Honorable J.Blair Shoenfelt, United States Indian Agent, Muskogee,Indian Territory. 4 - have the honor to herewith enclose a resolution adopted by Council, in which I am authorized to respectfully request you to tallw some action relative to the suppression of the Choctaw Snake Band of Indians.. The information I have at hand iz such that I believe that unless steps are taken to imprison the leaders of this socalled Snake Band of Indians that much serious trouble will result from this species of outlawry which they now practice in secret. The leaders are asserting that the Government has promised them that on January 1,1904 the non-citizens will be removed from the Choctaw Nation by an armed force; that the Secretary of the Interior has promised to furnish them twenty thousand soldiers for that purpose. In addition to this they are advising their members to arm themselves for thnt occasion. These leaders say that all the acts of the Dawes Commission are without authority,and that they have been so informed by no less a personage than the Secretary of the Interior. They further assert that they have had personal conference with the Secretary,and that all the rights of the Treaty of 1830 are restored to them,. These poor deluded creatures have been misled by deigning leaders, and if prompt steps are taken
2 s- -2- at once, and a few of the leaders imprisoned, the threatened danger to other ullbloods who reside in their neighborhoods may be averted I earnestly and respectfully request that :you take some action in this matter aeyour earliest pri(loal moment, in order : that the ban of fear may be. removed from those who desire to select their allotments,but ave been restrain from doing so by threats of vengence from this secret band of Indians who foolishly oppose the present policy of the Government in carrying out the terps of t the-jreslint Treaties. Green McCurtain, Principal Chief, Choctaw Nation, Sans Bois, Indian Territory. Dear Sir: I beg leave to acknowledge receipt of your letter of June 19th, enclosing a letter written in the Choctaw language, to the effect that Willis Tobly, who claims to be the Chief of the Snake Band of the Choctaws, is intimidating Choctaw citizens with a view to preventing their selecting their allotments: Section 2111 of the Revised Statutes, (Page 369, Edition of 1878), is as follows: "Every person who sends any talk, speech, message, or letter to any Indian nation, tribe, chief, or individual, with an intent to produce a contravention or Infraction of any treaty or law of the United States, or to disturb the peace and tranquility of the United States, is liable to a penalty of two thousand dollars." This is the only provision of law known to me under which Tobly may be arrested. If evidence of his violation of this law can be secured and forwarded to the Commission we will take it up with the United States Court for the Central District. Possibly the writer of the enclosed letter could be summoned as
6 G. M., 2. one witness, but of this I am unable to determine, owing to the fact that it is written in Choctaw. In view of the harm which his seditious talk will produce a vigorous effort should be made to secure evidence upon WhiCh to convict him. The letter of L. IC Cobb is returned herewith.
