D Holt VAN BUREN COUNTY QUORUM COURT ORDINANCE NO. 2018- BE IT ENACTED BY THE QUORUM COURT OF THE COUNTY OF VAN BUREN, STATE OF ARKANSAS, AN ORDINANCE TO BE ENTITLED: AN ORDINANCE ESTABLISHING A DAILY FEE TO BE CHARGED MUNICIPALITIES FOR KEEPING PRISONERS OF MUNICIPALITIES IN THE VAN BUREN COUNTY DETENTION CENTER. WHEREAS: Pursuant to Arkansas Code Annotated 12-41-506, the quorum court may by ordinance establish a daily fee to be charged municipalities for keeping prisoners of municipalities in the county jail; and WHEREAS: The fee shall be based upon the reasonable expenses which the county incurs in keeping such prisoners in the county jail; and WHEREAS: The Quorum Court has determined that the reasonable expenses for keeping prisoners in the Van Buren County Detention Center total $53.00 per day; and WHEREAS: The Quorum Court desires to set a daily fee of $53.00 for the keeping of prisoners of municipalities. THEREFORE, BE IT ORDAINED BY THE VAN BUREN COUNTY QUORUM COURT THAT: SECTION 1. The Van Buren County Sheriff shall collect a fee of $53.00 per prisoner per day from municipalities for prisoners of municipalities who are maintained at the Van Buren County Detention Center. SECTION 2. Prisoners of municipalities shall include prisoners that are arrested and jailed by a municipal officer on a municipal ordinance violation and all prisoners arrested by a city and delivered to the county jail for incarceration from the point of arrest or intake until charging on a felony, sentencing on a misdemeanor, or release on a municipal-ordinance violation. SECTION 3. The Van Buren County Sheriff shall bill each municipality monthly for the cost of keeping prisoners pursuant to this ordinance. SECTION 4. The Van Buren County Sheriff shall remit to the Van Buren County Treasurer monthly the fees collected under this ordinance, and such fees shall be credited to the county general fund.

Philips ORDINANCE NO. 2018- BE IT ENACTED BY THE QUORUM COURT OF THE COUNTY OF VAN BUREN, STATE OF ARKANSAS, AN ORDINANCE TO BE ENTITLED: AN ORDINANCE RATIFYING AN OFFICE LEASE FOR THE VAN BUREN COUNTY JUVENILE PROBATION OFFICE. WHEREAS: Van Buren County has leased office space at 339 Boykin Street, Clinton, Arkansas since 2010; and WHEREAS: This office was first leased by owner John Aldworth for use by the Van Buren County District Court. In 2013 the Van Buren County Juvenile Probation Office moved into the office and another lease was signed between the County and John Aldworth; and WHEREAS: Chad J. Brown and Nickie Brown purchased the building from John Aldworth in 2014 and renewed the lease with the County. The Van Buren County Juvenile Probation Office has continued to occupy this office space to this date. The monthly rental rate is currently $200.00 per month and one-half of the monthly electric and water bill associated with the building; and WHEREAS: Nickie Brown is the justice of the peace-elect for District 2 with a term set to begin January 1, 2019. As the owner of the leased property, she receives a financial benefit from the lease; and WHEREAS: A.C.A. 14-14-1202(c)(2)(A) allows the county to purchase a real property interest from a quorum court member if the quorum court determines it is in the best interests of the county due to unusual circumstances; and

WHEREAS: It is in the best interests of the county to continue the lease of the office space for use by the Van Buren County Juvenile Probation Office. The office has been in use for over four years and is the recognized location of the Juvenile Probation operations. The monthly rent is below market for comparable commercial rent space. Money for rent and utilities has been appropriated in the proposed budget. NOW THEREFORE BE IT ORDAINED BY THE QUORUM COURT OF VAN BUREN COUNTY, ARKANSAS THAT: SECTION 1: The lease between Van Buren County, Arkansas and Chad and Nickie Brown for office space at 339 Boykin Street, Clinton, Arkansas dated March 26, 2014 is ratified.
