BETH SHALOM BENEVOLENT FOUNDATION MEMBERSHIP MARCH 1, 2016 I. MEMBERSHIP IN BETH SHALOM BENEVOLENT FOUNDATION Membership in Beth Shalom Benevolent Foundation shall be on the following basis: 1. BETH SHALOM BENEVOLENT FOUNDATION BY-LAWS WHEREAS, Beth Shalom Synagogue, in order to develop, promote and insure the continuance of the Jewish faith and tradition and family solidarity, and WHEREAS, the Synagogue is charged with the responsibility of caring and providing for the life cycle needs and concerns of its members and others of the Jewish faith, and WHEREAS, charity and benevolence is one of the highest commandments of our tradition; therefore, Beth Shalom Synagogue does hereby establish the BETH SHALOM BENEVOLENT FOUNDATION to carry out these purposes for its members: I. PURPOSE AND LAWS OF THE FOUNDATION 1. The Foundation shall have authority to provide and care for the needs of its members, widows, orphans and children in its wise and caring discretion. 2. The Foundation shall select, develop and manage all cemeteries belonging to Beth Shalom Synagogue for the use and needs of its members and others of the Jewish faith as may be needed. 3. The cemeteries, their development and perpetual use shall follow the strict rites and Halacha of the Conservative movement. Only persons of the Jewish faith shall be entitled to burial sites. 4. Any future changes in burial ritual practice as may be acceptable to the Conservative movement shall be incorporated in the practices of the Foundation only with the approval of the Synagogue Ritual Committee and the Rabbi of the Congregation. II. FOUNDATION POLICY AND GUIDELINES 1. The Foundation shall have authority for the supervision, maintenance and perpetual care of the Whaley Street Cemetery and the Arcadia Lakes Cemetery in perpetuity. 2. Members in good standing of the Synagogue shall be entitled to membership in the Foundation. 3. Persons of the Jewish faith who seek membership in the Foundation and who are not members of the Synagogue may join the Foundation by paying TWICE the then current prevailing membership fee, at the discretion of the Foundation Board. 4. The Board of the Foundation shall have the authority to approve the manner of payment and to allow and accept membership under special conditions and circumstances for those who require consideration at the sole discretion of the Board. 5. Members of Synagogue, who shall discontinue their membership in the Synagogue, shall be entitled to burial privileges provided that all Foundation fees have been paid and they were in good standing with the Synagogue at the time of discontinuance provided that said person (s) shall have been a member for at least five (5) years. 6. Members of the Foundation who have paid membership fees and who shall elect to terminate their membership shall upon written notice to the Foundation Board be entitled to a full reimbursement of fees paid. Perpetual maintenance fees are non-refundable.

7. Membership in the Foundation shall entitle persons to burial privileges in the Synagogue Cemeteries, but no title or ownership shall vest in any person or family in any burial plot. The Synagogue shall retain the ownership and title to all graves and land within the cemeteries. 8. Membership in the Foundation shall be for and extend during the life of the member or members. After death all membership shall expire. 9. Membership in the Foundation is not transferable by deed or by will. 10. A member of the Synagogue who may seek membership in the Foundation on an installment basis must remain in good standing in the Synagogue through the completion of paying the Foundation membership fee. Members of the Synagogue who are in default in payment of their Foundation membership fees may be subject to termination of their Foundation membership and default of all membership fees paid to the Foundation. The Board of the Foundation may make such arrangements that are fair and equitable to prevent a default; however, the Board shall have the authority to terminate such membership after one year delinquency. 11. All single memberships of the Foundation are entitled to burial privileges for one individual site. 12. All family memberships of the Foundation are entitled to burial privileges for two individual sites, one each for member and spouse. 13. Members are entitled in case of need to additional burial privileges at no cost for unmarried children under the age of 18. III. SELECTION AND RESERVATION OF CEMETERY PLOTS 1. The Foundation shall have the authority to develop the cemetery, set the location of grave sites within the cemetery and select the location of graves for its members. The Foundation shall cooperate with each member in the selection of sites in order to provide for the orderly development of the overall cemetery site. 2. The Foundation shall encourage members to select plots and will establish a policy of plot designation with a marker being made available by the funeral home, and approved by the Foundation at member s expense. 3. Members may reserve family plots consisting of ten (10) or more graves. 4. Single and/or family headstones of a uniform character shall be permitted. No curbing shall be permitted on any graves. IV. WHALEY STREET CEMETERY EXCHANGE 1. Synagogue members who have purchased and paid for plot(s) in the Whaley Street Cemetery since January 1, 1993 shall be entitled to exchange their plot(s) for a grave site in the Arcadia Lakes Cemetery and shall be given credit for the amount paid toward membership in the Foundation subject to the payment of the then current perpetual care fee.

V. MONUMENT POLICIES 1. Monument companies wishing to erect monuments and tombstones within the Foundation Cemeteries shall register with the Foundation and pay a fee of $50.00 for each monument erected. The Foundation shall reflect the name and address of the monument company. 2. All monument companies shall provide to the Foundation a contract or letter advising that the monument company is responsible for the perpetual care of the stone and setting of the stone as required. The family of the deceased shall be responsible for the expense of maintenance and repair of the monument if the original monument company is no longer in business. 3. No monument shall be more than thirty-six inches (36 ) in height or the width of a single grave or double size for a family grave (see monument drawings on next page.) A picture or a drawing of the monument or stone shall be pre-approved by the Cemetery Committee. No pictures shall be permitted on the monument; no curbing around the gravesite; no flat stone covering the grave; and no above ground grave or mausoleum shall be allowed. 4. The funeral home is responsible to make grave markers available, if requested. This service is between the funeral home and the Foundation member. 5. There is a designated area in the Arcadia Lakes Cemetery for the burial of unusable prayer books. 6. There is a designated area in the Arcadia Lakes Cemetery for infants less than 30 days old. 7. There is a designated area in the Arcadia Lakes Cemetery for body parts. As of 3/1/2016 Subject to change

The undersigned monument company does hereby apply to Beth Shalom Benevolent Foundation for the right to erect a monument/stone upon the gravesite of (deceased) on behalf of the (family) and does hereby submit the fee of $50.00. 2. The undersigned monument company, by its Agreement with the deceased s family and by this contract, agrees to be responsible for perpetual care of the monument/stone as to its foundation and the condition of the monument/stone, except to any damage thereto shall be caused by vandalism. In the event the monument company shall not be responsible for the perpetual care of the monument/stone, then such care is thereby assumed by the family of the deceased. The care of the monument/stone is not included, nor part of the perpetual care provided by the Foundation. 3. The monument will not be more than thirty-six inches (36 ) in height or the width of a single grave or double size for a family grave (see monument drawings on next page.) No pictures shall be permitted on a monument/stone; no curbing around the gravesite; no flat stone covering the grave; and no above ground grave or mausoleum. 4. The drawing or picture of the monument/stone shall be submitted to the Foundation for written pre-approval by the Cemetery Committee with this contract, post Rabbi s approval. The monument company shall be responsible for the proper erection of the monument/stone, cleaning up of all debris, and for any damage that may be caused to other monuments/stones, damage to underground irrigation pipes or sprinkler heads, or to the property of the cemetery. 6. The consideration of this payment is the privilege of the monument company and family member for the erection of the monument/stone. 7. The monument company shall contact the Cemetery Chairperson, or designee, of the Foundation when the monument/stone is ready to be placed at the gravesite. A representative of the Foundation will physically be present at the cemetery when the monument/stone is placed.
