Jammu and Kashmir Legislative Assembly B U L L E T I N Friday, March 27, 2015 The House met at 10.00 A.M in the J&K Legislative Assembly Hall, Jammu. Mr. Kavinder Gupta, Hon ble Speaker in the Chair. At the commencement of the day s proceedings, the leader of the largest opposition party N.C Mr. Omar Abdullah alongwith the Hon ble Members of Congress, CPI(M) and Er. Abdul Rashid Independent stood up from their seats and raised the issue of alleged refusal of the central government of handing over the Power Projects to the State with the contention that there are financial and legal problems, which depicts a sort of cheating with the people of J&K State. In response Dr. Nirmal Kumar Singh, Hon ble Deputy Chief Minister while pacifying the agitated members informed the House that the issue of Lok Sabha question had taken place prior to the formation of government in the state. He further said that the matter has been taken up with the Central Government, adding that the pervious Govt. could not solve the issue during its 6 years tenure,how can it expect the solution of the issue within 4 weeks of the formation of government in the state. However, the agitated members were not satisfied with the reply of the Government and continued slogan shouting.despite repeated requests from the Chair, the Hon ble Members did not take their seats thereby prevailing complete pandemonium and bedlam in the House as a result of which nothing was audible in the din. In the meanwhile Hon ble Member Mr. Devinder Singh Rana, stated that the Hon ble Governor s address envisages that the modalities in this behalf are being worked out.

Note.1 At this Stage Syed Basharat Ahmad Bukhari, Hon ble Minister for Law, Justice and Parliamentary Affairs stated that the concern of the House is genuine however, they are aware of the fact that it took two and a half months to prepare the Common Minimum Programme to the Coalition. followed by the session of the Assembly. The Opposition is fully aware of the system and the establishment. The question has been raised in the Parliament and dates back to one and half month adding that no process has been started officially in this behalf as yet. The Government remained busy in the matter and he assured the August House that the Common Minimum Programme will be implemented in letter and spirit and the power projects will be brought back. Note.2 While pacifying the agitated Hon ble Members Mr. A. R Veeri, Hon ble Minister for Horticulture Haj and Auqaf informed the House that the senior members of the other side particularly the Hon ble Ex. Chief Minister are fully aware of the fact that CMP has been finalized by the Coalition just before one month and we request them to allow us to fulfill our agenda within six years and let us prove our worth before the common man of the State enabling them to decide whether this Coalition has accomplished the job they have assigned to us in the interest of the State or not. Despite the repeated requests of the Hon ble Speaker, the agitated Members continued their slogan shouting thereby prevailing pandemonium in the House and nothing was audible in the din. The Hon ble Speaker then adjourned the House for 10 minutes.

Note: The House re-assembled at 10:45hrs. STARRED QUESTIONS Out of 28 Starred Questions set down in the Question List 04 Questions were called and orally answered. 03 Supplementary Questions were raised and answers given. UN-STARRED QUESTIONS Written replies to 20 Un-starred Questions set down in the Question List were placed on the Table of the House. House re-assembled at Note.1 At this stage Hon ble Member Mr. G. M Saroori raised the issue of his adjournment motion. In response the Hon ble Speaker informed him that the notice was given by him at 10.00 a.m which was not admissible under rules. Note.2 The Hon ble Members again started protesting against the issue of handing over of the NHPC Power Projects to the State. Amid uproarious scenes the Hon ble Speaker asked the agitated members to take their seats but they remained adamant and nothing was audible in the din. Taking cognizance the Hon ble Speaker ordered W.W Staff to take them away from the House. The Hon ble Members Mr. Abdul Majid Bhat (Larmi), Mr. Altaf Ahmad Wani, Mr. Usman Abdul Majid, Mohmmad Amin Bhat, Sheikh Ishfaq Jabbar, Ch. Mohammad Akram were taken away from the House under the orders of the Chair. However, the remaining Hon ble Members of opposition continued slogan shouting and disrupted the proceedings of the House continuously and nothing was audible in the din and Hon ble Speaker again adjourned the House for 05 minutes. The House re-assembled at 11:55hrs Mr. Kavinder Gupta, Hon ble Speaker in the Chair. 1. PAPERS LAID ON THE TABLE OF THE HOUSE.

MR. PAWAN GUPTA, HON BLE MINISTER OF STATE FOR FINANCE, AND INFORMATION TECHNOLOGY ON BEHALF OF MR. HASEEB A.DRABU HON BLE MINISTER FOR FINANCE laid on the Table of the House a copy each of the following Reports:- i. Audit Report on State Finances for the year ended 31 st March,2014; ii. Audit Report (Report No. 3 of the year 2014) on Revenue Sector and Public Sector Undertakings (Social, General and Economic Sectors) for the year ended 31 st March, 2014 ; iii. Audit Report (Report No. 4 of the year 2014) on Social, General and Economic ( Non-PSUs) Sectors for the year ended March, 2014; iv. Finance Accounts (Volume 1), Finance Accounts (Volume II), for the year 2013-14; and v. Appropriation Accounts for the year 2013-14. 2. DISCUSSION AND VOTING ON DEMANDS FOR GRANTS FOR THE YEAR 2015-2016 MR. NAEEM AKHTER, HON BLE MINISTER FOR EDUCATION moved the following demands:- Demand No. 27 That a sum not exceeding Rs. 94692.84 lakh be granted to payment during the year ending 31 st March, 2016 in respect of 2202- General Education, 2203-Technical Education, 2230-Labour & Employment, 4055-Capital Outlay on Police, 4202-Capital Outlay on Education, Sports, Art and Culture, 4250-Capital Outlay on Other Social Services. Cut motions notices whereof given by S/Shri M.Y Tarigami, Ali Mohammad Sagar, G.M Saroori, Er. Abdul Rashid, Mubarak Gul, Vikar Rasool Wani, Abdul Majid Bhat(Larmi) Altaf Ahmad Wani, Javed Ahmad Rana, Sheikh Ishfaq Jabbar, Asgar Ali Karbalie, were deemed to have been moved.

Demand No. 7 That a sum not exceeding Rs. 483430.74 lakh be granted to payment during the year ending 31 st March, 2016 in respect of 2055- Police, 2202-General Education, 2204-Sports and Youth Services, 4202-Capital Outlay on Education, Sports, Art and Culture. Cut motions notices whereof given by S/Shri Mubarak Gul, Ali Mohammad Sagar, Mian Altaf Ahmd, M.Y Tarigami, Nawang Rigzin Jora, Mohammad Akbar Lone, G.M Saroori, Mumtaz Ahmad Khan, Altaf Ahmad Wani, Javed Ahmad Rana, Er. Abdul Rashid, Sheikh Ishfaq Jabbar, Ch. Mohammad Akram, Asgar Ali Karbalie, Vikar Rasool Wani were deemed to have been moved. 3. DISCUSSION AND VOTING ON DEMANDS FOR GRANTS FOR THE YEAR 2015-2016 MR. LAL SINGH, HON BLE MINISTER FOR HEALTH & MEDICAL EDUCATION AND ARI & TRAININGS moved the following demand:- Demand No. 17 That a sum not exceeding Rs. 264914.36 lakh be granted to payment during the year ending 31 st March, 2016 in respect of 2210-Medical and Public Health, 2211-Family Welfare, 4210-Capital Outlay on Medical and Public Health. Cut motions notices whereof given by S/Shri Ali Mohammad Sagar, M.Y Tarigami, Mohammad Akbar Lone, Nawang Rigzin Jora, G.M Saroori, Mubarak Gul, Mian Altaf Ahmad, Er. Abdul Rashid, Vikar Rasool Wani, Abdul Majid Bhat(Larmi) Altaf Ahmad Wani, Sheikh Ishfaq Jabbar Javed Ahamd Rana, Mohammad Amin Bhat, Ch. 4. DISCUSSION AND VOTING ON DEMANDS FOR GRANTS FOR THE YEAR 2015-2016 MR. ABDUL HAQ KHAN, HON BLE MINISTER FOR RURAL DEVELOPMENT moved the following demand:- Demand No. 28 That a sum not exceeding Rs. 162770.58 lakh be granted to payment during the year ending 31 st March, 2016 in respect of 2236- Nutrition, 2501-Special Programmes for Rural Development, 2515- Other Rural Development Programmes, 4515-Capital Outlay on Other Rural Development Programmes. Cut motion notices whereof given by S/Shri M.Y Tarigami,Ali Mohammad Sagar, Mohammad Akbar Lone, Nawang Rigzin Jora, G.M Saroori, Mubarak Gul, Mian Altaf Ahmad, Er. Abdul Rashid, Vikar Rasool Wani, Abdul Majid Bhat(Larmi) Altaf Ahmad Wani, Javed Ahamd Rana, Sheikh Ishfaq Jabbar, Mohammad Amin Bhat,, Asgar Ali Karbalie were rejected with the leave of the House. Note: All the cut motions in respect of demand nos.27, 7, 17 and 28 were rejected with the leave of the House. Demand No.27, 7, 17 and 28 were passed by the House with the voice vote. The House then adjourned to meet again at 3.00.p.m. 2 nd Sitting (3.00 p.m. ) House re-assembled at 3:00hrs Mr. Kavinder Gupta, Hon ble Speaker in the Chair. Note: At the commencement of the proceedings of the second sitting all the Hon ble Members belonging to N.C and Congress

continued slogan shouting and protest against the issue raised by them in the 1 st sitting regarding the handing over of the NHPC Power Projects to the State. In the meanwhile Hon ble Speaker named SYED MOHAMMAD ALTAF BUKHARI, HON BLE MINISTER FOR PUBLIC WORKS, FLORICULTURE AND PARKS for moving his demand. SYED MOHAMMAD ALTAF BUKHARI, HON BLE MINISTER FOR PUBLIC WORKS, FLORICULTURE AND PARKS moved the following Demand:- Demand No. 16 That a sum not exceeding Rs. 229814.45 lakh be granted to payment during the year ending 31 st March, 2016 in respect of 2059- Public Works, 2216-Housing, 3054-Roads and Bridges,4059-Capital Outlay on Public Works, 5054-Capital Outlay on Roads and Bridges. Cut motion notices whereof given by S/Shri Ali Mohammad Sagar, M.Y Tarigami, Nawang Rigzin Jora, Mian Altaf Ahmad, G.M Saroori, Mohammad Akbar Lone, Mubarak Gul, Er. SUKHNANDAN KUMAR, HON BLE MINISTER FOR PUBLIC HEALTH ENGINEERING, IRRIGATION & FLOOD CONTROL moved the following demands:- Demand No. 22 That a sum not exceeding Rs. 91242.70 lakh be granted to payment during the year ending 31 st March, 2016 in respect of 2700- Major Irrigation, 2701-Medium Irrigation, 2702-Minor Irrigation, 2711-

Flood Control and Drainage, 4701-Capital Outlay on Medium Irrigation, 4702-Capital Outlay on Minor Irrigation, 4711-Capital outlay on Flood Control Projects. Cut motions notices whereof given by S/Shri M.Y Tarigami, G. M Saroori, Mubarak Gul, Mian Altaf Ahmad, Mohammad Akbar Lone, Nawang Rigzin Jora, Er. Abdul Rashid, Vikar Rasool Wani, Abdul Majid Bhat (Larmi) Altaf Ahmad Wani, Sheikh Ishfaq Jabbar, Mohammad Amin Bhat were deemed to have been moved. Demand No. 23 That a sum not exceeding Rs. 146921.76 lakh be granted to payment during the year ending 31 st March, 2016 in respect of 2055- Police, 2215-Water Supply and Sanitation, 4215-Capital Outlay on Water Supply and Sanitation. Cut motion notices whereof given by S/Shri M.Y Tarigami, Mubarak Gul, Mian Altaf Ahmad, G. M Saroori, Er. Abdul Rashid, Abdul Majid Bhat(Larmi) Sheikh Ishfaq Jabbar, were deemed to have been moved. Note: At this Stage, Syed Basharat Ahmad Bukhari, Hon ble Minister for Law, Justice and Parliamentary Affairs informed the House that the Government has no objection to the issue raised by the opposition, however informed the House that the question was moved on 17 th of Feb,2015 in the Lok Sabha and replied on 5 th of Mach, 2015.Our government came into existence on 1 st March,2015 and the Common Minimum Programme was under process. These people forget the fact that in 1998 the then Hon ble Chief Minister Dr. Farooq Abdullah gave all power projects to

government of India without taking the cabinet on board and today they are protesting on this issue and if any news paper after 22 days published the News they should understand its meaning. The opposition is wasting the precious time of the House and they are not interested in raising the issues for the welfare of the people. The following the Hon ble Members took part in discussion on demands for grants. 1. Mr. Mohd. Khalil Band, PDP 15:11hrs to 15:18hrs 07 minutes 2. Mr. Ravinder Raina,BJP 15:19hrs to 15:24hrs 05minutes 3. Mr.Farooq Ahmad Andrabi,PDP 15:25hrs to 15:30hrs 05 minutes Note:1 Intervening Mr. A.R Veeri, the Hon ble Minister for Horticulture Haj and Auqaf said that opposition is disrupting the proceedings of the House out of frustration adding that they are issue less and are playing to the galleries. He further said that both the opposition parties were in power for the last 6 years and they are supposed to say what they did during their tenure in this behalf. He also said that Common Minimum Programme will be implemented at all costs.he also referred to the statement made by Hon ble Law Minster and said that reply to the Lok Sahba question was given on February 17,2015 prior to the formation of the government. 4. Mr. Dalip Singh Parihar, BJP 15:31hrs to 15:38hrs 07minutes 5. Mr. Noor Mohd. Shiekh,PDP 15:38hrs to 15:40hrs 02minutes 6. Mr. Shakti Raj Parihar, BJP 15:40hrs to 15:45hrs 05minutes 7. Er. Abdul Rashid,Ind. 15:45hrs to 15:51hrs 06minutes Note.1 At this stage Hon ble Member Mr. G. M Saroori staged a walkout from House in protest alleging that he was not allowed to speak on the adjournment motion which was given by him at 10.00 a.m and was not admissible under rules. Note.2 At this stage Hon ble Speaker repeatedly requested the agitated members not to disrupt the proceedings of the House but they continued their protest thereby causing disorder in the House. The Hon ble Speaker taking cognizance directed the watch and ward staff to take S/ Shri Vikar Rasool Wani, Sheikh Ishfaq Jabbar, Usman Abdul Majid, Mumtaz Ahmad Khan, Deldan Namgyal, Mohd. Amin Bhat, Asgar Ali Karbalei, Javed Ahmad Rana, away from the House. Note: 2 At this stage while pacifying the agitated Hob ble Members, Mr. Abdul Rehman Veeri Hon ble Minister for Horticulture, Haj and Auqaf while addressing Mr. Devinder Singh Rana, Hon ble Member said that he is playing to the galleries and enough is enough and they have taken note of your actions, adding that the people know that the Hon ble Member have no sympathy with them and it has also been proved during their 6 years tenure.
