3 Introduction I am not a genealogist, but over the last few years I have researched my Lee family intensely. For this document the bulk of the information is what other family members and genealogists have recorded, and I have reproduced. My family has a fascinating history. The Lees go back to the very beginnings of Wayne County, Mississippi. Our extended family also goes back to the very early history of our nation. My Lee family has maintained a presence in and around Wayne County, Mississippi for over 200-years. Few other Wayne County families can state likewise. Before 2007, I did not know who any of my great grandparents are, now I know all eight. I wrote this document mostly for my immediate family; my wife, my daughter, my sons and their children. My perception was when developing this document that if I didn t capture this information for future generations, it may get lost to our family forever. I hope now it will be preserved. I did not write this for profit; any information presented here may be copied and used by anyone. I copied most of it myself from a number of sources. It seems this is a living document because over the years when I d think I was just about done, I d find something new to add, or incorrect information that needed changing. I hope others will add information or correct errors they find in this document in the future. Consider this my personal NOTES about my family. I assume no liability for any misinformation that s in this document; I got most of the information from others, and I won t throw them under the bus if they got it wrong. They got their information from others too. I stand on only the information that I captured from my own memory, and very little of it is in this document. Let me stress again, this document is my personal NOTES from other sources. However, these are the facts as I know them TODAY, and the intended audience for this information is for my wife, children, and grandchildren; others are more than welcome to accept; copy or modify; reject or just ponder it all. I found some pretty interesting things doing this work. Each person has 4 grandparents; 8 great grandparents; 16 great-great grandparents, and etc. There are normally 4,096 different individuals that make up a person s 10 th great grandparents. I said normally, because as the generations go back; sometimes distant cousins married, perhaps unknowingly, and you find a set of double grandparents in the mix. I have double 5 th great grandparents with the Overstreets! Three cousins, Charles Lewis, Dr. Ed Smith, and Luther Lee are the main sources of the information I present here. I made great effort to be accurate but obviously some information in this document cannot be verified. I reported what I found. I discovered different family stories for the same family events. Sometimes I offer my opinions about the stories. I did some extra research with respect to some events and investigated the history of that time and included it here. To me, this added information made the total package more interesting. I do admit to some conjecture on my part, 3

4 and I know that some of the data presented here obtained from others involves their conjectures too. Bottom line is I tried to be accurate, and this is the best effort I can make with the information I presently have. One criticism that I ve had about this document is that I repeat information over and over too much. I plead guilty. I want to make each section of this document sort of independent of the others. To do that, I had to repeat some information. However, if you read real close, you will most likely find a tad-bit of more info in the repeated areas than was presented previously. When I first started this document it was to record what I could find out about my Lee and Hyatt lineages. However, as I started discovering things, my knowledge expanded to include other families that are my extended families; like the Busbys, the Overstreets, the Braswells, the Shows, the Wests, and the Farmers. In fact when reviewing the Busby family, I found a source that expanded it back for over 700 years back to England! I don t claim to be an excellent speller; like most engineers I m a poor one. I am sometimes good at English, but not great. In writing something this big, I know for sure that I made a lot of errors. I did not have a professional editor to check this work for me; so expect to find errors. However, some misspellings are intentional as I did not know how some individuals spelled their names, and I left some different spellings as I found them on different sources. Also, some documents I did a simple cut and paste from elsewhere. When I did that, I left the spellings as they were unless I absolutely knew differently. In old Wills and other data and old documents, I left the spellings just as I found them. As a footnote to this introduction, in 2013, someone asked me if I was kin to the Lees living in Stateline, Mississippi and in Washington County, Alabama (the Millry, Alabama area). After doing some weak research, the answer is; I think so. Previous to this trivial research, I thought no. However, there might be a connection through Randall Lee. Randall Lee was Superintendent of Education in Wayne County, Mississippi for many years. His signature is on my own 1971 high school diploma. Some Lees in Stateline and in Washington County, Alabama told me that they are kin to him. According to my Aunt Polly (Lee) Lott, who is 71-years old (in 2013); we too are kin to Randall Lee through my Grandfather Gerod Lee (her father). Aunt Polly could not, however, remember the actual blood line. Aunt Polly is a lifelong resident of Wayne County and is the only surviving child of my Grandpa Gerod Lee. In my immediate Lee family, she would be my only means to make the connection via someone s living memory. 4

5 While doing this family research something jumped out to me that I before never considered. I use to think that the 1800s was a long time ago; almost ancient in nature. My Grandpa Hyatt was born in I was born in 1952 and my Grandpa Hyatt died in I m now 61-years old (Jan 2014), and I remember Grandpa Hyatt well as I was nearly 8-years old when he died. Thus I can relate to someone that lived in the late 1800s pretty well. I sat in his lap as a young child; he saw me nearly half-grown before he passed away. The 1800s were not really that long ago. Then another thing hit me. Over the years I have met a few people that were in their late 90s or even in their 100s. Now consider this; if Grandpa Hyatt knew someone that was about 100 years old when he was age seven; that would be in the year 1892; then he could have known and remembered someone that lived in the 1790s! That seems unreal, but it could be possible and very likely; a person born in 1799 would be only 86-years old when my Grandpa Hyatt was born. And if so, then I could say while I never knew anyone that lived in the 1700s, I personally knew someone that did! I am sure, if not my Grandpa; I have known someone during my early life that knew someone that lived in the 1700s. It only takes a few generations to go WAY back! Families span time. My extended family history in America goes way back; almost to the very first white settlers from England. I am presenting this information for the Internet in four Parts. The original document I wrote was not broken up and is right now about 480 pages long. It is too long to upload to the Internet, thus I ve broken it up into four Parts. I am not finished with this work and will likely update it for some time to come. This document is becoming a most pleasurable hobby for me. Part 1, the document you re now reading, covers the Lees from the time they first arrived in America from England. Then from Virginia the Lees migrated to North Carolina. Part 1 describes this and documents the Lees through my 4 th Great grandfather. His son migrated to Wayne County, Mississippi in the early 1800s. Part 2 covers my 3 rd and 2 nd Great grandparents in some detail and then it documents my Lee lineage up to the present day Lees. Part 3 covers the Old Lee Cemetery. My hope is the old cemetery will never be lost, but there is a real danger of that happening one day. Part 4 covers my Hyatt family as well as the extended Lee and Hyatt families. Part 4 also covers my Busby, Overstreet and Farmer families. I was amazed at what I found out! There is a lot of history that our ancestors played a part in. History certainly shaped their lives, as it does ours today. To me, I found this history entertaining. Try to imagine how life was for our forefathers. 5

6 The Lees of Wayne County, Mississippi There is much confusion about our family tree. The surname Lee is one of the most common surnames in North America; and obviously we are not all related. The Henry Lee Society is a genealogical organization devoted investigating the lineage of the Lee and similar surnames. This Society is becoming one of the largest and most devoted communities of researchers in the world. Their website is The Henry Lee Society at one time connected my Lee family of Robeson County, North Carolina to Henry Lee of Shropshire, England. However, several DNA tests have shown that my Lee family linage goes back to John Lee of Nansemond County, 1 Virginia. Nansemond County, now extinct, existed in Virginia from 1646 to 1972 (above from an 1895 map) 1 Nansemond County, Virginia is an extinct county. It was named for the Nansemond American Indian tribe. It is around Suffolk, Virginia 6

7 Sometime before 2007, my second cousin once removed, Luther William Lee, took a DNA test sponsored by the Henry Lee Society. 2 Luther s test proved that he belonged in the John Lee family group. 3 In the summer of 2007, I also took a DNA test sponsored by the Henry Lee Society that, as expected, linked me to the John Lee family group too. The Lees of Wayne County, Mississippi are descendants of this John Lee. Larry and Luther Lee (left to right) Lee s Chapel Freewill Baptist Church Wayne County, Mississippi May 2007 The research of the Henry Lee Society has found that the John Lee of Nansemond County family group appears to be one of the largest Lee-surname clans in the USA in modern times. I am now an active member of the Henry Lee Society myself as of November With those two DNA tests, my Lee family lineage was found; with no doubt. These two DNA tests were taken in different years, analyzed by different laboratories, yet they yielded SAME results for Luther and me. I am very aware that many of my kin folks are likely to dispute and reject the lineage that have recorded in this document, mostly because for many generations incorrect information has been passed down to them, and they sincerely believe what they have been told all their lives. I myself would have rejected this information in the 1980s; however, the odds of two DNA tests being wrong are inconceivably small. There is also overwhelming research evidence that I have found that was done by the many researchers of our family line literally from all over the nation that verifies the John Lee lineage for my family. The Lees did not start out in Wayne County; Part 1 is their story. I now present to you the Lee generations; starting with the first of my Lee family to step foot in America. 2 Luther s great grandfather Robeson Robert Earl Lee is my 2 nd great grandfather. Luther and my Dad are 2 nd cousins. 3 John Lee was known both as John Lee of England and/or John Lee of Nansemond County, Virginia. 7

8 Generation 1: John Lee of England 4 ~ Sometime before April 1694, the ship Bonaventure landed in Virginia carrying 169 passengers. One of those passengers was my 6 th Great grandfather, John Lee of England. My kinship to this John Lee has been verified by DNA tests that both my cousin Luther Lee and I took for the Henry Lee Society. John Lee was born about 1670 in Leicester, England. We know that John arrived in Virginia sometime before April 1694 because in April 1694 John shows up on a Virginia Land Patent that identifies him as having a party of 20 persons (including him) from England. We can assume he was very wealthy because the costs of transporting 20 people from England would have been enormous for his day. Five of those in his party were Negroes. John Lee was given 960 acres in the upper part of Nansemond County, Virginia as a land grant by the King of England. My guess is that this would be a land area near where Suffolk, Virginia is today. John Lee of England was also known as John Lee of Nansemond County, Virginia. In about 1694, John married a woman named Mary. Mary was born ~1675. We don t know Mary s maiden name for sure, but old Virginia land transactions show John Lee and wife Mary Lee on them. Much of what is known about John Lee is linked to his land transactions. Mary s maiden name may have been Mary Emerson. There was a Mary Emerson that was one of the 20 passengers that John paid passage for on the ship Bonaventure. John Lee was a member of the Planter Class of early immigrants. In the early South, the men were considered to be in one of three primary social classes; the Planter Class, the plain folk and the hill people. (Women were considered below these three classes.) Members of the Planter class were the wealthier and included property owners, landlords, creditors, and marketers. They often embellished old European ways such as chivalry, education, leisure, elegance and social grace. 5 John Lee was a very successful man. The evidence of such lies in the fact that he left considerable land holdings to his children in both Virginia and North Carolina. Several deeds after 1738 from John s children specifying acreage from the original 1694 land grant were used to verify John s death. 4 Information obtained from Charles Lewis website. I have expanded some of his information occasionally with information from other sources and with historical facts about that period of time. 9 Suffolk, Virginia (Red) From a number of sources; John and Mary had 7 children: 1. James Lee, born ~1702 in Nansemond County, Virginia. 2. Joshua Lee, born ~1706 in Nansemond County, Virginia. 3. Godfrey Lee, born 1707 in Nansemond County, Virginia. 4. John Lee, born ~1709 in Nansemond County, Virginia. 5. Mary Lee, born ~1710 in Nansemond County, Virginia. 6. William Lee, born ~1714 in Nansemond County, Virginia. 7. Richard Lee, born 1716 in Nansemond County, Virginia During the British rule of the colonies, John Lee lived under the following kings and queens. Charles II was King of England from James II was king from when he was deposed. William III (William of Orange) and Mary II ruled jointly as King and Queen from ; and William III ruled alone from Queen Anne ruled from King George I ruled from and George II was king from I am the ninth generation of Lee males from John Lee of England. 9

10 John Lee paid for 20 passengers (including him) that came to America from England on the ship Bonaventure: 1. John Lee 2. Dennit Abney 3. Mary Emerson (perhaps John s future wife) 4. Hannah Hains 5. Elizabeth Evans 6. Catherine Jones 7. Rachell Redfera 8. Alice Godale 9. Thomas Godale 10. George Lawrence 11. Walter Wright 12. William Knowles 13. Adam Roach 14. John Watts 15. John Saterwhite Negroes: 16. Pallas 17. Attkena 18. Jupiter 19. Vulcan 20. Mars If the five Negroes were servants or slaves, they may not have been servants or slaves to John Lee. They could have been servants or slaves to some of the other passengers that John paid passage for. There is also the possibility that the Negroes were indentured servants. There is a chance that they were free. 10

11 It is now being suggested by the Henry Lee Society that we descend through an Anglican rector, Thomas Lee, from Leicester, England. Thomas was born about Both his son and his grandson entered the ministry and all were graduates of the University of Oxford located in Oxford, England. Perhaps my 6 th Great grandfather John Lee was a graduate from Oxford too, but I found nothing to indicate that was the case. Oxford is the oldest English speaking university in the world, and is the world s second oldest surviving university. There is evidence of Oxford s existence as far back as the year This lineage goes as follows: Thomas Joseph I Joseph II John Lee of England Joseph Lee II would be my 7 th great grandfather Joseph Lee I would be my 8 th great grandfather Thomas Lee would be my 9 th great grandfather. Leicester, England: Since my 6 th Great grandfather John Lee (and perhaps his father, grandfather, and great grandfather) came from this city, I decided to look at some of its history. Leicester is a very old English city that lies on the River Soar near the city of Birmingham. Its history goes back over 2,000 years; that s before Jesus Christ was born. It was a tribal center during Roman times, and was probably a Roman fortress and there is an old Roman bath still in existence today that was built about 150 AD. In the medieval period, , it had a population boom. Key buildings were either built or rebuilt during this time; and many of these buildings exist today. In 1645, during the English Civil War, the town was a Parliamentarian stronghold. The forces of King Charles I laid siege to the town. The city was quickly captured and there was a large loss of life, but it was said that the Parliamentary press in London greatly exaggerated the severity of the event. Today it is a modern city with a rich and diverse culture. Semper Eadem means ever the same. 11

12 Generation 2: Joshua Lee 6 Bertie County, North Carolina ~ Joshua Lee was the second oldest child of John and Mary Lee of England. He was born in 1706 in Nansemond County, Virginia. In 1728, the Virginia and North Carolina boundary was surveyed. The results of this survey shifted the boundary between Virginia and North Carolina, and some of the Lee family property wound up in what was then Bertie County (now Gates County), North Carolina. In 1730, Joshua married Mary Woodard in Bertie County, North Carolina. She was born on ~1710 in Beaufort County, North Carolina. She is the daughter of John and Margaret Woodard. Joshua and Mary would have grown up about 4-miles from each other according to some sources; Joshua on the North Carolina side of the border and Mary on the Virginia side. Joshua Lee and Mary Woodard are my 5 th great grandparents. Mary s parents, John and Margaret Woodard, are obviously my 6 th Great grandparents. Joshua s son Jesse Senior fought in the Continental Army that was commanded by General George Washington. This could be an indication that the Lee family supported independence from England. I have a section for my 4 th great granduncle Jesse later in this document; a few genealogists suggest he may be my 4 th great grandfather. I think that information is incorrect, but I cannot absolutely eliminate the possibility. Examination of land transaction records indicate that by 1760 Joshua migrated south to what would become Duplin County, North Carolina. Joshua s sons migrated even further south to what would become Edgecombe and Robeson Counties, North Carolina. Mary (Woodard) Lee probably died after February 1765 in Edgecombe County, North Carolina. It is thought that Joshua died ~1782 in Duplin County, North Carolina. Joshua Lee was born under the rule of Queen Anne of England; she was queen from King George I was king from King George II was king from King George III was king from Information obtained from Charles Lewis website. 13 Gates County, North Carolina Edgecombe, County, North Carolina Duplin County, North Carolina From the maps above, you can see Joshua Lee s migration from the Virginia-North Carolina border to Duplin County. In about 1713, Robert Braswell and a number of his Braswell family moved into what became Bertie County, North Carolina (now Gates County). This Robert Braswell is my 7 th Great grandfather. As I stated in this section, in 1728 when the Virginia-North Carolina border was surveyed and shifted, some of the Lee property ended up in Bertie County. Thus, the Lees and the Braswells were neighbors in the early 1700s. However, best I can tell, it was a few generations later before the Braswells and Lees became connected by marriage; but I found evidence that the two families likely have known each other for over 300-years; from North Carolina to Mississippi; perhaps more than 60-years longer than the United States of America has existed! The Braswells were in American a few years before the Lees. My children and I are descendants of both of these families. 13

14 From the Internet, I found that Joshua Lee and Mary had 7 children 7 : 1. Joshua Lee, born ~1730 in Bertie County, North Carolina. 2. Jesse Lee, born ~1735 in Bertie County, North Carolina. 3. Reverend John Lee, born ~1737 in Bertie County, North Carolina. 4. Abraham Lee, born ~1741 in Bertie County, North Carolina. 5. Margaret Lee, born ~1742 in Bertie County, North Carolina. 6. Zachariah T. Lee, born ~1745 in Bertie County, North Carolina. 7. Elizabeth Lee, born in 1746 in Bertie County, North Carolina. I have highlighted the two brothers, Jesse and Zachariah, for a reason. I can use DNA tests, Wayne County, Mississippi records, and oral Lee family history to trace my lineage back to my 3 rd Great grandfather, Samuel Jefferson Lee, Senior. I m about as sure as one can be that Samuel Lee, Senior is my 3 rd Great grandpa. There is some disagreement between sources as to who Samuel s father is. For many years, I thought that Jesse Woodward Lee, Senior was Samuel s father. Jesse s and Zachariah s parents are Joshua and Mary Lee, as shown above. In the year 2013, I found strong evidence that suggested that Zachariah T. Lee was Samuel s father. Jean Strickland states in Who Lived Where in Wayne County?, that Samuel Lee is the son of Zachariah Lee and Lucy Farmer of Robeson County, North Carolina. Jean is backed up by data in the Henry Overstreet lineage that states that: Martha Patricia Patsy Overstreet married John Asbury West, Sr. and after his death she married Samuel Lee, the son of Zachary T. Lee and Lucy Farmer. Most sources state, including some very old oral family stories, that Samuel had an older brother named Everett. Charles Lewis believes that Samuel and Everett are in the household of Lucy (Farmer) Lee, the widow of Zachariah Lee, in a 1786 Bladen County, North Carolina census. Thus the brothers are believed by Charles and others to be the children of Zachariah and Lucy Lee. Still per a telephone conversation I had with Charles Lewis in 2013, while he does indeed believe Zachariah is Samuel s father, he stated that there are still some professional genealogists that focus on Jesse Senior as being Samuel s father. Obviously, no matter which one between Zachariah and Jesse Senior is Samuel s father; Samuel s grandpa is Joshua Lee, so the family lineage back to John Lee of England is preserved. 7 Not all listed are certain to be children of Joshua and Mary Lee, however all are thought to be by several genealogists. 14

15 John and Margaret Woodard John and Margaret Woodard are my 6 th Great grandparents. They are the parents of my 5 th Great grandmother Mary (Woodard) Lee. Mary is the wife of Joshua Lee. Proof of John Woodard being the father of Mary Lee is provided in John Woodard s Will where John Woodard mentions his daughter Mary Lee. Some suggest that the last name is spelled Woodward. I am going with Woodard because that is the spelling used in John Woodard s Will. John Woodard was born in about 1690 in Isle of Wight County, Virginia. In about 1710, John married Margaret; but only her first name is known. Sometime before August 1748 the family moved to Edgecombe County, North Carolina. John Woodard left this Will: (which gives us the names of his wife and children) Edgecombe County, North Carolina Will Book A, p. 146: Will of JOHN WOODARD: Written Feb. 11, 1765; Proven July of 1765, Parish of St. Mary, Edgecombe Co., North Carolina. Wife Margaret Woodard; son Elisha Woodard; son John Woodward; daughter Mary Lee; Margret Brown (daughter of said Mary Lee); Leonard Langston and Ann {Woodard Langston} his wife; granddaughters Sarah Langston and Elisabeth Langston; James Holland and Sarah his wife; grandson John Holland; son Thomas Woodard. Residue of my estate to my wife for her widowhood and then to be divided among my six children before mentioned. Executor of estate: son Thomas Woodard. Witnesses: Stephen Cobb, James Barnes, John Drew (July 1765 Court). John died after February John and Margaret Woodard s children: 1. Mary Woodard born 1710 Isle of Wight County, Virginia 2. John Woodard, Jr. 3. Thomas Woodard 4. Elisha Woodard born 1724 Isle of Wight County, Virginia 5. Ann Woodard 6. Sarah Woodard 15

16 Dad Woodard of England John Woodard s father is Dad Woodard of England. Dad Woodard would be my 7 th Great grandfather. Obviously Dad Woodard was born in, and migrated from, England. We do not know the names of Dad Woodard s parents or his wife. From old documents, we know he had at least two children: 1. John Woodard Senior 2. Joel Woodard 16

17 Generation 3: Zachariah T. Lee 1745 ~1784 Zachariah Lee is my 4 th Great grandfather. Some genealogist focus on Jessie Woodrow Lee, Senior (also a son of Joshua Lee) as being my 4 th great grandpa because they believe Jesse is the father of Samuel Lee, but the evidence now strongly discounts that. The following is from Charles Lewis website: According to many researchers, Samuel Lee is the son of Jessie Lee of Robeson Co NC. However according to Jean Strickland in Who Lived Where in Wayne County?, Samuel Lee was said to be the son of Zachariah Lee and Lucy Farmer of Robeson Co NC. Zachariah Lee was born in about 1745 in Bertie or Edgecombe County, North Carolina. Edgecombe County was formed from Bertie County in 1841 and that s the source of confusion about his birth county. He is the sixth child of Joshua and Mary Lee. He grew up on his father s farm. The family migrated from Bertie County to Duplin County in about Zachariah Lee married Lucy Farmer on October 11, 1763 in Edgecombe County. Lucy was born about 1745 in Halifax County, North Carolina. They both were about 18-years old. His marriage to Lucy is very significant. Lucy s ancestors were among the very first English settlers to come to America. I will talk about the Farmer family later in this document. Sometime after February 1770, probably before 1779, Zachariah and Lucy migrated to the area that became Robeson County, North Carolina, as did a large number of the Lee family. Apparently this area that would become Robeson County had a number of Tories living in it. Tories were colonists that were loyal to the King of England and did not want to succeed from British rule. This move may have proven to be fatal for Zachariah; I ll explain this statement later. A land document from 1784 notes that Lucy Lee, a widow, owned 1,549 acres of land in the Capt Regan s District of Bladen County, North Carolina. Because of this note, it is assumed that Zachariah died at the relatively young age of about 39 in about or before the year That may have been about the average lifespan for that period of time. Having left his widow 1,549 acres of land, it appears that Zachariah was well off. However back in his day, the fact a person owned a lot of land did not necessarily mean he was extremely wealthy. The question would be, was the land forest or cleared for farming? The more land cleared for farming, the wealthier the individual was. 17

18 In a 1786 Bladen County, North Carolina census, Lucy Lee is listed as head of household. It is believed by some genealogists that her household had the following individuals in it: Jesse, Everett, Samuel, and unknown son, Hester, William, and Lucy (herself). Children of Zachariah and Lucy Farmer: 1. Jesse Lee (was under the age of 21 in the 1786 Bladen County, North Carolina Census) 2. Everett Lee, born ~1771 in Bladen County, North Carolina. 3. Samuel Jefferson Lee, Sr., born in 1772 in Bladen County, North Carolina. 4. Unknown son. 5. Hester Lee, born in 1776 in Bladen County, North Carolina. (daughter) 6. William Lee, born 1778 in Bladen County, North Carolina. To confuse us all later, both Jesse Lee, Senior and his brother Zachariah Lee named a son Jesse Lee. At the time they named their boys; the generational suffix junior may not have been used to identify either of them. Thus we find two cousins named Jesse Lee that are about the same age and living in about the same areas. In this document, I call Jesse Lee, Senior s son Jesse, Jr.; which is logical. However, not everyone distinguished between the two just calling them both Jesse. Even the suffix Junior may have been mixed up between the two Jesse cousins in past documents; and this is totally not helpful to us now. The majority of Zachariah and Lucy s children migrated south and west to Mississippi, as did a large number in our Lee family; cousins and siblings alike. (Jesse Lee, Senior s children were among them.) One can only speculate, but something triggered their difficult migration. Perhaps they just all wanted to move on to something new. Lucy Lee is also listed as the head of household in the 1790 Robeson County Federal Census. I believe that the 1790 Federal Census was the first Federal census taken in the United States. In the 1790 Census, Lucy had two males over the age of 18, one male under the age of 17 and two females (including her) in her household. Two of the three males are thought to be Samuel Lee and his younger brother William. The two females are thought to be Lucy herself and her daughter Hester. In 1787 Robeson County, North Carolina Probate records, we find in Robeson County deeds, H. Brown, Sherriff of Robeson County, to Jesse Lee, 100 acres on Flowers Swamp, land of Lucy Lee sold at auction at estate settlement. Also found in Robeson County, North Carolina deeds: Feb. 6, Lewis Ivey of Robeson to James Suggs, 100 acres on Flowers Swamp, beginning at John Lambert s corner, west side of swamp. Witnessed; Stephen Starling, Lucy Lee. This Lewis Ivey land transaction is that last public record of Lucy Lee. Grandma Lucy s death date is cited as sometime after February

19 The 1801 Lewis Ivey land transaction is also interesting to me for another reason. Often land transactions back then were witnessed by other relatives. There is no way for me to tell if Lewis Ivey, Stephen Starling and/or Lucy Lee are related; but they surely could have been. An earlier land transaction, in February 1761, Jesse Lee, Senior shows up in Edgecombe County 8 records were he purchased land from Frances Ivy. Jesse is the brother of Zachariah Lee. In 2007, in the Old Lee Cemetery near the Chickasawhay River near Waynesboro, Mississippi, I found the graves of Ethel James Ivy (6/17/1899 2/18/1935), J. Edward Ivy (12/11/1934 2/11/1936) and Ruby Lee Starling ( ). I am very confident that everyone buried at the Old Lee Cemetery is related. So these three graves establish to me that there was/is a relationship between the Lees, Ivys and Starlings that existed in late 1800s through the mid-1930s and beyond. (I estimate these years by examining the dates on the headstones.) Looking at the 1801 Lewis Ivey land transaction, and the Feb 1761 Jesse Lee land transaction, could it be that the Lees, Iveys (Ivey; perhaps now spelled Ivy), and Starlings had a family relationship as far back an 1801? It is amazing that a lot of the families that are now my ancestors knew each other for a very long time going back with some to early Virginia in the late 1600s and early 1700s; others in the early Carolinas and early Georgia; all of this was way before they all came to Wayne County at different times in the early 1800s and eventually intermarried there. Examining other families and their migrations shows this pattern was not uncommon. One of my coworkers has ancestors that migrated from New England to Indiana. Once in Indiana they married into local families in the 1700s. Then the related families (brothers and sisters with spouses and children) moved farther out west scattering at different settlements along the way. Then their future generations moved on even farther out west. In about 100 or more years later, they found each other again in Nebraska, and intermarried there not knowing that they were descendants of earlier ancestors that made them distant relatives. Generations of females assumed names of the men they married, thus some just lost track of distant cousins. Some had changed the spelling of their family name which provided more camouflage to the situation. Others just didn t know they were related; some probably did not care. This could have happened with the Lees, Braswells, Overstreets, the Busbys, and Farmer families as well. The 1801 Lewis Ivey land transaction could be a clue to another link. Zachariah Lee was born under the rule of King George II of England. George III was king from and thus the ruling king when Zachariah died. 8 In 1742, Edgecombe County, North Carolina split from Bertie County, North Carolina. 19

20 The Rebecca Clark Letter In 2007 Luther Lee gave me a letter that was sent to him by Rebecca L. Clark in May I told Luther that I wanted to photo copy it and perhaps use it in a write up about our family, and Luther agreed to allow me to do so. I have tried to contact Rebecca myself, but failed in my attempts. I am not sure if she is still living (in 2013). Below is an excerpt from the letter. Rebecca is a distant cousin to Luther and me, but I do not know the exact lineage. It is obvious that Rebecca has done a lot of research on our family. She communicated several times with Luther about her research. She stated in her letter that she was going to continue her investigation next year (2005) by examining Robeson County records. If she was able to do more investigation(s), some of her information below may now be changed as a result, but I do not know that for sure. Rebecca s words are in italics. I supplied the information in brackets [ ] to make her information clearer to those not familiar with her subjects. I did not post the entire letter; but only what I thought was important for our family research. Perhaps the information might be helpful to a future researcher. Rebecca Clark writes to Luther Lee: As to who was the father of Samuel [Lee], it would appear at this time to possibly be Jesse, Sr. (although Samuel did not sign as an heir [after Jesse s death] he may have already been in S.C. [South Carolina] along with Everette Lee who is another possible brother of Samuel); other possibilities for Samuel s father would be Zechariah Lee, a brother of Jesse, Sr., or John Lee would was also a brother of Jesse, Sr. I tend to lean toward Zechariah being Samuel s father because of the names of Samuel s sons: Jacob & Zechariah. It is proved in court records that Zechariah, Sr. had sons named Isaac, Jacob, and Jesse, Jr. The Jesse, Jr. may be the Jesse that you [Luther] heard was a brother to your Samuel. A Mr. Lewis who resides in Texas has been researching your line for many years, as has a different Lee descendent who lives in McComb [Mississippi]. The Texas descendant believes that Jesse, Sr. is the father of Samuel and the McComb descendent, according to stories handed down in his line, believes that Zechariah was Samuel s father. This man s family has handed down the story that Zechariah was killed by a Tory. One thing is certain, Zechariah was deceased by 1783/84 or slightly before so this could be a true story. It is my understanding that most of Robeson Co. was composed of Tories or Tory sympathizers. 20

21 My comments on Rebecca s letter: Rebecca starts out by saying that Jesse Sr. is possibly Samuel s father, but then she seems to advocate Zachariah because Samuel Lee named two of his sons Jacob and Zechariah. She also states that Zachariah Senior had sons named Isaac, Jacob and Jesse, Jr. She stated that there are court records stating so. I wish I could find those court records myself because I could not find any other evidence that Zechariah had sons named Isaac and Jacob; but I m not saying it is not true. Zechariah and Jesse, Senior both named one of their sons, Jesse. Situations like this makes a genealogist s head spin because there were cousins both named Jesse Lee living at the same time. I don t understand Rebecca s use of Zachariah Sr. in her letter because I cannot find a corresponding Zachariah Jr. That s no big deal for me with respect to this document, however. According to data I found, Rebecca is correct that Samuel named two of his sons Jacob and Zachariah. Rebecca is also correct that Jesse had a brother named John. I found in an older family document, The Jesse Lee, Sr. family is enumerated in the 1790 Robeson Co NC Census. And, many family members are also found in the immediate area--brother John, Sr., Lucy the widow of brother Zachariah, and Joseph, Jesse, Stephen, and Everett who are believed to be sons of Jesse, Sr. Note, the word enumerated means that there were numbers given for the children of Jesse Lee, Senior in that census but not the children s names; which is unfortunate. Some family lists now suggest that Everett is the son of Jesse Sr., and if so, Samuel and Everett are cousins, not brothers. However, they were for sure related! I once thought that Rebecca s statement that The Jesse Jr may be the Jesse that you [Luther Lee] heard was a brother to your Samuel once again targeted Jesse Senior as being Samuel s father. However I now realize that both Jesse Senior and Zachariah named a child Jesse. Which Jesse was she talking about? The speculation adds to the fun and frustration to get it right. Rebecca s story about Zechariah Lee being killed by a Tory or a Tory sympathizer is interesting. If true, Zechariah would have been killed at the young age of about 39. He would have died just a year or two after his father, Joshua, died. If Zachariah was killed by a Tory, we can assume that Zachariah was killed because he supported the American Revolution. The Lee family appears to have supported the colonies obtaining independence from England. Zachariah s brother Jesse Senior fought against the British in George Washington s Continental Army. 21

22 Rebecca was right in her letter that there were a number of Tories and Loyalists in the area that was to become Robeson County at that time. I found the following in the history of Robeson County, North Carolina: The Tories and Loyalists burned the plantation homes of Captain Thomas Robeson and Colonel Peter Robeson, members of the Whig family for whom the County of Robeson was named. 9 Previous to seeing Rebecca s letter, I had been told stories that the Lee family encountered difficulties with the Tories. I was not sure if these statements were based on fact or not; but now I have Rebecca s story that seems to back them up. I first included Rebecca s letter into my document in At that time I was sure Jesse Lee, Senior was my 4 th Great grandpa. Now in 2014, I am sure that Zachariah Lee is my 4 th Great grandpa. Since I first read Rebecca s letter I have found two good sources that state that Zachariah, not Jesse, Senior, is Samuel Jefferson Lee, Senior s father; Samuel is my 3 rd Great grandfather with no doubt. 23 The bump in the road: Without doubt, my 3 rd Great grandfather is Samuel Lee Senior. DNA testing and Wayne County Census records verify this fact. My 5 th Great grandparents, Joshua and Mary Lee, had sons named Jesse and Zachariah Lee. There are conflicting data as to which one of these brothers is the father of my 3 rd Great grandpa Sam. There are professional genealogists believe that Jesse Lee is my 3 rd Great grandpa Samuel s father. Also, there are professional genealogists that believe Zachariah Lee is Samuel s father. New evidence (to me) suggests that Zachariah Lee is Samuel Lee s father. Jean Strickland states in Who Lived Where in Wayne County?, that Samuel Lee is the son of Zachariah Lee and Lucy Farmer of Robeson County, North Carolina. I have also recently found the following entry in the Henry Overstreet lineage records. It states: Martha Patricia Patsy Overstreet married John Asbury West, Sr. and after his death she married Samuel Lee, the son of Zachary T. Lee and Lucy Farmer. In September of 2013, I have found documentation in a Charles Lewis website that states that in a 1786 Bladen County, North Carolina Census, Lucy Lee had four males living in her household: Jesse, Everett, Samuel and William. She also had two females: Hester and an unknown female. All sources I found agree that Samuel and Everett are brothers. Samuel and Everett s presence in the household of Lucy Lee, who was Zachariah Lee s widow, is pretty strong evidence that Zachariah is Samuel s father. One could argue that perhaps Jesse s children (Everett and Samuel) moved to live in Zachariah s household after Zachariah s death. Lucy was left with over 1,500 acres of land to tend to; perhaps she needed help and her nephews came to help her out. But there is absolutely no proof this is true. If the all the males listed in the 1786 census for Lucy Lee s household are the children of Zachariah and Lucy Lee, then Zachariah is my 4 th Great grandpa; case closed. I think that s true because the 1790 Federal Robeson County Census shows Samuel still in Lucy s household. Samuel s older brother Everett would have been old enough to leave home by this time if he had wanted to. Just in case Jesse is my 4 th Great grandpa, I am including the following write up about him. 23

24 Jesse Woodard Lee, Senior Robeson County, North Carolina: ~ He is likely my 4 th great granduncle. However he could be my 4 th Great grandfather. In this section for Jesse Lee, Senior I have included some old documents that I thought very credible when I first found them. Now they are questionable with respect to the data in them showing that Everett Lee and Samuel Jefferson Lee, Senior are Jesse s sons. However, some genealogists still believe that Jesse is their father; and some old family documentation reflects that. Because Jesse was a Revolutionary War soldier, it would be neat if he was my 4 th great grandpa, but I am submitting to what I think is the truth. Right now, I cannot say 100% that Jesse Lee Senior is not my 4 th Great grandfather, but I now think from newer evidence I ve found that the odds of him being so are very slim. Still, just in case, here are the old data that I found about Jesse Lee, Senior; he could be my 4 th Great grandpa. Jesse Lee, Senior, was the second child of Joshua and Mary Lee. He was born in 1735 either in Bertie County or Bladen County, North Carolina. I suspect it was Bertie County. In 1841, Edgecombe County was formed from Bertie County. Thus he has property transactions that are recorded in Edgecombe County. Jesse fought in the Revolutionary War ( ). He was a member of the Continental Army which was commanded by General George Washington. 10 The Daughters of the American Revolution recorded some of Jesse Lee s history. They have placed a foot marker at Jesse s grave which I hope one day will help me find his gravesite. On source states that Jesse Lee appears as a Private in Ballard s Company in the Roster of Soldiers from North Carolina In the American Revolution. He enlisted July 20, In February 1761, Jesse Lee, Sr. shows up in Edgecombe County 12 records were he purchased land from Frances Ivy. 13 In about 1760, it is thought that Jesse Sr. married a woman named Elizabeth. This evidence comes from an Edgecombe County probate record on June 4, 1760: Jesse and Elizabeth Lee were witnesses to the Will of Phillis Williams. In 1787, Robeson County was formed from Bladen County, North Carolina. Jesse shows up in the 1790 Census in Robeson County. Robeson County is the largest county area wise in 10 General Washington was Commander-in-Chief of the Continental Army throughout the Revolutionary War and became the first president of the United States. I have no information that Jesse Lee knew George Washington personally, but it is possible since Jesse was wealthy. The Continental Army was large and included units from several colonies. 11 Kay s Family Tree; 12 In 1742, Edgecombe County, North Carolina split from Bertie County, North Carolina. 13 It is interesting to note that members of an Ivy family are buried at the old Lee Cemetery near Waynesboro, Mississippi: Ethel James Ivy, 6/17/1899-2/18/1935, and J Edward Ivy, 12/11/1934-2/11/1936. Is there a connection? Many families migrated west together. 24

Below is a list of Jesse s children from a source that states Everett and Samuel Lee are his children. (I now believe that Everett and Samuel are the children of Jesse s brother Zachariah.) 1. Jesse Lee, Jr., born on November, 10, 1768 in Bladen County, North Carolina. 5. Stephen Lee, born ~1769 in Bladen County, North Carolina. 6. Everett Lee, born ~1771 in Bladen County, North Carolina. 7. Samuel Jefferson Lee, Sr., born in 1772 in Bladen County, North Carolina. 8. General Benjamin Lee, born in 1774 in Bladen County, North Carolina. 9. Sarah Lee, born in 1775 in Bladen County, North Carolina. 10. Hester Lee, born ~1776 in Bladen County, North Carolina. 11. William Lee, born ~1779 in Bladen County, North Carolina. 12. Mary Keziah Lee, born 1780 in Bladen County, North Carolina. In most cases, for these very old family records, the birth years and birth places may be guesses with respect to unsubstantiated data. Unsubstantiated or not, it s the best data available and it may be accurate. A large number of Jesse s children decided to move toward the Pearl River in Mississippi shortly before or soon after Jesse s death. This information is very important in tracing our Lee family. The author of the below list assumed that Everett and Samuel are Jesse Sr. s children. If Everett and Samuel are the children of Zachariah and Lucy (Farmer) Lee, this list is still important for tracing the migrations of our Lee family. Jesse Jr married Nancy Lewis and moved to Marion County, Mississippi Stephen married Sarah Creel and moved to Marion County, Mississippi Everett married Charlotte Madison and moved to Claiborne/Warren County, Mississippi and eventually to Marion County. Samuel married Sarah Shay (or Burns) and moved to Wayne County, Mississippi, (and possibly later he moved to Marion County). General Benjamin Lee married Charity Pope and moved to Marion County, Mississippi Sarah Lee married Jacob Pope and moved to Marion County, Mississippi William married Susannah and moved to Marion County, Mississippi Mary Keziah Lee married Willis Everett Loe and moved to Marion County, Mississippi There is more detailed documentation of the siblings of Samuel Lee on the Internet. 25

26 Jesse Woodard Lee Senior is buried on his farm in Robeson County, North Carolina just north of the South Carolina state line. He is buried with his wife. The marker at his grave incorrectly states his wife was Judith Shelley. Bertie County, North Carolina Bladen County, North Carolina Robeson County, North Carolina (Red) Sometime before 1790, we find that Jesse moved from Bertie County, North Carolina, which was in the northeastern part of the state bordering Virginia; to Bladen County, North Carolina. Then he moved to Robeson County, North Carolina, which is in the south part of the state on the border with South Carolina. Bladen County is just east of Robeson County shown above. At least part Robeson County was created out of what was then Bladen County, so Jesse may not have had to move the last time to eventually end up living in Robeson County. Jesse Lee has a surviving Will that was written in 1816, transcribed by Sandra Cook. It can be found on the Robeson County, North Carolina website. I provided a copy of it below; I left the spellings as transcribed. It is listed as an historical Robeson County document. 26

Samuel and Everett are either brothers or cousins; depending on the source. 29

30 For thought: Obviously Jesse Lee Senior was a wealthy man and unfortunately a slave owner. Slavery was a grave national sin; not just a Southern sin. Before the Civil War, there was a growing antislavery movement in the South, and many Southerners believed slavery was eventually on its way out. The Civil War hastened its exit. Before legal slavery in the American colonies, it was common for individuals to sign a contract of indenture to get passage to the New World. 14 Once these contracts were satisfied, the indentured servant was freed. Strictly speaking, indentured servants were not slaves, but in reality there was often very little difference until the contract was fulfilled and the servant was given his or her freedom. In 1787, Thomas Jefferson proposed a law to abolish slavery, but it failed to pass Congress by just one vote! Jefferson himself owned hundreds of slaves; strangely enough, despite his proposing to Congress a law to abolish slavery, he never freed any of the slaves he owned. Abraham Lincoln is credited with freeing the slaves via his Emancipation Proclamation in 1863; however the proclamation only applied to the slave states that had succeeded and were part of the Confederacy. Lincoln had no authority in these states except in areas where the Union Army occupied. So in effect, the Emancipation Proclamation was a political move that did little to help the slaves, but it provided a moral reason to continue the War. Slave states that did not succeed from the Union, like Maryland and Kentucky, were not required to abolish slavery by Lincoln s Emancipation Proclamation, because Constitutionally President Lincoln had no authority to end slavery anywhere in the United States. Slavery became illegal via the 13 th Amendment to the Constitution which went into effect in December of 1865, well after the end of the Civil War and months after Lincoln s death. Some Northerners contributed to the slave trade. Wealthy Northern sea merchants owned slave ships that sailed to Africa, acquired slaves, and transported them cruelly back to the New World. Even Africans were not totally innocent. Tribes in Africa would sometimes conquer other tribes and take the captives to white slave traders on the coast where they were traded or sold. Therefore often the start of slavery for an individual born in Africa came from being captured by other tribes of his or her own race. But before the slave trade became common, captured tribes were often tortured and slaughtered by the conquering tribes, so to many, the idea of slavery was more humane. Of course to the enslaved, death was sometimes a better option. An Angolan African named Anthony has a unique place in American Colonial history. For some time Anthony was an indentured servant. (Anthony later named himself Anthony Johnson.) After he worked out his indenture and was freed, he himself obtained an indentured servant named John Cason, who was also a black African. In 1654, Anthony got a Virginia court to agree that John Cason was his for life, and this ruling technically established slavery in the colonies. Prior to this court ruling, no one in American owned another individual for life. Thus the first slave owner in the American Colonies was Anthony Johnson, who was a black man, and he owned another black man, John Cason. 14 Perhaps the five Negros that came from England with John Lee were indentured. 30
