Visit of District & Sessions Judges from Punjab, 15 to 17 November 2017 2 Next morning, the sessions of consultative workshops started in the conference room. Mr. Justice Khilji Arif Hussain, Honorable Director General, Sindh Judicial Academy, started the introductory session in a very lighter mode. In his introduction, he said that he started his practice on corporate side. He told the participants that during his professional career, he never spared some time for himself and he made some plans after the retirement but as the Man proposes God disposes Honorable Justice Nasir Aslam Zahid asked him to join the Legal Aid Society. He said that the Legal Aid Society have established a call center where a common man could seek the guidance in legal matters without any charges and his job was to see that whether the given advisory is up to the mark or not. Honorable Director General addressing The Honorable Director General said that at the end of the day he was very satisfied with the job. He said that one day the then Honorable Chief Justice Mr. Justice Anwer Zaheer Jamali asked him to join the Supreme Court, and then after completing his tenure, he was asked to take the charge as Director General at Sindh Judicial Academy. The Honorable DG told the audience that he is very satisfied to see the working of the Judicial Officers as their job is as tough as walking on Pule-Sirat, and they are going through a very hectic life and somehow he is making some efforts to boost the moral and confidence of subordinate Judicial Officers. He said that while performing Umrah a person came to him and said that you judges acquit the criminals who are caught by agencies after making a lot of efforts. He said that we judges have a specific role to play, we have our own jurisdictions, we are listeners and our job is to interpret the law and give the decision on the basis of facts and evidence and material available on record. The Honorable Director General told the participants that we are working on the capacity of building of all components of judiciary which include apart from other stakeholders: i. Investigation officers ii. Prosecutors iii. Advocates iv. Law students He shared an experience that investigation officers having more than 15 years of experience were astonished after having come to know that the legal requirements most of the investigations conducted by them were not as required by law. He emphasized this is the reason we have designed special courses for training of judges and other stakeholders at Sindh Judicial Academy for improving the quality of rest of the other supporting components. Mr. Justice Khilji Arif Hussain said that for every democratic society judiciary is everything and a common man reposes the confidence on it. He added that if that common person loses the confidence on us, no one knows what is going to happen. Finally, he said that the Punjab Judicial Academy have done a lot of good efforts and we really would like to learn from them. The learned District & Sessions Judge and Faculty Member Ms. Nuzhat Ara Alvi said that it was a passion rather than a profession. She said that only elites were in the profession and it was the profession of Lords and they were rich and did not charge any money. She added that they used to wear a gown in which there was a pouch at the back and was a tradition that whatever you want to give, put it in the pouch. She also said that as it has become a profession and the advocates are charging a handsome amount of professional fees so it is their responsibility to deliver and work hard to protect their client and assist the court. Madam Alvi told the participants that to improve the standard of judicial process, the Academy arranged a training program for the final years students of several law colleges of interior Sindh. She said that the overall impact of this training will definitely improve the standard of the profession. Mr. Shahid Shafiq, the learned District & Sessions Judge and Faculty Member of Sindh Judicial Academy told the participants that we are focusing on skill based training instead of lecture based training. He said that the students are involved in the training and they perform what they are learn. For the improvement of standard of judiciary, he added that, the final years students of law colleges from interior Sindh were given specially designed training during this year and soon we are going to have a new batch of internees.

A brief introduction of the delegates was done in which the respectable judges described their professional careers in a glance. During this introduction, the Honorable Director General said that in his opinion a judge should be independent and not even the High Court should intervene in the proceedings. He said that let the judge to decide the case and he/she should be independent in doing so. While sharing her experiences, Ms. Uzma Akbar Chughtai, the learned District & Sessions Judge and former Director General Punjab Judicial Academy told that while serving for PJA once she went through a very unique experience when about 35 judicial officers were sent to the Academy with the instructions by the High Court that this is the last chance for them for their improvement. She told the participants that how difficult it was for us to boost the morale and self-esteem of those officers. In addition the Honorable DG said that the Academy should act like mother as how she ignores the minor mistakes and how she pampers the children. He encouraged the passion and the positive efforts done by the respectable guests. He also welcomed the ideas given them and said that whenever a change comes, it comes very slowly, so keep on doing the good efforts. Introducing Mr. Ahmed Siddiqui, Director, IBA CEIF, Madam Alvi said that Mr. Siddiqui is going to describe the difference between ordinary Banking and Islamic Banking. The Honorable Director General said that you people are free to ask any questions because most of the people have these questions in their mind and the purpose of this session is to clarify our vision and concept. He said that if judges concepts are not clear then their performance would be a question mark. Mr. Siddiqui introduced himself and told the audience that along with his current position as a Founder Director of IBA CEIF, he is affiliated with several other renowned institutions like Sharia Department of Meezan Bank as a head, Member of ICAP Islamic Finance Standard Committee, Federation of Chamber and Commerce Islamic Committee and Takaful as a Senior Vice President etc.

Visit of District & Sessions Judges from Punjab, 15 to 17 November 2017 5 Mr. Ahmed Siddiqui, Director, IBA CEIF delivering his presentation He also mentioned the affiliation of IBA and SJA for sensitizing the Islamic Banking among the Judicial Officers. He said that most of the people believe that there is no concept of banking in Islam and the banking is considered as something evil. He explained the Financial Intermediation role of banking system. He shared the knowledge on Islamic Banking in such a way that most of the ambiguities and abstruseness were clarified. The Honorable Chief Justice High Court of Sindh sent the following Judicial Officers for two hours consultative meeting with the respectable delegates: Mr. Imdad Hussain Khoso, learned District & Sessions Judge (South) Mr. Abdullah Channa, learned District & Sessions Judge (East) Mr. Abdul Razzaq, learned District & Sessions Judge/Member Inspection Team-II The meeting started at 12:00 noon on court administration. They were taken to the mausoleum of Quad-e-Azam. They showed their keen interest while visiting the monumental things related to great leader of the nation.

Visit of District & Sessions Judges from Punjab, 15 to 17 November 2017 7 Visit to Quaid s Museum At night the participants were taken to Do-Darya the famous food court of the city where a lavish dinner was arranged by the Academy at renowned restaurant Kolachi. Dinner at Do-Darya The next day on November 17, 2017, a session was conducted by Honorable Dr. Zafar Ahmed Khan, former Judge High Court of Sindh delivered a lecture on court management. No monitoring by District & Session Judge. No Monthly Inspection. No Annual Report. No objective assessment of output. He also described the proactive role of presiding officer by: Fixation of cases as per P.O s capacity. Time Scheduling of the Court work should be notified. Case must proceed. Witness appeared must be examined. Accused in criminal case must be produced. The session was ended on Question and Answers session. Later on the members of delegate paid a visit to High Court of Sindh. The Honorable Chief Justice of Sindh Mr. Justice Ahmed Ali M Shaikh exchanged his views in the meeting. He distributed the certificates among the participants. The members of the delegates delivered a monument to the Honorable Chief Justice and the faculty Members of Sindh Judicial Academy.
