We urge you to deny his applications for Conditional Development Permits, to deny his applications for extensive variances and to deny any Site Development Permits. The Town's Staff Reports to the Planning Commission describe that these proposed new buildings are "boxy, rectangular" structures out of scale and inconsistent with our neighborhood. The variance requests are extensive and propose an extreme amount of encroachment on the neighboring properties. We ask the Commission to maintain our town's rural character and to continue supporting development within the rules. Please accept the staffs recommendation to deny these applications. Mr. Linebarger stated that his plan submissions were complete and the newly repositioned building-outline poles on the lots seemed to confirm that the application process with the town is proceeding. When looking at the plans, though, I was greatly surprised by his lack of addressihg any of the fundamental issues raised repeatedly by the neighbors. While Mr. Linebarger stated multiple times that he had reduced the "number" of variance requests from his last proposal (rejected by the Planning Commission), he has only minimally modified two of the four side set-back variance requests on significantly sub-par lots that are fundamentally unbuildable. Mr. Linebarger seeks permits to build two 4,000+sqft houses with proposed side set-back variances that massively violate the rules of Los Altos Hills. Indeed, just on March 28th, 207, LAH sent out Annexation Notices to the lower part of Mora Drive neighbors reiterating the commitment to maintain the rural character of the town through statements such as:
"... More cohesive development standards with the surrounding neighborhood... " "... Any new structures (such as new residences, second units or other accessory buildings and swimming pools) will be required to comply with Town standards... " (ed. balding of text is mine) The well-written leaflet also clearly summarizes the Los Altos Hills building setback standards as: Front setback 40ft Side setbacks 30ft Rearsetbacks 25ft Mr. Linebarger's proposed side setbacks fall well short of the LAH standard! Not only would his building ambitions instantaneously drive a massive density increase at the top of Mora Drive, it would also create an unstoppable PRECEDENT that will open the floodgates to innumerable variance demands by a wave of aggressive builders. To the Town leadership's great credit, it should be noted that since 2004, Los Altos Hills has not granted any set-back variances for new buildings on substandard lots requiring COPs! Thank you! Given the clarity of the Town's rules, given the extreme sub-standard size of the lots, given that this not existing residences but brand-new building, and given that Mr. Linebarger's creation of these unbuildable lots is self'"caused, there is no argument for special rule dispensation. The fact that he has threatened the Town multiple times with legal action needs to be pushed back on vigorously as the rules are well-established and the precedent set by caving in is unacceptable. We appreciate everything Los Altos Hills is doing and has done to protect the character and density of our neighborhoods. However, we would like to add our voices to the majority of residents opposed to the proposed new building developments at 0730 Mora Drive Lots and 3 by Mr. Forrest Linebarger. We urge you to deny his applications for Conditional Development Permits and to deny his applications for extensive variances. We ask the Commission to maintain our town's rural character and to continue supporting development within the rules, in this case specifically those rules requiring minimum lot size and setbacks. We believe that if the requested COPs are approved, the values of all adjacent and neighboring properties will be adversely affected.
