CITY OF LEBANON CITY COUNCIL MEETING MINUTES October 23, 2017 BE IT REMEMBERED that the Council of the City of Lebanon, Missouri, met in Regular Session on October 23, 2017 at 7:00p.m. in the Council Chambers at City Hall located at 401 South Jefferson. ROLL CALL AND DECLARATION OF A QUORUM Upon roll call, the following Officers were present: Ken Eldridge, Sheila Mitchell, Jim White, LeAnn Mather, Randy Wall, Chuck Jordan, Bob Garner, and Mayor Carr. Absent: Gib Adkins. Staff members and others in attendance: Public Works Director Richard Shockley, Police Chief Randy Halstead, Fire Chief Sam Schneider, Interim Community Development Director Noel Massey, Code Administrator Joe Berkich, Parks Director John Shelton, Street Superintendent Mike Moore, City Clerk Laina Starnes, and City Counselor Chris Allen. INVOCATION AND PLEDGE OF ALLEGIANCE Invocation was given by Don Anderson of Union Mission Church, followed by the pledge of allegiance. PUBLIC COMMENTS Joyce Massey- introduced several young people who had worked over a year to win the honor of being foreign exchange students in the United States. Massey said the students were here to learn about America from the ground up. The countries they represented were Turkmenistan, Kazakhstan, Indonesia, Sierra Leone, France, Brazil, Bangladesh, and Egypt. She thanked the Mayor and City Council for allowing the students to attend and observe their meeting. DISCUSSIONS AND PRESENTATIONS None. COUNCIL BILL NO. 4519- ADOPTION OF BUILDING FEE SCHEDULE COMMUNITY DEVELOPMENT An Ordinance by the City Council of the City of Lebanon, laclede County, Missouri, (hereinafter referred to as "City"), adopting an updated fee schedule for activities associated with the Community Development Department. Jordan moved and Eldridge seconded that the Council approve the second and final reading of Amended Council Bill No. 4519 and that the roll be called for the approval and passage of said bill. Mayor Carr declared Amended Council Bill No. 4519 duly passed and approved and that it be entered among City Records as Ordinance No. 5669. COUNCIL BILL NO. 4520- CODE AMENDMENT, OPEN MEETINGS AND RECORDS (SUNSHINE LAW) (hereinafter referred to as "City") amending the City Code of Ordinances Chapter II Administration to create a new Article VII Open Meetings and Records. Mather moved and Jordan seconded that the Council approve the second and final reading of Council Bill No. 4520 and that the roll be called for the approval and passage of said bill. Motion carried as follows: Yea: (7) White, Mather, Wall, Jordan, Garner, Eldridge, and Mitchell; Nay: (0) None; Abstain: (0) None; Absent: (1) Adkins. Mayor Carr declared Council Bill No. 4520 duly passed and approved and that it be entered among City Records as Ordinance No. 5670. COUNCIL BILL NO. 4521- AGREEMENT, GASCONADE AND SPILLER PARK SHELTERS, A AND C CONSTRUCTION (hereinafter referred to as "City") authorizing and directing the Mayor and City Clerk to enter into and execute agreements between the City and A&C Construction for the purchase, delivery, and installation of a 24x40 shelter with concrete pad at Gasconade Park and 24x30 shelter with concrete pad at Spiller Park. Jordan moved and Garner seconded that the Council approve the first reading of Council Bill No. 4521 and that it be passed to the second reading. Mitchell moved and White seconded that the funding source for Spiller Park, reflected in Section 4, be changed from Capital Fund 22 to Park Fund 79. COUNCIL BILL NO. 4522- PURCHASE, TANDEM AXLE SKID STEER TRAILERS, ANDERSON TRAILER SALES AND TRANSWEST TRAILERS (hereinafter referred to as "City") authorizing and approving the purchase of two Tandem Axle Skid Steer Trailers from Transwest Truck Trailer RV and Anderson Dairy Equipment, Inc. Wall moved and Garner seconded that the Council approve the first reading of Council Bill No. 4522 and that it be passed to the second reading. COUNCIL BILL NO. 4523- APPROVAL, TRACK LOADER UNDERCARRIAGE REBUILD (hereinafter referred to as "City") approving rebuilding the undercarriage of a 1999 Model Caterpillar 953C Track Loader Unit with Bar Code No. 10226. Wall moved and Mather seconded that the Council approve the first reading of Council Bill No. 4523 and that it be passed to the second reading. Wall moved and Jordan seconded to amend the not to exceed dollar amount in Section 2 from $20,331.29 to $30,000. RESOLUTION #429- ADOPTING THE 2017 REVISION TO THE STREET MAINTENANCE MASTER PLAN Mayor Carr introduced Resolution No. 429 for Council consideration as follows: "A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF LEBANON, LACLEDE COUNTY, MISSOURI, (HEREINAFTER REFERED TO AS "CITY") ADOPTING THE 2017 REVISION TO THE STREET MAINTENANCE MASTER PLAN (HEREINAFTER REFER ED TO AS "PLAN"). at its September 10, 2012 meeting, the City Council was presented with the initial Street Maintenance Master Plan; and since then, the Street Maintenance Master Plan has been successful in its approach to improving City streets; and that the Street Maintenance Master Plan implemented in 2012 now requires updating; and the City Council did at its Work Session on October OS, 2017, have presented to them by Staff the proposed 2017 Street Maintenance Master Plan; and Staff held a public forum on October 17, 2017 for residents interested in offering feedback and asking questions about the proposed 2017 Street Maintenance Master Plan; and that it is the desire of the City Council to adopt the 2017 Street Maintenance Master Plan as the City of Lebanon's Street Maintenance Master Plan of record. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LEBANON, LACLEDE COUNTY, MISSOURI, AS FOLLOWS: SECTION 1: The City of Lebanon adopts the 2017 Street Maintenance Master Plan as the Street Maintenance Master Plan of record for the City of Lebanon. SECTION 2: That the City Council hereby directs Staff to update Said Plan and present a new revision to the City Council for adoption in 2022. SECTION 3: That this Resolution shall be in full force and in effect from and after the date of its passage and approval. COMMENTS Police Chief Randy Halstead- provided information regarding the Drug Take Back Day scheduled for the following Saturday. Fire Chief Sam Schneider- reported his department had responded to two structure fires in the past 2 X weeks. Schneider also reported he had reached out to the Lebanon Middle School regarding the use of their facility for a storm shelter. He indicated there was interest and would continue to work with them on this issue. Public Works Director Richard Shockley- reported efforts had been made to ensure all street lights were working prior to Halloween. Parks Director John Shelton- announced that the Rotary Club's Route 66 SK Run was a success. He then reported that suggested routes for future SK and lok runs would soon be presented to City Council for discussion. Shelton concluded by saying he hoped to have the Gasconade Park and Spiller Park shelters completed by spring. City Clerk Laina Starnes- thanked Assistant City Administrator Ben DeClue for his assistance in putting to together this evening's ordinances and packet so she could take some vacation time. MIS Coordinator Jarrad Schomaker- reported that the Office 365 migration was completed, except for the City Councilmembers. He then announced that the request tracker was now functional within the City's app and more changes would be coming in the next few weeks. City Counselor Chris Allen- stated a closed session would need to be scheduled in November to discuss some legal issues. Councilman Eldridge- welcomed the guest foreign exchange students and said he hoped they enjoyed their stay in America. Councilwoman Mitchell- also welcomed the foreign exchange students and expressed she was happy they were here. Councilman White- asked about the status of the pole replacement project. Public Works Director Richard Shockley reported that a material purchase would be coming before Council soon for approval. White then questioned if Shockley was working on the street lights by the Lebanon Middle School he had asked about during previous meetings. Shockley replied by saying they were trying to get all the current lights working before adding new ones. White moved and Mather seconded that the meeting time for all future Council meetings be changed to 6:00 pm. Motion carried as follows: Yea: (7) Jordan, Garner, Eldridge, Mitchell, White, Mather, and Wall; Nay: (0} None; Abstain: {0} None; Absent: (1) Adkins. Councilwoman Mather- reported information about the upcoming transportation tax renewal election scheduled for November 7th. Mather shared the tax was not an increase and it supported about 75% of the street budget bringing in approximately $1.7 annually. Mather said she had heard a lot of positive support for the tax. In closing, Mather was complementary of the sidewalk project and said she was approached by someone who stated they would like to see the sidewalks extended from Elm Street Eatery to Vance Road. Councilman Jordan- welcomed the attending foreign exchange students and shared he once had the privilege of hosting two students from Germany. Councilman Garner- shared he had also hosted a foreign exchange student from Germany and encouraged the attending students to reach out to City Council if they needed anything. Mayor Carr- commended Public Works Director Richard Shockley and Street Superintendent Mike Moore on the City's Street Master Plan.
