They should also rerognize he effor pu in by hose of heir fellow sudens who did he organizaional work needed o make he convenion possible. Wheher you have signed up o ake par in he convenion as a delegae or no be sure o aend he convenion's sessions and ake par in Nore Dame's radiional performance of America's grea quadrennial riual. commenary Aborion: Jus he Quesions iiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiii. p a h a n i f; n PART Aborion is an issue which has probably araced more fanaics on boh sides han any oher since he slavery conroversy ended in civil war. Fanaics are irraional bu even reasonable people become easily confused in he angle of inerconneced quesions surrounding aborion. This was obvious in he debae over aborion a he recen Mock Convenion plaform commiee hearings and will likely be even more apparen when all 700 delegaes ry o debae he issue. This wo-par commenary will ry o unangle some of he quesions, jus he quesions, no he answers. This is ambiious enough. The firs quesions deermine he area of he issue we are alking abou: n wha circumsances, if any, is aborion moral? n wha circumsances, if any should aborion be legal? These wo quesions are disinc. No everyhing which is immoral should be made illegal, nor is everyhing which should be legal necessarily moral. For insance: according o he Ninh and Tenh Commandmens, coveous houghs are immoral bu i would be ridiculous o make hem illegal since he law would be unenforceable. Premarial sex is legal in civilized jurisdicions (alhough no a cerain insiuions of higher learning) bu his does no make i moral. Le us look a he moral issue firs. We come here o he key quesion of he whole debae: Wha is he saus of he feus (using feus here o cover he embryo and zygoe as well)? This is no iself an ehical quesion: a quesion of he form ''Wha ough we o do abou X?" is a quesion abou exisence or naure: "Wha is X?" f we wan o know wheher he feus is human we are going o have o decide wha a human being is. Normally i is obvious wheher a paricular craure is human and hence he idenifying characerisic of an indispuably human being over nine monhs. The quesion of feal saus can, herefore, be phrased as Wha are he minimal characerisics which mark a creaure as definiely huijlan? There are hree possiqle kinds of evidence abou h'e saus of he feus: scienific and medical, heological, and philosophical. The scieniss and docors have chared he developmen of he feus and can ell us a wha age i acquires which characerisics and abiliies. Bu hey canno ell us he poin a which i becomes human: ha depends on which characerisics we believe are sure signs of humanness. The heologians can offer help o hose of heir own religion. Bu hose who are irreligious will find lile help from hem and we are looking for a generally accepable answer. The mos crucial evidence will come from philosophical analysis. Since he Greeks firs ried o define man as a raional animal here has been philosophical debae on wha a man is. Philosophical quesions may be raised abou all he cu-lines beween human and non-human which have been drawn across he course of feal developmen. The srices pro-life people draw he line a he sar and say ha he feus is human from he momen of concepion. They poin o he fac ha a your concepion a cell was creaed wih your unique geneic informaion. Bu any cell in your body has precisely he same informaion. is possible o grow culures of human cells in he es ube. Are such living, growing cells wih human genes human beings? Do you ake a human life if you desroy he culure? Graned ha such a culure will never grow ino an adul human; bu if he crucial disincion beween culur and zygoe is wha will happen o hem in he fuure, are you alking abou human life or merely abou poenial human life? Some have suggesed drawing he line when he feus shows brain waves and a hearbea. This is based on an analogy wih he new definiion of deah. s he definiion of deah adequae? s he analogy appropriae? Some sugges viabiliy, he poin when he feus could survive on is own ouside he womb. Bu viabiliy depends grealy on he qualiy of medical aid available. s an American feus human earlier han a Bengali feus because American medicine can keep i alive a an earlier dae? Wha is mean by surviving "on is own"? A newborn baby is as dependen on is moher for all necessiies (excep oxygen) as i was while sill in he womb. The Supreme Cour decision has effecively made birh he cu-line by allowing hird rimeser aborion for vaguely defined reasons of "healh". Bu wha crucial characerisics does he newborn baby have ha i did no have as a feus only hours before? This commenary will be compleed in omorrow's Observer. iiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiipa ric i a berg e son For hose who would like o fanasize ha he days of Nixon's and Michell's regime of "law and order" is behind America, Senae Bill # (S-) may come as a surprise. Officially named he "Criminal Jusice Codificaion, Revision and Reform Ac of 975," i is osensibly designed, wih boh liberal and conservaive suppor, o modernize he Federal Criminal Code. Alhough is original purpose may have been jus ha, in he hands of Nixon's Jusice Deparmen he bill became a lenghy documen of poliical repression. Today, S- is pending in he Senae ofhe Unied Saes. Unless i is soundly defeaed, our consiuional and democraic righs will be seriously compromised. S- embodies a major assaul on he Firs Amendmen. revives he provisions of he infamous Smih Ac, which was passed 30 years ago and laer became he basis for he McCarhy wich-huns of he 950's. The Smih Ac prohibied anyone from advocaing or eaching he desirabiliy of overhrowing he governmen by force or violence. n 957, he Supreme Cour found he Smih Ac o be essenially unconsiuional. However, S- revers o he Smih Ac, albei in a disguised form. The erm "advocacy" is no used bu insead he words "inciemen o... conduc"' are subsiued. A person is liable for a prison erm of 5 years and a fine of $00,000 if, 'wih inen o bring abou he forcible overhrow or desrucion of he governmen of he Unied Saes or of any sae as speedily as circumsances permi, he incies oher persons o engage in conduc ha hen or a some fuure ime would faciliae overhrow or desrucion of such governmen; or organizes, leads, recruis members for, or paricipaes as an acive member in, an organizaion or group ha has as a purpose such inciemen.'' The use of such erms as "incies," "speedily as circumsances permis," "a some fuure ime" and "faciliae" obviously gives he prosecuor unbridled discreion. Under such language, nearly anyone who voices a "radical" opinion of he governmen could nealy fi wihin he sauory prohibiion. The aciviy proscribed is so far away from immediae acion ha advocacy is indeed being penalized. S- could hen easily become he legal basis for a police sae. S- also defines a "rio" as a "public disurbance involving an assemblage of 0 or more persons ha, by violen and umuluous conduc, creaes a grave danger of injury or damage o persons or propery.'' This definiion requires proof ha he danger was "grave" bu he hreaened "injury or damage" need no be significan. The civil righs and aniwar demonsraions of he pas would hen be anamoun o a rio, and paricipaors could face a 3 or 7 year prison erm. The righ o assemble could well become a hing of he pas under S-. The naional defense provisions of S- are equally as chilling. S- would make i a crime o delay or obsruc he "producion, repair, or delivery" of any propery suied for "naional defense use" if he aciviy would be done ''in reckless disregard of he fac ha his conduc migh impair he abiliy of he U.S. o prepare for defense aciviies." Such aciviies as picke lines o proes napalm manufacure or proess agains arms shipmens o foreign governmens migh fall wihin he prohibiion. The penaly is 3 years in jail and can be increased o 7 years during a "naional defense emergency," which he Presiden is auhorized o declare whenever he finds an "acual or hreaened disurbance of he inernaional relaions of he U.S." Oher provisions of S- redefine reason, saboage, and sediion in similarly vague language. These are only examples of he ominous implicaions S- would have on our consiuional freedoms. Wha is so puzzling is he lack of publiciy ha he bill has received in he "responsible" press. Radical papers and underground weeklies have publicized he dangers of S- bu he majoriy of he American public is unaware of his legislaion. The American Civil Liberies Union and he Naional Lawyers Guild have aken up he figh agains S- bu hey have encounered siff resisance from he Ford Adminisraion. Only powerful pressure from he people, in he form of leers, elegrams, and peiions, will sop S-'s passage. would be indeed be ragic if, by heir silence and passiviy, he American people condone a reurn o repression. 5 Wednesday, March 3, 976 he observer 5 Liberaed woman: free like man? by Jeau O'Meara Saff Reporer n an informal alk Monday evening. Siser Ann da Gannon, pas presiden of Mundelein College, challenged he norms of boh Church and sociev which evaluae a woman's worh on sexis raher han human scales. "Women are liberaed in so far as hey are free o do wha men do, no because i's fulfilling, bu because men can do i," she said. "The naure and value of woman is Siser da Gannon challenges women's role in he Church. (Phoo by Mike Kron) esablished in erms of man, raher han in erms of human naure," Gannon sressed. Gannon, a pas winner of he Laeare Medal, spoke o a small predominaely female group, aking issue wih churchmen hrough he ages from Thomas Aquinas o Bishop Fulon Sheen. "Aquinas," she said, "saw women as incomplee men." Therefore, somehing was missing in heir make-up." "Lile wonder," she added, "ha women couldn' be ordained." Bishop Sheen. on he oher hand, saw only he "moherhood role" for all women. f a woman was no a moher physically, hen he only role lef was "Spiriual Moherhood... her crowning glory." "We've been in a box oo long!" exclaimed Gannon. "The radiional role ha boh he Church and Sociey sancon is ha of he weak, proeced, submissive, periodically unsable female. This box is a produc of our own culural hangups and we mus ge ourselves ou of ha box!" Sexism in our sociey is found in he exreme of boh conservaive as well as liberal camps, Gannon believes. "The liberal sees woman as being free o do wha man does, while he conservaive pus woman in he elevaed role of he fulfilled moher.'' "We have overburdened sex oo long as a means of idenifying happiness. The myh ha only hrough sex can we be fulfilled is wha makes dayime elevision dramas so sickening." she said. The woman is cas in he role of one who exiss o please or displease he man. Sad o sav, she coninued, "many women over 40 are waching and living ou heir lives commied o his visual saemen of sociey's evaluaion of he female.'' Wha we should be abou. sressed Gannon, is far more posiive han being a par of his sor of passiviy. "Women should have a share in dealing wih he serious quesions of our ime: race, war, peace, hunger." New aspecs of he problem surfaced during he lenghy quesion period. Asked if sexism was a problem confined o he middle class, Gannon agreed. The difficulies wih having enough housing for parens and complains of noise from paries las year were oher reasons why housing will be handled hrough he CAC, according o Francis Foss, Conference Coordinaor of he CCE and chairman of he CAC. "Las year oo many people sayed," Foss said. " made housing parens more difficul and also here was more noise. Some paries caused complains and parens were no able o ge heir sleep." "We ried o publicize he policy quie early his year," Foss coninued. "We waned o be fair o everyone." Sr. Barbara Couns, Lyons' Hall recor, who was a new recor a Nore Dame las year, complained ha here were no rigid guidelines which sudens were allowed o say las year. "They were no as specific as his year," she said. "On he whole i jus depended on he suden coming o he recor and saying, ' wan o say,' and why. 8 he observer Wednesday, March 3, 976 ND icers looking for home ice edge by Paul Hess.. ' r i! r -... Tuesday afernoon in upsae ndiana was, in a word, miserable. Typically Souh Bend, o pu i anoher way. Wih he emperaure hovering abou fory degrees and a dreary mis suspending iself above he Nore Dame campus, i was he kind of day ha made one hink a leas wice before geing ou of bed. Beneah he souh dome of he ACC all was quie, as Digger Phelps' roundball crew had been given a rare reprieve following a rying weekend. Over in he norh end, however, i was business as usual as he Fighing rish hockey squad prepared for ye anoher weekend. Coach Lefy Smih's alened young eam is undoubedly very ired of he word "crucial" by now. Bu such is he naure of he WCHA race his year. n a season-long scramble reminiscen of he American League in 967, or he Naional in '64, no one eam of group of eams has esablished iself as elie among he res. Wih wo games remaining for each eam, for example, no one of he league's en schools has been eliminaed from he playoff picure. And he seemingly endless possible combinaions of eams, foes, and sies are enough o befuddle even he mos adep suden of Mah 04. Nore Dame's posiion is paricularly confusing. Wih a wo-game series a Wisconsin beginning Saurday, he rish are currenly ied for fourh place wih Michigan, hree poins behind no. 3 Minnesoa. Fourh place is he spo ha Lefy's roops have coveed all season long, as he op four finishers in he WCHA sandings ge he all-imporan home ice advanage for he playoffs opening round. Considering ha Wisconsin is in las place, "playing mosly for pride" as Lefy pus i, and ha Michigan's final opponen, Michigan Sae, is in second, Nore Dame's chances appear prey good. Bu due o he fac ha he Wolverines oaled more goals han he rish in heir four meeings his year, a ie in he final sandings wih he Wolves would do he rish no good. Of course, hird place is no ou of he quesion, eiher--wo Nore Dame wins coupled wih a pair of Norh Dakoa riumphs over Minnesoa "would be ideal," says Lefy. n ha case (assuming ha Michigan doesn' sweep), Lefy's squad would be a home agains Colorado College, "he mos advanageous siuaion," as Lefy sees i. "We're jus hoping Norh Dakoa plays some inspired hockey his weekend," he amiable rish coach candidly declares. Bu Norh Dakoa's no he only eam ha Lefy's couning on o play ''some inspired hockey his weekend,'' because "everyhing else is academic," as he saying goes, unless he rish win wo a Wisconsin. Only an ac of The rish Eye During he las week of March, Nore Dame will be compeing for he naional championship in Philadelphia. This isn' opimisic speculaion abou he baskeball eam, i is he ruh abou he fencing eam. Yes, while Nore Dame spors fans spend hours puzzling over where he baskeball and hockey eams will go in heir respecive ournamens, and who hey will have o play, few know ha he fencing eam is as good as here. Presenly, he rish hold a 2-0 record. They have compiled a sring of 39 consecuive vicories, an all-ime Nore Dame record. There is no official poll for college fencing eams, bu unofficially, Nore Dame is number one. Coach Mike DeCicco has already noified he officials ha ND will be represened a he ournamen, scheduled for March 26h and 27h a Pennsylvania Universiy. ndeed, seems o be he peak of wha has been a gradual rise in he Nore Dame fencing program. The rish have improved yearly, finishing hird in he naion las season. Coach DeCicco feels ha par of he reason is ha young fencers now realize ha Nore Dame does devoe iself o fencers, ha he spor does exis here. Thus he school is acquiring beer ahlees. " like o hink we've always had a successful program," explains DeCicco. ''The naional championship has always been our ambiion. Bu ever since 970, when we hosed he NCAAs, young men have looked o us as a place o go o school and ge a viable fencing program. When we had he Junior Fencing Championships in 97, all he graded fencers aended. A lo of hem never knew fencing had a good program here. Since hen we've been geing qualiy ahlees." DeCicco, who has been he fencing coach since 960, feels he draw of Nore dame as a school has been imporan oo. "Oher schools can offer a <;ee per fencing radiion," he says, "bu no many can offer so well-rounded an experience." He also credis his assisan coaches, Tim Taylor and Ed DeVivo. Taylor has been assisan now for hree years, and DeVivo. he capain of las year's naional championship eam a NYU and now a law suden, is in his firs year as assisan. "There's no magic formula." assers DeCicco, "he credi has o go o hese coaches, and o he fencers hemselves." Bu fencing has a problem. People don' exacly bea down he doors of he ACC o wach i. boass no Errol Flynns, and hey don' jump off balconies and over sairway banisers. Fencing simply isn' a specaor spor. Can i be? "To make fencing a specaor spor requires educaion," insiss DeCicco. "You have o sar wih a program of educaion and exhibiion, o enlighen people. People can' wach a spor wih enhusiasm unless hey know wha i's all abou, how i's scored, ec. does have exciemen and drama if you undersand how i works. "Also," he coninues, " hink you have o offer a big name. 's good o have an excellen fencer on your eam, people like o wach excellence. We have o develop a kind of supersar qualiy so peopie will ake he ime o come ou and wach i.'' Wheher ha is feasible in he near fuure is unclear. Nex weekend Nore Dame hoss one of he op fencing ournamens of he year, he Grea Lakes Tournamen. Unforunaely, mos of he sudens will be gone on break hen. Even he bes fencing seems doomed o anonymiy. l<eepig he opposing goalie in his posiion his weekend will pu he rish in good posiion for a home-ce playoff spo. (Phoo by Tom Paulius) God--namely, a Sparan sweep of heir home and home encouners wih Michigan (admiedly possible, bu "we can' coun on i," says Lefy)--can give Nore Dame he home ice advanage in he even of a spli. Two vicories, or a leas a win and a ie, are in order if he visiors from du Lac are o open he playoffs a home, and failure o do so has radiionally been he WCHA's answer o hari-kari. The ask is a formidable one for a number of reasons. Firs of all, he rish are playing on he road, and a sweep on foreign ice has been somewha of an anomaly in he league his season. Moreover, hey're playing a Madison, he closes hing in college hockey o UCLA's Pauley Pavilion. Lasly, and perhaps mos imporan of all, hey'll be playing he firs game of he series Saurday nigh wihou he services of heir op wo righ wings, Alex Pirus and Kevin Nugen. Pirus and Nugen were unforunaely infused wih he spiri of he Bengal Bous las Saurday agains Duluh (hough i mus be said in defense of "Pie" ha probably l.ndiana ,94 2.Marquee 2 23-,060 3.Rugers N. "Losing Pirus and Nugen isn' going o help us any," Lefy confides. "Sill, our squad has fough agains adversiy all year long," he adds. " hink we are ready for he challenge." Following Sunday's game, he rish will reurn home o regroup, hen begin pracice Monday for he firs round of he playoffs, which begins Wednesday. As o whom hey'll play and where, well... your guess is as good as any. The opening series are wo-game affairs whose winner is deermined by he mos oal goals. n essence, i's a one hundred and weny minue game, wih he second "half" played on Thursday nigh. The secund round of playoffs is slaed for he following Saurday and Sunday, and he wo eams lef advance o Denver and he NCAA Championships. "Tha's six games in nine days for us," Lefy concludes, leaving lile doub ha he wouldn' mind playing a couple more aferwards.
