafts). At present the centers we have spoken with mainly do these during the day for seniors. Evening classes will be on a separate feel schedule and that will be per class or project. While this is new to all of us, we are trying to hear what the residents including seniors would like to see. They have spoken and we have heard so our calendar of events for the first quarter of 2019 has already been filled in with the yoga, chair and Osteo programs. Presently we are diligently working on line dance classes, art classes, and cooking classes and hope to have them filled in for February and Marah ASAP. While we would like very much to have these ready to roll in January we have been faced with finding instructors. With that being said we have reached out to other Senior/Rec centers to speak with them and see who they use for instructors; we have obtained some names and phone numbers and are presently reaching out to them. Additionally, I would like to institute the option of paying online with a credit card. An email was sent out with all the particulars to the Town attorney as well as all the board members. I have received the go ahead from the attorney and I am anxiously waiting for permission to move forward from the board. Basketball is underway. Coaches were notified and clinics began on December 1, 2018. Please call Kristin at 469-7000 ext. 336 for more information. On November 15, 2018 we showed the movie JUMANJI and had a nice group of seniors that braved the weather forecast and enjoyed the show. Everyone made it home safe and sound before Mother Nature dumped nearly a foot of snow on us. On November 15, 2018 I met with Tracy Schuh and Sona from the NYNJ Trail Conference to discuss the possibility of connecting Chester Commons Park with Goosepond Mountain State Park. We recently started a walking path and hope to connect the two so we can have the option of an easy walk or a more rigorous hike all from the Commons location. The Children s Holiday Party on Friday, November 30 at the Sugar Loaf Engine Company was a great success. Santa and his helpers did a fantastic job. A big thank you to Michele, Kristin, all the volunteers, and the members of the sugar Loaf engine company for all their help.

Supervisor Valentine announced Speak Up to Stand Up Against Hate funded by the Jewish Federation of Greater Orange County. Supervisor Valentine announced the Bellvale Community Christmas Carol Sing Along on December 14, 2018 at 6:30pm. Supervisor Valentine announced the Walton Engine and Hose Holiday Breakfast on December 16. TOWN BOARD COMMENTS Councilwoman Smith advised the Board of Nick Zungoli of Sugar Loaf s request to have installed speed bumps through the Hamlet due to the 5-ton truck limit and the speed thereof. Councilwoman Smith thanked Lydia Quadros for all her work organizing the quaint Sugar Loaf Festival with horse drawn carriages and caroling. She mentioned the impact on future garbage contracts due to the impending cost of recycling. Councilwoman Smith referred to the Building Inspectors response letter of November 30 th concerning the denial of building permits at the Greens of Chester, which follows: AREA LEFT INTENTIONALLY BLANK

She said the Building Department looks seriously at all applications. Councilwoman wished all a Merry Christmas. Supervisor Valentine wished all a Merry Christmas and a Happy Hanukkah. PUBLIC COMMENTS Frank Pileggi, 19 June Road, Chester congratulated the Town Board on the great job with the new Senior Center. He announced his toy Drive for Veterans and needy families. The drop off is at 19 June Road. He wished everyone a Happy New Year. He acknowledged Keller Williams for honoring him for their senior of the year award to be presented at Palacio s tomorrow night. Steve Keahon, 8 June Road, Chester thanked Michele Deshler for all her work with the successful Village of Chester Christmas Parade. He noted how the wards could affect unexpired terms and having elections all at once. Tracy Shuh, 81 Pickerel Road, Chester referenced the Chronicle article noting the DEC violations issued on November 6 and 26 to the Greens of Chester. She asked if there were any stop work orders or fines imposed by the Town as Storm Management Officer. She asked where fine monies would be allocated and suggested it be used to monitor the stream to protect resources or conduct water studies for a baseline and ongoing monitoring for groundwater contamination. Caren Riegelhaupt, Library Trustee, 6 Vivian Lane, Chester. Ms. Riegelhaupt asked the Board for an update on the library building lease. Supervisor Valentine said it should be finalized soon. Supervisor Valentine said he met with the County, Town of Blooming Grove, Village of Chester and the Great Wolf Lodge applicant to discuss access, sewer, and water. Although not a done deal, he said the Camp LaGuardia is the target site in Orange County. He said it would be a good ratable for the Town as it is a high-class operation with a resort and indoor park. He continued to update the public on the Sugar Loaf Performing Arts Center, stating that the paper work is being done along with inspections and bonding as it is getting closer to title transfer. He said he will keep the public informed and schedule an open house.
