Main Street, Covington, VA 24426 (VSB #17376) Title Insurance: None Part of Map Nos. 01200-00-000-0610; 0620; 0630; 0590 WHEREAS, the Alleghany County School Board is vested with title to certain real property situate in the Falling Springs Magisterial District, Alleghany County, Virginia, pursuant to two (2) certain Deeds, to-wit: (a) Deed, dated June 30, 1982, of record in the Office of the Clerk of the Circuit Court of Alleghany County, Virginia, in Deed Book 307, at Page 82 (Parcel L therein) from the School Board of Alleghany County; and (b) Deed, dated June 25, 1927, of record in Alleghany County Deed Book 61, at Page 258, wherein Irene B. Mann, et vir., conveyed 3-1/10 acres to the School Board of Alleghany County, Virginia; and WHEREAS, the Trustees of the Falling Spring Presbyterian Church are vested with title to certain real property, also situate in Alleghany County, Virginia, adjoining the aforesaid Alleghany County School Board lands, and having been conveyed pursuant, to-wit: (a) Deed, dated January 15, 2014, from the Trustees of the Sinking Spring Presbyterian Church, recorded as Alleghany County Instrument No. 140000154; (b) Deed, dated May 29, 1956, from Myrtle M. Cash, et als., to Trustees of the Falling Spring Presbyterian Church, of record in Alleghany County Deed Book 137, at Page 89; and (c) Deed, dated September 26, 1893, from Caleb Griffith, et als., to the Trustees of the Presbyterian Church, of record in Alleghany County Deed Book 18, at Page 420; and WHEREAS, the aforesaid Alleghany County School Board and the Trustees of the Falling Spring Presbyterian Church desire to establish a boundary line between their aforesaid properties;
NOW, THEREFORE, THIS BOUNDARY LINE AGREEMENT, made and entered into this day of February 2014, by and between CHARLES ALLEN FORNWALT, RYLAND DYER BURCHETTE, and RODNEY WARREN KYLE, Trustees of the Falling Spring Presbyterian Church, party of the first part; and the ALLEGHANY COUNTY SCHOOL BOARD, party of the second part; WITNESSETH: In consideration of the establishment of a true and correct boundary line between their adjoining lands and the mutual conveyances recited herein, but no monetary consideration, the parties of the first part and the party of the second part, to-wit: (A) Agree that the true and correct boundary line between their lands recited hereinbefore is that certain property line, as shown upon that certain plat dated July 10, 2000, by Randall E. Trout, L.S., entitled "Survey For The Falling Spring Presbyterian Church," recorded as Instrument No. 140000155, incorporated herein by reference, and more particularly described as those three (3) survey lines (hereinafter "Boundary Line") beginning at that certain Rod Set on the northerly side of State Route 686, thence S. 30 12' 29" W. 22.80' to a Rod Set; thence S. 22 02' 54" W. 175.69' to a Rod Set; thence S. 13 31' 20" E. 474.35' to a Rod Set along the northerly line of State Route 640; (B) The said Trustees of the Falling Spring Presbyterian Church do hereby Remise, Release, Convey and Quitclaim unto the Alleghany County School Board all their right, title and interest in and to the lands situate to the east of the said Boundary Line; and
(C) The Alleghany County School Board does hereby Remise, Release, Convey and Quitclaim unto the Trustees of the Falling Spring Presbyterian Church all its right, title and interest in and to the lands west of the said Boundary Line. Conveyance of the aforesaid real property by the Church Trustees is authorized pursuant to an Order of the Circuit Court of Alleghany County, Virginia, entered on August 14, 2013, Case No. CL13-151.
