[CrossJ Don Alberto Lopes Aguado, first ranking ordinary alcalde of this Villa of San Fernando, Capital.of the Province of Texast New Philippines, etc.: Inasmuch as the fulfilment of my obligations and His Majesty's regulations compel me to quell the many irregularities existing in this villa; and in order that all persons may live as is fitting and enjoy the fruits of their lawful labours, I do ordain and decree the following articles: Article 1: All loiterers, dissemblers and vagrants shall hereafter and within three days of the posting of this notice find for themselves masters to serve or leave these lands as contagious nuisances within the same limit of time. Article 2: No one within the settlement shall carry small arms nor wander about after curfew. The person of anyone so found shall be incarcerated and fined twelve pesos which will be applied to the work of the church. Article 3: Anyone convicted of trifling shall9 without exception, be taken to the pillory and shall be given two hundred lashes and exiled from this entire Province.
Article 4: Anyone caught gambling in public or in customary enclosures shall receiv,e a fine of twenty pesos, current gold, and fifteen days in jail for his first offence. The fine shall be applied to the material work of the Church. For his second offence the fine shall be doubled and, if he is married, he and his family shall be exiled from the said villa. Article 5: No one shall allow his animals, horses, mules or flocks to enter.the irrigation projects because of illness resulting from their urine and because it is against His Majesty's laws. Anyone disregarding this rule shall be fined twelve pesos which shall be distributed; half going to the work of the Church and half for the repair of bridges and roads. Article 6: All.fandangos and music shall cease after lv retreat because of the evils //which result from fandangos at such Y.hours. The penalty for those having such carryings-on in their homes shall be twelve pesos, current gold, and for those attending such, six pesos. The fines I shall apply to the work of the Church and the benefit of the City Ha1l. 8 Article 7: No one shall drive herds of flocks into the Villa because of the serious danger which would threaten
37 the central irrigation ditch, the bridges and the streets. For the b:er?efit of citizens, each individual shall be allowed two or three animals to begin with but for more than these he shall build corrals on the other side of the arroyo. The penalty for infringements shall be a fine of six pesos, current gold, to go to the building of the said corrals. Article 8: All the farmers shall have their fences erected and in good condition between now and the.last day of March leaving only gateways constructed in the trail paths and no one shall use any trails or routes other than those apportioned in the distribution of grasslands. The first infringement carries a fine of six pesos to be applied to the work of the Church. Article 9: The farmers shall not neglect.their payments as has been their custom and they shall not leave their families without a necessary supply of corn nor without that corn which is necessary for seeding. Article 10: Finallyt no person shall manufa.cture. rum of any quality whatever because this is against His Majesty's Royal Cedulas. The penalty for infraction shall be a fine of fifty pesos in current gold. I shall destroy the equip-
0 ment used in this manufacture and apply the fine to the Church. No person coming in from outside shall sell rum, even though it be of the best quality, because of the evils which this traffic originates in this neglected villa and in the presidios of this Frovince. On some occasions of special urgency one or two barrels may be permissible provided they are pres.ented^to the magistrates of this villa who will inspect it to test whether it is Castilian distillation,affix a tax, and provide such measures as experience has shown to be necessary for the prevention of disorder in these affairs. Anyone infringing shall have his liquor confiscated and spilled out in the public square and shall be fined one hundred pesos, current gold, 2 which shall be applied //of course, to the work of the aforementioned Church. The procurator shall also be instructed to make advanced preparations within eight days of the posting of this order on all community bridges, streets and necessary places in order to see that all its provisions with corresponding penalties are implemented. In order that all shall be notified and none may allege ignorance of this my decree, it shall be advertised in the City Hall of this Villa and in the large assembly which shall take place in the morning after High Mass. This is done in this Villa on the tenth day of the month of January
