A This email chain starts with some notes from Shell Development in Australia about an announcement on the Gorgon Development by Chevron Texco, the operator of Gorgon. And if r--- I remember it correctly, it was about obtaining some permissions which made the development of Gorgon more likely and actually probably would move it up the pecking order in terms of priorities for development. And it came to me in general because any such communications related to material assets would go to both group IR and group media to ensure that there was consistent use of the material and preparation on questions. Q And then that some reserves you're talking about is the 00 million BOE that you A I had a figure in mind, the 00 million BOE. I was looking for Rhea to confirm with the same objective we just already discussed, if this announcement was made albeit in Australia, there were still chances of questions coming in to my team in London about Gorgon and the likelihood of booking reserves. And then there was a second part of my email which again looks to be a trait of saying, while we're on the subject, here is another -- asking about Sakhalin. And the r--- reserves, the profile or the timing of reserves recognition for a large project and me trying to ensure I go up the learning curve in terms of how quickly reserves will be booked again and the words here in email so we can then show we don't set expectations too high. Q For someone without the oil and gas expertise that you have, is that 00 million BOE a large or small volume? A It's a large volume. Q What would losing that 00 million BOE have done to

Q Is there a reason why you didn't inform Mr. Watts that 00 million BOE were booked before FID, were already on r> Shell's books? A I can't think of a specific reason other than this was just before the meetings, the main meetings I think I held with Phil. Phil was ex-chief executive of the business and chairman of the CMD and he was talking about a project which although it didn't come with the same enthusiasm as the others, I assumed he knew more about it than I did. Q So, you assumed he knew that the 00 million BOE had already been booked and that's why you didn't relay it to

Q And if you had thought that there was any way that Mr. Watts didn't know that the 00 million BOE had already been booked, would you have not told him? A I would like to think I would have told him if I thought that there was something that he didn't know that he should know or otherwise. I do not recall telling him. And you asked why I didn't tell him, it was not always the easiest thing to do to tell him things like that but I don't recall in this case that being necessarily an issue. Q Well, if there was a large volume that had been booked before FlO that de-booking would have caused a 0 percent drop in the reserve replacement ratio, that's something you would have told Mr. Watts if you didn't think he knew it, isn't it? r--- A If I felt or believed that a de-booking or a negative revision was likely to happen, then yes, I would definitely have advised him whether I thought he knew it or not because that would have been part of my -- Q And if he'd been telling the market that there were certain volumes that may be booked in the future for Gorgon, he would need to know about volumes that had been booked in the past that couldn't be rebooked, correct? A Correct. But he never did give specific data for

And I was of the impression that there was more to come from Gorgon, they would just be less than one might expect. Q But this was an issue that was on your radar screen? A The fact that when Gorgon was bought or when a final investment decision was made, that the reserves that would be added would be less than you might expect, yes, it was on my radar screen. Where was it on the radar screen? Somewhat lower than other reserves replacement issues because we didn't expect a final investment decision for at that time maybe another two years. Still some time off. Q And just absolutely cutting to the chase, in February of 0, you thought that Mr. Watts would have known about the booking, initial booking of Gorgon or the fact that Gorgon was on the books, right? ~ A I thought he would have known more than I did in general. So, I'm saying yes. Q That would be a yes, he would know about Gorgon? A I would have thought that he should have known about Gorgon. I honestly, because the way he carefully chose his words around most things and it didn't really cross my mind that he might not know. Q So, it's something that you assumed he would know? A I would assume that as ex-chief executive, he would

Q On the top in the bolded area, and this is another r>. email draft that's actually I believe drafted by Mr. Pay, it's on the page A That's correct. This part was drafted by John Pay. Q Now, in the bolded area, I think he's talking about Sakhalin and he is noting that, 'I believe it's more likely that we will exploit flexibility on the rules for booking and limit the 0 impact to a maximum of percent." What did you interpret exploiting flexibility on the rules for booking to mean? A That the company's experts on the rules for booking believed that there was flexibility within the rules to make choices about what was booked in any given year. Q And then what would exploiting that mean? A It would mean making choices within the rules that r>. in practice given the string before, smooth their bookings over to a period. Q And that would be to try to please the market? A Not necessarily please the market. In this case, Q Or not displease the market? A To give an accurate, is the fact that didn't show a large negative revision if it were to be determined that Gorgon would require one.

A Well, we talked yesterday about the credit rating agencies, the market, and one could argue anybody engaged in the industry would have an interest in reserve replacement from a company the size of Shell. Q Turning to the first page, looks like Rhea Hamilton's response in the thread to you and others, it looks like she is confirming what you talked about with some of the numbers with Gorgon. And then she notes with Gorgon that the reserve replacement, looking at the bolded area, do you see that, 'Therefore, the reserve replacement ratio impact will at best be zero in the short to medium term." And then she notes, 'This is something of an IR time bomb." A I note the words though I don't believe they're r> Rhea's. These were John Pay's. This is still in the area of John Pay. Q Oh, you're right, I apologize. Did you find these two sentences by it looks like Mr. Pay to be accurate? A The first statement that the RRR impact will at best be zero in the short to medium term I have to presume was accurate because he was the expert on the subject. Q Cutting into your expertise, the 'this is something of an IR time bomb,' do you believe this was accurate? 0

It is, clearly it was an issue for us such that at the point at which Gorgon was booked, sorry, if an investor FID'ed, if there had not been a negative revision before that point, then there would be a negative reaction in the market at the point in which reserves for that year were made public. r---- Q Did you convey this to -- go ahead. BY MR. PEAVLER: Q Why is that? A Because the booking or, well, the investment decision of a major project like Gorgon would be expected by the market to impact reserves of the companies involved. And particularly in this case, there were two other high profile companies that were involved. And I have no idea what bookings they might have made but the market would have r--- expected reserves for all three. Q And the absence of booking by Shell when your partners are making sizeable bookings would in your view have produced negative reaction about Shell in the market? A If that had happened, yes, there would have been a negative reaction in the market. BY MR. CRAINE: Q Did you come to know that Shell's partners in fact had not booked Gorgon?

We sometimes hear in the corridor. Q So, would you agree with Mr. Pay's comment that this is something of an IR time bomb? Do you think that's an accurate statement? r=>. A It's an overstatement but, yes, it's an IR issue for the future, all other things staying equal. Q I'm handing you what's been marked as Exhibit. And why did you initiate this one? r">. A This is now April 0 following the EP/GP presentation and we're seeing sell side research analysts doing quite a bit of detailed work and analysis around historical performance on reserve replacement ratio. In particular, this email follows a request from the analyst at Credit Suisse First Boston. Q Who is that? A His name is Rod MacLean, (M-a-c-L-e-a-n). Q Are you certain that this follows his request? A Yes. This particular request came to me.
