Present: Supervisor Oliverio Councilwoman Annabi Councilwoman Whetsel Councilman Mackay Councilman Luongo Also Present: Town Counsel Florence Town Clerk Sherry Howard Supervisor Oliverio opened the Pre-Work Session at 6:00 p.m. Pledge of Allegiance.DISCUSS BUILDING VIOLATION APPEAL Discussion Mr. and Mrs. Correia, who are in violation and their contractor, were present along with Planning Board Chairman, Mike Raimondi. Supervisor Oliverio did tour their property and saw the existing mounds of unauthorized fill. He said there is a feeling in this town of I ll do it and ask the Zoning Board for forgiveness later. He would like this attitude to stop. Supervisor Oliverio said to Mr. Correia, if you want to do something you need to go through the proper channels, which you did not do. Mr. Correia had fill dumped onto his property in a rather large area. Mr. Raimondi said that a 22,000 feet area was distributed, which is about 240 yards of fill. The Town Engineer has calculated that it may even be more. The applicant did come to the Planning Board, and received a special use permit, but did not mention this part of the job. This appears to make the dumping even more blatant because they knew about it and did not say anything. Council Florence said they can either take the fill out or prove that it is clean. He said this is something that could have been worked out with the Town Engineer. Mr. Raimondi said this could have potentially been approved if it had gone through the proper channels. They need to mitigate this. Supervisor Oliverio said that Mr. Correia needs to be given the maximum fine of $ He also feels that the fines in Town are too low and should be raised as they are a pittance right now. Supervisor Oliverio told Mr. Correia that he needs to go back to the Planning Board and finalize this issue by July 1 st. If he does not fix this, the special use permit he already received will be in jeopardy. There must be consequences. The Planning Board will then tell the Town Board what the resolution is. Council Florence stated that we don t know where the fill came from. There could be macadam in it if it came from a highway, which will get covered over with some other material. Macadam is a toxic material. He inquired as to whether or not it had been tested? Mr. Correias Engineer said they do have plans to test it; and that it came from

2 P R E - W O R K S E S S I O N A p r i l 6, Yorktown s Highway Garage. Mr. Correia said that the fill came from a job going on in Yorktown. It is from a new site next to the Bowling Alley. Supervisor Oliverio emphasized again that this is a new Board and a new era and procedure must be followed. However this case is settled, the $ fine will still be levied, and the site proposal must be finalized by July 1, Councilwoman Whetsel commented that we don t want to set a bad precedent. So the choice is to remove the fill or test it. If the fill is removed it does mitigate the Planning Board. They will only have to work with the Planning Board if they choose to leave the fill on the property. Council Florence said we will make a resolution and take a vote to settle this in July when the answer is given to us; it is premature to do it now. The Correia s Engineer feels that this issue can be settled by the deadline. AMENDMENTS TO THE AGENDA ADD: 2A. Set Public Hearing for the rollover Comcast contract - Cablevision that serves Roaring Brook. 2B. Authorize Supervisor to go out to bid for a repair on the Roaring Brook Lake dike. 2C. Vote at the Work Session on the 20% basement law. APPROVE TOWN BOARD MINUTES RESOLUTION # R RESOLVED that the Town Board accept the Town Board minutes dated March 2, SET DATE FOR PUBLIC HEARING FOR THE ROLLOVER COMCAST CONTRACT THAT SERVES ROARING BROOK We would like to set this Hearing for 5:45 on April 20 th. This is simply a rollover; it is the Cablevision contract that serves Roaring Brook. There is no other company that wishes to take over Roaring Brook. Supervisor Oliverio called other Cable providers and they are simply not expanding anymore because there will be new technology. RESOLUTION #R RESOLVED that the Town Board set a Public Hearing on April 20 th at 5:45 PM to sign rollover contract with Comcast, which serves Roaring Brook. Seconded by Councilman Mackay, unanimously carried

3 P R E - W O R K S E S S I O N A p r i l 6, AUTHORIZE SUPERVISOR TO GO OUT TO BID FOR REPAIR ON THE ROARING BROOK LAKE DIKE The cement is coming loose so the dike needs to be fixed; the dam was fixed last year. RESOLUTION # R RESOLVED that the Town Board authorize the Supervisor to go out to bid for the repair on the Roaring Brook Lake dike. AUTHORIZE TOWN BOARD TO VOTE ON THE 20% BASEMENT LAW We already held the Public Hearing on this law, so now we need to vote on it. Councilwoman Annabi asked if it could be signed right now. Supervisor Oliverio does not want to vote at these special meetings. RESOLUTION # R RESOLVED that the Town Board authorize the Supervisor to sign the 20% Basement Law at the next Work Session - April 13, Seconded by Councilman Luongo, unanimously carried. UPDATE CABLEVISION CONTRACT DISCUSSION Supervisor Oliverio stated that the cable companies are no longer laying lines, because in the future your TV set will pull all its programming from the cloud so nobody is expanding. It will eventually work much the same as an IPad. What we have is what we have. Technology is changing rapidly. Our revenue source will remain the same but there will be some add-ons. He called FIOS and Optimum and found there is no choice. That s why we have to stay with the contract and just do a rollover. UPDATE PARKS AND RECREATION CENTER DISCUSSION Tomorrow Supervisor Oliverio, Frank DiMarco and Philip Keating have a meeting to discuss some possible plans a feasibility study - for a recreation center in the Town Park. They need to get some preliminaries such as square footage, placement, and start talking to some architects. When things are tighter it will be presented to the Board first and then the public.

INVOICE He would like to move this item to the Executive Session RESOLUTION # R RESOLVED to move this discussion on the Andrea Catalina, Esq. invoice to Executive Session. Seconded by Councilman Luongo, unanimously carried APPOINTMENT OF CRAIG COTONE TO PUTNAM VALLEY TOWN SAFETY COMMITTEE RESOLUTION #R RESOLVED, that the Town Board authorize the Town Supervisor to appoint Craig Cotone to the Putnam Valley Town Safety Committee. Seconded by Councilwoman Annabi, unanimously carried. DISCUSS ROARING BROOK LAKE REQUEST FOR APPROVAL OF CARP FENCE CLEANING BID AND SNOW PLOWING Supervisor Oliverio said there was never a contract for this. He would like to accept this bid at the next meeting. RESOLUTION #R RESOLVED, that the Town Board accept the lowest price on the cleaning of the carp fence in Roaring Brook Lake from RJ Chesnut Construction Co., 72 Oakridge Drive, Putnam Valley, New York in the amount of $70.00 per cleaning. The proposal is attached for your review. This bid will be accepted at the next work session meeting
